Emmart Jr., authorizing the removal of an existing house from lot onto a barge and remove the foundation in the CIRW shoreline AEC at 99 Aqua Vista Drive, as requested in the permittee's application, dated January 31, 2005. This permit, issued on February 22, 2005 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terns may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ❑ A copy of this permit shall be onsite for regulatory inspection. ❑ An adequate ramp must span coastal wetlands for loading house onto the barge. ❑ No disturbance of coastal wetland vegetation. If any disturbance does occur during transport, it must immediately be stabilized. ❑ Disposal of foundation materials must be in an approved disposal site. ❑ House to be off-loaded at Atlantic Diving and Marine Contractors, Inc. dock at 3330 River Road, Wilmington, NC. ❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence is or other protective barrier(s) must be placed and maintained between the disturbed area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas. ❑ All proposed development and associated construction must be done in accordance with the permitted workplat drawings as submitted. ❑ All construction must conform to the NC Building Code requirements and all other local, State and Federal requirements. ❑ Any changes or changes in the plans for development, construction or land use activities will require a reevaluation and modification of this permit. ❑ No filling or development within the Federally regulated 404 wetlands is authorized. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease unfit the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2008. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances.
