This permit, issued on _ February17, 2017 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconstructed docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is .consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation, and shall not exceed the established Wrightsville Beach pier head line.
8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
10) The authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Excavation
12) In order to protect juvenile finfish resources, no excavation shall be permitted between April 1 and
September 30 of any year without prior approval of the North Carolina Division of Coastal Management
and the U.S. Army Corps of Engineers, in consultation with appropriate resource agencies.
13) Excavation shall not exceed -6 feet below normal low water. In no case shall the depth of excavation
exceed the depth of the connecting waters.
14) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters
outside of the alignment of the fill area indicated on the workplan drawing(s).
15) The temporary placement of double handling of excavated materials within waRMG tlands
is not authorized.

16) All excavated materials shall be confined above normal high water level and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids
into any marsh or surrounding waters.
17) No spoil material shall be placed within 30 feet of the normal high water line.
18) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion.
19) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
beginning of any dredge activities.
Sedimentation and Erosion Control
20) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
Maintenance Clause
21) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to .be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
U.S. Army Corps of Engineers Conditions
22) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.Avs.gov/nc-

23) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States o the State of North Carolina.

24) Approval of the structure is based on determinations that there would be no obstruction to navigation.
The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not
be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats
will not be damaged by wave wash.
25) Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing
activities shall take place at any time in the construction or maintenance of this project, in such a manner
as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of
waters or wetlands.
26) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition.
27) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
General
28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
projecf initiation.
29) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third panty without the
written approval of the Division of Coastal Management.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2016-
02308.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2016-1048.

Development permit, acting as agent for Jill & Jeff Morris, to undertake development activities
at property adjacent to Motts Channel, at 228 Seacrest Drive, in Wrightsville Beach, New
Hanover County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary
that the standard review time be extended. An additional 75 days is provided by G.5.113A-122(c)
which would make March 24, 2017, the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

Dear Mr. and Mrs. Morris:
Reference your application for a Department of the Army permit to perform new dredging
within waters of waters of Motts Channel and reconfiguration of an existing docking facility at
228 Seacrest Drive, in Wrightsville Beach, New Hanover County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization fiom the State of North Carolina. Therefore, you may
commence construction activity in strict accordance with applicable State authorization, attached
Federal special conditions, Manatee Guidelines, and the approved plan which were revised on
January 12, 2017, Failure to comply with the State authorization or conditions of the Federal
permit could result in civil and/or administrative penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization
modified. Your Department of the Army permit will expire on December 31, 2021.

The total area of floating dock and platform was calculated as follows:
Shoreline length = 220 ft. x 8 ft. = 1760 sq. ft. allowable
Proposed Pier = 85 ft. x 6 ft. = 510 sq. ft. (not counted)
Proposed gazebo= 14 ft. x 16 ft. = 224 sq. ft. (140 sq. ft. not counted due to alignment)
Relocated Floating dock = 65 ft. x 6 ft. = 390 sq. ft. (not counted due to alignment)
Proposed boatlift = 15 ft. x 16 ft. = 240 sq. ft. (not counted)
Total counted sq. ft. = 84 sq. ft.
The proposed development would provide docking space for a total of Four (4) vessels. The proposed docking
facility extends approximately 91 ft. into the waterbody, which measures approximately 365 ft. across, which is
CONSISTENT with NCAC 07H .0208 (b)(6)(G). The application also appears to be CONSISTENT with the
remaining use standards set forth in NCAC 07H .0208(b)(6), including those which dictate the maximum
allowable platform area (the 8 square foot rule), the 15' riparian setback and federal channel setback.
This office has no objection to the proposed work, provided it is consistent with all other state, local and federal
permitting requirements. If a permit is issued it should include standard permit conditions for docking facilities
and excavation.

