DAMS Maw A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The Town of Manteo proposes to perform a maintenance dredge on the Dough's Creek Canal. The dimension of the proposed excavation are 3,7501inear feet by 50 feet to a depth of -9 feet at NWL. The material will be dredged and placed on a barge and then will be hauled to an upland disposal site. New SAV surveys and EFH assessments has been completed for the project and it should result in minimal negative impacts to fisheries resources in the area. However, to further reduce the potential for negative impacts from the dredging event an in -water work moratorium from April I — September 30 is recommended. Limiting the dredging to the winter month will reduce the direct impacts of turbidity to larval and juvenile fish that would be more likely to occur during the summer months. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located within Shallowbag Bay and Doughs Creek near Manteo, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended, 16 U.S.C. 661 et seq.). The applicant proposes to maintenance dredge the 3,750' by 50' Doughs Creek access channel to -5' NWL, the Town's boat basin to -9' NWL, and a man-made boat basin to access the spoil site. Excavation would be done mechanically, placed in water tight containers, barged to the transfer site (Khmkiewicz Property), and trucked to the Public Works facility. This area of Doughs Creek near Festival Park is classified SC HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries. The NCWRC has reviewed the permit application and does not object to the maintenance dredging as originally allowed in CAMA Major Permit 83-82. To protect important aquatic resources, we request all previous permit conditions, including the April 1 — September 30 moratorium, be incorporated. Project Setting The project is located within Shallow Bag Bay off Roanoke Sound in Manteo. Doughs Creek access channel is located between Festival Park, a 25-acre interactive and interpretative historic site to the south and coastal marsh lands to the north. The project will also include a boat basin at the mouth of Doughs Creek that includes a boat ramp, paved parking and docking facilities with a residential lot to the North and Ananias Dare Street to the south. The projects second basin farther to the south, at the proposed transfer site, has bulkheading on the Northside and marshlands to the south. Vegetation noted on the site includes, but is not limited to, Bullrush (Scirpus spp.), Cattails (Typha spp.), Black Needlerush (Juncus roemenanus) and indigenous yard grass along the shoreline. Submerged aquatic vegetation located on site includes, but is not limited to, Widgeon Grass (Ruppia maritima). Soil types on the surrounding lands include, but are not limited to, Psamments (PsB), Johns Loam Sand (JoA), and Hobonny Muck (HoA). Also, the water classification for the site is Aquatic Life, Secondary Recreational, Salt Water (SC) and High Quality Watrs (HQW). The existing channel has an elevation of approximately -6.00 feet. Development Proposal The applicant proposes to dredge a 3,750-foot channel that is 50 foot in width and approximately -3.0 feet deep in the center of Doughs Creek access Channel. The applicant also, proposes to dredge the Town of Manteo boat basin that is 250-foot-long by 180-foot wide to about -9.0 feet deep. The spoil is proposed to be off loaded into sealed containers at the Klimkiewicz property located at 501 South Highway 64/264 in Manteo where they propose to dredge a 278 foot by 43-foot channel that is -5.0-foot-deep to get the barge in and out. The spoil will then be transported to the Manteo Public Works facility on Bowerstown Road in Manteo. The applicant also proposes to replace several navigation markers that have been damaged. Anticipated Impacts The proposed development will result in temporary turbidity in the dredge areas within the Public Trust Area and Estuarine Waters Areas of Environmental Concern. RECEIVED JUN 0 5 2017 Submitted by: Cynthia Rountree DCM- MHD CITY Date: May 31, 2017 MA"', _ t, 1p7/ Protect Narrative Introduction The Town of Manteo proposes to perform maintenance dredging of 3,750 linear feet by 50 feet wide channel known as the Doughs Creek Canal (Relevant Portion of USGS Topographic Quadrangle-Manteo attached). The canal was created in the early 1980's to provide access to Roanoke Sound and Shallowbag Bay for larger boats that were cut off from traditional access when the State of North Carolina, Division of Cultural Resources (and NC DOT) constructed the bridge that connects Festival Park and Downtown Manteo. In addition, several navigation markers have been destroyed that marked the channel and will need to be replaced as part of the project. The Town will work directly with the US Coast Guard at the conclusion of the project to properly mark the channel. Proposed Project The proposed project is the maintenance dredge of a 3,750 linear feet by 50 feet "box cut" access channel (Doughs Creek Canal), maintenance dredge of a 35,699 square feet boat basin and maintenance dredge of the man-made boat basin leading into the transfer Site (Klimkiewicz Property). The estimated cumulative volume of the project is 16,000 cubic yards. All materials will be dredged mechanically using excavators and barges. Water tight containers and dump trucks will be used to transport dredge spoils to the transfer Site (Klimkiewicz Property) and ultimately to the disposal Site at the Public Works facility. Purpose and Need Dough's Creek Canal currently has depths of -4.5 to -5.0 NWL (with some shallower depths that are dangerous during low wind tide events) in sections of the channel that are creating navigation issues for larger commercial vessels that use the access. In addition, the channel is very narrow in several