This permit, issued on November 27, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Dockin¢ Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the perrnittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather. .
5) This permit authorizes a maximum of 6 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors. No tie pilings are authorized
on the northern side of the floating dock.
7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
NOTE: Due to the presence of submerged aquatic vegetation (SAV) in close proximity to the project
area, the permittee is encouraged to install pilings in a manner that will not result in the
formation of sedimentary deposits ("donuts" or "halos") around the pilings. Pile driving is the
preferred method of installation, followed by jetting with a low-pressure pump.
NOTE: The permittee is further advised that all available precautions should be utilized to ensure that
damage to SAV habitat does not result from the construction and/or operation of the authorized
facilities. Additionally, the permittee should be aware that the Rules of the Coastal Resources
Commission prohibit new dredging within SAV beds.
8) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
U.S. Army Corps of Engineers Conditions
11) No portion of any structure shall be located within the setback of the federally maintained AlW W channel.
As as -built survey shall be performed of the docking facility, and copies of the survey provided to the U.S.
Army Corps of Engineers and Division of Coastal Management, within 60 days of completion of
construction of the project.

ADDITIONAL CONDITIONS
General
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2017-
01959.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2017-0823.
NOTE: An application processing fee of $250 was received by DCM for this project.

The applicant proposes to install a six -slip docking facility at 2026 Scotts Hill Loop,
adjacent to the AIWW and Middle Sound in Pender County.
Areas of Environmental Concern (AFC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SA and are open to the harvesting of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Pender County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation and Resource Protection.
In general, Pender County allows development in Conservation and Resource Protection
classified AECs which is consistent with the State's minimum use standards. The Pender
County Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these more restrictive policies appear to be applicable to
this project.
This project is consistent with the 2012 Pender County Comprehensive Land Use
Plan Update.

The total area of the proposed structures was calculated as follows:
Shoreline length=+/-185 ft. x 8 sq. ft. = 1,480 sq. ft. allowable.
Proposed:
Platform = 20' x20' = 400 sq. ft
Floating dock = 8' x 24' =192 sq. ft.
Fixed dock spine = 6' x 65' = 390 sq. ft.
Finger piers = 2' x 35' = 140 sq. ft.
Boatfifts x 4 = 676 sq. ft. (not included)
Total (proposed) minus boat lifts = 1,122 sq. ft.

The proposed development would provide docking space for a total of six (6) vessels. The proposed
docking facility currently extends approximately 18' into the waterbody, which measures approximately
72' across, which is CONSISTENT with NCAC 07H .0208 (b)(6)(G). The application also appears to
be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208(b)(6), including
those which dictate the maximum allowable platform area (the 8 square foot rule), the 15' riparian
setback and federal channel setback.
Provided the resource agencies do not have any concerns regarding significant adverse impacts resulting
from the proposed project, this office has no objections to the issuance of a permit.

On August 17, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and
specifications on August 18, 2017 has determined that the development activities proposed at this time will not pose
a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed
and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the
stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter,
we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has
reviewed. the CAMA.permit application for proposed actions, that;impact fish and fish habitats. The
applicant is proposing to install a docking facility -at 2026 Scotts Hill Loop Road, adjacent to the
AIWW and Middle Sound. The applicant is proposing to instaTa 130' x 6' pier which leads to a20'
x 20' covered gazebo. From this gazebo,'a fixed 65 x 6 pier will run parallel to shore and have two
(2) 35' x 2' catwalks surrounded by four (4) 13' x 13' boatlifts: Also, coming from the gazebo,.
oriented perpendicular to shore, a ramp leading to a 24' x 8' floating. dock.
This area is known to have the presence of submerged aquatic vegetation (SAV) habitat from year to
year. Per MFC rule TI5A NCAC 03I.0101- (4)(i) SAV habitat designation is defined:
"within the past 10 annual growing seasons -and that meet the average physical requirements of water
depth (slx-feet or less), average light availability (Secchi depth of one foot or b more , and limited wave
e osure that characterize the environment suitable for growth of SAV. e resence of SAV ma
demonstrated I b aerial hoto a h , SAV survey, map, or other documentation. An extension of the
past 10annual growing season's criteria may be considered whenaverage environmental conditions
are altered by drought, rainfall, or storm force winds."
SAV supports high diversity of foraging fish and invertebrates, and provides valuable ecosystem
services as a.primary producer and enhancer of water quality. SAV filters water, stabilizes sediment,
and provides refuge for juvenile finfish; .crabs and shrimp. SAV supports a vast array of epiphytes
and -other sessile invertebrates that serve as a food source foimany fisheries species. Waters "
containing SAV have higher species richness and abundance than those without SAV, and can
improve water quality and clarity through the filtration of water by the associated epiphytic
community: SAV is recognized• as essential fish habitat due to its"primary production, structural
complexity, modification of energy regimes, sediment" and shoreline stabilization, and nutrient
cycling.
Due to the designation as SAV habitat, the following practices are suggested based on the
Construction Guidelines for minorpile,supported structures constructed over SAV developed by the