The applicant proposes to relocate the existing floating dock and construct a new pier and
covered gazebo for a private four (4) slip docking facility with associated dredging. The
project is located at 228 Seacrest Drive, adjacent to Motts Channel and Greenville Sound,
in Wrightsville Beach, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are CW, EW and
PTA. Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation/Resource Protection.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan.

given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name { 15A NCAC 02H .0501 and .0502],
2 Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired pemrits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)], The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3 Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion
control practices must be used to meet this standard. Turbidity curtains, shall be used as
appropriate. Nease notify this Office if any turbidity issues arise at 910.796.7215
4 This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit, The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration of this Certification.
5 The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification.. A gopy,of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 0211.0507 (c) and 15ANCAC 02H .0506 (bx2) and (c)(2)]
6 Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any requirements
resulting from compliance, with 303(d) of the Clean Water Act), and any other
appropriate requirements of State and Federal law. If the Division determines that such
standards or laws are not.being met, including failure to sustain a designated or achieved
use, or that State or Federal law is being violated, or that further conditions are necessary
to -assure compliance, than the Division may reevaluate and modify this General Water
Quality Certification. [15A NCAC 02H .0507(d)]

7 All mechanized equipment operated near surface waters or wetlands will be regularly
• inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potentialtoxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/coidtactor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington
Regional Office at 910.796.7215 and after hours and on weekends call (aoo) asg.63ea.
Management of such spills shall comply with provisions of the'North Carolina,Oil
Pollution'and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3),15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
8 Fueling, lubrication and general equipment maintenance should not take place within'50
feet of a waterbody or wetlands to prevent contamination by fuel and oils, [15A NCAC
02H :0506 (b)(3) and (c)(3) and 15A NCAC 02B :0200 (3)(1)].
9 This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC.02H.0502(e).
10 Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent -modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources,1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification
and may esult in criminal and/or civil penalties. The authorization to proceed with your

This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by

On October 26, 2016, the Wilmington Regional Office of the Division of Energy, Mineral, and Land
Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review
of the plans and specifications on October 27, 2016 has determined that the development activities
proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director
has determined that projects that are reviewed and approved by the Division as not posing a water quality
threat from stormwater runoff should not be subject to the stormwater management permitting
requirements of 15A NCAC 2H.1000, the stormwater Hiles. By copy of this letter, we are informing you
that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff,
then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater
discharge requirements. You are required to have an NPDES permit for stormwater discharge from
projects meeting these criteria. All temporary built -upon area associated with the construction of the
project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

requested that they extend as far out as possible to reduce the need for dredging. The plans submitted show the dock
20' from the Town's pier headline. Could they extend the dock out another 20' to the pier headline or would that cause
any issues at the local level?

a gazebo 14ft.x:l6ft.. Afloating dock measuring 65ft x 6ft would extended waterward from the,gazebo tothe
% width, but short of the town's established, pier head line. The surrounding waters are classified as SR, are
closed to the.harvest of shellfish,. and coastal wetlands are present on site. There is no indication of oyster
resource noted; in the documentation. The average water depth is -3fi: at:Normal Low Water(NLW). The
proposed dredge footprint:proposes to impact 75ft IongxS2ft wide x-6ft depth of shailowbottom, totaling
approximately 400 cubic yards of spoil. As proposed, the dredge footprint is"a,pproximately20ft from coastal
wetlands. Of, the four proposedrslips,.one slip is proposed to have a boat lift, identified"at.the•:eastern
terminus of the floating,dock.
Shallow'softbottom is an: important'foraging habitat for juvenile and -adult ,fish and invertebrates, and aids in
storing'andcycling of sediment, nutrients, and toxins+between the bottom and water column Soft bottom
habitat is used tosome extent, by most native coastal fish species in North Carolina. The habitat is
particularly productive and, by providing refuge from predators, is an important nursery. area. Species
dependent on shallow soft bottom include -clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays.
Many benthic-predators,are highly associated with the shallow soft bottom habitat,including flounders,
weakfish, red'drum, sturgeon and coastalsharks, although almost all fish will forage on microalgae, infauna,
or'epifauna on the soft bottom.
The proposed` floating dock Is located approximately 20ft landward of the established pierhead'line, in
waters ranging from -2ft (landward edge) to-6ft (waterward edge). The associated dredge footprint is
located' in waters ranging fromapproArnately-1.5ft to-6ftatNLW. _ If there is away to move.the floating
dock"20ft waterWard, outto'the pier headline, this would give the facility access to deeper water and would
shiftthe: dredge footprint;20ft.waterward with the floating dock, starting the dredge footprint in waters
approximately 42ft at NM. It also recommended the dredge depth be reduced from =6ft to -Sft at NLW, a
depth sufficient for the proposed, activity.. These actions would reduce the,dredge footprint: (to
approximately 52ft"wide z 42ft long x Sft'deep) and, associated impacts to.shallow bottom, reduce the
applicants Investment in maintaining a largerfootprint, and increase the buffer between the:dredge
fcotprint.and coastal wwetlands and any associated oyster resource. These,modifications would avoid and

