This permit, issued on Jannary 30, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Marina Facility
1) Unless specifically altered herein, this permit authorizes only the docks, piers, and other structures
and uses located in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
marina facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal
facility shall be installed and operable at any easily accessible location. The pumpout facility shall be
maintained and in operable condition for the life of the marina.
4) The manna shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrances and exits from each of the two main piers.
5) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a
representative of the Division to ensure that the required pumpout facility is in place and operable.
6) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
marina facility.
7) No portion of the authorized docking facility shall extend more than one quarter width of the waterbody.
Measurements to determine the width of the water body shall be made from the waterward edge of any
coastal wetland vegetation which borders the waterbody.
8) In order to ensure compliance with Condition No. 7 of this permit, and to satisfy requirements of the U.S.
Army Corps of Engineers, an as -built survey shall be conducted on the docking facility, and copies of the
survey provided to the U.S. Army Corps of Engineers (USACE) and Division of Coastal Management,
within 60 days of completion of construction of these portions of the project. At a minimum, this as -built
survey shall show the new docking facility; one quarter distance of the waterbody, USACE channel and
the USACE channel setback.
NOTE: Failure to provide the survey required in Condition No. 8 may result in a violation of this permit.
9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
11) This permit authorizes a maximum of 53 formalized boat slips.
12) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.

13) In accordance with commitments made by the permittee, and to allow for pu is SUM o the waters
located landward of the main docking structure, the portion of the northern access pier shall be elevated a
minimum of six feet above normal high water level, as depicted on the attached workplan drawing 4 of 5
dated 11/14/16.
14) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
15) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
16) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant shall
implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements within. The guidelines can be found at:

17) The permittee understands and agrees that, if future operations by the United States requires the removal,
relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice
from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby,
without expense to the United States or the state of North Carolina. No claim shall be made against the
United States or the state of North Carolina on account of any such removal or alteration.
18) 15A NCAC 07H .0208(b)(5)(D) of the Rules of the Coastal Resources Commission require that the no
more than 27 square feet of public trust area per one linear foot of shoreline adjacent to these public
areas shall be allowed for residential docking facilities. In order to ensure consistency with this
requirement, deed restrictions shall be placed on all waterfront lots with the subdivision dedicating the
entire shoreline of each lot to the proposed community access facility. The deed restriction shall further
state that no T's, finger piers, platforms, or decks shall be allowed off of the waterfront lots in the future
as long as the permitted access facility is in place. These deed restrictions shall be recorded with the
New Hanover County Register of Deeds, and copies of the recorded deeds provided to the Division of
Coastal Management, prior to the initiation of construction of the access facility.
Breakwater/Debris Deflector
19) The breakwater shall be marked with reflectors extending at least three feet above normal high water.
One reflector shall be placed on each end of the breakwater and one in the middle.
20) The authorized breakwater shall adhere to the alignment depicted on the attached workplan drawings.

Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environmental Quality, Land Quality Section, 127 Cardinal Drive
Extension, Wilmington, NC 28405.
Stormwater
21) The Division of Energy, Mineral & Land Resources (DEMLR) approval of this project under stormwater
management rules of the Environmental Management Commission is covered by way of Stormwater
Permit No. SW8-061026. Any violation of the permit approved by the DEMLR shall be considered a
violation of this CAMA permit.
Upland Development
22) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the 53-lot subdivision, all as expressly and specifically set forth in
the attached permit application and workplan drawings. Any additional land disturbing activities and/or
construction may require a modification of this permit. Contact a Division of Coastal Management
representative at (910)796-7215 for this determination.
General
23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management..
25) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit
NOTE: The permittee is advised that backflow prevention is required between public water systems and
waterfront facilities. Other requirements may apply if a well will serve the dock. Please contact
the Department of Environmental Quality -Public Water Supply Section at (910) 796-7215 for
additional information.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including, but not limited to, a special use
permit from New Hanover County.

Recommendations for State Permit — Hoosier Daddy, LLC for Sunset Reach Community Marina
The total square footage of the community marina was calculated as follows:

