Along with requiring special care by those who build and develop, the General Assembly directed the Coastal Resources Commission (CRC) to imple- ment clear regulations that minimize the burden on the applicant. This application for a minor development permit under LAMA is part of the Commission's effort to meet the spirit and intent -of the 1seneral Assembly. It, has been designed to be straightforward and require no more time or effort necessary from. the applicant. Please go over -this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand whatinformation he or she needs. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. You can speed the approval process' by making certain that your application is complete and signed, that your drawing meets the specifications given inside and that your application fee is attached. Other permits are sometimes required for development in the coastal area. While these are not CAMA-related, we urge you to check with the Loral Permit Officer to determine which of these you may need. A listing is included on page 2 of this folder. Lake Park Blvd. Carolina Beach, NC 28428 Dear Mr. Peck: January 13, 2005 Re: CAMA Minor Development Permit No. CB2004-56 issued to Jes Skip Properties, LLC, c/o Ron Jessup II on December 17, 2004, for construction of four duplexes. After checking with the North Carolina Division of Water Quality, and finding that a water and sewer permit would be needed for the development proposed by this Minor Permit, it has been determined that Coastal Area Management Act (CAMA) Major Permit is necessary. As such, the Minor Permit issued by the Town of Carolina Beach's Local Permit Officer is null and void. Furthermore, if the applicant proposes to not expand the existing utility lines for the proposed development, the Minor Permit through the Town of Carolina Beach would remain active. This determination is in accordance with the provisions of 15A NCAC 7I .0702 which states: " When the local permit -letting agency exceeds the scope and extent of its authority, which is limited to consideration of applications proposing minor development as defined in the Coastal Area Management Act, the action shall be null, void and no effect." The applicants for this Minor Permit have been advised of this determination by copy of this letter. They have also been advised by telephone, as per my conversation with the applicant on January 11, 2205, we discussed that proposed expansion of the existing water and sewer utility lines indicated in the application would require a CAMA Major Permit. Dear Mr. Jessup: This letter is a follow up to the letter we sent on February 4, 2005 referring to the CAMA Minor Development Permit listed above, which listed conditions thl needed by the N.C. Division of Coastal Management and the local permit -letting authority to modify the existing permit listed above in order to keep the permit valid and consistent with the CAMA Minor Development Permit criteria. After receiving the revised plans and correspondence through the N.C. Division of Water Quality, receiving letters from the Town of Carolina Beach indicating consistency with the Town's Revised Local Land Use Plan and the Town's capabilities of the existing utilities to handle the sewer and water for the proposed development, and receiving by notification no objections from all adjacent properties owners for the modification to existing permit, the N.C. Division of Coastal Management has determined that the CAMA Minor Development Permit listed above as in compliance and valid. l will include the local permit -letting authority with the information we received in our office and that no further additional information is needed to allow the modification of the applicant's permit to become in compliance under Minor Development. As we discussed in our conversation on February 2, 2005, the local permit -letting authority will need additional information prior to allowing the modification of the applicant's permit to become in compliance under Minor Development. This determination is in accordance with the provisions of 15A NCAC 7J .0405 (d) which states: "An applicant may modify his permitted minor development project only after approval by the local permit -letting authority. In order to modify a permitted project the applicant must make a written request to the local permit -letting authority showing in detail the proposed modifications. The request shall be reviewed in consultation with the appropriate Division of Coastal Management field consultant and granted if all of the following provisions are met: (1) The sue of the project is expanded less than 20 percent of the size of the originally permitted project; and (2) A Signed, written statement is obtained from all adjacent riparian property owners indicating they have no objection to the proposed modifications. (3) The proposed modifications are consistent with all local, state, and federal standards and local Land Use Plans in effect at the time of the modifications requests; and (4) The type or nature of development is not changed. Failure to meet these provisions shall necessitate the submission of a new permit application." The local permit -letting authority will need the following information to determine if the proposed development would be considered Minor Development: (1) Revised plans indicating where and how the proposed four units would tie info the existing water and sewer lines without expansion of the existing utility lines. (2) Letter from the N.C. Divisions of Water Quality and Public Water stated that -e proposed connections for this development would not require permits from their divisions. (3) Letter from the Town of Carolina Beach stating that the proposed development would be consistent with town's regulations. After checking with the North Carolina Division of Water Quality, and finding that a water and sewer permit would be needed for the development proposed by this Minor Permit, it has been determined that Coastal Area Management Act (CAMA) Major Permit is necessary. As such, the Minor Permit issued by the Town of Carolina Beach's Local Permit Officer is null and void. Furthermore, if the applicant proposes to not expand the existing utility lines for the proposed development, the Minor Permit through the Town of Carolina Beach would remain active. This determination is in accordance with the provisions of 15A NCAC 7I .0702 which states: " When the local permit -letting agency exceeds the scope and extent of its authority, which is limited to consideration of applications proposing minor development as defined in the Coastal Area Management Act, the action shall be null, void and no effect."
