Docking Facility 1) This permit authorizes.only the piers, gazebo, boat lifts, floating kayak launch, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. ADDITIONAL CONDITIONS Permit No.109-17 Page 2 of 3 The authorized docking facility shall not exceed the quarter width of the water body as measured from the most waterward finger of marsh in front of the permittee's property to the mash island across the shallow natural channel. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes a maximum of 4 formalized boat slips. The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 'The roof of the covered gazebo shall not be designed for second story use.. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General .This permit does not authorize any dredging in association with the authorized docking facility. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the "permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Milkman Investments, LLC Carteret County Project Narrative Introduction Milkman Investments, LLC is the owner of a waterfront parcel located at 10016 Coast Guard Road in Emerald Isle. The undeveloped residential lot is also identified as Tract No. 4 of the Division of Wooten Property. Douglas Starcke is the Manager of Milkman Investments, U.C. The owner is requesting a major CAMA permit to construct a four -slip docking facility. The dock will include boatlifts, a platform with roofed gazebo, finger piers, and a kayak launch. It will serve a future single-family residence to be located on the property. The permit application was accepted by the NC Division of Coastal Management as complete on May 15, 2017. Comments recently received by other regulatory review agencies suggested changes to the dock design that will result in two of the boat slips being located in deeper water. The plans have been changed accordingly. Incorporating the modifications will require other minor adjustments to address safety concerns brought about by the changes. The current proposed dock design is described below under "Project Description." Site Description The property contains 74,402 square feet (1.708 acres) of highground area, with 519 feet of shoreline measured along Normal High Water/Mean High Water (NHW/MHW). The wooded lot fronts Bogue Sound and is zoned by the Town of Emerald Isle for residential use (R-2). Undeveloped single-family residential parcels are located immediately to the east and west of the site. Trees, shrubs, and coastal and non -coastal wetlands are located on the property. A fringe of non -coastal wetlands ranging in width from 1.5' to 25' is located along the waterfront portion of the project and transitions to coastal wetlands, as shown on project plans. Three sections of non -coastal wetlands are also found at the front of the parcel near Coast Guard Road. The US Army Corps of Engineers issued a Notification of Jurisdictional Determination (JD) for the project site on November 25, 2013 (SAW-2013-02269). A copy of the JD is included with the application package. Typical of this section of Bogue Sound, the area beyond NHW/MHW is characterized by coastal wetlands interspersed with open water and marsh islands. The coastal wetlands are primarily Milkman Investments, LLC RECEIVED Major CAMA Permit Application June 23, 2017 JUN .2 9 2017 Page 1 DCM- MHO CITY Black Needle Rush (Juncus roemarianus) and Smooth Cordgrass (Spartina alterniflora). Occasional oyster rocks can also be seen in the area. A local channel used by residents to access deep water is visible on aerial photos of the area. The location and orientation of the channel were identified in consultation with Division of Coastal Management staff during a previous major CAMA permit process undertaken on behalf of a neighboring property owner. The local channel was used to determine the riparian corridors for properties within the immediate vicinity of the neighbor's property, including the current project site. The width of the water body at the project site is 150', measured from the waterward edge of coastal wetlands to the edge of a marsh island opposite the shoreline. The Intracoastal Waterway is located well beyond the deep water historic channel used to site the proposed dock. Waters of Bogue Sound at the project site are classified as SA ORW by the Environmental Management Commission and are open to the harvesting of shellfish. The area is not classified as a Primary Nursery Area. There are no shellfish leases adjacent to or within close proximity of the project. The highground topography of the lot is also typical of this area of Emerald Isle, with high ridges transitioning to lower elevations (ranging from 0 to 29 feet above NHW/MHW).The entire parcel is located within the 575' Coastal Shoreline Area of Environmental Concern (AEC). There are no manmade structures currently located on the site, although the owners recently obtained