The following recommendations made by staff as a part of CAMA Major Permit #99-10 are consistent with the
findings by this staff for this application:
It is the staffs recommendation that the proposal to construct a community marina is CONSISTENT with the
Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use
Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas.
It is staff s recommendation that the proposal to construct a community marina is INCONSISTENT with the
Rule in 15 NCAC 7H.0208 (b) (5) (D) which states "marinas to be developed in waters subject to public trust
rights (other than those created by dredging upland basins or canals) for the purpose of providing docking for
residential developments shall be allowed no more than 27 square feet of public trust areas for every one linear
foot of shoreline adjacent to these public trust areas for construction of docks and mooring facilities. The 27
square feet allocation shall not apply to fairway areas between parallel piers or any portion of the pier used only
for access from land to the docking spaces." As proposed the community marina would exceed the allowable
square footage by approximately 1,260 square feet; however, this application is consistent with the total square
footage originally proposed and authorized through CAMA Major Permit #99-10. The applicant could reduce
the size of the proposed platforms to conform with this Rule.
It is staffs recommendation that the proposal to construct a community marina is INCONSISTENT with the
Rule in 15 NCAC 7H.0208 (b) (5) (H) which states "marinas shall be designed so that the capability of the
waters to be used for navigation or for other public trust rights in estuarine or public trust waters are not
jeopardized while allowing the applicant access to deep waters." As proposed the two (2) access piers would
limit the use of the public trust waters landward of the main spine floating dock. The applicant has stated that
the northern access pier would be elevated at least 6 feet above MEW so as to maintain public access on the
landward side of the marina. The southern access pier would be constructed to maintain a slope that would
preserve handicap accessibility. The area landward of the main spine floating dock and access piers would
incorporate an additional 72,000 square feet of Estuarine Waters. This application is consistent with the
dimensions originally proposed and authorized through CAMA Major Permit #99-10. The applicant could
reduce the incorporated area by constructing a single access pier and aligning the main spine landward 25-30
feet to the -5 feet water depth contour.
It is staff s recommendation that the proposal to construct a community marina is CONSISTENT with the Rule
in 15 NCAC 7H.0208 (b) (5) (M) which states "marinas shall post a notice prohibiting the discharge of any
waste from boat toilets and listing the availability of local pump -out services." As proposed the applicant would
display "no sewage discharge" signage at both ends of the main spine floating dock and a "pump -out available"
signage located adjacent to the pumpout facility.
It is staffs recommendation that the proposal to construct a community marina is CONSISTENT with the
Rule in 15 NCAC 7H.0208 (b) (6) (A) which states "docks and piers shall not exceed six feet in width. Wider
docks and piers shall be permitted only if the greater width is necessary for safe use, to improve public access,
or to support a water dependant use that cannot otherwise occur." As proposed the main spine floating dock
and floating dock spines associated with the slip configuration would be 8 feet in width. The proposed 8 feet
wide floating docks is necessary to provide ease of access to boaters and overall stability for the structure.
It is staffs recommendation that the proposal to construct a community marina is CONSISTENT with the Rule
in 15 NCAC 7H.0208 (b) (6) (J) (iii) which states "Pier and docking facility length shall be limited by: not
extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements
to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal
wetland vegetation that borders the water body. The one-fourth length limitation shall not apply in areas where
the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has
established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier
is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the
proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or
docking facilities, nor longer than one-third the width of the water body." Based on the submitted distances on
Sheet 1 of 6 the marina as proposed does not appear to exceed the'/4 width limitation. The applicant has aligned
the pier along the -5 foot contour in an effort to meet the quarter width.
It is the staff s recommendation that the proposal to construct a community marina is CONSISTENT with the
Rules of 15 NCAC 7H.0209 (d)(10)(D) which states "elevated, slatted, wooden boardwalks exclusively for
pedestrian use and six feet in width or less. The boardwalk may be greater than six feet in width if it is to serve
a public use or need." The applicant is proposing to construct two (2) access walkways within pedestrian
easements from the highground connecting to the proposed main spine floating dock. The submitted cross
section drawing of the proposed northern access walkway depicts an elevated walkway over the highground.
Any permit issued should include conditions that the portions of the walkway located within the Coastal
Shoreline AEC be elevated, slatted, wooden, and exclusively for pedestrian use and six feetinwidth or''less.

This office has no objections to the proposal to construct a eommunity marina provided it RFmsrtstf �vl4AP
other state and federal regulations. Any permit issued should include the following conditions:

[2] Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing,
all development/construction shall be located a distance of 30 feet landward of Normal High Water.
[3] No sewage, whether treated or untreated, shall be discharged at any time from boats using the facility.
Any sewage discharge at the facility shall be considered a violation of this permit for which the permittee
is responsible. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
[4] Prior to occupancy of any new slips authorized under this permit, a marina pumpout sewage disposal
facility will be installed and operable, and, maintained for the life of the marina

[8] The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with

within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
[9] This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of this facility without permit modification. No non -water
dependent uses of structures may be conducted on, in, or over public trust waters without permit
modification.
[10] No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
[11] The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
[12] The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the
U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
[13] This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
[14] In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
[15] Permanent reflectors should be attached to the breakwater structure in order to make it more visible during
hours of darkness or inclement weather.
[16] The construction of the proposed project shall be in compliance with all local, State and Federal
regulations and associated permit conditions.
[17] This permit authorizes a maximum of (53) boat slips. At no time shall more than (53) vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
NOTE: The potential exists for additional vessels to moor along the southern end of the main spine floating dock.
The applicant should include aspects of the design that would prevent vessels for becoming moored at
this location, such as, and hand rail, piling installation, etc.
NOTE: The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third -Party.
NOTE: The applicant should contact the local Health Department regarding their requirements for septic tank
installations (as required under 10 NCAC, 10A.1900, et. seq). For information concerning septic tank
and other onsite waste disposal methods, contact the New Hanover Environmental Health Department at
(910)798-6664.

NOTE: Future development on the permittee's property may require a modification of this permit. Contact a
representative of this Division at (910) 796-7215 prior to commencement of any such activity for this
determination.
NOTE: The entire length of shoreline for the tract was used to determine that allowable square footage for the
community marina, therefore the ability of lot owners to apply for individual pier permits should be
enforced through restrictive covenants of the subdivision and/or individual deed restrictions.
NOTE: The applicant's proposal to construct a 53-slip community marina along the Northeast Cape Fear
River is consistent with the Wilmington -New Hanover County Land Use Plan, so long as, the lots are
properly recorded with the rights to use the facility conferred by an easement/deed rights appurtenant
to the residential lot it is intended to serve. Any permit issued should state "no commercial activities
of any kind, including the commercial letting of slips to parties who are not residents of the
waterfront subdivision, shall be allowed within the confines of the facility and shall remain in effect
for the life of the facility."

