This permit, issued on Febuary 4, 2005 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ❑ A copy of this permit shall be onsite for regulatory inspection. ❑ All proposed development and associated construction must be done in accordance with the permitted workplat drawings as submitted. ❑ All construction must conform to the NC Building Code requirements and all other local, State and Federal requirements. ❑ Any changes or changes in the plans for development, construction or land use activities will require a reevaluation and modification of this permit. ❑ The amount of impervious surface areas shall be limited to no more than 25% of the 575' Area of Environmental Concern area of the land to be developed; in this case there is no increase of impervious coverage. ❑ No filling or development within the Federally regulated 404 wetlands is authorized. ❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence is or other protective barrier(s) must be placed and maintained between the disturbed area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing dale. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2008. In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. The work amounts to adding two plant beds on different parts of the property. I assume, because of the proximity to the marsh, that a permit is necessary. The only vegetation that will be removed is some lawn grass. We want to add a small amount of soil to create raised beds at both locations. Please note that the only riparian landowner is the Figure Eight Island Utility Company whose signed approval letter is attached. Thank you.