minor CAMA permit #17-17 for high ground development from the Town of Emerald Isle. The permit authorizes construction of a single-family residence with attached and detached garages, driveway with parking courts, swimming pool, and retaining walls. The minor permit also authorizes grading and filling of the property and installation of a septic system. Haibo Zhou is the adjacent riparian property owner to the west of the project site. LCVKJ Land Holdings, LLC owns the property to the east. Both neighbors have been notified of the proposed project and provided copies of the application and project plans by certified mail. Project Description The owners propose to construct a four -slip dock with platform, finger piers, boatlifts and a kayak launch. A roofed gazebo is proposed for location on the t-head platform. As previously stated, the design of the docking facility has been revised from the original submission. The current plan is shown on revised project plans (enclosed with this submission) and is described below. The 6' pier width is needed to allow pedestrians carrying gear and kayaks to safely meet and pass while on the structure. The length of the pier measured from NHW/MHW is 710'. It measures 384' from the waterward edge of coastal wetlands. The docking facility will extend 37' into the waterbody noted above as 150' wide. The bottom of the pier decking will be elevated a minimum of 3' above the wetland substrate. Water depths at the end of the proposed dock and at the boat slip locations measure -2.75' NLW/MLW. An 18' x 40' t-head platform will be located at the end of the pier. An 18' x 24' roofed gazebo with 12" overhang will be located on the western end of the platform. Revised (current) project plans relocate Slips #1 and 2 from the original proposed location (landward of the main platform) to adjacent the west side of the main platform. The kayak launch platform, originally located to the west side of the main platform, has been relocated to a position alongside the main pier and landward of the main platform. Two L-shaped finger piers located landward of the main platform and extending from the main pier will provide access for four (4) boat slips, as shown on project plans. With the current changes, the finger pier located on the west side of the main pier for access to Slips #1 and 2 has increased in length from 25' to 65.66'. The second finger pier measuring 51.66' remains located on the east side of the main pier to provide access to Slips #3 and 4. The distance between the main platform and the sections of the finger piers parallel to the main platform has been decreased from 14.33' to 633', thus encompassing less public trust area than originally proposed. Narrowing the distance between the platform and finger piers has resulted in portions of both finger piers being located in slightly deeper water. Boat lifts measuring 13' x 13' are proposed for installation in all four slips. The longer finger pier length over deeper water increases safety concerns for the owners as they load and unload young children, elderly relatives, guests, gear, and similar items onto boats stored in the slips. To address safety issues the width of the finger piers has been increased from 3'to 4, as shown on the revised project plans. The kayak launch platform originally measured 18' x 5' and was located in deep water (-2.6' to - 2.9' NLW/MLW) immediately to the west of the main platform. Relocation of Slips #1 and 2 resulted in the kayak platform being moved to shallower water measuring about -1.7' NLW/MLW on the west side of the main pier directly landward of the main platform. To Millunan Investments, LLC Major CAMA Permit Application June 28,2017 RECEVED Page JUN 2 9 2017 DCM- MHD CITY increase stability and functionality of the kayak platform in shallower water, the modified (current) plan increases the width of the platform from 5' to 8' and incorporates a floating rather than fixed kayak platform (current measurements of 18' x 8'). All components of the docking facility will be fixed, with the exception of the floating kayak platform. The kayak launch will be positioned lower than the main pier and will be installed to float in 1' of water to avoid resting on the bottom at NLW (measured at -1.7' at the kayak launch location). The dock will be located 46' from the western adjacent riparian boundary and 37' from the adjacent riparian boundary to the east. The dock will be located 173' from the adjacent docking facility on the west, as shown on project plans. It will be 519' from the nearest docking facility to the east, measured from Google Earth images. No impervious surfaces will result from work proposed in this application, although the previously permitted high ground work (minor CAMA permit 17-17) will create approximately 9,000 square feet of impervious surfaces or 12% of the project area located above