This permit, issued on November 1, 2017 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation wifli appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -3.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
Maintenance Clause
The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Spoil Disposal
In order to ensure proper containment of the spoil material, and to prevent unnecessary contamination of
private property and state -maintained roadways during transport of the spoil material, the permittee shall
establish a "wash down" facility for all vehicles used to transport the spoil material to the disposal site.
The transport vehicles shall be "washed down" of all excess material prior to leaving the site.
The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2016-01671).
The N.C. Division of Water Resources assigned the project DWR Project No. 1998-1082 V2.
The permittee is advised that many land disturbing activities are not authorized within 50 feet of
the normal water level unless specifically exempted by Environmental Management
.Commission's (EMC) Neuse River buffer regulations in place at the time of such development.
An application processing fee of $400 was received by DCM for this project.

Project Narrative — Dredging Maintenance/Lewis Branch
The earliest CAMA General Dredging and Fill Permit is dated July 14,1997, Permit # 018721-C.
Subsequent permits have been issued as follows:

Based on the Dredging General Permit history over the past 20 years, and in order to maintain maximum
year round use of the associated property, boat basin, tie ups and lift, the canal needs to be dredged
and maintained at least once a year. With the current general permit, the window for permitting and
excavation is narrow. As a result, most years this narrow window limits full year round use of the water
way. It is believed that a major permit, which allows for a continuous, five (5) year maintenance
program, would greatly improve the year-round access to the waterway and its contiguous properties.
As well, the major permit would allow more efficient and effective scheduling of digging equipment.
Projects may be scheduled to coincide, providing cost and time savings as well as unnecessary
duplication of paperwork.
The dredging or dig -out would be done by track hoe excavator. As the spoil is removed from the Lewis
Branch, it will be loaded on trucks and moved to the disposal area, eliminating the need for a holding
area on the adjacent property. (There is a working agreement with the Minnesott Golf and Country Club
to take the spoils from the adjacent property at 757 Country Club Drive, Minnesott Beach and deposit it
at their maintenance site located at 186 Country Club Drive, Minnesott Beach).
The location of the spoil site is 34058'20"N, 76049'06"W, elevation 20'. Size is 134' X 64' or 8,576.89
sq.ft. Please see the attached spoil acceptance statement and spoil site location print outs.
Additionally, please note that the applied for dig out depth of 3.5' is the same as the Neuse River and
Lewis Branch channel connecting the Point Area as shown on the attached Dennis Fornes drawing
updated June 20, 2017.

near Minnesott Beach, in Pamlico. County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make December 25, 2017 the new deadline for reaching a decision on your
request. However, we expect to take action prior to that time and will do so as soon as possible.

Narrative Description:
The property is located adjacent to Lewis Branch off of Country Club Drive at 76 Beach Drive in
Minnesott Beach, Pamlico County. This property is currently developed with a single family
residence, dock, and shoreline stabilization. The adjacent riparian properties are similarly developed.
There are no Coastal Wetlands within the project area. Water depths within the project area range
from —0.5' to 11' normal water level (NWL). The subaqueous substrate is firm without shell. This
area of Lewis Branch has bulkheads on both shorelines and rock groins at the mouth.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 35' across at this location. These coastal waters are not classified as a Primary Nursery
Area. Submerged aquatic vegetation is not present at this location. This area is closed to shellfish
harvest and is classified as SB; Sw, NSW. There is not a defined Federal Channel in the nearby
vicinity of this project area. This project area is subject to the Neuse River Riparian Buffer Rules.
Proposed Development:
The applicant proposes to excavate within Lewis Branch, in Minnesott Beach. The proposed
development would take place adjacent to 76 Beach Drive and 757 Country Club Drive, Pamlico
County. This is a maintenance excavation proposal. The mouth of Lewis Branch experiences
constant shoaling. There is an extensive permit history of excavation within this tributary. Over the
last twenty years, this has been accomplished via CAMA General Permits at an annual or biannual
frequency. The applicant is seeking to maintain previously authorized water depths under a CAMA
Major Permit.
The proposed maintenance excavation is to connect to the -3.5' NWL depth contour at the mouth of
Lewis Branch. The excavation would result in the removal of approximately 250 cubic yards of sand,
as needed. The high ground spoil disposal location is on the adjacent Minnesott Golf and Country
Club property.
Anticipated Impacts:
The proposed excavation would impact 6,725 square feet of shallow bottom. The spoil would
impact 8,576 square feet of high ground. Traditional bucket to truck methodology will be utilized
during excavation. Temporary turbidity impacts are anticipated during excavation activities in Lewis
Branch.
There is not a cultural resource in the nearby vicinity of the project area. This project area is
subject to the Neuse River Riparian Buffer Rules. These waters of Lewis Branch are not
classified as a Primary Nursery Area and the presence of submerged aquatic vegetation was not
observed. This area is closed to shellfish harvest and is classified as SB; Sw, NSW. There is not
a defined Federal Channel near the project area.