This area is known to have the presence of submerged aquatic vegetation (SAV) habitat from year to
year. Per MFC rule T15A NCAC 03I.0101 (4)(i) SAV habitat designation is defined:
"within the past 10 annual growing seasons and that meet the average physical requirements of water
depth (six feet or less), average light availability (Secchi depth of one foot or more), and limited wave
exposure that characterize the environment suitable for growth of SAV. Th- !:past+ resence of SAY ma ,

past 10 annual growing season's criteria may be considered when average environmental conditions
are altered by drought, rainfall, or storm force winds."
SAV supports high diversity of foraging fish and invertebrates, and provides valuable ecosystem
services as a primary producer and enhancer of water quality. SAV filters water, stabilizes sediment,
and provides refuge for juvenile finfish, crabs and shrimp. SAV supports avast array of epiphytes
and other sessile invertebrates that serve as a food source for many fisheries species. Waters
containing SAV have higher species richness and abundance than those without SAV, and can
improve water quality and clarity through the filtration of water by the associated epiphytic
community. SAV is recognized as essential fish habitat due to its primary production, structural
complexity, modification of energy regimes, sediment and shoreline stabilization, and nutrient
cycling.
Due to the designation as SAV habitat, the following practices are suggested based on the
Construction Guidelines for minor pile -supported structures constructed over SAV developed by the
U.S. Army Corps of Engineers/National Marine Fisheries Service:

1. The height of piling -supported structure shall be a minimum of 5 feet above MHW/OHW as
measuied from the top surface of the decking.
2. Over-SAV bed portions of the piling -supported structure shall be oriented in a north -south
orientation to the maximum extent that is practicable.
3. If possible, terminal platforms shall be placed in deep water, waterward of SAV beds or in an
area devoid of SAV beds.
4. Pilings shall be installed in a manner which will not result in the formation of sedimentary
deposits ("donuts" or "halos") around the newly installed pilings. Pile driving is the preferred
method of installation, but jetting with a low-pressure pump may be used.
5. The spacing of pilings through SAV beds shall be a minimum of 10 feet on center.
6. The gaps between deck boards shall be a minimum of/z inch.

Sorry this got lost in my email. Based on the hand drawn layout they will be very close if not in the setback. There is
approximately 183 feet from what looks like a bulkhead to the setback, they say the overall length of the dock is 185ft.
this is so close that I think it is best for us to require an asbuilt as well as condition it that they can not cross the setback
line. If they build upto but not into the setback we do not have any concern with the project but if the project crossed
into the setback we would not approve it. Thanks.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and Bio Report
for the subject project. The attached notice requests federal agency comments on this project by October 30, 2017.
The applicant proposes to construct a 6-slip docking facility, located along Middle Bay, at 2026 Scotts Hill Loop Road, in
Wilmington, Pender County, NC.
Specifically, the project consists of constructing a 6ft wide X 130ft long access pier, which will terminate in an 19ft wide X
19ft long platform (which will be covered with an 20ft X 20ft roof), with one fixed 6ft X 65ft fixed spine with 2 finger
piers measuring 35ft long X 2ft wide to the south of the platform and on 8ft wide X 24 ft floating dock to the east of the
platform. The facility will contain 6 boat slips, 4 of which will have 13ftX 13Ft boat lifts. No dredging is proposed. The
Corps Federal Navigation Channel is located to the east of the project area.

EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not
likely to adversely affect EFH and associated fisheries managed by the South Atlantic or Mid Atlantic Fishery
Management Councils or the National Marine Fisheries Service. Impacts would be temporary and limited to increased
sedimentation during piling installation. The waters within the project area are NOT designated as PNA, are classified as
SA-ORW, and open to the shell fishing. Water depths within the project area average -2.5ft to -3ft NLW. Based on
multiple site visits by DCM staff, there is no SAV within the project area.
.ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. The Corps initial determination on species listed as threatened or
endangered pursuant to the Endangered Species Act of 1973 (ESA) within the project area, is may affect, not likely to
adversely affect for the West Indian Manatee. Manatee Guidelines would be required as a condition of the permit.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

*If possible, due to the relatively small amount of impacts to resources associated with this project, we request