NHW/MHW. Construction Methods One barge with pile driving equipment stored in deep water will be used for construction of the dock. Conventional marine construction methodology will be employed. A mini -excavator stored on high ground will be used with protective mats to construct the sections over wetlands. Overview: The applicant is proposing to construct a 4-slip docking facility with four boatlifts, two finger piers, covered platform, uncovered platform, and a kayak launch on Bogue Sound at 10016 Coast Guard Rd., Emerald Isle, Carteret County, North Carolina. The property is undeveloped and wooded. There is a thick fringe of Coastal Wetlands containing Spartina alterniflora and Juncus roemerianus along the shore, with tidal creeks meandering throughout. The project is in the Estuarine Waters, Estuarine Shoreline, Coastal Wetlands, and Public Trust Area AECs. Bogue Sound is classified as SA (MarketShel[fishing, Salt Water)/ORW (Outstanding Resource Water), is open to the taking of shell fish, and is not PNA. The bottom substrate is mostly sand and mud with clusters of oysters. Anticipated impacts resulting from this project are expected to include: 4,889 ft2 of Pubic Trust Area usurped, 3,450 ftZ of Estuarine Water shaded, 2,520 ft2 of Coastal Wetlands shaded. Some disturbance bottom disturbance would occur when installing pilings. Impact to the bottom from boating activity (prop scarring) could occur due to shallow water depths (-1' to -3' NLW). Basis for Determination: The project site is located in Emerald Isle and is subject to the town's Land Use Plan. The Future Land Use Map (FLUM) designates the site as Living Areas (Single/Dual Family Residential) and Conservation (Estuarine Waters and Coastal Wetlands). NC 28557 252 808 2808 e-- Land Use Policies: The following LUP policies may be applicable to this request. 2.1 Due to the essential role that they play in protecting water quality and providing food and habitat for fish and wildlife, the Town supports protection and conservation of Emerald Isle's coastal wetlands. 2.1.1 The Town endorses the CAMA use standards, which may be minimum requirements, and the development permit system as an effective tool for conserving coastal wetlands. 2.1.2 Through enforcement of local ordinances, the Town will ensure that land use and development are consistent with conservation of coastal wetlands. The Town will allow only land uses in coastal wetlands that require water access and cannot function elsewhere. Examples of acceptable uses are utility easements, piers, and docks. Where such uses are permitted, the Town will require them to be developed in such a manner that the impact on coastal wetlands is minimized. 2.3 The Town recognizes the importance of the 575 foot ORW-estuarine shoreline in protecting water quality in Bogue Sound and supports use standards that preserve natural barriers to erosion, require vegetated buffers, requires on -site retention of stormwater, and keep impervious surfaces to a minimum. The Town will continue to enforce local ordinances that support these objectives in the ORW-estuarine shoreline. 2.4 The Town will only allow uses in estuarine waters that are compatible with protection and conservation of their biological and community values. 2.4.1 Only development associated with water -dependent uses is allowed. Examples of appropriate development may include public access facilities, docks and piers, or erosion control structures. 2.4.2 In all cases, the design of facilities or activities will ensure that any negative impacts on estuarine waters are minimized. The applicant proposes to construct a four -slip docking facility with boatlifts, covered platform, and a kayak launch. The pier will be 6' wide and will cross 420' of coastal marsh and 375' of open water. The pier will terminate in a t-head platform consisting of a 20'x26' covered platform, 14'xl8' uncovered platform area, and a 5'xl8'kayak.launch area that will be lower to the water. There will be two finger piers leading to the boat lifts and these will be 3'x25' and 3'x58' respectively. One set of lifts is located behind the platform and the other located adjacent to west side of the platform. The total platform area of the project as proposed is 1110 square feet. The project is located in Bogue Sound which is classified as an outstanding resource water, is open to shellfishing, is not a designated primary nursery area. The substrate is sandy mud with clusters of oysters. The based on the depths provided in the project plan the platform and not the boat lifts are located in the deepest waters available on the site. This is particularly apparent on the lifts that are directly landward of the platform. The reduce the potential for prop kicking when loading and unload from the boat lifts they should be reoriented to be waterward or adjacent to the proposed platform to ensure adequate water