CON ATION:
This project is consistent with the 2016 New Hanover unty Comprehensive Land
Use Plan. A
The applicant proposes to construct a 53-slip community marina along the Northeast
Cape Fear River for the residents of the Sunset Reach Subdivision. The project is located
at 1305 Rockhill Road in New Hanover County.
Areas of Environmental Concern (AFC's) impacted by the proposal are ES, EW and
PTA. Waters at the project site are classified as SC, Sw and are not open to the harvesting
of shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2016 New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection.
In general, New Hanover County allows development in Resource Protection classified
AECs, which is consistent with the State's minimum use standards. The Wilmington -
New Hanover County Land Use Plan contains some policies, which exceed the State's

Dear Mr. Yopp:
You have our approval, in accordance with the attached conditions and those listed below, to
construct a 53-slip open water marina within the Northeast Cape Fear River as described within
your application received by the Division on November 28, 2016. After reviewing your
application, we have decided that the impacts are covered by General Water Quality Certification
Number 3900 (GC 3900).
You should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your'project including (but not limited to) Erosion and Sediment Control,
Non -discharge, and storniwater regulations. Also, this approval to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration
of , the 404 Permit. This Certification can also be. found, on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
thefuture) exceed one acre of wetland or 15,0 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 211.0506 (h). This.approvaI requires you to. follow the
conditions listed in the attached certification and any additional conditions listed below.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you

given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name { I SA NCAC 02H .0501 and .0502).
2 Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 0211.0502 (b) and 15A NCAC 02H .0506.(4)]. The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3 Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion
control practices must be used to meet this standard. Turbidity curtains shall be used as
appropriate. Please notify this Office if any turbidity issues arise at 910.796.7215
This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project,
regardless of the expiration of this Certification.
The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [i SA
NCAC 021-1.0507 (c) and 15A NCAC 02H .05.06 (b)(2) and (c)(2)]
6 Continuing Compliance:
The applicant/pemrittee and their authorized agents shall conduct all activities in a
manner consistent with State water quality standards (including any requirements
resulting from compliance with 303(d) of the Clean Water Act), and any other.
appropriate requirements of State and Federal law. If the Division determines that such
standards or laws are not being met, including failure to sustain a designated or achieved
use, or that State or Federal law is being violated, 'or that further conditions are necessary
to assure compliance, than the Division may reevaluate and modify this General Water
Quality Certification. [15A NCAC 02H .0507(d)]

7 All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels;
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington
Regional Office at 910.796.7215 and after hours and on weekends call (soo) ass -ones.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H :0506 (b)(3), and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10 Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina. Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:
Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized. by this Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4.of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
htin://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the
OAH. A petition is considered filed when the original and one (1) copy along'with any
applicable OAH filing fee is received in the OAH during normal office hours (Monday through
Friday between 8:00 am and 5:00 pm; excluding official state holidays).The petition may be
faxed to the OAH at (919) 431-3100, provided the original and one copy of the petition along
with any applicable OAH filing fee is received by the OAH within five (5) business days

Hello, Heather.
The Applicant and I have been in contact with Ben Andrea (New Hanover County Planning and Zoning)
regarding this project. It was not Ben's intension to suggest that the CAMA permit should not be issued without
the SUP. In actuality, the County finds it beneficial for the CAMA permit to be in hand, when applying for the
SUP, as the permit ensures that all State and Federal regulations have been met. With that said, we request
that the DCM not suspend the project until a new SUP has been secured and that the project deadline remain
as noted in the notice of complete application, which is 1/30/17.
Should you or Doug wish to discuss this further, I would suggest a conference call. Ben, the Applicant and
myself are available Tuesday (1/3) afternoon. If this is necessary, please let me know, and I will arrange the
call.

I talked to Doug about this and we need to put this project on hold pending the SUP approval. I'II still receive comments
during this time, so it's really just suspending the "clock" until such time that we can ensure it's consistent at the local

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to
construct a 53 slip facility as authorized in expired permit #99-10. The surrounding waters are classified as
Primary Nursery Area (PNA), Anadromous Fish Spawning Area, SC, SW and are closed to shellfish harvest.
Water depths indicated in application range from -5ft to -20ft. The application states that submerged aquatic
vegetation and shellfish beds have not been observed in the area.
Comments made by the previous Specialist are still relative and were conditioned in Permit #99-10. The
marina is located in PNA habitat, which is very sensitive to bottom disturbing activities. PNAs are estuarine
waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile
and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food, protection, and proper
environmental conditions during vulnerable periods of their life history, thus protection of these areas are
imperative. Docking facilities have the potential to shoal after construction leading to decreased depths in
slip areas, and should be considered though the design process. Since this area is PNA, future requests to
dredge will be opposed by the DCM Fisheries Resource Specialist.