from NMFS? Gregg has actually requested that they extend further out to reduce the dredging impacts.
They can move the dock out another 20' or so and still meet the Town's pier headline and thereby eliminate some of the
dredging. Would that work for you all or would that complicate matters?

Based on your calculations, this project will be approximately 23 feet from the setback so we have no issue with the
dock changes, provided they stay behind the setback in the area.
The disposal area identified is encompassed on 2 sides by the USACE AIWW ROW. If their plan is to cross our easement,
to access the land outside of our easement they will need a Consent to, Cross, which give them permission to cross the
easement to get to the disposal location and protects the government should any issues arise. If they do'not have a
consent to cross they should not be in the easement with any machinery or vehicles (land or water based). Typically, in
the past, this disposal location is accessed by crossing our easement.

All,
Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by January 5, 2016.
The applicant proposes to reconfigure a single family docking facility and perform dredging within waters surrounding
the newly configured dock. The docking structures include V x 85' pier originating from the existing bulkhead, over
coastal wetlands, and end with an L-shaped 14' X16' covered gazebo. The existing 6' X65' floating dock would be
relocated and extend water ward from the gazebo out towards Motts Channel. The applicant also requests authorization
to excavate — 400 cubic yards of sediment from 3900 sq. ft. of shallow bottom habitat within a 75' long by 52' wide area
(around the relocated floating dock) to a depth of -6' MLW, within Motts Channel, Wrightsville Beach, NC. Existing
water depths in the proposed dredge footprint average-3'MLW. The applicant proposes to utilize a site identified as the
'Agnes Beane' site (see attached disposal location map), adjacentto Motts Channel, as the disposal location. The
proposed dredging method is bucket to barge.
The proposed excavation and construction project is located at 228 Seacrest Drive in Motts Channel, Wrightsville Beach,
New Hanover County, North Carolina. Coordinates in Decimal Degrees are:34.2144 N,-77.8086 W. Additionally, a
Google Earth Amz file is attached for reference.
Please seethe attached field investigation report/application for more detailed information concerning the proposed
project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to small size of the project
area and temporary nature of sedimentation impacts, but the change in habitat and use of the shallow bottom habitat
will be permanent. The waters within the project area are not designated as PNA and are closed to the harvest of
shellfish. SAV is not present within the projecCarea based on aerial imagery.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
will affect, but not likely adversely affect the West Indian Manatee. The project will not affect any other species listed as
threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973
(ESA) within the project area. The use of Manatee Guidelines will be required as a permit condition.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

conservation and management of marine, estuarine, and diadromous fishery resources, the
NMFS provides the following comments and recommendations pursuant to the authorities of the
Fish and Wildlife Coordination Act and the Magnuson -Stevens Fishery Conservation and
Management Act (Magnuson -Stevens Act).
The applicants propose realigning the pier to adhere to riparian corridor setback requirements.
The newly configured docking structures would include a pier (six feet by 85 feet) originating
from the existing bulkhead, over coastal wetlands, and ending with an L-shaped covered fixed
platform (14 feet by 16 feet). The existing floating dock (six feet by 65 feet) would be. relocated
and extend waterward from the fixed platform out towards Motts Channel. To improve access
and navigation to the docking facility, the applicants propose to dredge using a bucket -to -barge
operation and to transport the dredged material to an upland disposal site. The estimated volume
of dredging is 400 cubic yards from 3,900 square feet of shallow bottom habitat to establish a
controlling depth of -6.0 feet at mean low water.
To protect salt marsh habitat adjacent to the dredging area, the NMFS recommends the permit
require a ten -foot dredge offset, based on the projected equilibrated side slopes, from coastal
wetlands, including all emergent salt marsh vegetation, oyster aggregations, and shell bottom.
Alternatively, the applicants are.encouraged to consider moving the floating dock to the
