This permit, issued on June 1.2022, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and noles set forth below. Any violation of these lerms may subfect permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: Construction of a retaining wall above the normal high water line. (1)All proposed developmenl and associated conslruction must be done in accodance with the permited work plat drawings(s) daled received DCM MHD City May 16, 2022. All construction must conform to the N.C. Building Code requiremenb ard allother local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations, Any change or changes in the plans br development, conslruclion, or land use activities will require a re-evaluation and modilication of this permit. (6) Tte amount of imperuious sur{ace shall not exceed 30% of fle lot area within 75 feet 0f normal high water level (Estuarine Shoreline Area of Environmental Concem). (7) All_development shall provide lor a buffer zone along the margin of the Estuarine Water which is sufficient to conline visible siltation within 25 perceilt of the buffer zone nearest the land disturbing development. (8) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land-disturbing activities, a banier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as lhe area has beenproperly stabilized with a vegetalive cover. (9) Any proposed for grading within the 30' buJfer lrom the normal high water level must be contoured to prevent additional stormwater runoff to the adiacent ma6h. This area shall be immediately vegetatively stabilized, and must remain in a vegelated state. (10)All graded and filled slopes shall be of a suflicient angle to retain a vegetative cover or other eosion contml device or structure. (11) This pemit does nol aulhonze development within any wetlands or open water arcas. (12)Priortoany development, the permittee is required to contact the DCM Field Representative at 252-5,15-5400, to mark the landward edge of ttre 30 ft. buffer. (13) Prior to any land'disturbing activities, a banier line of lilter cloth must be installed between the tand disturbing ac1vity and the adiacent maBh or water areas, until such lime as lhe area has been properly stabilized with a vegetative cover. (14) All other distuded areas shall be vegetatively stabilized (planted and mulched) wilhin 14 days ot construction completion ('15) Pursuant to 'l5A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transtened, sold, or otheMise disposed of to a third-party. (16) The Permittee and/or the Permittee's Authorized Agent shall be responsible for obtaining any and all necessary authorizations, approvals, or zoning and buildlng permits from the local government haiing jurisdiction (Town of Emerald lsle and/or Cafteret County) prior lo commencing work.