Thank you for the opportunity to comment on the above referenced CAMA application fora 53-slip community boating
facility at 1305 Rockhill Road.
The New Hanover County Board of Commissioners approved with conditions a Special Use Permit request for the
aforementioned community boating facility (Case S-583) in August 2008, The North Carolina Permit Extension Act kept
the special use permit valid until December 31, 2012. After that, the special use permit remained valid for two years and
expired on December 31, 2014. Because no construction activity for the project commenced during the special use permit
validity period, our office determined in March of this year that the special use permit was null and void, and the
development of the proposed community boating facility is contingent on an approval of a new special use permit by the
New Hanover County Board of Commissioners. A representative of the property owner was notified of this determination
via email on March 16, 2016.

New Hanover County. To locate the project site from the intersection of College Road (NC Highway 132) and
Kerr Avenue, travel north on N. Kerr Avenue. Kerr Avenue will merge with Bavarian Lane and continue to the
west approximately 2.5 miles crossing over Blue Clay Road. At the intersection with Castle Hayne Road
(Highway 133) turn right and follow for approximately 1.3 miles to Rockhill Road. Turn left onto Rockhill
Road and follow to the west approximately 1.75 miles. The project site is located at the end of Rockhill Road
adjacent to the Northeast Cape Fear River.
The project site is located on an approximately 28 acre tract previously owned by Rockford Partners, LLC and
currently owned by Hoosier Daddy, LLC. The property has approximately 1,551 linear feet of shoreline frontage
along the Northeast Cape Fear River. The project site has an average elevation of approximately 33 feet above
Normal High Water (NHW). Development on the project site has been limited to the clearing of upland
vegetation, installation of subdivision infrastructure such as sewer, electricity, roads and water, and one single
family residence. Proposed future development would be a 53-lot single-family residence subdivision and 53
slip docking facility. The project site has retained some highground vegetation consisting primarily of domestic
grasses and native trees including: Bald Cypress, Magnolias, Dogwoods, Pines and Oaks. The highground
slopes gradually to the edge of wetlands along the southern end of the property shoreline. The shoreline along
the majority of the project site is not easily accessible from the highground. Coastal Wetland vegetation exists
along the shoreline of the project site with a dense expanse located on the southern shoreline of the project site.
The area of Coastal Wetlands, along the southern shoreline, extends approximately 250 feet from the shoreline,
is triangular in shape and narrows in width to the north. This area consists primarily of mature Bald Cypress
and Coastal Wetland plants including: Giant Cord Grass (Spartina cynosuroides), Cattails (Typha spp.), Bulhush
(Scirpus spp.), and Sawgrass (Cladium jamaicense).
The site was previously operated as an equestrian farm with a barn and outbuildings that have since been
demolished. Existing structures on the property include an existing fixed pier with floating platform and
subdivision infrastructure including roads, storm water features and underground utilities. A proposed 53 slip
community marina was originally applied for for this site by Rockford Partners, LLC and was authorized through
CAMA Major Permit #99-10 on September 22, 2010. CAMA Major Permit #99-10 was then transferred to
Hoosier Daddy, LLC on November 13, 2014, and expired on April 10, 2015. Hoosier Daddy, LLC is seeking a
CAMA Major Permit for a proposed community docking facility that is identical to the use and dimensions of
what was originally authorized under CAMA Major Permit #99-10.
Minor modifications to the upland area have been made since the original permit was issued in 2010. Rockford
Partners, LLC received approval for clearing and grading by way of a New Hanover County Grading Permit
#76-06. State Stormwater Permit # SW061026MOD was also issued to Rockford Partners, LLC for the existing
impervious surfaces. Cape Fear Public Utility Authority has installed Municipal water services to each home
site. Sewer services have been installed for the subdivision, however, the applicant states the individual lots
have been approved for septic systems. Furthermore, the New Hanover County Environmental Health
Department has approved septic Improvement Permits for only 10 of the 53 lots and no septic system
Construction Permits have been issued. The adjacent riparian property to the north is developed, I-140 is located
to the south, and light residential development is present to the east. The applicant states that the proposed
project is not located in a National Historic District and does not involve a National Register listed or eligible
property; however, Nh533, Nh 534, Nh 535 all appear to be located on the subdivision highground of the project
site. Site Nh 532 also appears to be located within close proximity (approximately '/s mile) of the proposed
subdivision.
The Wilmington -New Hanover County LUP classifies the upland areas of the project site as Wetland Resource
Protection and the open water as Conservation. The waters of the North East Cape Fear River are classified as
SC, Sw by the NC Division of Water Resources (DWR). The NC Division of Marine Fisheries (DMF) has
designated this area of the NE Cape Fear River as Primary Nursery Area and the waters are closed to the

