Issued to Mr. and Mrs. Richard Grant, authorizing the construction of a retaining wall, swimming pool, new driveway,
landscaping, demolition of existing garage and addition of new garage in the ORW shoreline AEC at 8224 Bald Eagle
Lane, as requested in the permittee's application, dated July 5, 2004. This permit, issued on August 5, 2004 is subject
to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and
special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment
or civil action, or may cause the permit to be null and void.
❑ This modification per site plan revised February 24, 2005.
❑ NO encroachment into "404" wetlands allowed.
❑ A copy of this permit shall be onsite for regulatory inspection.
❑ An undisturbed buffer zone of at least thirty feet from the mean high water (normal water
line) must be maintained at all times.
❑ All proposed development and associated construction must be done in accordance with the
permitted workplat drawings as submitted.
❑ All construction must conform to the NC Building Code requirements and all other local,
State and Federal requirements.
❑ Any changes or changes in the plans for development, construction or land use activities will
require a reevaluation and modification of this permit.
❑ The amount of impervious surface areas shall be limited to no more than 25% of the 575'
Area of Environmental Concern area of the land to be developed; in this case 8 9.02 sq. ft. of
impervious coverage.
❑ No filling or development within the Federally regulated 404 wetlands is authorized.
❑ No sediment or building materials can be allowed to enter the marsh grasses or waters. Silt
fence is or other protective barrier(s) must be placed and maintained between the disturbed
area and any 404 wetlands or coastal wetlands, to keep sediment from ente#g those areas.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date. From
the date of an appeal, any work conducted under this permit must
cease until the appeal is resolved.
This permit must be on the project site and accessible to the permit
officer when the project is inspected for compliance.
Any maintenance work or project modification not covered under
this permit, require further written permit approval.
All work must cease when this permit expires on
December 31, 2007.
In issuing this permit it is agreed that this project is consistent with
the local Land Use Plan and all applicable ordinances.
This permit may not be transferred to another party without the
written approval of the Division of Coastal Management.
