This permit, issued on September 21, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
>e subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the reconfigured docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconfigured docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the pemiittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
<n issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The petmittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips.
6) Should either adjacent property be sold prior to the initiation of construction, the permittee shall be
required to obtain a signed riparian corridor waiver from the new property owner(s) prior to the placement
of any structures within the 15 foot riparian corridor.
7) The tie piling associated with Slip No. 2 shall have a minimum setback distance of 15 feet between any
part of the structure and the adjacent property owner's riparian access corridor to the south.
8) No portion of the authorized docking facility shall extend past the Wrightsville Beach Pier Head Line.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Bulkhead
10) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the existing
deteriorated bulkhead.
11) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
12) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
13) The bulkhead shall be constructed prior to any backfilling activities.
14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.

Sedimentation and Erosion Control
17) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
19) The permittee and/or his or her contractor shall meet with a representative of the prior to project
initiation.
20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
21) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 and 197800080 (Action ID No. SAW-2017-01757), which was issued on 8/21/17.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
17-0913.
NOTE: An application processing fee of $250 was received by DCM for this project.

The total area of floating dock and platform was calculated as follows:
Shoreline length = 62.5 ft. x 8 ft. = 500 sq. ft. allowable
Existing covered platform = 13.7 ft. x 22 ft. = 219 sq. ft. (82 sq. ft. not calculated for access credit)
Existing open platform = 10 ft. x 22 ft.= 160 sq. ft. (60 sq. ft. not calculated for access credit)
Proposed floating dock = 6 ft. x 80 ft. = 224 sq. ft. (total not calculated due to access)
Proposed finger pier = 6 ft. x 20 ft. = 120 sq. ft.
Total = 499 sq. ft.
The docking facility would provide potential docking space for up to five (5) vessels at this location. It
appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6),
including the eight square foot rule and the pier width rule. Specifically, the project is CONSISTENT
with the use standards set forth in NCAC 07H .0208(b)(6)(Gxiii), including the official pier -head line
established by the Town of Wrightsville Beach, the 1/4 width and channel location. The proposed
structures would be located entirely over open water. The facility would encroach into the 15' riparian
corridors on the northern and southern neighbor sides, and a waiver has been obtained from both
neighbors. In the absence of any concerns from the commenting agencies, it is recommended that a permit
be issued subject to the standard conditions for private docking facilities.
It appears that the applicant's proposal to install approximately 62.5 linear feet of bulkhead 2' water ward
of the existing deteriorating bulkhead is CONSISTENT with the Rules of 15 NCAC 711.0206 (d) Use
Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas and
Rules of 15 NCAC 71-1.0208 (bx7) Use Standards for Bulkheads. In the absence of any concerns from the
commenting agencies, it is recommended that a permit be issued subject to the standard conditions for
bulkheads.

The applicant proposes to replace an existing bulkhead and expand a private docking
facility along the edge of Banks Channel. The project is located at 7 Auditorium Circle
in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT, ES and EW.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Wrightsville Beach Land Use
Plan Update and offer the following comments.
The general area of the project is classified as Developed and Conservation.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Developed and Conservation classified AECs, which is consistent with
the State's minimum use standards. The Wrightsville Beach Land Use Plan contains
some policies, which exceed the State's minimum use standards. However none of these
policies appear to be applicable to this project.
This project is consistent with the 2005 Wrightsville Beach Land Use Plan Update.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to replace an existing bulkhead and to expand the docking facility at
7 Auditorium Circle, adjacent to Banks Channel, in Wrightsville Beach, North Carolina.
Coordinates are: 34.209132 N,-77.798751 W.
On January 1, 2017, we renewed General (Regional) Permit Nos. 197800056 and
197800080, (copies enclosed), authorizing the maintenance, repair, construction and installation
of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater
structures, the backfill of bulkheads and riprap structures along eroding highground shorelines,
and the construction of riprap structures to protect eroding wetland shorelines in navigable waters
of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and
Harbors Act of 1899. Both General Permit No. 197800056, and General Permit No. 197800080
expire December 31, 2021.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general and special conditions.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

I thought I'd follow up our conversation with an email to hopefully make it easier for you to respond.
As discussed, please confirm whether there are 3 or 4 tie pilings proposed. Your MP-4 indicates there are 4, but I'm only
seeing the 3 sets of dolphins on the plans. And no other mooring pilings are proposed in addition to those, correct?
And please also confirm again that the only fill proposed is simply bulkhead backfill. If that's the case, I will cross out the
"Other Fill (excluding shoreline stabilization)"/Section 4 on the MP-2 form.
That's all 1 need from you. And I double-checked my file after we spoke and realized 1 do have the Corps permit. What
I'm missing is the Town's comments, so I just need to check with the Town and DWR. Once I have the info from you and
check in with them, I should be able to finish everything up soon after!

serve as your notice of an extended review. However, an additional letter will be provided on or about
the 75th day.
If this agency does not render a permit decision within 70 days from July 20, 2017, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed

9. PROJECT DESCRIPTION
The project site is located at 7 Auditorium Circle, adjacent to Banks Channel in the Town of Wrightsville
Beach, New Hanover County. To locate the project site from the W iRO take US Hwy 74/76 to Wrightsville
Beach. Travel across the drawbridge and keep right on Causeway Drive. Turn right on Auditorium Circle,
just before the Causeway Bridge leading to the barrier island. The property of interest is the third home
located on the left side of the road.
The project site is approximately 0.29 acres in size, on which the applicant currently maintains a single-
family residence. The high ground is vegetated primarily with maintained lawn grass and ornamental
landscaping. The project site has approximately 62.5 linear feet of shoreline frontage along Banks Channel,
which is stabilized by a timber bulkhead, and Normal High Water (NHW) meets the bulkhead. There are
no Coastal Wetlands on the property. At the property, the applicant also maintains a private docking facility,
which consists of a fixed pier (6' x 24') that extends to a platform (22' x 22') the westernmost 14' of which
is covered, which connects (via ramp) to a floating dock (6'x 60'). A 13' x 15' boatlift exists along the
northern side of the floating dock on the landward most edge. The lift and gazebo encroach into the 15'
riparian corridor setback from the northern property owner. The property to the north is an undeveloped
lot, with a timber bulkhead and docking facility that is approximately 34' away from the subject docking
facility. The property to the south is developed with a single-family residence, timber bulkhead and a
docking facility that is approximately 50' from the subject docking facility. According to the application
package, existing water depths surrounding the existing docking facility range from approximately -4.0' to
-18.0', relative to normal low water (NLW). DCM was not able to locate a previous permit for the existing
facility; however, based on historical aerial photography the existing docking facility appears to have been
in place since the early 1990's.
The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of the
property as Conservation. The waters of Banks Channel and Middle Sound are classified SB by the Division
of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of
Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to replace an existing bulkhead and expand a private docking facility along the edge
of Banks Channel. The configuration of the existing docking facility currently provides dockage for up to
four (4) vessels. Based on drawings provided by the applicant, the existing docking facility is shown to be
located within the 15' riparian corridor setback along the northern side of the property. The application
states the existing pier and gazebo would remain in place with no modifications or expansions; however, a
new floating dock spine (6' x 80') would be installed just waterward of the existing fixed gazebo, along
with one finger pier (20' x 6'). The floating docks would be installed approximately 6' south of their current
alignment. The finger pier would run perpendicular to the shoreline and would be installed approximately
13' from the landward most end along the southern side of the main spine. Along the waterward end of the
southern side of the main spine, 3 sets of dolphin tie piles are proposed to accommodate dockage of a 65'
vessel. As proposed, the finger pier and 2 sets of dolphin piles encroach into the southern 15' riparian
corridor setback and a waiver has been obtained. In addition to the floating component, a new 16' x 18'
boat lift would be installed along the northern side of the proposed 6' x 80' finger pier, on the landward
most side. This lift would encroach into the 15' riparian corridor setback along the northern side of the
property and a waiver has been obtained. As designed, the proposed facility would provide dockage for up
to four (4) vessels, but potentially could accommodate five (5) vessels, if a larger vessel is not present.

range from approximately 4.0' to -18.0' at NLW. In total, the proposed facility would extend
approximately 136' from the waterward edge of the proposed bulkhead.
Additional development on the subject property includes the installation of a new bulkhead just waterward
of the existing bulkhead, located along the western edge of Banks Channel. According to the application
package, the existing wall is failing and is in need of replacement. The new alignment would be positioned
an average of two (2) feet, with a maximum of two (2) feet, waterward of the normal high water line and
the existing bulkhead. There are no Coastal Wetlands present. Each end of proposed wall would "tie" into
the adjacent bulkheads located on either side of the applicant's property.
10. ANTICIPATED IMPACTS
The proposed structures (bulkhead, floating docks and boatlift) would incorporate an additional
approximately 528 sq. ft. of Estuarine Waters and Pubic Trust Area, essentially within an area currently
usurped by the existing docking. The proposed structures would extend approximately 136' into a
waterbody, which measures approximately 720' across. This distance conforms to the quarter width of the
waterbody, nor does it exceed the established pier -head alignment. The proposed structures would encroach
into both adjacent 15' Riparian Corridor Setback Areas, however, waivers have been obtained' I. The
facility could potentially accommodate up to five (5) vessels within water depths ranging from
approximately -5.0' to -18.0' at NLW.
The proposed bulkhead would result in the filling of approximately 125 sq. ft. of Estuarine Waters and
Public Trust Area. Additional high ground disturbance, as a result of the bulkhead installation, would total
approximately 1,250 sq. ft. Minor increases in turbidity should be expected during construction.

As you know I have applied for a CAMA permit to reconfigure the dock and pier
extending from my lot at 7 Auditorium Circle. The plans submitted to CAMA and for which I
am seeking a permit are attached. To obtain the CAMA permit for the construction, I will need
to have you, as adjoining property owner, to waive the 15' minimum setback from your extended
property line. This area is the riparian boundary for each of our properties. If you waive the 15'
setback and I construct the dock/pier as shown on the plans, I agree that upon your request I will
remove the dolphin pilings and any other encroachments so that the 15' setback is restored.
Further, I agree to not hold you responsible if you or a guest's boat unintentionally damages the
dolphin pilings, structures, or any of my boats that encroach into the riparian corridor. This
agreement will apply to an future owners of mFoperty unless this agreement is nullified by