Your application package proposing to dredge Lewis Branch is thorough and well prepared. However, there are some
items that you need to address before the DCM can accept the application package as complete and begin
processing. They are as follows:
1. Project Narrative: please submit a narrative discussing (in detail) the permit history of excavation there, the
purpose and need, the specific methodology of how the work is to be performed, the exact location of the spoil
disposal area, and the proposed to existing connecting water depths;
2. DCM MP-1, 5d: please revise your answer to state maintenance excavation;
3. DCM MP-1, 5f: please calculate the fill of the high ground disposal area of spoil material;
4. DCM MP-2, 5b: please elaborate on whether or not this activity is to be accomplished via bucket to barge, or
bucket to truck;
5. Work Plan Drawings: please update the details of these drawings to reflect current conditions (as these
drawings are dated over 2 years ago), and please note that the terminus of the proposed excavation does not
appear to meet the existing connecting water depths in the Neuse River (which is in conflict with the
rules). Once you have evaluated the current water depths, you can make adjustments to the proposal to
address this issue.

The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal excavates 6,725 square feet of shallow bottom and fills 8,576 square feet of high ground. These
waters of Lewis Branch are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This
proposal is subject to the Neuse River Basin Riparian Buffer Rules. Assuming that state and federal agencies
concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following
conditions:
1) Excavation will not exceed -3.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters;
2) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized;
3) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work;
4) The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside of the area of construction or construction -related discharge. Increases such that the turbidity
in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant;

5) Appropriate sedimentation and erosion control devices, measures or structures must be implemented
to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt
fence, diversion swales or berms, sand fence, etc.);
6) Any development or land disturbing activity that is considered non -water dependent is not authorized
within 50 feet of the normal water level unless specifically exempted by Environmental Management
Commission (EMC) Neuse River buffer regulations in place at the time of such development.

Consistency Determination: The request is consistent with/not in conflict the Pamlico County
Joint CAMA Land Use Plan certified by the CRC on January 28, 2005.
Overview: The applicant is proposing to perform maintenance excavation on Lewis Branch adjacent to
76 Beach Drive and 757 County Club Drive, Pamlico County. Existing onsite development of a single-
family residence, dock, and shoreline stabilization.
Areas of Environmental Concern affected include: Estuarine Waters (EW) and Public Trust Areas (PTA).
Lewis Branch is approximately 35' across at this location. The waterbody is classified as SB; Sw, NSW.
The site is not classified as a Primary Nursery Area, and is closed to shellfishing. Submerged Aquatic
vegetation (SAV) is not present at this location. There is not a defined Federal Channel in the nearby
vicinity of the project area. The project is subject to the Neuse River Riparian Buffer Rules.
Anticipated impacts resulting from this project are expected to include: excavation of 6,725 sq. f.t of
shallow bottom. The spoil would impact 8,576 sq. ft. of high ground. Traditional bucket to truck
methodology would be used during excavation. Temporary turbidity impacts are anticipated during
excavation.
Basis for Determination:
The project is subject to the Pamlico County Joint CAMA Land Use Plan. The Future Land Use Map
(FLUM) classifies the site as "Rural with Services" and "Community Centers" I.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant is
proposing maintenance dredging in Lewis Branch canal, adjacent to the Neuse River near Minnesott
Beach. The area is experiencing ongoing shoaling and has been previously maintained through CAMA
general permits. The project will have a final depth of -3.5 NLW removing approximately 250 cubic
yards of primarily sandy material using bucket to truck methods.
Although the area is not designated as a PNA the shallow bodies of water along the Neuse river do
provide habitat for larval and juvenile finfish and shellfish during the summer months. In order to protect
these fisheries resources daring the period of peak productivity and highest biological diversity a
moratorium on dredging activities from April 1 to September 30 is recommended.

Reference the application of Mr. Bob McDonald to perform maintenance excavation of
approximately 6,725 square feet of accumulated sediments within Lewis Branch, adjacent to the
Neuse River, at 76 Beach Road, in Minnesott Beach, Pamlico County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

3) No signs of any kind shall be permitted, except
a "House For Sale" sign not to exceed 2' x 2- in
size.
4) No animals, livestock, or poultry of any kind
shall be raised, bred or kept on the lot.
5) Grantee agrees to maintain a "buffer -zone"
of trees along the northern fifty feet of 'the
lot. Trees may be removed for purposes of
providing access, installation or maintenance of
a septic drainfield or when a tree is creating a
safety hazard.
6) Enforcement of these restrictions and con-

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that application for a development permit in an Area of Environmental Concern as designated
under the CAMA was received on July 28, 2017. According to said application, Mr. Robert McDonald
proposes to excavate a portion of Lewis Branch, adjacent to 757 Country Club Drive, Pamlico County. A
copy of the entire application may be examined or copied at the office of Brad Connell, NC Division of
Coastal Management, located at 400 Commerce Avenue, Morehead City, NC, (252) 808-2808 during
normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, N.C. 28557, prior to September 5, 2017, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

This permit, issued on November 1, 2017 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
ri mese terms may oe suoject to noes, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -3.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the. area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the pennittee's signature shown anew on the original plan.

The permittee is advised that many land disturbing activities are not authorized within 50 feet of
the normal water level unless specifically exempted by Environmental Management
Commission's (EMC) Neuse River buffer regulations in place at the time of such development.
An application processing fee of $400 was received by DCM for this project.
