with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.

Conditions
I . All proposed development and associated construction must be done in accordance with the permitted
workplat drawing as originally submitted on September 10. 2004.
2. All construction must conform the the North Carolina Building Code requirements and all other Local.
State and Federal regulations.
3. Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
4. The amount of impervious surface areas shall not exceed 30% of the lot area within the 75' Area of
Environmental Concern (AEC); in this case, 10 %
5. In order to prevent sedimentation, a vegetated buffer zone must be maintatined between all disturbed areas
and the adjacent waterbody or marsh. In this case a 30 foot wide buffer has been accepted.
6. Prior to initiating any land -disturbing activities, a barrier fine of filter cloth, staked bales, or burlap must
be installed between the land -disturbing activity and the adjacent marsh or water areas, until such time as
the area has been properly stabilized with a vegetated cover.
7. Pursuant to 15 NCAC, Subchapter 1j.0406(b), this permit may not be assigned, transferred sold, or
otherwise disposed of to a third party.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this per-
mit m,.st cease until the appeal is resolved.
This permit must be on the project site and accessible to the
permit officer when the project is inspected for compliance.
Any maintenance work or project modifications not covered
under this permit requires further written permit approval.
All work must cease when this permit expires on December
31, � FF
In issuing this permit it is agreed that this project is consistent
with the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without
the written approval of the Division of Coastal Management.

Re: DENIAL OF CAMA MINOR DEVELOPMENT PERMIT
Dear Mr. Rufenacht :
After reviewing your application in conjunction with the development standards required by the Coastal
Area Management Act (CAMA) and locally adopted Land Use Plan and Ordinances, it is my determination
that no permit may be granted for the project you have proposed.
This decision is based on my finding that your requested violates NCGS 113A-120(8) which requires
that all applications be denied which are inconsistent with State guidelines or the local land -use plans. You have
applied for a permit which is inconsistent with State Stormwater Permit N. SW8 940224 Modification issued to
Indigo Plantation on February 17, 1998 by the North Carolina Division of Water Quality. Specifically, your
permit application is requesting development that would exceed the maximum built -upon limit for Lot 69
(4,660 sq. ft.). Your application indicates that the total built -upon area within the Area of Environmental
Concern would be 6,490 sq. ft.
Should you wish to appeal my decision to the Coastal Resources Commission or request a Variance
from that group, please contact me so I can provide you with the proper forms and any other information you
may require. Appeal notices must be received by the Division of Coastal Management in Raleigh within
twenty (20) days of the date of this letter in order to be considered..
