authorizing development in New Hanover County at the AI W W. North of Whiskey Creek. off of
SR1492 as requested in the permittee's application dated letter dated 10/29/96 and 1/11/97
including attached work plan drawing dated 1- 8/96.
This permit, issued on is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) This minor modification authorizes the replacement and lengthening of the destroyed docking
facility, the use of a concrete floating dock system, an increase in the number of permitted slips to
25, and the relocation to a high ground area of the boardwalk system. The permitted activities must
be accomplished in strict compliance with the attached 10/28/96 work plan drawing.
2) Any deviation from the work detailed in the 10/28/96 work plan drawing, including, but not limited
to an increase in the number of docking slips, will require a modification of this permit.
NOTE: The permitted is encouraged to remove all storm damaged timbers and pilings so that they
will not become either a floating or stationary hazard to navigation.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

3) This modification must be attached to the original of Permit No. 41-89, which was issued on
2/21/89, as well as the maintenance renewal of 12/17/92 and the minor modification of
1/25/94. All documents must be readily available on site when a Division representative
inspects the project for compliance. All conditions and stipulations of the original permit and
subsequent renewals and modifications remain in force under this modification unless altered
herein.
