as authorized by the State of North Carolina, Department of Environment.
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General Statues, "Coastal Area Management"
Issued to Dr. and Mrs. Steve Royal, authorizing the construction of an addition to the south and west of the existing
single family residence with removal of some of existing driveway and addition of new deck in the Ocean Hazard/ORW
shoreline AEC at 82 Beach Road South, as requested in the permittee's application, dated May 24, 2005. This permit,
issued on June14, 2005 is subject to compliance with the application and site drawing (where consistent with the
permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may
subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void.
❑ A copy of this permit shall be onsite for regulatory inspection.
❑ The addition of 86 sq. ft. of new self-supporting detached drip through deck within the 6W
CAMA setback for a total of 374 sq. ft. deck is authorized.
❑ The amount of impervious surface areas shall be limited to no more than 25% of the 575' Area
of Environmental Concern area of the land to be developed; in this case 314 sq. ft. new
impervious for a total of 4,813 sq. ft. impervious surface.
❑ The structure must be located entirely off of the frontal dune, and if a primary dune is present, behind
the crest of the primary dune.
❑ All pilings within the Ocean Hazard Area shall have a tip penetration of at least 5' below mean sea
level, or 16' below average original grade, whichever is least.
❑ An undisturbed buffer zone of at least thirty feet from the mean high water (normal water line) must
be maintained at all times.
❑ No impermeable surfaces shall be allowed over any functional part of the septic tank system.
❑ All proposed development and associated construction must be done in accordance with the permitted
workplat drawings as submitted.
❑ All construction must conform to the NC Building Code requirements and all other local, State and
Federal requirements.
❑ Any changes or changes in the plans for development, construction or land use activities will require a
reevaluation and modification of this permit.
❑ No,frlling or development within the Federally regulated 404 wetlands is authorized.
❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence is or
other protective barrier(s) must be placed and maintained between the disturbed area and any 404
wetlands or coastal wetlands, to keep sediment from entering those areas.
❑ Any structure shall be located or dismantled when it becomes imminently threatened by changes in
shoreline configuration. The structure(s) shall be relocated or dismantled within 2 years of the time
when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if
a natural shoreline recovery or beach nourishment takes place within 2 years of the time the structure
becomes threatened, so that the structure is no longer imminently threatened, then it need not be
relocated or dismantled at that time. This condition shall not affect the permit holder's right to
seek authorization of temporary protective measures allowed under 7H.0308[a][2].
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the dale of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 2008.
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

I acknowledge that the land owner is aware that the proposed development is planned for an area which may be susceptible
to erosion and/or flooding, I acknowledge that the local permit officer has explained to me the particular hazard problems
associated with this lot. This explanation was accompanied by recommendations concerning stabilization and floodproofing
techniques.

Preferred oceanfront protection measures are beach
nourishment and relocation of threatened structures.
Hard erosion control structures such as bulkheads,
seawalls, revetments, groins, jetties and breakwaters are
prohibited. Temporary devices, including sand bags, may
be allowed under certain conditions.
This structure shall be relocated or dismantled within two