sections and is not marked at all after exiting the "land cut' along the north side of Ice Plant Island. The Town proposes to dredge Areas #1 and #2 as shown on the attached Figure 1-CAMA Major Site Plan to provide safe and historic water access to Shallowbag Bay for commercial fishermen and working watermen. Previous Permitting The original dredge work was performed under CAMA Major Permit 83-82 and subsequent modifications (Attachment 1) with a project depth of -9.0 feet at Mean Low Water (MLW). The channel was created to provide access to Shallowbag Bay for commercial fishermen that are unable to pass under the bridge that was built to access Roanoke Island Festival Park. The State of North Carolina, per the Mutual Development and Use Agreement for Ice Plant Island, Manteo, North Carolina is responsible for maintaining the channel "...and maintained Providing adequate access to the inner harbor:..." A copy of the relevant page from the Mutual Development and Use Agreement (DB 351 PG 891) along with other Town and State correspondence has been included as Attachment 2. Water Depth Surveys A comprehensive water depth survey was conducted in 2015 and subsequent site visits have been performed to verify that the water depths are generally consistent with the 2015 survey. Normal Water Level (NWL) was established by gaining vertical and horizontal corms yi PSE D technology on land and observing tide gauges in the area as well as biological m stains on pilings, barnacle positions, marsh edge elevations etc...) present at the boat ramp and along the Ice Plant Island shoreline. NWL was measured at an elevation of 0.47 NA=8#.5,%17 DCM- MHD CITY of the survey data collected is relative to real-time elevations based on NAVD 88 and horizontal positions gathered via the SonarMite Echosounder and GPS technology. SAV Review and Water Quality Classification Doughs Creek channel is listed as a Permanent Secondary Nursery Area with Doughs Creek carrying a Primary Nursery Area classification and outer Shallowbag Bay is listed as Special Secondary Nursery Area (Attachment 3). Shallowbag Bay is classified as SC Waters, in part due to the Town of Manteo Wastewater Treatment Plant outfall discharging in the bay. Several Submerged Aquatic Vegetation (SAV) surveys have been conducted in the proposed project area over the last three years. The latest SAV review was conducted on May 3, 2017. In each of the SAV Survey events, trained Environmental Scientists dove within the channel and along the sides of the channel throughout the project area to visually inspect for the presence or absence of rooted SAV and also inspect the substrate for any evidence of roots or rhizomes. SAV is observed sporadically along the fringes of the channel in depths no greater than -3.5 (NWL) and predominantly along the eastern shore of Ice Plant Island. No SAV has been observed within the actual channel or any of the areas proposed for maintenance dredging over the last three years. Ruppia maritima (Widgeon Grass or Ditch Grass) was the only species identified in shallow waters adjacent to the project area over the last three years. SAV surveys have been conducted in April, June and August over the years and there is no indication that there is an SAV resource within the proposed project area. EFH Assessment An Essential Fish Habitat Assessment performed by Quible on behalf of the Division of Water Resources in 2004 (for all of Shallowbag Bay) has been forwarded to NOAA NMFS as part of this permit process. NOAA NMFS is not requiring an updated EFH as part of this permit application provided the project remains maintenance of existing channels and basins. Copies of the 2004 EFH Assessment are provided as Attachment 3. Disposal Area and Selected Methodolosry Dredging will be mechanical and performed using barges and excavators. Excavated spoils will be loaded onto barges with containers and floated to the Klimkiewicz property (transfer Site) and transferred by excavator from the barge (location identified on Figure 1-CAMA Major Site Plan) onto special dump trucks equipped with seals to eliminate spillage during transportation. Dump trucks will transport the spoils to the Town of Manteo Public Works facility, located at 700 Bowsertown Road. A Spoils Disposal Area will be constructed at the Public Works facility using on site materials and expanded using dredge spoils as necessary and shown on the attached CAMA Major Site Plan. Silt fence and other standard erosion control measures will be utilized as required. An NCDEMLR Sedimentation and Erosion Control permit will be obtained in conjunction with the proposed dredge activities requiring this CAMA Major Permit application. Wetlands No USACE or CAMA jurisdiction wetlands will be impacted as a result of this project. Wetlands delineations and/or analyses have been conducted on the Town of Manteo Public Works property and the Klimkiewicz transfer property. A Preliminary JD (SAW 2016-02224) was issued for the Public Works disposal Site and a copy of this PJD is provided as Attachment 4. E,IVED JUN 0 5 2017 ATTACHMENT RECEIVED JUN 0 5 2017 DCM- MHC CITY Permit Class 2nd Modification STATE OF NORTH CAROLINA Department of Natural Resources and Community Development and Coastal Resources Commission Permit 's 7917 for Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 © Excavation and/or m ing pursuant to NCGS 113.229 to at Permit Number t 83-82 i, Page 1-0 f 2 1 l F" Vert f JUL 15 t88 1 Ocm -Ec I Ice Plant Islam as requested in the permittee'sapp c on ated rev. 2/3/83 including attached mats- sheets 1-9 of 9 with 153-6 dated 3/82 and 267-9 dated 3/83 and canal basin plats, 2, dated rec, 6/ZU/8:J This permit, issued on , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. INTRODUCTION January 2005 This Essential Fish Habitat (EFH) Assessment