Marina Expansion
This permit authorizes only the finger pier extensions, additional finger pier and 8 boatlifts, and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this marina without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.
No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which
the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.

The marina shall display a sign showing the location of the nearest pumpout facility, including other
;.: appropriate waste disposal information, at the entrance and exit from the main pier(s).
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
The authorized structure and associated activity shall not cause an unacceptable interference with
navigation.
This permit authorizes 1 additional slip for a maximum of 14 formalized boat slips.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-01305).
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-70728
PE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
An application processing fee of $400 was received by DCM for this project.

ITAC 246, LLC is applying for a CAMA Major permit to add a boat slip located at 300 Atlantic
Beach Causeway, Atlantic Beach located on West Canal of the Bogue Sound. The existing development
consists of 13 boat slips, of those 5 have boat lifts. There are seven floating finger piers (2 at 3.5' x 30'
and 5 at 3.5' x 215) and two fixed finger piers (2'-4' x 24'). The proposal is to shift the finger pier
between existing spaces 3 and 4, north approximately 4.25', widening to allow for an additional boat
slip. The shifted finger pier and the one located between existing spaces 5 & 6, 7 & 8, 9 &10 are to also
be extended 8' to an approximate length of 30'. These modifications will allow for the installation of
eight (8) boat lifts in spaces 3, 4, 5, 6, 7, 8 and 9 plus the additional space 3A.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Beach Causeway, in Carteret County.
Although processing of the application is nearing completion, additional time is needed for this

Hey Robb,
This marina has been around since before I started with CAMA. I have completed a few GP 2000 permits to reconfigure
the existing marina. Gregg has searched for major permits but couldn't find any. I also researched google photos and it's
been around at least since the early 90's. I am thinking this is one of the early marinas from early 80's or even possibly
before. I have been trying to do a deed search but haven't had any luck yet. It also could have been in another name.

The following is my assessment and consequent recommendations of the above referenced
proposal:
This proposal involves the addition of a 14' slip with a new finger pier, 3 finger piers
extensions and the addition of 8 boatlifts within the slip areas for the existing docking
facility. The development conforms to the guidelines set forth under 15A NCAC
07H .0208. The canals within this area are closed to shellfish harvest but are not
considered Primary Nursery Areas. Assuming that state and federal agencies concur with
the proposal; the District recommends the project be authorized as proposed, contingent
upon the following conditions:
All portions of the development shall be constructed as shown on plats dated
received by DCM on 5/9/f7 and shall remain within the existing docking facility
footprint.
Recommend posting a minimum of two "No Sewage or Overboard Discharge"
signs at the docking facility.

Consistency Determination: The request is consistent with/not in conflict with the 2008 Town of
Atlantic Beach Core Land Use Plan certified by the CRC on July 24, 2008.
Overview: The applicant is proposing to reconfigure an existing 13-slip marina to accommodate
an additional slip, for a total of 14-slips. The reconfiguration includes the extension of existing
finger piers to 30', the addition of a finger pier (3.5' x 30% and the installation of eight (8) 12x12
boatlifts at 300 Atlantic Beach Causeway along a man-made canal at 108 North Court., Atlantic
Beach Carteret County, North Carolina. Existing site improvements include a 13-slip marina, four
(4) boatlifts, fingers and pilings, a commercial building, and a driveway/parking area.
The project is in a Public Trust Area (PTA) Areas of Environmental Concern (AEC). The waters of the
canal are classified as SA/HQW, are closed to the taking of shellfish, and is not designated as a
Primary Nursery Area. There were no shellfish resources observed in the area, and the presence of
SAV was not noted.
Anticipated impacts resulting from this project are expected to include: the incorporation of 1,341
ft2 and the shading of 189ft2of open water. The placement of the pilings has the potential to result
in temporary impacts due to turbidity.
Basis for Determination:
The project site is in the Town of Atlantic Beach and is subject to the town's 2008 Land Use Plan.
The Future Land Use Map (FLUM) designates the site as Mixed -Use Commercial with an Urban
Waterfront Overlay Zone, and the subject AECs as "Conservation". Development within the
designated AECs is limited by CAMA regulations and development guidelines.