harvesting of shellfish. The presence of submerged aquatic vegetation and shellfish "11 a Ii W) C I TY
observed in this area of river. The applicant states that the -5 foot water depth contour is located
approximately 50 feet waterward of Normal High Water (NHW). The water depths slope to a depth of -20 feet
approximately 120 feet waterward of NHW. The USACOE federally maintained navigation channel is
located approximately 250-300 feet waterward of the NHW level. The width of the river in the location of
Sunset Reach ranges from approximately 775 feet (along the southern portion of the property) and narrows to
approximately 625 feet in width (along the northern portion of the property).
Development Proposal
Hoosier Daddy, LLC is proposing to construct a 53-slip community marina along the Northeast Cape Fear
River for the residents of the Sunset Reach Subdivision. Existing development on the site has been limited to
subdivision infrastructure including: roads, utilities, and land clearing resulting in approximately 367,347
square feet of disturbance (8.43 acres). No additional highground disturbance is proposed at this time,
although one single-family residence has been built. The proposed individual lot boundaries and 20 foot
pedestrian access easements to the north and south are shown on the submitted drawings; however, they have
not yet been recorded. The proposed 53-slip docking facility would be accessed by two 20-foot wide
pedestrian access easements located on the north and south portions of the shoreline. The proposed access
easement on the north portion of the project site would be located between the lots 18 and 19; the northern
access pier would originate from this easement. The proposed access easement on the south portion of the
project site would be located between lots I and 2; the southern access pier would originate from this
easement. Currently two (2) stormwater retention basins have been constructed within the 20' pedestrian
access easement. The proposed access piers appear to be crossing these features although the applicant has not
shown these features on the submitted drawings for the marina (Sheets 1-3). The access walkway located
between Lots 18 and 19 along the northern portion of the project boundary, would measure 6 feet in width and
332 feet in length, with approximately 50 feet extending over water. The northern access pier would connect
via ramp to a main spine floating dock, extending north to south, parallel to the shoreline, and measuring
approximately 972 feet in length and 8 feet in width. On the northern most end of the main spine floating dock
is a proposed 53 feet long by 16 feet wide platform located adjacent to the proposed pump out station and
canoe/kayak launch area of the main spine floating dock. Extending in a westerly direction and perpendicular
from the main spine floating dock are four (4) proposed floating dock spines with "T'- heads and associated
forger piers that would make up the proposed 53-slips. The northernmost floating dock spine would be
oriented perpendicular to the main spine floating dock and would measure approximately 97 feet in length and
8 feet in width. As proposed, the northernmost floating dock spine would have a "T" - head oriented parallel
to the shoreline measuring 6 feet in width and 79 feet in length. The northernmost dock would also consist of
four (4) forger piers, oriented perpendicular to and evenly distributed on the north and south sides of the
floating spine. The proposed forger piers on the northern most dock would each measure 34 feet in length and
3.5 feet in width, would be spaced thirty feet apart and six (6) mooring piles would designate the slips
(numbered 1-14). Moving to the south, the second floating dock spine, oriented perpendicular to the main
spine floating dock, would measure approximately 92 feet in length and 8 feet in width. As proposed this
floating dock spine would have a "T" head oriented parallel to the shoreline measuring 6 feet in width and 89
feet in length. The second dock would also consist of four (4) forger piers, oriented perpendicular to and
evenly distributed on the north and south sides of the floating spine. The proposed forger piers on the northern
most dock would each measure 39 feet in length and 4.5 feet in width, would be spaced fifteen to thirty feet
apart, and six (6) mooring piles would designate the proposed slips (numbered 15-26) within the finger piers.
Moving to the south, the third floating dock spine, oriented perpendicular to the main spine floating dock,
would measure approximately 109 feet in length and 8 feet in width. As proposed, this floating dock spine
would have a "T"- head oriented parallel to the shoreline measuring 6 feet in width and 89 feet in length. The
thud dock would also consist of four (4) forger piers, oriented perpendicular to and evenly distributed on the
north and south sides of the floating spine. The proposed forger piers on the third dock would each measure
39 feet in length and 4.5 feet in width, would be spaced thirty feet apart, and six (6) mooring piles would
designate the proposed slips (numbered 27-40) within the forger piers. Moving to the south, the fourth
floating dock spine, oriented perpendicular to the main spine floating dock, would measure approximately 121