has been prepared by Quible & Associates, P.C. (Quible) as a component of an Environmental Assessment (EA) required by the North Carolina State Environmental Protection Act (SEPA) for side channel dredge activities proposed in and around Shallowbag Bay and Pirates Cove, Dare County, North Carolina (Figure 1). The EFH assessment was requested by Mr. John Sutherland as partt of an EA currently being prepared for side channel dredging to Ballast Point, Pirates Cove, former Salty Dawg Marina, Manteo Town docks, Elizabeth II and the Shallowbag Bay Club from existing State and Federally maintained channels. Side channel orientation and numbering is shown on the enclosed Figure 2. As defined in the Magnuson -Stevens Fishery Conservation and Management Act (MSFCMA), EFH's are considered "those waters and substrate necessary to fish for spawning, breeding, feeding, or growth to maturity". II. PROJECT The proposed project area is located in and around Shallowbag Bay extending from the mouth of Dough's Creek to the mouth of Scarboro Creek, including outer Shallowbag Bay and Roanoke Sound channel near The Washington Baum Bridge. In general, the project is the maintenance dredging of a total of seven side channels that connect various developments to the Federally and State maintained channels in Shallowbag Bay and Roanoke Sound. The project proposes to remove an average of two to three feet of material from existing side channels. Water depths in the channels vary and will be presented as part of the EA Document. Side Channel 1 is an expansion of an existing channel leading to the Elizabeth II berth. Side Channel 2 is maintenance dredging in and around the public Town Dock in Manteo. The dredge area proposed will deepen the connection to Range I extending to the submerged ramp for the Elizabeth II and includes maintenance dredging of the slips around the dock. Side Channel 3 is an L shaped channel that extends from Range 2 to the former Salty Dawg Marina and south to the Shallowbag Bay Club. Side Channel 4 is an access channel from Range 4 leading to the Ballast Point Subdivision. Side Channels 5-7 are access channels leading into Pirates Cove Subdivision. Side Channel 7 is proposed to lead into the Pirates Cove Marina. All of the proposed side channels with the exception of the channel around the Elizabeth II berth are maintenance dredging of existing channels. Included as Figure 3 is an orthophotograph of the project area and vicinity including a line drawing overlay of the proposed channels. The proposed dredging of the side channels will be conducted using hydraulic dredging techniques. ANALYSIS OF SHELLFISH AND FINNED FISH, VEGETATION AND SUBSTRATE A survey of the occurrence or non-occurrence of submerged aquatic vegetation, including substrate sampling and extensive coring in the proposed channels has been performed based on field data collected by or under the direct supervision of Quible & Associates, P.C. (Quible). Sampling data for finned fish and shellfish occurrence has been provided to Quible by the North Carolina Division of Marine Fisheries (NC-DMF). A. Shellfish and Finned Fish In order to supply an accurate representation of juvenile finned fish species composition in the vicinity of the subject site, NC-DMF was asked to provide sampling data from sample sites nearest to the subject site. NC-DMF provided documentation from sampling events and data summaries for Shallowbag Bay, Dough's Creek and Scarboro Creek. Data provided for juvenile finned fish occurrence was collected from 1983 to the present. Please note, tow times, sampling times and locations vary per station location. In general, sampling for finned fish occurs in the months of May and June. Mr. Clay Caroon with the NC-DMF offices in Morehead City provided data summaries for shellfish occurrence in Shallowbag Bay, Dough's Creek and Scarboro Creek. The shellfish data also includes substrate data and maps summarizing substrate types. Included with this report as Appendix A are copies of the finned fish occurrence data and report provided by NC-DMF marine biologist, Beth Burns. A data summary of shellfish occurrence in Shallowbag Bay provided by NC-DMF has ben included as Appendix B. I. Finned Fish Occurrence Finned fish occurrence data summaries in and around Shallowbag Bay for federally listed species in the Southern and Mid -Atlantic Fishery Management Council (SFMC and MAFMC) is presented in Table 1. Based on the data provided by the NC-DMF, areas of Scarboro and Dough Creek are defined as classic primary nursery areas. In fact, according to Beth Bums, these areas were some of the first to be designated as such in North Carolina. These primary nursery areas provide protection and habitat to juvenile fishes during the early stages of their development. As juvenile fish mature they begin to move out of the creeks into adjacent waters of Shallowbag Bay. This secondary nursery habitat then gives way to special secondary habitats. Included as Figure 4 is a map illustrating the numerous nursery area designations of Shallowbag Bay. Based on data collected between 1983 and 2004 by the NC-DMF, summer flounder (Paralichthys dentatus ) and brown shrimp (Farfantepenaeus aitecus) species rcRorted to occur in Scarboro and Dough Creeks (Primary Nursery Areas-PNAs).titer Shafl©v i my All 05 2017 DCAti- iWHD CITY Shallowbag Bay Dredge Project Manreo, Dare County, NC January 2005 (Permanent Secondary Nursery Area-PSNA), Outer Shallowbag Bay (Special Secondary Nursery Area-SSNA) and the Roanoke Channel in reportable numbers. In addition, several other species listed in the FMC are reported to occur in the PSNAs as noted in the tables in the NC-DMF Report. These species include pink shrimp, white shrimp, bluefish and king mackerel. Additional FMC species reported to occur in the