This permit, issued on February 19, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie subject to lines, imprisonment or civil action; or may cause the permit to be Hutt and void. Marina and Boat Ramp Reconfiguration 1) Unless specifically altered herein, this Major Modification authorizes the docks, platform, piers, slip relocation associated with the marina reconfiguration, boat ramp relocation and associated bulkhead reconfiguration, all as expressly and specifically set forth in the attached application, narrative and workplan drawing. Any additional development activities may require a modification of this permit. 2) This modification does not authorize any additional formalized boat slips. 3) The piers and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No. 40-17 Page 2 of 2 ADDITIONAL CONDITIONS 4) This permit modification does not authorize the placement of tie pilings located on the west side of the marina, associated with the adjacent riparian corridor or within the adjacent riparian property. 5) Should the permittee obtain approval from the western riparian property neighbor, additional authorization may be requested from the Division. Upland Development 6) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the placement of the fuel tanks over existing impervious, all as expressly and specifically set forth in the attached permit application and workplan drawings. General 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) This Major Modification shall be attached to the original Permit No. 40-17, which was issued on 3/31/17, and copies of both documents must be readily available on site when Division personnel inspect the project for compliance. 9) All conditions and stipulations of the active permit remain in force, under this Major Modification, unless specifically altered herein. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2018-00239 issued 2/16/18. Improvements requiring a Major Modification to CAMA Major #40-17 include relocation of the permitted fueling facility from the end of the existing western most pier to a proposed floating pier adjacent to the existing structure and boat ramp.The permitted AST location will be affected by this move and will be relocated to the new fueling dock location. These adjustments will require a realigment of the permitted boatramp, bulkhead, woodwalk, and open decking around the existing structure and reconfiguration of the existing slips. Four finger piers along the west side of the marina building are also proposed. See attached Narrative for a detailed description of the proposed modifications. e. The property is predominantly covered with gravel and concrete with some areas of maintained grasses. The site falls within the Elizabeth City city limits on the Camden Causeway. The property owners Niels and Melissa Jensen received a CAMA Major permit (#40-17) on March 31, 2017 for enhancement and repair of the Marina. Modifications to the existing permit are proposed and detailed below and on the attached plans. Proposed Work Currently proposed work requiring a modification to CAMA Major permit #40-17 includes the relocation of the permitted fueling facility from the end of the existing western most pier to a proposed floating pier adjacent to the existing structure and boat ramp. The proposed floating dock will be 53-feet-long by 10.2-feet-wide with a 23-feet-long by 6.3-feet-wide platform, accessed by a 15-feet-long by four -feet -wide metal gangway. Septic pump out facilities and fuel will be available on the proposed floating dock. The new fuel dock location requires the permitted Above Ground Storage Tanks (ASTs), to be moved from the west side of the property to the new proposed fuel dock locations, as shown in blue on the attached plan. Full specifications of the proposed floating dock and ASTs can be found in Attachment A. Relocation of the permitted AST location requires that the permitted boat ramp location move west as shown on the attached Site Plan. The boat ramp shift will also affect the surrounding wood walk way and bulkhead alignment. The permitted 778 square feet decking around the existing structure will be modified to fit with the new boat ramp and fuel dock alignment, adding an extra 205 square feet (983 total square feet) and squaring the shape of the permitted deck. The existing western most pier, where the fueling facility was originally permitted, will be reconfigured with six (6) 50-feet-long by 20-feet-wide slips with three 10-feet-long by four -feet - long floating finger piers and associated tie pilings. One "side to" slip is being added to the platform of the proposed floating fuel dock to keep the existing slip count at 62. The owner also proposes to add four (4) eight -feet -long by three -feet -wide fixed finger piers and 11 feet long by 2.5 feet long