depths are available at all tides. To achieve this goal the kayak platform could be moved to a location landward of the platform or even alongside the pier in the shallower waters. This relatively small reorientation of the boatlift location and kayak launch should reduce the potential for bottom impacts and increase the usability of the boat lifts. The applicant, Milkman Investments, LLC, requests authorization to build a single-family pier and dock with four boat slips and kayak launch in waters adjoining Bogue Sound Bay, in Emerald Isle, Carteret County. The waters within the project area are not a state -designated Primary Nursery Area, but oysters are abundant in the project area and the waters are open to shellfish harvest. The Wilmington District's initial determination is the proposed project may affect essential fish habitat (EFH) or associated fisheries managed by South Atlantic Fishery Management Council (SAFMC), the Mid -Atlantic Fishery Management Council, or NMFS. As the nation's federal trustee for the conservation and management of marine, estuarine, and diadromous fishery resources, the NMFS provides the following comments and recommendations pursuant to the authorities of the Fish and Wildlife Coordination Act and the Magnuson -Stevens Fishery Conservation and Management Act (Magnuson -Stevens Act). Description of the Proposed Project The applicant propose construction of an access pier (six feet by 710 feet) extending over coastal wetlands and ending with a T-shaped platform (18 feet wide by 40 feet long) and two L-shaped finger piers measuring four feet wide by 66 feet long and four feet wide by 52 feet long. A floating kayak launch (eight feet by 18 feet) will adjoin the western side of the pier. All walkways and docks would be constructed a minimum of three feet above wetland surfaces. Water depths within the docking facility footprint are -2.75 feet normal low water. No dredging is proposed. Impacts to Essential Fish Habitat The NMFS primary concern is with regards to the abundance of shell bottom and shellfish resources within the project area. As documented within the application, the site includes an extensive amount of shallow bottom habitat. Some of the shallow bottom habitat is covered with clusters of oysters or loosely covered with shell material (oyster cultch). A detailed shellfish survey has not been completed. The SAFMC identifies shallow intertidal and sub -tidal bottom in estuarine waters as EFH for brown shrimp, pink shrimp, and white shrimp and for estuarine species within the snapper/grouper complex (e.g., gray snapper and gag). The SAFMC identifies these areas as EFH because fish and shrimp concentrate in these habitats for feeding and refuge and experience high growth and survival rates when located in these habitats. The SAFMC also identifies oysters as a Habitat Area of Particular Concern (HAPC) for gag and gray snapper. HAPCs are a subset of EFH that are rare, particularly susceptible to human -induced degradation, especially important ecologically, or located in an environmentally stressed area. The SAFMC provides detailed information on the EFH requirements of federally managed species in amendments to the fishery management plans and in Fishery Ecosystem Plan of the South Atlantic Region (available at www.safmc.net) The project area clearly functions as nursery habitat for federally managed species as well as other species of commercial or recreational importance including red drum, Atlantic croaker, spot, Atlantic menhaden, bay anchovy, striped mullet, weakfish, and blue crab. A number of these species serve as prey for fish that are managed by the SAFMC (e.g., king mackerel, Spanish mackerel, and cobia) or for highly migratory fish managed by the NMFS (e.g., billfishes and sharks). EFH Conservation Recommendation Section 305(b)(4)(A) of the Magnuson -Stevens Act requires NMFS to provide EFH Conservation Recommendations for any federal action or permit which may result in adverse impacts to EFH. Therefore, NMFS recommends the following to ensure the conservation of EFH and associated fishery resources: • The permit should expressly prohibit dredging at the location and discourage future permit applications for dredging at the site. Section 305(b)(4)(B) of the Magnuson -Stevens Act and implementing regulation at 50 CFR Section 600.920(k) require the Wilmington District to provide a written response to this letter within 30 days of its receipt. If it is not possible to provide a substantive response within 30 days, in accordance with the "findings" with the Wilmington District, an interim response should be provided to the NMFS. A detailed response then must be provided prior to final approval of the action. The detailec response must include a description of measures proposed by the Wilmington District to avoid, mitigate, or offset the adverse impacts of the activity. If the