feet in length and 8 feet in width. As proposed this floating dock spine would have a "T"-head oriented
parallel to the shoreline measuring 6 feet in width and 114 feet in length. The fourth dock would also consist
of four (4) finger piers, oriented perpendicular to and distributed on the north and south sides of the floating
spine. The proposed finger piers on the north side of the fourth dock would each measure 44 feet in length and
5 feet in width, would be spaced 37 feet apart, and three (3) mooring piles would designate the proposed slips
(numbered 41-47) within the finger piers. The proposed finger piers on the south side of the fourth dock
would measure 59 feet in length and 6 feet in width, would be spaced approximately 45 feet apart, and two (2)
mooring piles would designate the proposed slips (numbered 48-53) within the finger piers. Located on the
landward side of the main spine floating dock adjacent to the four (4) floating spines would be associated
transformer platforms approximately 90 square feet. Approximately 350 linear feet of the southern portion of
the main spite floating dock could potentially provide mooring for additional vessels. The applicant has not
provided any information in the application that references how vessels will be prevented from utilizing this
area of the floating dock for mooring. At the southernmost end of the main spine floating dock is a proposed
36.2 feet long by 15.5 wide floating platform. The platform would be connected via ramp to a proposed 16
feet long by 16 feet wide fixed platform. The proposed platform would be constructed at the waterward end to
the southern fixed access walkway. The access walkway originating from the highground, between lots 1 and
2, would measure approximately 325 feet in length and 6 feet in width. Midway along the access walkway
would be a proposed 6 feet wide by 25 feet long hexagonal shaped "golf -cart pass -a -round". The applicant has
aligned the pier to avoid the Cypress trees and has stated that it is their intention "to avoid, to the greatest
extent practicable, the cutting of cypress trees" (see Narrative). The applicant is also proposing to construct a
150 feet long by approximately 2 feet wide debris deflector adjacent to the platform on the north end of the
main spine floating dock. The proposed debris deflector would be located approximately 90 feet waterward of
NHW at the closest point and approximately 175 feet waterward of NHW at is most waterward point. The
proposed debris collector would be constructed of vertical pilings with horizontal foam filled and empty
dredge pipe, the dredge pipe would be attached to the pilings, float at water level, and extend approximately
3.5 feet below the water level. The vertical support pilings would have elevated solar powered navigation
lights and would be painted along the water level with reflective paint. As proposed, the breakwater would not
extend waterward of the proposed marina. As proposed, the marina would extend approximately 170 feet at
the northernmost dock and approximately 175 at the southernmost dock. The submitted work plan drawing
(see Sheet 1 of 6) indicates the width of waterbody at the northern property boundary to be approximately 625
feet and at the southern property boundary the width is approximately 775 feet. The '/4 channel width setback
(see Sheets 1, 2, and 3 of 6) shown on the submitted work plan drawings appears accurate. The distances
submitted were verified in the field on May 27, 2010 and an additional distance was meas
boundary between lots 15 and 16 indicates the width of waterbody in this location 3
feet. As proposed, the marina does not appear to exceed the''/4 width limitation an has proposed to align the
main spine floating dock along the -5 foot contour. DEC 01 W6
Anticipated Impacts M1-lll CITY
Hoosier Daddy, LLC is proposing to construct a 53-slip community marina alon�hbt Cape ear
River for the residents of the Sunset Reach subdivision. The constructed subdivision infrastructure has
disturbed approximately 367,347 square feet (8.43 acres) of highground and one single-family residence has
been constructed. The submitted workplan drawing (sheet 1 of 6) shows "future development" at the entrance
to the subdivision. The applicant has not provided any information regarding future expansion plans for the
53-lot subdivision. The proposed breakwater structure would extend approximately 175 feet into the
waterbody and would incorporate 300 square feet. Due to the linear design and floating pipes, no bottom or
shading impacts are anticipated, aside from the vertical support pilings. The proposed community marina
would impact Coastal Wetlands, Public Trust Waters and Estuarine Waters. The proposed northern access
pier would impact approximately 1,722 square feet of highground. As proposed, the northem access pier
would shade approximately 120 square feet of Coastal Wetlands and approximately 150 square feet of Open
Water. The proposed southern access pier would impact approximately 1,290 of highground. As proposed,
the southern access pier and golf -cart -pass -around would shade approximately 11908 square feet of Coastal
Wetlands. The proposed marina platforms and floating structures would result in the shading of approximately

17,516 square feet of Open Water. The proposed community marina would incorporate approximately
43,137 square feet of Estuarine and Public Trust Waters. An additional area of open water, landward of the
main spine floating dock, would be usurped by the proposed alignment of the access piers resulting in the
incorporation of approximately 72,000 additional square feet of Estuarine and Public Trust Waters. As
proposed, the marina does not appear to exceed the ''/< width limitation and has proposed to align the main
spine floating dock along the -5 foot contour. As proposed, the marina would provide maximum of 53-boat
slips; however, the southern end of the main spine floating dock could potentially provide moorings for
additional vessels. The applicant's proposal to construct a 53-slip community marina along the Northeast
Cape Fear River is consistent with the Wilmington -New Hanover County Land Use Plan so long as the lots are
properly recorded with the rights to use the facility conferred by an easement/deed rights appurtenant to the
residential lot it is intended to serve.

Existing Conditions:
The property has approximately 1,551 linear feet of shoreline along the Northeast Cape Fear River and has an
average elevation of 33 feet above normal high water (NHW). The waters of the Northeast Cape Fear River, in the
vicinity of the proposed project, are classified as Class C;Sw, by the Division of Water Resources. In addition,
these waters have been designated as Primary Nursery Area (PNA), by the Division of Marine Fisheries. The site
abuts a Federal Navigation Channel. The setback from the edge of this channel is 52'. Water depth at the
waterward edge of the marina structure is approximately -25.0' at normal low water. USACE Section 404 and
Section 10 wetlands (i.e. coastal wetlands) are located within the property boundaries along the shoreline. These
wetlands were verified with the USACE's authorization of the General Permit. To SEGi's knowledge, no changes
to the wetland lines have taken place since the original permit was issued.
To date, the buildable upland area of the project has been cleared of vegetation, but development has been limited
to subdivision infrastructure, such as roads, sewer, water and electric lines, as well as the stormwater management
system. One house has been constructed. No land disturbing activities associated with the water dependent
structures have taken place.
There still remains an old wood dock, measuring approximately 6' x 80', near Lot 15, as well as several timber
pilings located waterward of the structure. All existing water dependent structures will be removed during the
construction of the docking facility.
Proposed Project:
The proposed project is identical to that which was previously authorized by the agencies and consisting of the
following work:
• Grading and other land disturbing activities associated with constructing single family dwellings on 53
lots within the existing Sunset Reach Subdivision;
• Construction of a 53-slip marina facility, with kayak/canoe launch and temporary tie-up for the pump out

station, temporary golf cart parking platform, and 3 vehicular parking spaces (486 SF BUA) within the
common area;
• Golf cart access boardwalk, with 2 uncovered sitting areas and golf cart parking area; and
• Installation of a 150 linear feet breakwater (debris collector).
No additional highground disturbance is being proposed, at this time, however, construction of single family
homes is anticipate to start in the near future. The work is not proposed to take place within the 75' Estuarine
Shoreline AEC.
The proposed 53-slip marina will be accessed by two (2) 20' wide pedestrian access easements located on the north
and south ends of the shoreline. The northern access will be located between lots 18 and 19, while the southern
access will be located between lots 1 and 2. All proposed pile supported structures will be elevated at least 3' above
the substrate, in areas where crossing USACE Section 404 or Section 10 Wetlands. The Applicant will position the
two access piers in such a way as to avoid, to the greatest extent practicable, the cutting cypress trees. The

