CP-03-13 Dear MICHAEL MCGHEE After reviewing your application in conjunction with the development standards required by the Coastal Area Management Act.(CAMA) and our locally adopted Land Use Plan and Ordinances, it is my determination that no permit may be granted for the project you have proposed. This decision is based on my finding that your request violates NCGS 113-120 (8), which requires that all applications be denied which are inconsistent with CAMA guidelines. You have applied to construct a swimming pool with concret pad within the required thirty (30) foot buffer zone, which is inconsistent with 15 NCAC7H.0209 (d) 10 which states that: All new development shall be located a distance of 30 feet landward of the normal water level or normal high water level. Your proposal will also exceed the 30% impervious surface areas, which is inconsistent with 15 NCAC711.0209 (d) 2 which states that: The amount of Impervious surface areas shall not exceed 30% of the lot area within 75' of the normal high water contour/normal water contour, which defines the Coastal Shoreline AEC at this location. Should you wish to appeal my decision to the Coastal Resources Commission or request a Variance from the group, please contact me so I can provide you with the proper forms and other information you may require. Appeal notices must be received by the Division of Coastal Management in Raleigh within twenty (20) days of your receipt of this letter, in order to be considered.
