This permit, issued on June 23, 2005, is subject to compliance with the application and site, drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth belo rv. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ❑ A copy inf this permit shall be onsite for regulatory inspection. ❑ No new:, impervious surfaces are authorized under this permit. ❑ All pro osed development and associated construction must be done in accordance with the permittworkplat drawings as submitted. ❑ All co traction must conform to the NC Building Code requirements and all other local, State at I Federal requirements. ❑ The S cture shall comply with the North Carolina Building Code, including the Coastal and Flood I Rain Construction Standards, Chapter 37, Volume 1 or Chapter 41, Volume 7, and the Local ood Damage Prevention Ordinance as required by the National Flood Insurance Progratr. If any provisions of the building code or a flood damage prevention ordinance is inconsi:,tent with any of the following AEC standards, the more restrictive provision shall control. ❑ The stricture must set back 60 feet from the first line of stable natural vegetation. ❑ The structure must be located entirely off of the frontal dune, and if a primary dune is present, behind i he crest of the primary dune. ❑ Dune disturbances will be allowed only to the extent necessary for development and if the dune's jprotective value is not weakened or reduced. Disturbed areas will be immediately stabilized. ❑ Any ctr. nge or changes in the plans for development, construction or land use activities will require ; i reevaluation and modification of this permit. ❑ The per mittee is required to contact the Local Permit Officer shortly before construction is to begin to arrange a setback measurement, which will be effective for 60 days baring a major shoreliruv change. Construction must begin within 60 days of the determination or the measurement is void and must be redone. ❑ No impi:xmeable surface shall be allowed over any functional part of the septic tank system. ❑ All distF a bed dunes will be regraded to approximate original grade. ❑ All disv irbed areas will be re-vegetated/stabilized immediately.. ❑ Any structure shall be located or dismantled when it becomes imminently threatened by change in shoreline configuration. The structure(s) shall be relocated or dismantled within 2 years o the time when it becomes imminently threatened, and in any case, upon its collapse or subs dence. However, if natural shoreline recovery or beach nourishment takes place within years of the time the structure becomes threatened, so that the structure is no longer immine itly threatened, then it need not be relocated or dismantled at that time. This conditi shall not affect the permit holder's right to seek authorization of temporary protectiiye measures allowed under 7H.0308[a][2]. This permit action may appealed by the permittee or other qualified persons within enty (20) days of the Issuing dale. From the date of an appeal, arty' work conducted under this permit must cease until the appeal is resolved. This permit must be on thr project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work cr project modification not covered under this permit, require further iwitten permit approval. All work must cease when this permit expires on December 31, 2008. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan arid all applicable ordinances.