SSNA include the Spanish mackerel, pink shrimp and white shrimp. Species listed in the report tables as "other" are generally species of low occurrence during the times sampled. Please note, sampling generally takes place in May and June with some exceptions noted in the report provided by NC-DMF. During these months the main targeted species are spot, croaker, blue crab, Atlantic menhaden, southern flounder, summer flounder and brown shrimp. However, many other species of interest are netted and reported. According to Beth Bums of the NC-DMF, many juvenile fish species use the nursery areas and outlying areas during different months of the year. However, the NC-DMF typically samples in May and June. In addition, sampling locations are not representative of all habitats found in the various nursery areas. For example, grassy areas (SAV beds or SAV areas) are not sampled. Typically in a healthy nursery, many juvenile species will use grasses as cover during their development. According to the SFMC and MAFMC, EFH requirements for post larval and subadult life stages of pink, white and brown shrimps are listed as marsh edges, SAV beds, tidal creeks, inner marsh and mud bottoms. These ecosystems occur within the project area. Summer flounder and bluefish larvae and juveniles live in estuaries and shelf waters. Adult summer flounder also inhabit estuaries and shelf waters. These ecosystems occur within the project area. Recent data of catches in the outer reaches of Shallowbag Bay were either not available or not presented by the NC-DMF. It is reasonable to assume, however, that maturing species found in the PNAs will move into the SNAs and eventually out into the Roanoke Sound Channel. Historical data provides evidence of this. A species comparison is provided by the NC-DMF in Table 3 (page 4) of the NC-DMF Report. The report provided by Beth Bums, NC-DMF marine biologist, is included in its entirety as Appendix A. 2. Shellfish Occurrence In order to supply an accurate representation of species composition in the vicinity of the subject site, NC-DMF was asked to provide sampling data from sample sites nearest to the subject site. Clay Caroon, with NC-DMF in Morehead City provided shellfish occurrence and surficial substrate classification for Dough's Creek, Scarbom Creek and Shallowbag Bay. According to the data provided by Mr. Caroon, the only shellfish found to occur in the project area are oysters. In addition, the substrate data concurs with the findings of the SAV sampling and vibracore sampling conducted by Quible. Substrate data provided by NC-DMF lists three main substrate types: (D)-subtidal soft non -vegetated without shell; (G)-subtidal firm non -vegetated with shell and (H)-subtidal firm non -vegetated without shell. The Shellfish Strata Data is presented along with the shellfish occurrence data and relevant maps as Appendix B. Please note, no SAVs were reported to occur in the NC-DMF data summary. Based on the maps provided, the majority of Shallowbag Bay, Dough Creek and Scarboro Creek are classified as D and G type substrates 67 rc ) 3 SEC G JUN 0 5 2a11 iTY Shallowbag Bay Dredge Project Manteo, Dare County, NC January 2005 sq. ac.). A relatively small portion of Shallowbag Bay (28.2 sq. ac.) was found to be of G type substrate. None of the federally listed species of shellfish were reported to occur in the data provided. Please note, the data set is relatively old (1995). Oyster shells were identified during SAV field analysis and vibra-coring activities, however, the oyster shells appeared to be fossil shells and not living specimens. B. Submerged Aquatic Vegetation (SAV) Survey On October 20, 2004, environmental scientists from Quible conducted a SAV survey in and around the areas of Shallowbag Bay and the Roanoke Sound where the proposed side channel dredging is proposed. In addition, during vibra-core sampling conducted between October 28 and October 30, 2004, a trained diver/environmental scientist visually inspected 31 locations within the project area for the existence of SAVs. Please note, during the numerous dives conducted during the month of October, murky conditions were noted and visibility in the water column was generally three or four feet, Locations of the substrate sampling, vibra-core sampling along with rake stations is depicted on Figure 3. Photographs taken during the SAV survey are presented in Attachment A. On October 20, 2004, a total of thirteen random sampling locations were chosen within the project area. In addition, three raking stations were chosen in shallow water areas adjacent to the proposed dredging areas. At each sampling location, latitude and longitude coordinates were recorded along with depth to bottom measurements, which were obtained with a PVC measuring rod calibrated in feet. Substrate samples were collected using a petite PONARTM substrate grab sampling device. The volume of the sampling device is approximately 2.5 liters or six inches square. Specifications of the sampling device are included as Appendix C. At each sampling location, the PONARTM was lowered to the bottom. Once in contact with the bottom, the PONARTM "snaps" shut and is subsequently retrieved by line to observe collected sediments. Observations from the 13 sampling locations and three rake stations have been presented in Table 2. The majority of the samples collected consisted of black organic rich muds commonly referred to as gorp. Gorp is a term that refers to organic rich muds with low settling rates and having the consistency of a pudding or mayonnaise. Raking was conducted in shallow areas (less than 6 feet). Raking was not deemed necessary in deeper areas where sunlight does not penetrate to the substrate. No SAVs or evidence of SAVs were noticed or recorded in any of the 13 samples collected or in