DIVISION OF COASTAL MAINIPMMOftEVELOPMENT PERMIT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development In an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management" 05-026 Permit Number �J Issued to Mr. Charles Link, authorizing a residential addition, replace swimming pool and landscaping in the ORW shoreline AEC at 3 Cedar Island, as requested in the permittee's application, dated April 19, 2005. This permit, issued on May 6, 2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terns may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ❑ A copy of this permit shall be onsite for regulatory inspection. ❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence is or other protective barrier(s) must be placed and maintained between the disturbed area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas. ❑ An undisturbed buffer zone of at least thirty feet from the mean high water (normal water line) must be maintained at all times. ❑ All proposed development and associated construction must`be done in accordance with the permitted workplat drawings as submitted. ❑ All construction must conform to the NC Building Code requirements and all other local, State and Federal requirements. ❑ Any changes or changes in the plans for development, construction or land use activities will require a reevaluation and modification of this permit. ❑ The amount of impervious surface areas shall be limited to no more than 25% of the 575' Area of Environmental Concern area of the land to be developed; in this case 13,325 sq. ft in impervious coverage. ❑ No filling or development within the Federally regulated 404 wetlands is authorized. ❑ No impermeable surface shall be allowed over any functional part of the septic tank system. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease unfit the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2008. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances.