response is inconsistent with the EFH conservation recommendations, the Wilmington District must provide a substantive discussion justifying the reasons for not following the recommendations. Coast Guard Rd. is found by turning right at the first stop light once crossing the Emerald Isle bridge. This property is about 2mi down Coast Guard Rd. on Bogue Sound Bay Currently the property is undeveloped and wooded. Minor permit # 17-17 has been issued by the Town of Emerald Isle for a single-family home with a swimming pool and retaining walls. There is a thick fringe of Coastal Wetlands containing Spartina alterniflora and Juncus roemarianus along the shore with tidal creeks meandering through. Water depths in this area of Bogue Sound range from -1' to -3' at NLW. The bottom is mostly sand and mud with clusters of oysters. Bogue Sound is an Outstanding Resource Water and is open to shell fishing. This area is not a Primary Nursery Area. Emerald Isle's Land Use Plan classifies this lot as residential. The 6'' wide pier would leave high ground and cross 420' of Coastal Wetlands before reaching open water. Small tidal creeks meander through the marsh in this area. The pier would continue another 375' over open water before reaching the platform area. Extending south off the pier would be a TX25' finger pier with two 13'X13' boatlifts. The undeveloped residential lot is also identified as Tract No. 4 of the Division of Wooten Property. Douglas Starcke is the Manager of Milkman Investments, LLC. The owner is requesting a major CAMA permit to construct a four -slip docking facility. The dock will include boatlifts, a platform with roofed gazebo, finger piers, and a kayak launch. It will serve a future single-family residence to be located on the property. The permit application was accepted by the NC Division of Coastal Management as complete on May 15, 2017. Comments recently received by other regulatory review agencies suggested changes to the dock design that will result in two of the boat slips being located in deeper water. The plans have been changed accordingly. Incorporating the modifications will require other minor adjustments to address safety concerns brought about by the changes. The current proposed dock design is described below under "Project Description." Site Description The property contains 74,402 square feet (1.708 acres) of highground area, with 519 feet of shoreline measured along Normal High Water/Mean High Water (NHW/MHW). The wooded lot fronts Bogue Sound and is zoned by the Town of Emerald Isle for residential use (R-2). Undeveloped single-family residential parcels are located immediately to the east and west of the site. Trees, shrubs, and coastal and non -coastal wetlands are located on the property. A fringe of non -coastal wetlands ranging in width from 1.5' to 25' is located along the waterfront portion of the project and transitions to coastal wetlands, as shown on project plans. Three sections of non -coastal wetlands are also found at the front of the parcel near Coast Guard Road. The US Army Corps of Engineers issued a Notification of Jurisdictional Determination (JD) for the project site on November 25, 2013 (SAW-2013-02269). A copy of the 1D is included with the application package. Typical of this section of Bogue Sound, the area beyond NHW/MHW is characterized by coastal wetlands interspersed with open water and marsh islands. Occasional oyster rocks can also be seen in the area. A local channel used by residents to access deep water is visible on aerial photos of the area. The location and orientation of the channel were identified in consultation with Division of Coastal Management staff during a previous major CAMA permit process undertaken on behalf of a neighboring property owner. The local channel was used to determine the riparian corridors for properties within the immediate vicinity of the neighbor's property, including the current project site. The width of the water body at the project site is 150', measured from the waterward edge of coastal wetlands to the edge of a marsh island opposite the shoreline. The Intracoastal Waterway is located well beyond the deep water historic channel used to site the proposed dock. Waters of Bogue Sound at the project site are classified as SA ORW by the Environmental Management Commission and are open to the harvesting of shellfish. The area is not classified as a Primary Nursery Area. There are no shellfish leases adjacent to or within close proximity of the project. The highground topography of the lot is also typical of this area of Emerald Isle, with high ridges transitioning to lower elevations (ranging from 0 to 29 feet above NHW/MHW).The entire parcel is located within the 575' Coastal Shoreline Area of Environmental Concern (AEC). There are no manmade structures currently located on the site, although the owners recently obtained