any of the raked areas. In addition, during the 31 plus shallow water dives performed during the core sampling (October 28-30, 2004) no SAVs were observed to occur. Please note, a majority of the areas proposed for maintenance dredging are an average of five feet below normal water level. Based on field observations and data collected, it is unlikely that any SAV grows in the types of substrates noted (gore) or at the water depths recorded in the proposed side channels. C. Substrate Between October 28'and October 30, a total of 31 vibra-core samples were collected from locations shown on the enclosed Figure 3. The locations were determined based on "RECEIVED JUN 0 5 2017 DCM- MHD CITY Shallowbag Bay Dredge Project Manteo, Dare County, NC January 1005 orientation of the channels proposed for maintenance dredging. Core samples were obtained by vibrating three inch O.D. aluminum piping into the substrate. In general, two to three feet of core sample were collected at each location. Once the piping was advance to the desired depth, or depth of refusal, a vacuum cap was placed on the exposed end of the pipe. The pipe was then removed with an electric wench. A diver capped the bottom of the pipe as it emerged from the substrate. The core samples were subsequently removed from the water, cut to length, logged and stored. Photographs taken during the vibra-coring activities are presented as Attachment B. The cores were transported to Greenville, NC where they were split, described, logged and placed in sieves by a NC Licensed Geologist, Mr. Tames Watson. Two samples were collected (RCRA-1 and RCRA-2) from near the Town Docks using PVC pipe. The sediments collected in the PVC piping were extruded at a later date and submitted to a licensed laboratory for analysis of 8 RCRA metals. Please note, the cores were stored in a refrigerator until the composite samples were extruded, placed in laboratory provided containers and submitted for analysis. The - hold time for 8 RCRA metals analysis in soils is 6 months. The laboratory analytical report and chain of custody is presented as Appendix D. Based on the laboratory analytical data reported for the samples collected from RCRA-1 the concentrations of arsenic (4.96 mg/Kg), barium (25.3 mg/Kg), cadmium (6.32 mg/Kg), chromium (27.9 mg/Kg), lead (53.7 mg/Kg), mercury (0.095 mg/Kg) and silver (2.35 mg/Kg) were reported above the method detection limit. Based on the laboratory analytical data reported for the samples collected from RCRA-2 the concentrations of arsenic (1.20 mg/Kg), barium (25.3 mg/Kg), cadmium (1.22 mg/Kg), chromium (28.5 mg/Kg), lead (46.9mg/Kg), mercury (0.032 mg/Kg) and silver (1.72 mg/Kg) were reported above the method detection limit. A detailed report listing the cores collected, their content descriptions and the results of the sieve analysis is presented in its entirety as Appendix E. Location coordinates given in latitude and longitude (NAD 83) for the sampling locations are presented at the conclusion of the vibra-core report. Visual field analysis and grain size results of the substrate within the proposed project area reveal one dominant surficial sediment type. This sediment type is best characterized as black organic rich mud (gorp). This is the type of material one would expect to find on the surface in channels or depressions in estuarine environments. The small particle size (silt and smaller) is easily transported and accumulates in low lying/low energy areas such as channel bottoms. Due to the extremely low settling rates, silts often remain in suspension for hours, and days in the case of particles less than 4 microns (clay sized). Settling rates are calculated to be .03 ft/hr for clay size particles (< 4 microns) and 3.08 ft/hr for silt sized particles (4-62 microns). These extremely slow settling rates lend to the loose nature of channel deposits. Based on grain size analysis results, immediately underlying the loose surface, there is a considerable amount of sand. Percentages of sand, silt and clay are listed in the attached report. For dredge disposal purposes, the average grain size of side channel dredge material would be nearly 70 percent sand (> 44)), 28 percent silt or clay sized particles (< 4 tb) and 2 percent pebble G sized particles (> -1 ), by weight. Please refer to the enclosed grain size analysis for det oE,v G'D ®CW1` OkAo CO' Shallowbag Bay Dredge Project January 2005 Manteo, Dare County, NC IV. ANALYSIS OF POTENTIAL ADVERSE IMPACTS (1) Negative water quality effects from removal of sediments and potential "stirring" of sediments. During hydraulic dredging activities, approximately two to three feet of material will be removed from the side channels. This activity has the potential to stir up sediments and create turbidity in the water column. To minimize the impacts this stirring of sediments will have, dredging should occur during months of the year when affects to aquatic life will be lessened. Based on materials analysis collected during core sampling (Appendix E), a majority of the sediments are sand sized at depths of one to two feet below the substrate surface. However, the sutficial sediments were noted to be silt to clay in size. Therefore, settling rates for silts and clays should be used when determining the effect the stirring of sediments will have on the water column. In areas such as Inner Shallowbag Bay, where there is relatively little current, the potential for sediment transport is limited, however, in areas such as Roanoke Sound where current is stronger, more potential for sediment redistribution and water column turbidity is likely. Currently, the Roanoke Sound around the proposed Pirates Cove side channels is not designated as PNA or SNA. The whole of Shallowbag Bay is designated as a SNA. Dough's Creek and Scarboro Creek are