The project site is located at 2026 Scotts Hill Loop Road, adjacent to the AIWW and Middle Sound, in
Wilmington, Pender County. To find the project site, travel north (from Wilmington) on US Highway 17
and turn right onto Scotts Hill Loop Road. Continue along Scotts Hill Loop Road and the project site will
be at house number 2026.
Existing man-made features include a 10' x 20' observation platform over land and a wooden bulkhead.
High ground vegetation consists of lawn grass and ornamental shrubs. The high ground portion is elevated
approximately 10'-15' above the normal high water (NHW) level. The shoreline (+/- 185 linear feet) is
stabilized by a timber bulkhead. Coastal Wetland vegetation seaward of the existing bulkhead includes such
species as: Smooth Cord Grass (Spartina alterni,Jlora), Sea Lavender (Limonium spp.), Glasswort
(Salicomia spp), Spike Grass (Distichlis spicata) and Salt Meadow Grass (Spartina patens). Residential
properties border the site to the north, west and south, and the AIWW/Middle Sound border the property to
the east.
The waters of the AIW W and Middle Sound (adjacent to the project site) are classified as SA-ORW by the
North Carolina Division of Water Resources. They ARE NOT designated as a Primary Nursery Area
(PNA) by the North Carolina Division of Marine Fisheries, and they are OPEN to the harvest of shellfish.
Based on visual observations made by DCM staff during the August 2017 site visits, there appears to be
NO Submerged Aquatic Vegetation (SAV) near the project area. Water depths in the vicinity of the
proposed facility range from -2.5' to -3.0', relative to normal low water (NLW).
PROPOSED PROJECT:
The applicant proposes to install a new six -slip docking facility. As designed, the new facility would consist
of a 6' x 130' access pier (originating from the northern side of the property along the bulkhead), 20' x 20'
covered platform, 8' x 24' floating dock, 6' x 65' fixed dock (spine) and two - 2' x 35' floating finger
docks. In addition, four - 13' x 13' boatlift would be installed.
As depicted on the site plan(s), the 6' x 130' access pier would originate from the northern side of the
property and would run perpendicular to the existing bulkhead. The applicant's agent notes that the
proposed pier, gazebo and floating dock would be close to the riparian corridor of the northern neighbor
(Agnes Serock), but would not encroach into the 15' riparian corridor setback. At the terminal end of the
access pier, the applicant proposes to install an "L" shaped covered platform/gazebo measuring 20' x 20'.
The proposed platform would span toward the south and provide access to both the 8' x 24' floating dock
and 6' x 65' fixed dock spine. The 8' x 24' section of floating dock would span from the platform, toward
the east and in alignment with the access pier, and would stop just short of the existing pier -head line. The
proposed 6' x 65 fixed dock spine would also extend from the platform, but would run in a southerly
direction, parallel to the bulkhead. Two, 2' x 35' catwalks or finger piers would extend from the spine and
be oriented in an easterly direction. The terminal ends of the finger piers would align with the outer edge
of the proposed floating dock, just inshore of the existing pier -head line. Two boat lifts would be located
on either side of the proposed finger piers, resulting in a total of four (4) 13' x 13' boatlifts at the facility,
and six (6) slips overall.

The proposed structures would incorporate approximately 2,578 sq. ft. of Estuarine Waters and Pubic Trust
Area. The proposed structures would extend approximately 185' feet from the bulkhead (or +/- 150' from
the outer edge of marsh grass) and terminate just inshore of the existing pier -head line, which is the same
approximate alignment for the %< width of waterbody limitation. The docking facility would remain
consistent with the '/< width rule and established pier -head line along a water body that measured
approximately 630' in width. Minor increases in turbidity should be expected during construction.

The enclosed CAMA Major Permit application for Dexter Johnson at 2026 Scotts Hill Loop Road is to
build a new pier and floating dock with 4 boat lifts. The pier will be 6' wide x 130' long leading to a
19'x19' gazebo with a covered roof. This will lead down a ramp to an 8'x24' float that will be used for
loading and unloading. Also, off the south side of the gazebo will be a 6'x65' walkway. This will lead to
(2) 2'x35' catwalks and 4 boat lifts. There will be a total of 6 slips. The dock will be private and for boat
owners only.

NCGS 113A-119(b) that the following application was submitted for a development permit in an
Area of Environmental Concern as designated under the CAMA: On August 7, 2017 Dexter
Johnson proposed to construct a private docking facility at 2026 Scotts Hill Loop Rd.,
adjacent to the AIWW in Wilmington, Pender County. A copy of the application can be
examined or copied at the office of Jason Dail, N.C. Dept. of Environmental Quality, Division
of Coastal Management, 127 Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7221)
during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to September 9, 2017 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in these matters will be
provided upon written request.

behalf of Dexter Johnson, requesting authorization under the Rules of the N.C. Coastal Resources
Commission for development activities at 2026 Scotts Hill Loop, adjacent to Middle Sound, in
Wilmington, Pender County. It was received as complete on August 7, 2017, and appears to be adequate
for processing at this time. The projected deadline for making a decision on your permit application is
October 21, 2017. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 7, 2017, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Secondary Road No. 1571, said Lot being shown in Hap Book No. 1 at
Page 33 in the Ponder county Registry, and being that same property
as shown in that deed recorded in Book 462 at Page 79 of the Pander
