RE: DENIAL OF CAMA MINOR DEVELOPMENT PERMIT
APPLICATION NO.03-12 for Margaret Bradley-Doppes
Dear Mr. Doppes:
After reviewing your application in conjunction with the development standards required
by the Coastal Area Management Act (CAMA) and our locally adopted Land Use Plan
and Ordinances, it is my determination that no permit may be granted for the project you
have proposed.
This decision is based on my finding that your request violates NCGS 113A-120(8)
which requires that all applications be denied which are inconsistent with CAMA
guidelines. You have applied to cover an existing 20' x 36' deck with a roof three feet
(3) from the normal water level which is inconsistent with 15 NCAC 7H.0209(d)(10)(F)
which states that:
Within the Coastal Shorelines category (estuarine and public trust shoreline
AECs), new development shall be located a distance of 30 feet landward of the
normal water level or normal high water level, with the exception of the
following:
(F) Decks/Observation Decks limited to slatted, wooden, elevated and
Unroofed decks that shall not be singularly or collectively exceed
200 square feet.
I have concluded that your request violates NCGS 113A-120(8) which requires that all
applications be denied which are inconsistent with our Local Land Use Plan. On Page
8-5 of the Land Use Plan, you will find that Policy 8.1.2(d) states that "Because
development within the estuarine shoreline AEC can harm the marshlands and estuarine
waters, and because of the inherent dynamic and hazardous nature of coastal shorelines,
specific restrictions, limitations and standards have been adopted by the State for
construction in these areas, as outlined in 15A NCAC 7H at .0209." It firther states that
a CAMA permit must be obtained for compliance with these standards. Your project
calls for an existing 20' x '36 Deck three feet (3') from normal water level to be covered.

erosion and/or flooding. I acknowledge that the local permit officer has explained to me the particular hazard problems associ-