minor CAMA permit #17-17 for high ground development from the Town of Emerald Isle. The permit authorizes construction of a single-family residence with attached and detached garages, driveway with parking courts, swimming pool, and retaining walls. The minor permit also authorizes grading and filling of the property and installation of a septic system. Haibo Zhou is the adjacent riparian property owner to the west of the project site. LCVKJ Land Holdings, LLC owns the property to the east. Both neighbors have been notified of the proposed project and provided copies of the application and project plans by certified mail. Project Description The owners propose to construct a four -slip dock with platform, finger piers, boatlifts and a kayak launch. A roofed gazebo is proposed for location on the t-head platform. As previously stated, the design of the docking facility has been revised from the original submission. The 6' pier width is needed to allow pedestrians carrying gear and kayaks to safely meet and pass while on the structure. The length of the pier measured from NHW/MHW is 710'. It measures 384' from the waterward edge of coastal wetlands. The docking facility will extend 37' into the waterbody noted above as 150' wide. The bottom of the pier decking will be elevated a minimum of 3' above the wetland substrate. Water depths at the end of the proposed dock and at the boat slip locations measure -2.75' NLW/MLW. An 18' x 40' t-head platform will be located at the end of the pier. An 18' x 24' roofed gazebo with 12" overhang will be located on the western end of the platform. Revised (current) project plans relocate Slips #1 and 2 from the original proposed location (landward of the main platform) to adjacent the west side of the main platform. The kayak launch platform, originally located to the west side of the main platform, has been relocated to a position alongside the main pier and landward of the main platform. Two L-shaped finger piers located landward of the main platform and extending from the main pier will provide access for four (4) boat slips, as shown on project plans. With the current changes, the finger pier located on the west side of the main pier for access to Slips #1 and 2 has increased in length from 25' to 65.66'. The second finger pier measuring 51.66' remains located on the east side of the main pier to provide access to Slips #3 and 4. The distance between the main platform and the sections of the finger piers parallel to the main platform has been decreased from 14.33' to 6.33', thus encompassing less public trust area than originally proposed. Narrowing the distance between the platform and finger piers has resulted in portions of both finger piers being located in slightly deeper water. Boat lifts measuring 13' x 13' are proposed for installation in all four slips. The longer finger pier length over deeper water increases safety concerns for the owners as they load and unload young children, elderly relatives, guests, gear, and similar items onto boats stored in the slips. To address safety issues the width of the finger piers has been increased from 3' to 4', as shown on the revised project plans. The kayak launch platform originally measured 18' x 5' and was located in deep water (-2.6' to - 2.9' NLW/MLW) immediately to the west of the main platform. Relocation of Slips #1 and 2 resulted in the kayak platform being moved to shallower water measuring about -1.7' NLW/MLW on the west side of the main pier directly landward of the main platform. All components of the docking facility will be fixed, with the exception of the floating kayak platform. The kayak launch will be positioned lower than the main pier and will be installed to float in 1' of water to avoid resting on the bottom at NLW (measured at -1.7' at the kayak launch location). The dock will be located 46' from the western adjacent riparian boundary and 37' from the adjacent riparian boundary to the east. The dock will be located 173' from the adjacent docking facility on the west, as shown on project plans. It will be 519' from the nearest docking facility to the east, measured from Google Earth images. No impervious surfaces will result from work proposed in this application, although the previously permitted high ground work (minor CAMA permit 17-17) will create approximately 9,000 square feet of impervious surfaces or 12% of the project area located above NHW/MHW. Construction Methods One barge with pile driving equipment stored in deep water will be used for construction of the dock. Conventional marine construction methodology will be employed. A mini -excavator stored on high ground will be used with protective mats to construct the sections over wetlands. The undeveloped residential lot is also identified as Tract No. 4 of the Division of Wooten Property. Douglas Starcke is the Manager of Milkman Investments, U.C. The