HomeMy WebLinkAboutNH_04-016_EmmartNew Hanover County Is" MODIFICATION 04-016-Mod Local Government Permit Number IEOK"� CAMQ MAR 09 2005 MINOR DEVELOPMENT DIVISION OF PERMIT COASTAL MANAGEMENT as authorized by the State of North Carolina, Department of Environment, and Natural Resources and the Coastal Resources Commission for development in an area of environment concern pursuant to Section 113A-118 of the General Statues, "Coastal Area Management' Issued to Mr. Maurice S. Emmart Jr., authorizing the construction of a new single family residence, retaining wall, and the placement of fill material, in the ORW shoreline AEC at 99 Aqua Vista Drive, as requested in the permittee's application, dated February 27, 2004. This permit, issued on February 22, 2005 is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. ❑ This modification per site plan revised February 8, 2005. ❑ A copy of this permit shall be onsite for regulatory inspection. ❑ An undisturbed buffer zone of at least thirty feet from the mean high water (normal water line) must be maintained at all times. ❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt fence is or other protective barrier(s) must be placed and maintained between the disturbed area and any 404 wetlands or coastal wetlands, to keep sediment from entering those areas. ❑ All proposed development and associated construction must be done in accordance with the permitted workplat drawings as submitted. ❑ All construction must conform to the NC Building Code requirements and all other local, State and Federal requirements. ❑ Any changes or changes in the plans for development, construction or land use activities will require a reevaluation and modification of this permit. ❑ The amount of impervious surface areas shall be limited to no more than 25% of the 575' Area of Environmental Concern area of the land to be developed; in this case 5,838 sq. ft. of impervious coverage. ❑ No filling or development within the Federally regulated 404 wetlands is authorized. This permit action may be appealed by the pernittee or other qualified persons within twenty (20) days of the issuing date. From the date of an appeal, any work conducted under this permit must cease until the appeal is resolved. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on December 31, 2007. In issuing this permit it is agreed that this project Is consistent with the 1=1 Land Use Plan and all applicable ordinances. This permit may not be transferred to another party without the written approval of the Division of Coastal Management. F— Linda E.