A debris deflector (breakwater) will be located along the northern side of the marina to help protect vessels from
large debris that could potentially flow with the prevailing tide. The breakwater will be made of three 10 inch
construction grade dredge pipes with composite block spacers in between. The pipe closest to the surface of the
water will be filled with foam to allow for floatation. The piping will be anchored by timber pilings and will extend
approximately 3.5 ft. below the surface of the water. Timber pilings will be spaced every 24 ft. and will all have

Known Changes with the Project
During the time when the original CAMA Permit application was under review and subsequently approved, septic
systems and community water were proposed. However, the Cape Fear Public Utility Authority has since installed
sewer and water in this area These lines have been installed throughout the Sunset Reach Subdivision. This is the
only known change to the proposed project.
Threatened and Endangered Species and Critical Habitat
The US Fish and Wildlife Service (FWS) identify the site as potentially providing suitable habitat for the
following: American Alligator (Alligator mississippiensis); American eel (Anguilla rostrata); shormose sturgeon
(Acipenser brevirostrum); West Indian manatee (Richechus manatus) and the Northern Long-eared Bat (Myotis
septentrionalis).
Impact concerns, for all but the Northern Long-eared Bat, were addressed within the previously submitted CAMA
Major Application packet. Issuance of the CAMA Major Permit #99-10 suggests that the project, as proposed,
would not have an effect on those species.
With regard to the Northern Long-eared Bat, while the range of the bat extends into New Hanover County, it is not
anticipated that the bat is utilizing the project area of the site for habitat, as large trees have already been removed
from limits of disturbance. According to the NWS's Fact Sheet, the designation of critical habitat is not prudent in
the protection of the bat.
Archeological Evaluation
Land Management Group, Inc. (LMG) performed an archeological remote sensing and diving survey in the area of
the proposed marina. This report was submitted as part of the previous CAMA Major Permit Application. As a
result of LMG's assessment, it was found that the proposed project would not have an effect on historical or
archeological resources. Support of the agencies' acceptance of this documentation is based on the issuance of the
of the DCM's letter indicating no further environmental review would be necessary. A copy of the letter should be
in the DCM's file. Copies will be furnished upon request.
Stormwater
This project was approved under State Stormwater Project Number SW8061026. The stormwater permit has been
transferred into the Applicant's name. To SEGi's knowledge, the proposed plan has not changed, with regard to
stormwater management, and the approved stormwater management system has been installed and is operating as
intended.
Adjacent Property Owner Information
As part of the CAMA Major Permit process, it is required to notify the applicable adjacent riparian property
owners (ARPOs). According to the New Hanover County GIS Mapping System, the northern adjacent riparian
property is listed as Parcel ID R02400-002-025-000 and owned by William P. Loughlin Et al, and the southern
adjacent riparian property is listed as being owned by the North Carolina Department of Transportation. Notices
have been submitted to these two property owners. Either waivers or US Postal Service Certified Green Cards will
be submitted as soon as they are received.

Mr. James Yopp; acting agent for Hoosier Daddy, LLC is requesting the transfer of State Permit No. 99-
10, which was originally issued to Rockford Partners, LLC on September 22, 2010. State Permit No. 99-10
authorized the construction of a 53-slip community marina for a new subdivision (Sunset Reach). To date, the
construction of the marina has not been initiated; however, the infrastructure of the new subdivision appears to
have been constructed. State Permit No. 99-10 was extended in accordance with Session Law 2009-406, and
amended by Session Law 2010-177, the Extension Act. State Permit No. 99-10 is due to expire on April 10,
20t5.
Mr. Yopp is requesting State Permit No. 99-10 be transferred into Hoosier Daddy, LLC and states that
the new owner intends to utilize the permit for the purposes for which is was issued, and in compliance with its
terms and conditions, without modification except as previously approved and listed on the permit. Mr. Yopp
has included a check (ck no. 1108) in the total amount of $100.00 for the processing of the transfer request.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Yopp:
You have our approval in accordance with the attached conditions, to construct a 53 slip community
marina along the Northeast Cape Fear River for the residents of the Sunset Reach subdivision as
described in your CAMA Major application received by the DWQ on June 15, 2010. After reviewing
your application, we have decided that the impacts are covered by General Water Quality Certification
Number 3642 (GC3642). This certification may also be viewed on our webshe at
http://h2o.onr.state.ne.us/ncwetiands. This Certification allows you to use the Regional General #
1980000291 Permit when issued by the US Army Corps of Engineers. In addition, you should obtain or
otherwise comply with any other required federal, state or local permits before you go ahead with your
project including (but not limited to) Erosion and Sediment Control, Non -discharge, and stormwater
regulations. Also, this approval to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the attached RECEIVED
certification and any additional conditions listed below.

2) Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B. 0200. Appropriate sediment and erosion control practices must be
used to meet this standard.
3) Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached form and
return it to the 401/Wetiands Unit of the Division of Water Quality.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties.
If you do not accept any of the conditions of this certification, you may ask for an adj udicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition, which conforms to Chapter 150D of the North Carolina General Statutes to the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its
conditions are final and binding unless you ask for a hearing.

Marina Facility
1) Unless specifically altered herein, this permit authorizes the docks, piers, and other structures and
uses located in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
marina facility without permit modification. No non -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage
disposal facility shall be installed and operable at an easily accessible location. The pumpout facility
shall be maintained in operable condition for the life of the marina.

date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department

3) The marina shall display a sign showing the location of the on -site pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the train pier.
4) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with
representative of the Division to ensure that the required pumpout facility is in place and operable.
5) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. New dredging in any manner, including "kicking' with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
6) No portion of the authorized docking facility shall extend more than one quarter the width of waterbody.
Measurements to determine width of the water body shall be made from the waterward edge of any
coastal wetland vegetation which borders the water body.
7) In order to ensure compliance with Condition No. 6 of this permit, and to satisfy requirements of the
U.S. Army Corps of Engineers, an as -built survey shall be conducted on the docking facility, and copies
of the survey provided to the U.S. Army Corps of Engineers (USACE) and Division of Coastal
Management, within 60 days of completion of construction of these portions of the project. At a
minimum, this as -built survey shall show the new docking facility, t/a distance of the waterbody,
USACE Channel and USACE channel setback.
NOTE: Failure to provide the survey required in Condition No. 7 may result in a violation of this permit.
8) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
9) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
10) In accordance with commitments trade by the permittee, and to allow for public access to the waters
located landward of the main docking structure, the portion of the northern access pier shall be elevated
a minimum of six feet above normal high water level, as depicted on the attached workplan drawing 5 of
6 dated 3/3/10.
11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

ADDITIONAL CONDITIONS
13) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the marina facility shall be considered a violation of this
permit for which the petmittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
14) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
15) This permit authorizes a maximum of fifty-three (53) formalized boat slips.
16) The breakwater shall be marked with reflectors extending at least three feet above normal water level.
One reflector shall be placed on each end of the breakwater and one in the middle.
17) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Environment and Natural Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
Stormwater
18) The Division of Water Quality approval of this project under stormwater management rules of the
Environmental Management Commission is covered by way of Stormwater Permit No.
SW061026MOD, which was issued on 12/5107. Any violation of the permit approved by the DWQ
shall be considered a violation of this CAMA permit.
General
19) In order to ensure compliance with the New Hanover County Land Use Plan, each individual slips shall
be tied by an easement appurtenant to the residential lot it is intended to serve. Each easement shall be
recorded with the New Hanover County Register of Deeds, and copies of each of the recorded deeds
provided to the Division of Coastal Management, prior to the initiation of construction of the marina
facility.

21) Unless specifically altered herein, any mitigative measures or environmental commitments specifically
made by the applicant in the Environmental Assessment for this project shall be implemented, regardless
of whether or not such commitments are addressed by individual conditions of the permit and any
subsequent modifications.
22) The federally endangered West Indian manatee (Trichechus manatus), has been reported in North
Carolina waters. In order to protect the manatee, all work should be done between November 1 and
May 31. If work must be done outside of this time frame, the permittee shall adhere to enclosed
guidelines, entitled "Precautions for General Construction in Areas Which May Be Used by the West
Indian Manatee in North Carolina'.
23) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
25) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit
modification.
Upland Development
26) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the 53-lot subdivision, , all as expressly and specifically set forth in
the attached permit application and workplan drawings. Any additional land disturbing activities and/or
construction may require a modification of this permit. Contact a Division of Coastal Management
representative at (910)796-7215 for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a stormwater
management permit from the Division of Water Quality.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for development of
your client's property located at 1305 Rockhill Road, adjacent to the Northeast Cape Fear River, in Castle Hayne, New
Hanover County. It was received complete on November 16, 2016, and appears to be adequate for processing at this time.
The projected deadline for making a decision is January 30, 2017. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 16, 2016, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed
you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You
should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples
would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in
an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or
Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my
field report and/or comments from reviewing agencies.

Division of Coastal Management's notification of incomplete application for the above referenced project,
which requested the following information be submitted:
1. MP-1 Form - Primary applicant is written as "Rockford Partners, LLC" but the cover letter states
"Hoosier Daddy, LLC" as the applicant. Please clarify business, name, and address.
The form has been revised to reflect Hoosier Daddy, LLC is the Applicant.
2. Attachments and Appendices not labeled, inaccurately labeled, or not reference accurately.
All attachments and appendices have correctly and adequately labeled.
3. Submitted project plans are copies and not to scale. Must submit original copies of proposed project
plans that are to scale.
One set of full sized plans have been included with this submittal. Additional copies of the
plans will be submitted once the DCM considers the application complete.

The 20' north and south easements have not been recorded. These easements are technically
stormwater drainage easements, but will also serve as access easements to the marina
structure. The easements will be recorded concurrently with the recordation of the lots.
10. MP4 1(c),(d), and (e) reference an "MP 4 Attachment" that would reference the type and dimensions
of the proposed structures. There is no such attachment included in this application.
This denotation has been removed.
11. Please indicate dimensions of all proposed structures for this project. If structures are to remain the