owner is requesting a major CAMA permit to construct a four -slip docking facility. The dock will include boatlifts, a platform with roofed gazebo, finger piers, and a kayak launch. It will serve a future single-family residence to be located on the property. The permit application was accepted by the NC Division of Coastal Management as complete on May 15, 2017. Comments recently received by other regulatory review agencies suggested changes to the dock design that will result in two of the boat slips being located in deeper water. The plans have been changed accordingly. Incorporating the modifications will require other minor adjustments to address safety concerns brought about by the changes. The current proposed dock design is described below under "Project Description." Site Description The property contains 74,402 square feet (1.708 acres) of highground area, with 519 feet of shoreline measured along Normal High Water/Mean High Water (NHW/MHW). The wooded lot fronts Bogue Sound and is zoned by the Town of Emerald Isle for residential use (R-2). Undeveloped single-family residential parcels are located immediately to the east and west of the site. Trees, shrubs, and coastal and non -coastal wetlands are located on the property. A fringe of non -coastal wetlands ranging in width from 1.5' to 25' is located along the waterfront portiop of the project and transitions to coastal wetlands, as shown on project plans. Three sections of non -coastal wetlands are also found at the front of the parcel near Coast Guard Road. The US Army Corps of Engineers issued a Notification of Jurisdictional Determination (JD) for the project site on November 25, 2013 (SAW-2013-02269). A copy of the JD is included with the application package. Typical of this section of Bogue Sound, the area beyond NHW/MHW is characterized by coastal wetlands interspersed with open water and marsh islands. Occasional oyster rocks can also be seen in the area. A local channel used by residents to access deep water is visible on aerial photos of the area. The location and orientation of the channel were identified in consultation with Division of Coastal Management staff during a previous major CAMA permit process undertaken on behalf of a neighboring property owner. The local channel was used to determine the riparian corridors for properties within the immediate vicinity of the neighbor's property, including the current project site. The width of the water body at the project site is 150', measured from the waterward edge of coastal wetlands to the edge of a marsh island opposite the shoreline. The Intracoastal Waterway is located well beyond the deep water historic channel used to site the proposed dock. Waters of Bogue Sound at the project site are classified as SA ORW by the Environmental Management Commission and are open to the harvesting of shellfish. The area is not classified as a Primary Nursery Area. There are no shellfish leases adjacent to or within close proximity of the project. The highground topography of the lot is also typical of this area of Emerald Isle, with high ridges transitioningto lower elevations (ranging from 0 to 29 feet above NHW/MHW).The entire parcel is located within the 575' Coastal Shoreline Area of Environmental Concern (AEC). There are no manmade structures currently located on the site, although the owners recently obtained minor CAMA permit #17-17 for high ground development from the Town of Emerald Isle. The permit authorizes construction of a single-family residence with attached and detached garages, driveway with parking courts, swimming pool, and retaining walls. The minor permit also authorizes grading and filling of the property and installation of a septic system. Haibo Zhou is the adjacent riparian property owner to the west of the project site. LCVKJ Land Holdings, LLC owns the property to the east. Both neighbors have been notified of the proposed project and provided copies of the application and project plans by certified mail. Project Description The owners propose to construct a four -slip dock with platform, finger piers, boatlifts and a kayak launch. A roofed gazebo is proposed for location on the t-head platform. As previously stated, the design of the docking facility has been revised from the original submission. The current plan is shown on revised project plans (enclosed with this submission) and is described below. The 6' pier width is needed to allow pedestrians carrying gear and kayaks to safely meet and pass while on the structure. The length of the pier measured from NHW/MHW is 710'. It measures 384' from the waterward edge of coastal wetlands. The docking facility will extend 37' into the waterbody noted above as 150' wide. The bottom of the pier decking will be elevated a minimum of 3' above the wetland substrate. Water depths at the end of the proposed dock and at the boat slip locations