This permit, issued on December 21.2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Millstream Properties I, LLC Permit No.147-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility expansion shall extend past. the Wrightsville Beach Pier Head Line. -8) - No attempt shall be made bythe perinittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. The proposed structure would not encroach into either adjacent 15' riparian corridor setback requirement and would meet the Town of Wrightsville Beach's Pierhead Line. The existing floating platform, boat lift and tie pilings would remain, including those portions that exceed the Town of Wrightsville Beach's Pierhead Line. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The project is located at 1905 N. Lumina Avenue in Wrightsville Beach. Areas of Environmental Concern (AEC's) impacted by the proposal are PTA and EW. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2005 Wrightsville Beach Land Use Plan Update and offer the following comments. The general area of the project is classified as Developed and Conservation. In general, the Wrightsville Beach Land Use Plan contains policies, which allows development in Developed and Conservation classified AECs, which is consistent with the State's minimum use standards. The Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However none of these policies appear to be applicable to this project. This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update. Lumina Ave., adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property, travel east on Eastwood Road (N.C. HWY 74) from Military Cut -Off Road for approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. HWY 74) approximately 1 mile and proceed to cross the bridge over Banks Channel. Veer left at the light onto N. Lumina and continue to travel north approximately 1.2 miles until you reach the property of interest, which will be on the left-hand side. The applicant currently maintains a single-family residence on the project site. The property is adjacent to residential properties with existing single family structures and private docking facilities. Highground vegetation consists of ornamental landscaping. The lot is approximately 0.46 acres in size and has an average elevation of approximately 6' above normal high water (NHW). The project site has approximately 92 linear feet of shoreline frontage stabilized by an existing concrete retaining wall, which meets NHW. There is an existing concrete boat ramp near the southern end of the property that measures approximately 10' in width. NHW is approximately 5' landward of the bulkhead in the area of the boat ramp. There is a patch of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alterniflora), which measures approximately 35' in width and is located north of the existing fixed pier. The applicant currently maintains an existing docking facility within Banks Channel. An access pier, measuring approximately 55' in length by 4' in width extends in a westerly direction from the existing retaining wall. The pier terminates onto a covered platform, measuring approximately 16' in length by 16' in width, which is centered creating an 7-head" configuration. An access ramp leads from the platform onto a floating dock, measuring approximately 20' in length by 14' in width, which runs in the same alignment as the access pier. On the north side of the pier is an existing boat lift measuring approximately 13' in width by 13' in length. There are two existing tie pilings on the north side of the ramp leading to the floating platform. There are also three tie pilings running perpendicular to the shoreline approximately 15' from the southern edge of the floating dock. The existing floating dock exceeds to Town of Wrightsville Beach's Pierhead Line by 5' and one tie piling exceeds the Pierhead Line by 13'. The existing docking facility currently accommodates up to two (2) vessels. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility within Banks Channel. A new finger pier, measuring approximately 24' in length by 5' in width would be constructed approximately 4' from the terminus on the southern side of the existing floating platform. The application states that the existing water depth in the location of the proposed structure would be approximately -6' at normal low water (NLW). The proposed expansion of the existing docking facility would accommodate up to three (3) slips at this location (see Sheets 2 of 4). The existing floating platform, boat lift and tie pilings would remain, including those portions that exceed the Town of Wrightsville Beach's Pierhead Line. ANTICIPATED IMPACTS: The proposed structure would incorporate an additional 120 sq. ft. of Estuarine Waters and Public Trust Areas. The proposed structure would not encroach into either adjacent 15' Riparian Corridor Setback Area requirement. The current facility extends approximately 71' into a waterbody, which measures approximately 890' across. The proposed finger pier would not encroach any further into the waterbody than the existing structures, and conforms to the 1/4 width rule and the locally established pier head line. Minor increases in turbidity should be expected during construction.
