attached workplan drawings (3) all dated 3/27/17.
This permit, issued on June 21, 2017 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
1) This permit authorizes only the platform expansion and boatlift, and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes one additional slip, for a maximum of 3 formalized boat slips.
(See attached sheet for Additional Conditions)
i nis permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Groin
The groin extension, as depicted on the attached workplans, shall not extend more than 20 feet
waterward of the normal water level at the time of construction.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
CE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-01602) issued 6/15/17.
1TE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-0615.
rE: The permittee is advised that many land disturbing activities are not authorized within 50 feet of
the normal water level unless specifically exempted by Environmental Management
Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development.
An application processing fee of $250 was received by DCM for this project.

I am proposing the following project making additions to my existing structures. I currently have a 93'
pier with a 15' x15' platform on the end, two boat lifts, and an existing bulkhead, 40 feet of it being
wood and the remaining portion rip rap. Emanating from the wood section of the bulkhead are two
wood jetties. One is 20 feet and the other is 10 feet. I am proposing to extend the 10 foot jetty out 10
more feet, for a total of 20 feet. I am also proposing to extend my 15' wide platform on the end of the
pier by 10 feet. This will make the platform on the end roughly 15' x 25', staying within the maximum
area of 400 square feet required. I also would like to add a third boat lift at the end of the pier. I have
included drawings and cross sections of these proposals for review.

In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) (d are always applicable to any major development application. Please consult the application
instruction booklet on how to property prepare the required items below.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish

c. A site or location map that is sufficiently detailed to guide agency personnel unfamiliar with the area to the site.
d. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties.

where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Proiect setting
Marcus Jones has submitted a CAMA Major Permit request for development onsite his
property. The project site is a single-family residential lot with a riprap shoreline located off SR
1300 at 580 Jamaka Road on the Pamlico River near the City of Washington in Beaufort County,
North Carolina. The lot is approximately 12 acres (522,720 ft2) in size and has approximately 240
linear feet of shoreline. Man-made features on the lot include a single-family residence, 90' long
pier with a f 15' by f 15' L-head platform, two uncovered boadiffs, 20' long groin and 10' long groin.
Water depth at the terminal end of the pier structure is approximately -5.5' below Normal Water
Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually
slopes upward to an approximate elevation off4' above the NWL. The lot is mostly vegetated with
lawn grasses, ornamental shrubs and wooded wetlands.
The adjacent upstream property is a developed single-family residential lot with a pier and a
rip rap shoreline. The downstream property is an undeveloped single-family residential lot.
The Pamlico River is classified as SB NSW by the Environmental Management Commission
at the project site. The Pamlico River at this location is designated Coastal Waters and is not open to
shell fishing. The project is located within the Tar -Pamlico River Basin.
Project description
The applicant proposes to extend the 10' long groin an additional 10' for a total length of 20'.
Also, the platform will be expanded to a total size of 25' x 15'. A 13' x 13' uncovered boatlift will
be installed on the East side of the expanded platform. The addition of the boat lift will bring the
total number of slips to three.
Anticipated impacts
The project will result in the localized turbidity from the installation of the boatlift,
platform and groin extension. The completed project will result in a total platform square footage
of 375 square feet, 169 square foot uncovered boatlift and an additional 20 square feet of wooden
groin.

for making a decision is 5 July 2017. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by

NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.

Marcus Jones has submitted a CAMA Major Permit application request for the expansion of an existing
platform, extension of existing groin to a final length of 20' and the installation of an uncovered boatlift at his
property located off SR 1300 at 580 Jamaka Road on the Pamlico River near the City of Washington in Beaufort
County, North Carolina.
Staff has reviewed the proposed project with regard to Hiles found in Subchapter 7H concerning development
in a Public Trust Area. It is staffs recommendation that the proposed project appears consistent with 15A NCAC
07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(E) which states in part that
"The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a
documented need for a larger boat lift". The applicant has proposed an uncovered boatlift which is approximately
169ft2in size. Additionally, the proposed groin extension is consistent with 15A NCAC 07H .1405 and the platform
expansion is consistent with 15A NCAC 07H .1205.
Staff recommends the following conditions be included if the project is permitted.
1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, may
become a permanent part of this docking facility without permit modification. No non -water dependent uses
of structures may be conducted on, in or over public bust waters without permit modification.
3. This permit authorizes a maximum of three boat slips.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s)198000291 issued by the US Army Corps of Engineers (USACE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4097 (GC 4097), the impacts described in your
application do not require written authorization to utilize GC 4097. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and Sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint
Land Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land
development and land use activities comply with the requirements of the Tar -Pamlico Buffer Rule,
unless located in the exempted or allowed areas (see policy 2.1.5).
Overview: The applicant is proposing to expand an existing platform to 25' x 15', extend existing groin
from 10' to 20', and install an uncovered 13' x 13' boatlift; for a total of 3 (three) boat slips. The project
site is located at 580jamaka Rd adjacent to the Pamlico River in Beaufort County, North Carolina.
The project site is approximately 12 acres, and has approximately 240 linear feet of shoreline. The sites
existing upland features include: a single-family residence, 90' long pier with a ±15' x ±15' L-head
platform, two uncovered boatlifts, 20' long groin, and 10' long groin.
The project is located within in Tar -Pamlico River Basin. The Pamlico River is classified as SB (Primary
Recreation, Salt Water) and NSW (Nutrient Sensitive Waters). The site is a not a Primary Nursery Area,
is closed to shellfishing. Vegetation on the project site consist of wooded wetlands, ornamental shrubs
and lawn grasses. A review of Submerged Aquatic Vegetation (SAV), and archaeological/cultural
resources was not provided.
Anticipated impacts resulting from this project are expected to include: localized turbidity from the
installation of the boatlift, platform, and groin extension; and the shading of ±395 ft2 of Non -Vegetated
Wetlands River Bottom

Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future
Land Use Map (FLUM) classifies the site as Transition (land) and Conservation I (water). The LUP
classifies the Conservation I area as follows:
The Conservation I classification delineates land and water features where there are serious hazards to
personal safety or to property, where new development would cause serious damage to the values of natural
systems, or where new development is not permitted by local, state, or federal policy. The classification is
designed to provide for the protection and long-term management of the planning area's most important
natural systems. The areas included in this classification are described in Part lll, Section B., 2.0. (pg. III-38).
The following LUP policies may be applicable to this request:
2.1 Conservation
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (ISA NCAC 02B .0259).