measure -2.75' NLW/MLW. An 18' x 40' t-head platform will be located at the end of the pier. An 18' x 24' roofed gazebo with 12" overhang will be located on the western end of the platform. Revised (current) project plans relocate Slips #1 and 2 from the original proposed location (landward of the main platform) to adjacent the west side of the main platform. The kayak launch platform, originally located to the west side of the main platform, has been relocated to a position alongside the main pier and landward of the main platform. Two L-shaped finger piers located landward of the main platform and extending from the main pier will provide access for four (4) boat slips, as shown on project plans. With the current changes, the finger pier located on the west side of the main pier for access to Slips #1 and 2 has increased in length from 25' to 65.66'. The second finger pier measuring 51.66' remains located on the east side of the main pier to provide access to Slips #3 and 4. The distance between the main platform and the sections of the finger piers parallel to the main platform has been decreased from 14.33'to 6.33', thus encompassing less public trust area than originally proposed. Narrowing the distance between the platform and finger piers has resulted in portions of both finger piers being located in slightly deeper water. Boat lifts measuring 13' x 13' are proposed for installation in all four slips. The longer finger. pier length over deeper water increases safety concerns for the owners as they load and unload young children, elderly relatives, guests, gear, and similar items onto boats stored in the slips. To address safety issues the width of the finger piers has been increased from 3' to 4, as shown on the revised project plans. The kayak launch platform originally measured 18' x 5' and was located in deep water (-2.6' to - 2.9' NLW/MLW) immediately to the west of the main platform. Relocation of Slips #1 and 2 resulted in the kayak platform being moved to shallower water measuring about -1.7' NLW/MLW on the west side of the main pier directly landward of the main platform. All components of the docking facility will be fixed, with the exception of the floating kayak platform. The kayak launch will be positioned lower than the main pier and will be installed to float in 1' of water to avoid resting on the bottom at NLW (measured at -1.7' at the kayak launch location). The dock will be located 46' from the western adjacent riparian boundary and 37' from the adjacent riparian boundary to the east. The dock will be located 173' from the adjacent docking facility on the west, as shown on project plans. It will be 519' from the nearest docking facility to the east, measured from Google Earth images. No impervious surfaces will result from work proposed in this application, although the previously permitted high ground work (minor CAMA permit 17-17) will create approximately 9,000 square feet of impervious surfaces or 12% of the project area located above NHW/MHW. Construction Methods One barge with pile driving equipment stored in deep water will be used for construction of the dock. Conventional marine construction methodology will be employed. A mini -excavator stored on high ground will be used with protective mats to construct the sections over wetlands. The wooded lot fronts Bogue Sound and is zoned by the Town of Emerald Isle for residential use (R-2). Undeveloped single-family residential parcels are located immediately to the east and west of the site. Trees, shrubs, and coastal and non -coastal wetlands are located on the property. A fringe of non -coastal wetlands ranging in width from 1.5' to 25' is located along the waterfront portion of the project and transitions to coastal wetlands, as shown on project plans. Three sections of non -coastal wetlands are also found at the front of the parcel near Coast Guard Road. The US Army Corps of Engineers issued a Notification of Jurisdictional Determination (JD) for the project site on November 25, 2013 (SAW-2013-02269). Typical of this section of Bogue Sound, the area beyond NHW/MHW is characterized by coastal wetlands interspersed with open water and marsh islands. The proposed 6' wide dock will provide boating and water access for Mr. Starcke and his family and guests. The 6' pier width is needed to allow pedestrians carrying gear and kayaks to safely meet and pass while on the structure. Length of the pier measured from NHW/MHW is 723'. It measures 397' from the waterward edge of coastal wetlands. The docking facility will extend 55' into the waterbody noted above as 251' wide. Three finger piers located landward of the main platform and extending from the main pier will provide access for four (4) boat slips. One finger pier measuring 25' x 3' is located on the west side of the main dock. Slip #1 is located between the finger pier and main platform.