extension to the west side deck of the marina building to serve the exiting four slips. All proposed modifications are shown on the updated CAMA Plan. In addition, and as requested a color contrast plan showing existing, permitted, and proposed improvements has been provided for convenience. Purpose and Need The Elizabeth City Fire Marshall did not approve of the formerly permitted fuel AST locations, nor the fuel dispenser locations. Therefore, Pelican Marina is proposing to relocate the tanks, dispensers, and sewage pump out to the locations shown on the attached plans. The need to reconfigure the fuel dock has necessitated greater changes than original realized and gives the applicant an opportunity to refine the proposed development of the existing marina facility. I have reviewed the rules and would like to offer the following: 15 NCAC 07H .0208 Use Standards (b) Specific Use Standards (5) Marinas shall comply with the following standards: (A) Marinas shall be sited in non -wetland areas or in deep waters (areas not requiring dredging) and shall not disturb shellfish resources, submerged aquatic vegetation as defined by the MFC, or wetland habitats, except for dredging necessary for access to high -ground sites. (E) To protect water quality in shellfishing areas, marinas shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas if shellfish harvest closure is anticipated to result from the location of the marina. Consistent: No shellfishing in or near the project area. (F) Marinas shall not be located without written consent from the leaseholders or owners of submerged lands that have been leased from the state or deeded by the state; Consistent: No known leasehold in or near the project area. (G) Marina basins shall be designed to promote flushing through the following design criteria: Consistent: Open water location. (H) Marinas shall be designed so that the capability of the waters to be used for navigation or for other public trust rights in estuarine or public trust waters are not jeopardized while allowing the applicant access to deep waters; Consistent: navigation will not be jeopardized within or near the project area. (1) Marinas shall be located and constructed so as to avoid adverse impacts on navigation throughout all federally maintained channels and their boundaries as designated by the US Army Corps of Engineers. DATE: December 12, 2017 Consistency Determination: The request is consistent with/not in conflict with the Pasquotank County/Elizabeth City 2004 Advanced Core Land Use Plan (LUP) certified by the CRC on February 9, 2012. Overview: The .65 acre property has approximately 542 linear feet of shoreline along the Pasquotank River. The site is minimally vegetated with domestic grasses and weeds. The property is low lying with an average elevation of 1 foot above Normal Water Level (NWL). A 14 sq. ft. patch of wetland plants is located on the shoreline to the east. Water depths adjacent to the shoreline are between -2.8 feet to -4.5 feet. Water depths are between -9.2 feet and -9.6 feet approximately 220 feet waterward of NWL. The property is located within the AE Floodzone. Approximately 80% of the site is covered in gravel parking area. A fenced dumpster and a 1,000 gallon capacity fuel tank are located on the gravel area. The city provides water and sewer service to the site. Existing shoreline improvements consist of wood, stone and concrete sections of bulkhead; a pile -supported 40 foot by 80 foot primary structure over water with a marina store on the lower level and a second floor laundry and bathing facility; a dock with associated tie pilings on the west side of the store; a 3 foot wide by 84 foot long landward walkway along the storefront; an 8 foot wide by 177 foot long pier with a terminus platform and associated finger piers and tie pilings that includes a storage building on the platform used to store a portable pump -out; a 13 foot wide by 25 foot long boat ramp; a 4 foot wide by 28 foot long concrete breakwater/courtesy dock with associated finger piers and tie pilings; a storage building on a platform over the water housing a kitchen for owners living at the marina; an 8 foot wide by 215 foot long pier with associated finger piers and tie pilings, and; a 4 foot wide floating dock. On March 31, 2017, NMJ Properties was issued CAMA Major Permit No. 47-17 to replace the bulkhead, add a boardwalk, add a fuel dock at the end of the main pier extending from the marina store, install a pump -out station at the end of the main pier, enlarge an existing boat ramp, expand an existing platform adjacent to the boat ramp, repair an existing storage building on the platform, add floating docks in front of the platform and storage building along with three (3) finger piers, repair and expand the dock around the ships store, add