with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Dredging and Spoil Disposal
1) This modification authorizes the use of a hydraulic dredge to perform the previously permitted
maintenance excavation, as well as a new dredge spoil disposal site, as indicated on the attached
workplan drawings.
2) The pemrittee shall contact the N. C. Division of Environmental Health, Shellfish Sanitation Section,
at (910) 395-3900, at least ten (10) days prior to the initiation of dredging activities, in order to allow
for a temporary closure of shellfish harvesting in waters adjacent to the spoil disposal site. The
permittee shall also notify the Shellfish Sanitation Section immediately following completion of the
project.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1997
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
3) All excavated materials will be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover
of solids into any marsh or surrounding waters.
4) The dike walls shall have a minimum slope of 2:1.
5) The diked disposal area will be constructed a sufficient distance from the mean high water level
or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters.
6) Proper sedimentation and erosion control devices, such as silt fences, shall be employed in order
to prevent the movement of eroded materials into adjacent areas.
7) The settling basin must have a minimum height of 6', with at least a 2' vertical separation from
the top of the dike wall.
8) The effluent pipe must be elevated over all wetland areas.
9) Mats must be utilized if wetlands are crossed with equipment necessary to construct the dike
system.
GENERAL
10) This modification must be attached to the original of Permit No. 41-89, which was issued on
2/21/89, as well as the maintenance renewal of 12/17/91, and the minor modifications of
1/25/94 and 1/30/97, and all documents must be readily available on site when a Division
representative inspects the project for compliance. All conditions and stipulations of the
original permit and subsequent renewals and modifications remain in force under this
modification unless altered herein.
