as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
in an area of environment concern pursuant to Section 113A-118 of the
General statues, "Coastal Area Management'
Issued to Mr. Stephen White, authorizing construction of an in ground swimming pool with cement and wooden decking
and the expansion of the fourth floor for a master bedroom and media room in the Estuarine shoreline AEC at 227
Gazebo Court, as requested in the permittee's application, dated February 22, 2005. This permit, issued on March 14,
2005, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void.
❑ A copy of this permit shall be onsite for regulatory inspection.
❑ Only an additional 130 square feet of drip through elevated wooden decking allowed in
the 30 foot buffer area.
❑ An undisturbed buffer zone of at least thirty feet from the mean high water (normal water line)
must be maintained at all times.
❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt
fence is or other protective barrier(s) must be placed and maintained between the disturbed area
and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas.
❑ All proposed development and associated construction must be done in accordance with the
permitted workplat drawings as submitted.
❑ All construction must conform to the NC Building Code requirements and all other local, State
and Federal requirements.
❑ A building permit is required.
❑ Any changes or changes in the plans for development, construction or land use activities will
require a reevaluation and modification of this permit.
❑ The amount of impervious surface areas shall be limited to no more than 30% of the 75' Area
of Environmental Concern; in this case 500 sq. ft. total impervious.
❑ No filling or development within the Federally regulated 404 wetlands is authorized.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the dale of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 2008.
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.

Dear Mr. & Mrs. Bailey:
The following will respond to your letter of objection to the above referenced permit application.
In your letter, you objected to this project for various reasons, including the addition exceeding the height
restriction of 35 feet, and the pool encroaching into the 30-foot buffer from normal high water.
Section 23-4 of the New Hanover County Zoning Ordinance defines building height as follows:
"The vertical distance measured from the average elevation of the proposed finished
grade at the front of the structure to the mean level of the slope of the main roof."
Mr. White's architect has provided this office with calculations showing that the proposed addition's mean
height will be at 29 feet, which is consistent with New Hanover County regulations for building height.
The county has no restrictions on the placement of an accessory structure, which includes pools, as long as
they meet the required setbacks. In this case, the pool is less than 600 square feet and needs to be setback 5
feet from the property line. Mr. White's plans show the pool placement to be 30 foot landward of the
normal high water level as required by CAMA regulations [15A NCAC 07H.0209(d)(10)].
Exceptions to CAMA buffer regulations [15A NCAC 07H.0209(d)(10)(F)] allows for Decks/Observation
Decks limited to slatted, wooden, elevated and unroofed decks that shall not singularly or collectively
exceed 200 square feet. Mr. White's plan include the construction of 130 square feet of new decking in the
30 foot buffer, which when added to the existing 70 square feet will not exceed the 200 square feet
maximum allowed by the regulations. This new decking will not encroach into the 20-foot
drainage/maintenance easement of the subdivision.
CAMA officials are restricted to a specific list of criteria on which permits must be granted or denied. I
have enclosed a copy of these criteria. I have concluded that the proposed development is consistent with
all requirements of G.S. I 13A-1 20(a), enclosed and that the permit must therefore be issued over your
objection [G.S.113A-120(b)].

You may appeal the issuance of this permit by requesting a certificate of appropriateness for a contested
case hearing. DCM Form 5, the prescribed form for such an appeal, is enclosed. A copy of CAMA Minor
Permit #05-008 is also enclosed. Note that any appeal must be received by the Division of Coastal
Management within twenty days of today's date.

Dear Mr. Buflkin:
The following will respond to your letter of objection to the above referenced permit application.
In your letter, you objected to this project for various reasons, including the addition exceeding the height
restriction of 35 feet, and the pool encroaching into the 30-foot buffer from normal high water.
Section 23-4 of the New Hanover County Zoning Ordinance defines building height as follows:
"The vertical distance measured from the average elevation of the proposed finished
grade at the front of the structure to the mean level of the slope of the main roof."
Mr. White's architect has provided this office with calculations showing that the proposed addition's mean
height will be at 29 feet, which is consistent with New Hanover County regulations for building height.
The county has no restrictions on the placement of an accessory structure, which includes pools, as long as
they meet the required setbacks. In this case, the pool is less than 600 square feet and needs to be setback 5
feet from the property line. Mr. White's plans show the pool placement to be 30 foot landward of the
normal high water level as required by CAMA regulations [15A NCAC 07H.0209(d)(10)].
Exceptions to CAMA buffer regulations [15A NCAC 07H.0209(d)(10)(F)] allows for Decks/Observation
Decks limited to slatted, wooden, elevated and unroofed decks that shall not singularly or collectively
exceed 200 square feet. Mr. White's plan include the construction of 130 square feet of new decking in the
30 foot buffer, which when added to the existing 70 square feet will not exceed the 200 square feet
maximum allowed by the regulations. This new decking will not encroach into the 20-foot
drainage/maintenance easement of the subdivision.
CAMA officials are restricted to a specific list of criteria on which permits must be granted or denied. I
have enclosed a copy of these criteria. I have concluded that the proposed development is consistent with
all requirements of G.S.113A-120(a), enclosed and that the permit must therefore be issued over your
objection [G.S.I13A-120(b)].

You may appeal the issuance of this permit by requesting a certificate of appropriateness for a contested
case hearing. DCM Form 5, the prescribed form for such an appeal, is enclosed. A copy of CAMA Minor
Permit #05-008 is also enclosed. Please note that any appeal must be received by the Division of Coastal
Management within twenty days of today's date.
