This permit, issued on December 17, 1992 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
*This renewal must be attached to the original of Permit #41-89 and be
available on site when division personne.i inspect the project for compliance.
All conditions and stipulations of the original permit remain in force
under this renewal.
MAINTENANCE CLAUSE
The Division of Coastal Management will be notified in writing at least
two (2) weeks in advance of any maintenance work (after Dec. 31, 1992)
authorized by this permit and that notification include:
A. the number of the original permit.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.
Signed by the authority of the Secretary of DEHNR and the
Chairman of the Coastal Resources Commission.

the area to be maintained, the area to be used for spoil, and the
estimated amount of material to be removed.

Enclosed please find a request from the homeowners of Oyster Bay
subdivision to renew their dredge permit #41-89. The original
permit to dredge this area was issued on 2/18/80, to expire on
12/31/83. The work was to be accomplished hydraulically, and was
conditioned to recognize the dredge moratorium. A new permit was
issued on 2/21/89 for continuance of this same work. This permit
expires on 12/31/92.
The applicants are proposing to renew permit #41-89. The actual
work authorized in 1989 has not been done. The anticipated date of
commencement is late 1994 or early 1995. The applicants want to
keep the permit active until that time.
I recommend the renewal of this permit with all the original
conditions.

Application for renewal of Maintenance Dredging Permit
Dear Ms. Barrett,
The Homeowner's Association of Oyster Bay Subdivion
presently holds DNRC Permit # 41-89, issued 21 Feb 1989.
This permit allows maintenance dredging of an existing
entrance channel and boat basin cross section as outlined
on the attached drawings. The basin is located in New
Hanover County, on the ICW, approximately one quarter mile
north of Whiskey Creek (please see attachments).
Although dredging is not anticipated until late 1994 or
1995, the Association would like to renew the maintenance
permit at this time. Per our recent telephone conversation,
this letter is submitted as our renewal application.
The attached drawings indicate a spoil area located on
the east side of the ICW. A specific spoil site would be
selected and, of course, approved at such time as actual
dredging is deemed necessary.