Land Use Policies: The following LUP policies may be applicable to this request

P.22 - The Town of Atlantic Beach supports 15A NCAC 7H for the protection of all AECs
P.29 - The Town of Atlantic Beach supports the construction of all marinas, docks, and piers which minimize
or eliminate adverse effects on coastal wetlands and subaquatic vegetation and comply with 15A NCAC
7H minimum use standards. Marina development standards are outlined on pages 73-76.
1.34 - The Town of Atlantic Beach will enforce/pursue the following actions to regulate floating homes and
both open water and upland marina development:

North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 300
Atlantic Beach Causeway in Atlantic Beach, NC adjacent to West Canal. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as
amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife
Coordination Act (48 Stat 401, as amended, 16 U.S.C. 661 et seq.).
The applicant proposes to reconfigure an existing 13 slip marina to accommodate 14 slips. To accomplish
this slip increase, a 3.5' by 30' floating pier is prosed to bisect Slip 3. Three floating pier extensions, 3.5'
by 8', are also proposed Nine boatlifts will be placed within the renovated area. The current facility
accommodates vessels from 30' to 50' in length. Water depths in the area are over -4' NWL. West Canal
is classified SA HQW by the Environmental Management Commission.
The NCWRC has reviewed the permit application and is not concerned with the increase of slips to 14 or
the installation of the 9 boat lifts. However, the installation of the 3.5' by 8' pier extensions will narrow
navigability within the canal and slips. Since the facility can already accommodate 30' by 50' vessels, we
are not sure the benefit of the extensions, especially within a narrow water body with large vessel use.

On June 9, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a
copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
June 16, 2017 has determined that the development activities proposed at this time will not pose a threat to surface
water quality from stonmwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

Carteret County. The project area is found by turning off Highway 70 East in Morehead City
(Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach Causeway
for approximately 2,500 feet. The entrance to the property will be located on the left and
across from Old Causeway Road.
The commercial property is 17,990 square feet in its entirety and has a shoreline length of
238'. The average elevation of the property is 5' to 6' above nhw and is developed with an
existing bulkhead, 13-slip docking facility with boatlifts (slips 1&2 and 11-13), fingers and
pilings, a commercial building and driveway/parking area. The project is adjacent to
commercial businesses to the east and west along the manmade canal. The upland vegetation
mainly consists of lawn grasses. The Division of Water Quality classifies the waters of the
canal as SA/HQW. This area is not designated as a Primary Nursery Area and is closed to the
taking of shellfish. The Town of Atlantic Beach's Land Use Plan classifies this area as
commercial with Conservation within the AECs. There were no shellfish resources observed
within the area. The existing docking facility accommodates boats typically from 30' to 50' in
length.
10) Proposed Development:
The applicant is proposing the reconfiguration of an existing 13-slip marina so they can add an
additional docking space for a total of 14 slips.
The applicant proposes to reconfigure the existing docking facility to accommodate a
proposed slip addition. This would increase the total number of slips to 14. They propose to
extend three existing finger piers (3.5' x 8' extension) within slip areas 5-9 to a total length of
30' from the existing floating platform (40' maximum (waterward) from the bulkhead). They
also wish to add a 3.5' x 30' proposed finger pier between proposed slip #3A and existing slip .
#4 by relocating the existing finger pier between slips 3 and 4 to the north approximately
4.25'. This would allow the construction of the additional boat slip. The final portion of the
project would be the installation of eight 12' x 12' boatlifts within slips 3-9 (includes
proposed slip 3A). All portions of the proposal would remain within the existing docking
facility footprint and would not encroach within the 15' riparian access line setback. The
water depths are -4' plus nlw depending on location.
9. Anticipated Impacts:
The slip addition (proposed 3A), proposed finger pier, boatlifts and finger pier extensions
would incorporate 1,341 ft2 and shade 189ft2 of open water area and increase the number of
docking spaces from 13 to 14. The placement of the pilings has the potential to result in
temporary impacts due to turbidity; Adverse impacts are not expected, due to water depths
within the area (4' plus nlw). There should be no undue interference to navigation from the
proposed development since the proposed work would remain within the existing docking
facility footprint.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development at 300 Atlantic Beach Causeway, Atlantic Beach, Carteret County. The complete
package was received on 5/9/17. The projected deadline for making a decision is 7/23/17. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 5/9/17, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

ITAC 246, LLC is applying for a CAMA Major permit to add a boat slip located at 300 Atlantic Beach
Causeway, Atlantic Beach located on West Canal of the Bogue Sound. To accomplish this an existing
finger pier is to be shifted north along the floating dock approximately 4.25' north. This finger pier and
three other finger piers are proposed to be extended 8', to a length of 30'. Eight of the slips along this
floating dock also propose to install lifts. The specifics of the proposed work are in the enclosed forms
and drawings.
As the adjacent riparian property owner to the previously mentioned project, I am required to notify
you of the development in order to give you the opportunity to comment on the project. Please review
the attached permit application and drawings.
Should you have any objections to this proposal, please send your written comments to Heather Styron,
Morehead City Headquarters, 400 Commerce Avenue, Morehead City NC 28557, within 30 days of your
receipt of notice. Such comments will be considered by the Department in reaching a final decision on
the application. No comment within 30 days of your receipt of this notice will be considered as no