a floating dock to the east side of the property along with three (3) finger piers and add a total of twenty-seven (27) tie pilings. Placement of the approved floating dock and three (3) finger piers 10 to 12 feet to the east and enlargement of the floating dock by 287 sq. ft. to accommodate relocation of the approved fuel docking facility, addition of a 2.5 foot by 11 foot extension onto an approved dock along with the addition of three (3) finger piers, extension and squaring off an existing platform, placement of the approved boat ramp 7 feet to the west, relocation of a total of eleven (11) boat slips and six (6) finger piers, the repair or replacement of four (4) pilings, and installation of seven (7) tie pilings are proposed. Repair or replacement of four (4) pilings will require approval and/or a waiver from the adjacent property owner to the west. The waters of the Pasquotank River in this area are classified as SC and Joint waters in this and are closed to shellfish harvesting. There is no Submerged Aquatic Vegetation (SAV) adjacent to the property. There are no known geological formations or archaeological resources associated with the property. Anticipated Impacts resulting from this project modification are expected to include: the disturbance of 175 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and; the shading of 760 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The Pasquotank County/Elizabeth City 2004 Land Use Plan identified the project site as "General Commercial". As indicated on Page 165 of the Elizabeth City Future Land Use Plan Map (FLUPM), "Conservation/Open Space" areas include parks, coastal wetlands, estuarine waters, estuarine shoreline, public trust waters, and non -coastal '404' wetlands. The effluent water from the dredge spoil shall not be released Into open shellfish waters unless Shellnsh Sanitation and the DWR Washington (252-946.6481) or Wilmington (910-796-7215) Regional Office, as applicable, are notified and provide approval prior to the release. If this Water Quality Certification is used to access residential, commercial or Industrial building sites, then all parcels owned by the applicant that are part of the single and complete project authorized by this Certification must be buildable without additional Impacts to streams or wetlands. If required In writing by DWR, the applicant shall provide evidence that the parcels are buildable without requiring additional impacts to wetands, waters, or state regulated riparian buffers. [15A NCAC 02H .0506(b)(4) and (cX4)] 3. For road construction purposes, this Certification shall only be utilized from natural high ground to natural high ground, 115A NCAC 02H .0506(bX2) and (cX2)] 4. Deed notifications or similar mechanisms shall be placed on all lots with retained jurisdictional wetlands, waters, and state regulated riparian buffers within the project boundaries In order to assure compliance with NC Wetland Rules (15A NCAC 02H .0500), NC Isolated Wetland Rules (15A NCAC 02H .1300), and/or State Regulated Riparian Buffer Rules (15A NCAC 02B .0200). These mechanisms shall be put in place at the time of recording of the property or Individual parcels, whichever Is appropriate. [15A NCAC 02H ,0500(bX4) and (c)(4)] 5. For living shorelines, the sills shall have at least one five-foot opening every 100 feet and may be staggered or overlapped or left open as long as the five-foot separation between sections Is maintained. Overlapping sections shall not overlap more than 10 feet. [15A NCAC 02H .0506(bX4) and (cX4)] 6. For living shorelines, the permittee shall employ all sedimentation and erosion control measures necessary to prevent an Increase in sedimentation and turbidity within waters and wetlands outside the permitted area. This shall Include, but Is not limited to, the Immediate Installation of sill fencing, turbidity curtains or similar appropriate devices around all areas subject to soil disturbance. Additionally, the project must remain In full compliance with all aspects of the Sedlmenta0on Pollution Control Act and the Mining Act of 1971. [16A NCAC 02H .0506(bX4) and (cX4)) Page 4 of 12 GC4144 7. Llving shorelines in Primary Nursery Areas (as designated by the NC Marine Fisheries Commission) shall be coordinated with the appropriate NC Wildlife Resources Commission (WRC), National Marine Fisheries Service (NMFS) and NC Division of Marine Fisheries (DMF) personnel. [15A NCAC 02B .0221] 8. For the North Carolina Department of Transportation, compliance with the NCDOT's Individual NPDES permit NCS000250 shall serve to satisfy this condition. All other high- density projects that trigger threshold Item (f) above shall comply with one of the following requirements: [15A NCAC 02H ,OWb)(5) and (c)(5)] a. Provide a completed Stormwater Management Plan (SMP) for review and approval, including all appropriate 8tormwater control measure (SCM) supplemental forms and associated items, that complies with the high -density, development requirements of 15A NCAC 02H .1003. Stonnwater management shall be provided throughout the entire project area in accordance with 15A NCAC 02H .1003. For the purposes of 15A NCAC 02H .1003(2)(a), density thresholds shall be determined in accordance with 15A NCAC 02H .1017. b. Provide documentation (including calculations, photos, etc.) that the project will not cause degradation of downstream surface waters. Documentation shall Include a detailed analysis of the hydrological Impacts from stonnwater runoff when considering the volume and velocity of stormwater runoff from the project built upon area and the size and existing condition of the receiving stream(s). Exceptions to this condition require application to and written approval from DWR GENERAL CONDITIONS: 1. When written authorization Is required, the plans and specifications for the project are incorporated Into the authorization by reference and are an enforceable part of the Certification. Any modifications to the project require notificetlon to DWR and may require an application submittal to DWR with the appropriate tee. [15A NCAC 02H .0501 and .05021 2. No waste, spoli, solids, or fill of any kind shag occur in wetlands or waters beyond the footprint of the Impacts (Including temporary impacts) as authorized in the written approval from DWR; or beyond the thresholds established for use of this Certification without written authorization. [15A NCAC 02H .0501 and .0502] No removal of vegetation or other impacts of any kind shall occur to state regulated riparian buffers beyond the footprint of impacts approved in a Buffer Authorization or Variance or as listed as an exempt activity in the applicable riparian buffer rules. [15A NCAC 02B ,0200] 3. In accordance with 16A NCAC 02H .0506(h) and Session Law 2017-10, compensatory mitigation may be required for losses of greater than 300 linear feet of perennial streams and/or greater than one (1) acre of wetlands. Impacts associated with the removal of a dam shall not require mitigation when the removal complies with the requirements of Part 3 of Article 21 in Chapter 143 of the North Carolina Page 6 of 12 GC4144 General Statutes. Impacts to Isolated and other non-404 jurisdictional wetlands shall not be combined with 404 jurisdictional wetlands for the purpose of determining when impact thresholds trigger a mitigation requirement. For linear publicly owned and maintained transportation projects that are not determined to be part of a larger common plan of development by the US Army Corps of Engineers, compensatory mitigation may be required for losses of greater than 300 linear feet per perennial stream. Compensatory stream and/or wetland mitigation shall be proposed and completed In compliance with G.S. 143-214.11. For applicants proposing to conduct mitigation within a project site, a complete mitigation proposal developed in accordance with the most recent guidance issued by the US Army Corps of Engineers Wilmington District shall be submitted for review and approval with the application for impacts. 4. All activities shall be In compliance with any applicable State Regulated Riparian Buffer Rules in Chapter 2 of Title 15A. 5. When applicable, all construction activities shall be performed and maintained in full compliance with G.S. Chapter 113A ANcle 4 (Sediment and Pollution Control Act of 1073). Regardless of applicability of the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management Practices for the control of sediment and erosion so that no violations of state water quality standards, statutes, or. rules occur. [15A NCAC 02H .0505(b)(3) and (c)(3) and 15A NCAC 02B .0200] Design, Installation, operation, and maintenance of all sediment and erosion control measures shall be equal to or exceed the requirements specified In the most recent version of the North Carolina Sediment and Erosion Control Manuel, or for linear transportation projects, the NCDOT Sediment and Erosion Control Manual. All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites, including contractor -owned or leased borrow pits associated with the project. Sufficient materials required for stabilization and/or repair of erosion control measures and stormwater routing and treatment shall be on site at all times. For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated, and maintained in accordance with the most recent version of the North Carolina Surface Mining Manual. Reclamation measures and Implementation shall comply with the reclamation in accordance with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971. If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs), SA, WS-I, WS-II, High Quality Waters (HQW), or Outstanding Resource Waters (ORIN), then the sedimentation and erosion control designs shall comply with the requirements set forth In 15A NCAC 048 .0124, Design Standards In Sensitive Watersheds. 