designated as PNAs. Based on laboratory analytical results, concentrations of metals in the sediments around the former rotary waste water distributor are above method detection limits. Please note, the Town of Manteo upgraded their waste water discharge system in 1993 and no longer discharge waste water from the rotary distributor into Shallowbag Bay. The RCRA metals analyzed were for metals occurring attached to solids, not dissolved metals in the water column. More data will need to be collected to determine if the metals are dissolving and entering the water column. In addition, some background samples could be collected to determine the metals concentrations that occur in Shallowbag Bay. Based on soil to ground water contaminant concentrations listed in the 21, Standards, chromium (27 mg/Kg) appears to be the only constituent that exceeds the soil to ground water concentration. Please note, however, the concentrations reported in the samples collected were 27.9 mg/Kg in the sediments collected from RCRA-1 and 28.5 mg/Kg in the sediments collected from RCRA-2. These concentrations are just slightly above the action levels. There is a slight risk associated with the discharge of potentially contaminated soils at a disposal facility (presumably Skyco). However, once sediments are pumped into piping and distributed to the spoils facility it is unlikely that the relatively low concentrations will be above any soil to ground water quality standards. Designated channels can limit disturbance to sediments by creating deeper channels by which boaters can navigate without stirring up sediments. In theory, deep, well marked navigation channels reduce the amount of traffic over shallow areas. The potential of sediment disturbance is much greater if there are no navigation channels available for the public to use. Channels do exist now, however, and many sections of the channels are five feet deep duringFs1'MVED water. It is during these times that prop wash could affect the sediments. Therefore, deepening L JUN 0 5 2017 DCM- MHD CITY Shallowbag Bay Dredge Project Manteo, Dare County, NC January 2005 and marking channels may actually decrease the possibility of daily turbidity in the water column. No studies have been performed in Shallowbag Bay to determine at what depth prop wash has an effect on sediments. (2) Increase in boater traffic. Boater traffic is not likely to increase as a result of side channel maintenance dredging. The channels already exist to some degree. In addition, the number of transient vessels accessing Shallowbag Bay may decrease now that the Salty Dawg Marina has been relocated. The new development proposed at the site of the former marina will add permanent boats to the area, however, channels already exist to service the former marina and the dredging proposed in Shallowbag Bay and the Roanoke Sound Channel is maintenance. (3) Loss of habitat. Because a majority of the proposed work is maintenance dredging of existing channels, there will be no actual loss of habitat. However, there are areas of Inner and Outer Shallowbag Bay that can be designated EFH for federally listed species of shrimp and flounder. No habitat will be lost, however, dredging should not occur during times when juvenile and post larval species are present. The dredging proposed within the mouth of Doughs Creek adjacent to the Elizabeth II is adjacent to a coastal marsh expanse. Any dredging in this area would certainly be within a PNA and according to the SFMC and MAFMC is defined as EFH for postlarval and subadult shrimps and juvenile and adult flounder. According to the April 2001 NMFS EFH update, "The Magnuson Stevens Act does not authorize NMFS to regulate dredging actions. NMFS EFH conservation recommendations are not binding. Furthermore, the designation of EFH does not confer any automatic restrictions on dredging or dredge material disposal..." "The designation of EFH allows NMFS to craft conservation recommendations specifically to minimize impacts to federally managed species." Based on data reported and summarized by NC-DMF oysters are reported to occur in Shallowbag Bay, but not in the PNAs of Scarboro and Dough's Creek. Oyster occurrence in Shallowbag Bay in bushels per acre is greatest in the H Strata (16.51). The proposed channels are located in the D Strata which is reported to have 7.25 bushels per acre. The data used to generate the summary strata and shellfish occurrence maps is relatively old (1995). Oysters are not part of the Southern or Mid -Atlantic Fisheries Management Plan (FMP). V. MITIGATIVE MEASURES Based on data collected and provided in this report, impacts to SAVs, finned fish and shellfish appear to be limited with the project as proposed provided certain mitigation measures are met. Mitigation measures should certainly include dredging during months when juvenile finned fish and post larval and sub -adult shrimp are not present. Additional mitigation could be in the form of contributions to boater education programs or aQ campaign that brings awareness to the public in regards to PNA, SNA, EFH, FMPs an ` Shallowbag Bay Dredge Project Manteo, Dare County, NC January 2005 importance of protecting sensitive habitats. In addition, signs could be erected in and around the developments in the project area and along channels reminding boaters to navigate in designated channels and avoid shallow and sensitive habitats. Public education campaigns could also be in the form of advertisements in both printed and radio/television broadcast mediums. The scientific community is well aware of the significance of these sensitive habitats, however the average boater may be uninformed. VI. CONCLUSIONS The project outlined above proposes to dredge an average of two to three feet of material from existing side channels to act as