Dear Mr. Baker:
After reviewing your application in conjunction with the development standards required by the Coastal
Area Management Act (CAMA) and our locally adopted Land Use Plan and Ordinances, it is my
determination that no permit may be granted for the project you have proposed.
The decision is based on my findings that your request violates NCGS I I3A-120(8) which requires that all
applications be denied which are inconsistent with CAMA guidelines. You have applied to erect a canopy.
over an existing wait area, which is inconsistent with 15A NCAC 711.0209 (d) 10, which states that:
Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall
be located a distance of 30 feet landward of the normal water level or normal high water level.
Should you wish to appeal my decision to the Coastal Resource Commission or request a variance from
that group, please contact me so I can provide you with the proper forms and any other information you
may require. The Division of Coastal Management in Raleigh must receive appeal notices within twenty
(20) days of the date of this letter in order to be considered.

Please run the following NOTICE(s) in a one -column advertisement under "Legal Notice"
PLEASE PUBLISH on Thursday, September 30, 2004.
I will need the usual affidavit of publication.
Pursuant to NCGS 113A-119(B), New Hanover County, a locality authorized to issue CAMA
permits in Areas of Environmental Concern, hereby gives NOTICE that on September 28, 2004,
Mr. Johnnie C. Baker, has applied for a Minor CAMA Permit to erect a canopy over an
existing wait area at 1414 Airlie Road, in Wilmington, NC. (04-053)
Mr. John M. Young, has applied for a Minor CAMA Permit to install a sink, toilet, washer,
lift station, a well, a well house and HVAC platform at 6700 River Road, in Wilmington, NC.

The applications may be inspected at the address below. Public comments received by October 10,
2004, will be considered. Later comments will be accepted and considered up to the time of the
permit decision. Project modifications may occur based on further review and comments. Notice of
the permit decision in this matter will be provided upon written request.