6. Sediment and erosion control measures shall not be placed in wetlands or waters except within the footprint of temporary or permanent Impacts authorized under this Page 8 of 12 GC4144 Certification. Exceptions to this condition require application to and written approval from DWR. [15A NCAC 02H .0501 and .0502] 7. Erosion control matting that Incorporates plastic mesh and/or plastic twine shall not be used along streambanks or within wetlands. Exceptions to this condition require application to and written approval from DWR [I5A NCAC 02B .0201] B. An NPDES Construction Stormwater Permit (NCG010000) Is required for construction projects that disturb one (1) or more acres of land. The NCGO10000 Permit allows stormwater to be discharged during land disturbing construction activities as stipulated in the conditions of the permit. If the project is covered by this permit, full compliance with permit conditions Including the erosion & sedimentation control plan, Inspections and maintenance, self-monitoring, record keeping and reporting requirements Is required. [15A NCAC 02H .0505(b}(5) and (c)(5)] The North Carolina Department of Transportation (NCDOT) shall be required to be In full compliance with the conditions related to construction activities within the most recent version of their individual NPDES (NCS000250) stormwater permit. (15A NCAC 02H .0505(b)(5) and (c)(5)] 9. All work In or adjacent to streams shall be conducted so that the flowing stream does not come In contact with the disturbed area. Approved best management practices from the most current version of the NC Sediment and Erosion Control Manual, or the NC DOT Construction and Maintenance Activities Manual, such as sandbags, rack berms, cofferdams, and other diversion structures shall be used to minimize excavation In flowing water. Exceptions to this condition require application to and written approval from DWR. [15A NCAC 02H .0505(b)(3) and (cx3)] 10.If activities must occur during periods of high biological activity (e.g. sea turtle nesting, fish spawning, or bird nesting), then biological monitoring may be required at the request of other stale or federal agencies and coordinated with these activities. [15A NCAC 02H .0500(b)(2) and 15A NCAC 04B .0125] All moratoriums on construction activities established by the NC Wildlife Resources Commission (WRC), US Fish and Wildlife Service (USFWS), NC Division of Marine Fisheries (DMF), or National Marine Fisheries Service (NMFS) shall be Implemented. Exceptions to this condition require written approval by the resource agency responsible for the given moratorium. A copy of the approval from the resource agency shall be forwarded to DWR- Work within a designated trout watershed of North Carolina (as Identified by the Wilmington District of the US Army Corps of Engineers), or Identified state or federal endangered or threatened species habitat, shall be coordinated with the appropriate WRC, USFWS, NMFS, and/or DMF personnel. 11.Culverts shall be designed and installed In such a manner that the original stream profiles are not altered and allow for aquatic life movement during low flows. The dimension, pattern, and profile of the stream above and below a pipe or culvert shall not be modified by widening the stream channel or by reducing the depth of the Page 7 of 12 GC4144 stream in connection with the construction activity. The width, height, and gradient of a proposed culvert shall be such as to pass the average historical low flow and spring flow without adversely altering flow velocity. [15A NCAC 02H .0508(b)(2) and (cH2)] Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts with a diameter greater than 48 inches, and 20% of the culvert diameter for culverts having a diameter less then or equal to 48 Inches, to allow low flow passage of water and aquatic life. If multiple pipes or barrels are required, they shall be designed to mimic the existing stream cross section as closely as possible Including pipes or barrels at flood plain elevation and/or sills where appropriate. Widening the stream channel shall be avoided. When topographic constraints indicate culvert slopes of greater than 5%, culvert burial is not required, provided that all alternative options for listening the slope have been investigated and aquatic life movement/connectivity has been provided when possible (e.g. rock ladders, cross vanes, etc.). Notification, Including supporting documentation to include a location map of the culvert, culvert profile drawings, and slope calculations, shall be provided to DWR 80 calendar days prior to the