attached workplan drawings (5), Figures 2-4 dated 8/16/17, Figure 5 dated 8/30/17 and Figure 6 dated 9/14/17.
This permit, issued on July 22, 2021 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the homesite,
driveway, cart path, culvert and other associated infrastructure, all as expressly and specifically set
forth in the attached permit application and workplan drawings.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside the approved
alignment, as depicted in the attached permit application, project narrative, and workplan drawings.
3) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

4) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
Docking Facility
5) This permit authorizes only the docks, piers, 4 mooring pilings, and other structures and uses located in
or over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this docking facility without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
7) This permit authorizes a maximum of 2 formalized boat slips.
8) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
10) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-02059).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-0796.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: A transfer application processing fee of $100 was received by DCM for this project.

The proposed project is for a private individual home, driveway, shoreline access and pier.

Proposed project will place fill in 7,405 sq. ft. (0.17 acres) of wetlands using dump trucks and a tractor. Once fill has been
placed then construction of the house, concrete driveway and pier will occur. All equipment will be stored on uplands during
construction.

The proposed project is for a house, driveway, golf cart /atv access to shoreline for elderly family members, pier and boat
slips.

package to be complete. Items (a) — M are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

404 wetland for the purpose of constructing a house, driveway
and access path to the shoreline. This project only places 360
sq. ft. of fill within the 75-foot AEC. The access path to the
shoreline will provide a goff cart / atv path for elderly to access
the shoreline and pier. The contractor can also use the path to

Beaufort County
Lot number 13 in Dowry Creek Estate, owned by Roger Peck, located near Belhaven on the
Pungo River in Beaufort County, North Carolina, subject of Major CAMA Permit No. 126-17, has been
sold to Mr. Benjamin Machon. CAMA Major Permit No.126-17 was originally issued on November 13,
2017 to Mr. Roger Peck for residential home site development which included 7,405ft2 of non -coastal
wetland fill for the home site and a cart path to the shoreline as well as a 5'x 40' pier with a 12' x 12' t-
head platform and two 14' x 25' wet -slips. The permit has been renewed once on December 31, 2020
and expires on Decembers , 2022. None of the permitted work has been completed.

Mr. Benjamin Machon is requesting transfer of CAMA Maj or Permit No.126-17 and Mr. Roger
Peck has agreed per the sale of the property. I recommend transfer of the Permit to Mr. Banamin Machin
noting he is subject to the conditons of the original permit and should contact the local CAMA field
representative for a pre -construction meeting before any work commences.