connections to several existing developments in and around the Shallowbag Bay and Roanoke Sound. Based on field observations, and data collected from Quible, there do not appear to be any SAV beds in any of the channels proposed to be maintained, or in any adjacent areas. However, the results and conclusions of the SAV survey are limited to the sampling locations and methodology used to collect and analyze surficial sediments. During times of low water the side channels are as shallow as four and five feet in some areas. The project proposes maintenance dredging of these existing channels so that sailboats and craft with deep keels can access the channels during times of low water. As proposed, the project should not facilitate an increase in boater traffic. In addition, the maintenance and marking of adequate channels in the area could limit the volume of traffic in shallow waters, which on a daily basis, could be more damaging than the proposed maintenance dredging. Based on PNA and SNA Habitat designations, Shallowbag Bay is obviously a sensitive marine habitat which is home to several species of juvenile finned fish, post -larval and sub -adult shrimp and oysters. The project as proposed should be conducted during winter months to avoid impacts to flounder and shrimp nurseries. An EFH designation can be given to those areas in Dough Creek, Scarboro Creek, Inner Shallowbag Bay and Outer Shallowbag Bay that provide specific habitat for post -larval and sub -adult shrimp, and juvenile and adult flounder. However, the majority of the proposed maintenance dredging will occur in areas of Shallowbag Bay that are not adjacent to the marsh edges, SAVs or marsh ponds. Dough Creek and Scarboro Creek are listed as High Quality Waters. Shallowbag Bay is listed as SC Waters for fish propagation. Metals concentrations around the former Town of Manteo rotary waste water distributor are slightly elevated. However, with the data collected it is not clear if the metals are dissolving in the water column. There is a possibility that the microbial and aerobic conditions of the sediments in Shallowbag Bay are actually reducing metals concentrations. However, biological data would need to be collected to determine this. Although the concentrations of metals appear to be slightly elevated, they do not appear to be a significant threat if dredged and disposed of. The removal of the sediments may actually help the local water quality with regard to metals removal. Water column metals testing should be conducted to determine of there is a significant source of metals pollution in the sediments around the former To of Manteo rotary distributor. ]RECEIVED E JUN 0 5 2011 DCM- MHD CITY Name: MANTEO Date: 1/6/2005 Scale: 1 inch equals 1.578 miles jh 4Wn Point HwA 0 S GUARD Nap =FOW Hd A L PengWo I Bw P= Ceder Oroad Cn*0 :¢ c \2` OW C. GOASO OVO QMA MEMORANDUM TO: Warren Eadus Qm'ble & Associates FROM: Beth Bums, Marine Biologist f a NC Division of Marine Fisheries DATE: December 20, 2004 SUBJECT: Shallowbag Bay Data Request REDam_9%,]ED JUN 0 5 2017 DCM- MHD C1TY The NC Division of Marine Fisheries has conducted trawling surveys since the 1970's to inventory the state's estuarine resources. The result of these surveys was the identification of estuarine areas that consistently supported populations of juvenile shrimp, crab, flounder, croaker, spot and menhaden. The Marine Fisheries Commission adopted regulations in 1977 to protect these estuarine areas, known as NurseryAreas. Nursery areas are defined by rule 15 NCAC 3N.0102: (a) Nursery areas are those areas in which for reasons such as food, cover, bottom type, salinity, temperature and other factors, young fmfish and crustaceans spend the major portion of their initial growing season." (b) Primary Nursery Areas (PNAs) are those areas in the estuarine system where initial post -larval development takes place. These areas are usually located in the uppermost sections of a system where populations are uniformly very early juveniles. (c) Secondary Nursery Areas (SNAs) are those areas in the estuarine system where later juvenile development takes place. Populations are usually composed of developing sub -adults of similar size which have migrated from an upstream primary nursery area to the secondary nursery area located in the middle portion of the estuarine system." Secondary Nursery Areas are further described as permanent secondary nursery areas (PSNA) or special secondary nursery areas (SSNA). PSNAs and SSNAs described in 15A NCAC 3R .0104 and .0105 generally pertain to those areas located between the described line and the primary nursery area lines or Inland -Coastal boundary lines where applicable. The NCDMF juvenile trawl survey data for Dough and Scarboro Creeks (PNAs) and Shallowbag Bay (SNAs: SSNA, PSNA), are presented herein. Data summaries are dependent upon the availability of consistent data. Please pay particular attention to the differences in years, months, and tow times, by station location. - For example, "Inner-Shallowbag Bay", Permanent Secondary Nursery Area (PSNA), was sampled 1983- 1991, "Outer-Shallowbag Bay", Special Secondary Nursery Area (SSNA), was sampled 1986-1989, and the non -nursery area station presented was only sampled 1987-1989; all three locations were sampled March -November. - Both Dough and Scarboro Creeks, Primary Nursery Areas (PNAs) were sampled from 1983-present, but March -November for 1983-1991, and May, June only for 1992-present. - Months sampled vary. Historically, data was collected March -November, 1983-1991. More recent data was collected only during the months of May -June, 1992-present. - When comparing CPUE data, please note that secondary nursery area information has recorded CPIJE as catch in a five-minute tow versus primary nursery area information where CPUE is for !