Installation of the culvert. When bedrock is present In culvert locations, culvert burial Is not required, provided that there Is sufficient documentation of the presence of bedrock. Notifiratlon, Including supporting documentation such as, a location map of the culvert, geotechnicat reports, photographs, etc, shall be provided to DWR a minimum of 50 calendar days prior to the installation of the culvert. If bedrock is discovered during construction, then DWR shall be notified by phone or email within 24 hours of discovery. If other site -specific topographic constraints preclude the ability to bury the culverts as described above and/or It can be demonstrated that burying the culvert would result In destabilization of the channel, then exceptions to this condition require application to and written approval from DWR. Installation of culverts in wetlands shall ensure continuity of water movement and be designed to adequately accommodate high water or food conditions. When roadways, causeways, or other flll projects are constructed across FEMA-designated fioodways or wetlands, openings such as culverts or bridges shall be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result In destabilization of streams or wetlands. The establishment of native woody vegetation and other soft stream bank stabilization techniques shall be used where practicable Instead of rip -rap or other bank hardening methods. NMJ Properties, LLCI Pelican Marina Field Investigation Report Page 2 Project Setting Niels and Melissa Jensen purchased the Pelican Marina located at 43 Camden Causeway (U.S. Highway 158) in Camden County under the name of NMJ Properties, LLC, in 2016. The property falls within the Extra Temtorial Jurisdiction (ETJ) of the City of Elizabeth City, and is situated-1,300' east of the Pasquotank/ Camden County line, adjacent to the Pasquotank River. Camden County and Elizabeth City zone the property as Mixed Use - Commercial. The property is classified as Urban Waterfront, with municipal services provided by the City of Elizabeth City. Adjacent uses include a restaurant and a small strip of vacant land owned by the City of Elizabeth City. Pelican Marina is bounded to the north by US 158 and to the south by the Pasquotank River, and consists of a small narrow strip of land along Highway 158 totaling 28,475 square feet. The project site is completely within the 75' Area of Environmental Concern. Approximately 80% of the property is covered by a gravel parking lot, and has - 542 linear feet of shoreline. The property is the site of a marina that has been approved for 62 slips and includes the following amenities:1) a 40' x 80' marina store located over the water, 2) a small dock along the west side of the store, 3) a storage building on a platform over the water converted to a kitchen, 4) a second storage building located at the end of a 197' x 8' pier located behind the marina store that is used to store a portable pump -out, 5) a boat ramp and small courtesy dock on the east side of the marina store, 6) a 215' x 8' pier is on the east side of the boat ramp, 7) erosion control structures consisting of wooden and stone/concrete bulkheads, 8) a gravel parking lot, 9) a fenced dumpster,10) a kayak rack, 11) a 4' wide floating dock, and an above ground 1,000-gallon capacity fuel tank (immediately adjacent to the bulkhead). The closest pier to the Pelican Marina property is over 295' west of the marina at a residential condominium complex. Classification of the adjacent waterbody is SC starting at the Norfolk Southern Railroad Bridge above the causeway to a line between Cobb Point and Hospital Point below the causeway. Waters within the project area are "Joint" and as such are Estuarine Waters. Water depths along the bulkhead are between -2.8' and 4.5'. Water depths at the end of the main pier (-200' waterward of NWL) are between -9.2' and -9.6'. There is no submerged aquatic vegetation adjacent to the subject property, and there are no wetlands associated with the property with the exception of -14sf of Arrow Arum along the timber bulkhead on the east side of the property where there is a small breach. Other vegetation on the property is limited to a few ornamental shrubs and a variety of domestic grasses and weeds. There are no known geologic formations or archaeological sites associated with the applicanfs property. The property is question is low lying with an average elevation of only 1' above NWL, and is subject to regular flooding. All water entering the property drains directly into the Pasquotank River. The marina store is only a few inches hgherthat the adjacent grade, and as such is subject to regular flooding. yo_ t1 On March 31, 2017, NMJ Properties was issued CAMA Major Permit No. 7, to replace the bulkhead, add a boardwalk, add a fuel dock at the end of the main pier extending from the marina store, install a pump -out station at the end of the main pier, enlarge an existing boat ramp, expand an existing platform adjacentto the boat ramp and repair an existing storage building on the platform, add floating docks in front of the platform and storage building with three finger piers, repair and expand the dock around the ships store, add a floating dock to the east side of the property with 3 finger piers, and a total of 27 new be pilings. Develooment Proposal 9)� �jo-11 N% The fuel dock approved by CAMA Major Permit No._44. was determined by the City of Elizabeth City, to be inconsistent with the Fire Code, necessitating the reconfiguration of the approved development. The inconsistency was not discovered until after the issuance of the CAMA Major Permit. The need to reconfigure the fuel dock has necessitated greater changes than original realized and gives the applicant an opportunity to refine the proposed development of the ®C c a facility as follows: t�) DEC 13 -Marina Store Dock: The applicant would like to extend the approved dock on the west side of the marina store 11' x 2.5' and add three 8' x 3' finger piers. Notes on the plan also indicate that 4 pilings are to be repaired or Ipse¢ If replaced 1 will have to receive approval from the adjacent property owner as it is not located within NMJ Properties, LLC/ Pelican Marina Field Investigation Report Page 3 the applicant's riparian corridor, and the remaining 3 will require a waiver from the adjacent property owner. Additional Impacts:-123.5sf of open water shading 2) Boat Ramp: Located on the property is an existing 13' x 25' concrete boat ramp. The relocation of the proposed fuel dock and tanks will necessitate the shifting of the ramp 7' west of the current approved location. No work had begun of the approve "expanded" boat ramp. Additional Impacts: -175sf of shallow bottom disturbance 3) Platform and Storage Building: The shifting of the boat ramp would leave a 7' wide gap between the staging pier and the existing platform. The applicant proposes to extend the platform and connect the two structures and square off the platform. No work approved by the original permit has been undertaken to date. Additional impacts: 205sf of open water shading 4) Floating Dock & Finger Piers: An approved (256sf) floating dock with (3)10' x 4' finger piers (120sf), to be located waterward of the platform and storage building, adjacent to the concrete groin, will be shifted between 10' and 12' to the east and enlarged (287sf) to accommodate the fuel docking facility and accessed by a gangway from the existing platform. The 5 associated boat slips and 3 finger piers will be relocated to the end of the main pier where the fuel dock was originally approved. Neither of the approved floating docks or finger piers have been constructed to date. Additional Impacts: 431sf of open water shading 5) Main Pier (immediately adjacent to the marina store): The approved floating fuel dock thatwas to be located behind the marina store will remain as approved and be used as a docking facility for 6 relocated boat slips and three relocated finger piers within the marina. The relocation of the slips will include the installation of 7 tie pilings 50' waterward of the existing pier alignment. The total distance that the pier will extend into the Pasquotank River, including the tie pilings, will be -250'. The Pasquotank River is-1,621' wide at the Pelican Marina with a Federally Maintain Channel. Additional Impact: 7 Tie Pilings 11. High Ground Disturbance: Relocation of the fuel tanks will result in no increased high ground impacts. 12. Replacement of Existing Tie Pilings: The CAMA Permit Site Plan states that 4 pilings on the west side of the marina store will be repaired or replaced. Replacement of 3 pilings will require a waiver from the adjacent property owner and the 41h piling on the waterward side of the slips is not within the riparian boundaries of the applicant's property and cannot be replaced without authorization from the adjacent property owner. Anticipated Impacts 1) Project will result in the shading of an additional 419.5sf of open water finger piers and platforms. 2) Proposed development will result in the disturbance of 175sf of shallow water bottom. 3) Installation of pilings for the proposed piers and fie pilings will result in a temporary increase in turbidity within surrounding waters. 4) Treated wood leaches overtime in surrounding waters and sediment. The amount of leaching is dependent on the type of organic material present in the water bottom substrate, oxygen levels and water movement; however, it is estimated that 90% of the leaching will occur within the first 90 days. 5) The proposed improvements will allow for safer access to existing boat slips.