-minute tow time. Dough and Scarboro Creeks (PNAs) Dough and Scarboro Creeks are some of the first primary nursery areas ever designated in the northern district. These creeks are exceptionally productive nursery areas, have soft mud/detritus sediments and shallow waters, and deserve as much protection as possible. CPUEs for predominant species are presented (Tables 1 & 3). Numbers of fish caught per tow (CPUE) were generally highest for May, June (Tables 1,3), a reflection of primary recruitment months for most of the key juvenile species (spot, A. Croaker, flounder, brown shrimp). Interestingly, the number of spot caught in the PNAs during May, June declined steadily from 1983-91, to 1992-99, and 2000-04 (Table 1). This may be a reflection of declines in the spot population, and probably not degradation of water quality and/or the nursery area habitat, since CPUEs of other key species such as Atlantic croaker, blue crab, summer and southern flounder, and brown shrimp have remained fairly consistent over time. Historical data (1983-91) was presented for March -November (Table 3) so that the data could be compared with the secondary nursery area CPUEs (Table 2) for the same years and months. Keep in mind, the secondary nursery area CPUEs (Table 2) reflect numbers caught in 5 minutes while the primary nursery area CPUEs were numbers caught in 1 minute (Table 3). As would be expected, species diversit3#is highest when all months sampled (March -November) are pooled (Tables 2 & 3). Inner-Shallowbag Bav (172.68 acres/0.27 square miles). The location of the permanent secondary nursery area (PSNA) is located near the town of Manteo and is situated between the Primary nursery areas, Dough Creek and Scarboro Creek, and the special secondary nursery area, Outer-Shallowbag Bay (Figure 1). Shallowbag Bay functions as a classic nursery area such that the primary nursery areas of Dough and Scarboro Creeks provide protection for the very early juveniles, which then migrate out into the protected waters of the secondary nursery areas of Shallowbag Bay where later juvenile development takes place. Catch per unit effort (CPUE) for the target species captured at the station located within the innermost Shallowbag Bay are compared with CPUES from special secondary nursery area "Outer Shallowbag Bay" as well as to catches from an adjacent non -nursery area within Roanoke Sound Channel (Table 2). Species diversity was similarly high for both of the Shallowbag Bay stations, but diversity of commercially/recreationally important species was higher for Inner-Shallowbag Bay (n=46): spot, croaker, blue crab, Atlantic menhaden, southern and summer flounder, weakfish, red drum, alewife, blueback herring, harvestfrsh, butterfish, bluefish, yellow and white perch, American eel, spotted hake, striped mullet, sheepshead, Atlantic spadefrsh, King mackerel, brown, pink and white shrimp. Intrinsic to the permanent secondary nursery area designation is the added protection to an oyster resource along the shoreline from Ice Plant Island to Sandy Point as it is unlawful to use trawl nets for any purpose in any of the permanent secondary nursery areas described in 15A NCAC 3R0104 Outer -Shallowbag Bay (446.82 acres/0.70 square miles). The location of this special secondary nursery area (SSNA) is located near the town of Manteo and is situated adjacent to the permanent secondary nursery area, Inner-Shallowbag Bay (Figure 1). Shallowbag Bay functions as a classic nursery area such that the primary nursery areas of Dough and Scarboro Creeks provide protection for the very early juveniles, which then migrate out to the PSNA, then further to the SSNA of Shallowbag Bay, as later juvenile development takes place. Catch per unit effort (CPUE) for the target species captured at the station located within Outer-Shallowbag Bay (n=42) are compared with CPUES from an adjacent non -nursery area within Roanoke Sound Channel (n=25) (Table 2). Species captured of commercial and/or recreational importance included spot, Atlantic 0 croaker, Atlantic Menhaden, southern and summer flounder, weakfish, spotted seatrout, butterfish, Spanish W mackerel, Atlantic spadefrsh, southern kingfrsb, blue crab, brown, pink and white shrimp. o ® ® N The channel of Outer-Shallowbag Bay has long been a traditional trawling area. However, the abundance LU and diversity of juvenile fish within the bay deserve the added protection of a nursery area classification. 9 The special secondary nursery area classification allows for the added protection of the nursery area,.while at the same time allow for the flexibility to permit trawling should it become prudent. Special secondary nursery areas may be opened to shrimp or crab trawling August 16-May 14, by proclamation. Table 1. CPUE's of primary nursery areas, Dough Creek a Scarboro Creek. Two were collected in PVC plastic pipe and submitted to Quible and Associates for RCRA metals analysis. The remaining 29 cores were taken in 3 inch diameter aluminum core pipe. These cores were opened, described and subsampled for grain size analysis. The samples taken for grain size analysis were continuous channel samples of the upper two feet of each core. Grain size analysis was done by wet sieving. Samples were dried at 50 degrees C., weighed, rehydrated for 24 hours in distilled water, and wet sieved. Sand/pebble separation was done with a 2 mm sieve, and sand/mud separation was done with the 0.074 mm sieve, per U.S Army Corps of Engineers document EM-1110-2-1906, appendix V, "Grain Size Analysis." Pebble and sand fractions were determined by weighing dried fractions, and mud fraction was determined by difference. Results are presented below. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AM to accomplish that result, as soon as is practicable.
