Shoreline Stabilization - Bulkhead
The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM
within a maximum of 30 days prior to the new expected start of construction.
The bulkhead shall be constructed prior to any backfilling activities.
The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.

ADDITIONAL CONDITIONS
The fill material shall be clean and free of any pollutants except in trace quantities.
All backfill material shall be obtained from a high ground source and confined behind the permitted
backfill material is to be placed within 30 feet of the normal water line, except that which will be

Sedimentation and Erosion Control
A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.

No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
This permit does not authorize the creation of any formalized boat slips.

The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-02152), which was issued on 11/27/17.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-12.29.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

This letter is in reference to your application for a Coastal Area Management Act Major Permit
to undertake development activities to construct a bulkhead at the above referenced property, in
Chowan County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make February 17, 2018 the new deadline for reaching a decision on your request.

The applicant would like to construct a replacement bulkhead along -270' of shoreline adjacent to, and
landward of, the remnant bulkhead constructed in 1974. The proposed replacement bulkhead would be an
average of 7.5', and a maximum of 11', waterward of NWL. The total area of anticipated shallow bottom fill will
be -2,025 square feet (so.
The landward extent of disturbance to backfill and slope the bank along the proposed bulkhead will be -50'
as needed to slope the bank to an approximate 3:1 slope along 320' of shoreline. The total area of high ground
disturbance anticipated in conjunction with the bulkhead construction is-16,000sf.
I have reviewed the rules as they pertain to marinas and bulkheads, and would like to offer the following:

(b) Specific Use Standards
(7) Bulkheads:
(A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of
normal high water or normal water level;

(B) Bulkheads shall be constructed landward of coastal wetlaNH§ 1H order to avoid significant
adverse impacts to the resources;

(C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of
Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project
involving excavation from a non -upland source, the material so obtained may be contained
behind the bulkhead;
Consistent: Applicant will obtain backfill from a high ground source located on the
applicant's property.
(D) Bulkheads shall be permitted below normal high water or normal water level only when the
following standards are met:

(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features,
e.g. steep grade bank, which will cause the applicant unreasonable hardship under the
other provisions of this Rule; Consistent
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of
application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship
resulting from the unusual geographic or geologic features;

Dear Mr. and Mrs. Hollowell:
The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of Engineers (USACE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4097 (GC 4097), the impacts described in your
application do not require written authorization to utilize GC 4097. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding
official state holidays).

SUBJECT: Major Permit Request by David and Glenda Hollowell to install 270 linear feet of
replacement bulkhead on the Chowan River at 537D Wingfield Road, in Tyner,
Chowan County.
DATE: October 9, 2017
Consistency Determination: The request is consistent with/not in conflict with the Chowan
County/Town of Edenton 2008 Core Land Use Plan certified by
the CRC on July 24, 2008.
Overview: The subject property consists of two (2) tracts totaling 30.98 acres with a combined
661 linear feet of shoreline along the Chowan River. Water depths range from -2 to -2.5 feet at
distances of 5 to 25 feet offshore. The shoreline bank is heavily vegetated and is elevated 16 to
17 feet above Normal Water Level (NWL). The property is located primarily outside of the
floodplain, with AE floodzone and ".2 percent annual chance of flooding" areas along the
shoreline.
Existing site improvements consist of two (2) single family houses, one of which is located within
55 feet of NWL. The existing shoreline improvement consists of approximately 270 linear feet of
derelict bulkhead located 5 feet to 25 feet waterward of NWL. Erosion is occurring at the
shoreline. The erosion appears to be caused by fast moving water draining from adjacent farm
fields during severe rain events. The property is used primarily for agriculture, but residential and
commercial fishing uses also exist. Boats are currently moored along an unprotected shoreline
and tied to a tree along an adjacent property to the south.
Installation of 270 linear feet of replacement bulkhead is proposed. The replacement will be
located landward of the remnant bulkhead, an average of 7.5 feet and a maximum of 11 feet
waterward of NWL. Backfill will be provided as needed to slope the bank to an approximate 3:1
slope along 320 feet of shoreline.
The waters of the Chowan River in this area are classified as SB and are closed to shellfish taking.
No Submerged Aquatic Vegetation (SAV) is located within the project area. A review of potential
historic or archaeological resources was not provided.

Anticipated Impacts resulting from this project are expected to include: the filling of 2,025 sq. ft.
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), and; the
cutting/filling of approximately .37 acre of Estuarine Shoreline AEC.
Basis for Determination:
The Edenton/Chowan County Future Land Use Map identifies the project site as "Residential
Agricultural". As indicated on Page 135, "...coastal wetlands, estuarine waters, estuarine
shoreline, public trust areas, and 'Section 404' wetlands..." are considered to be part of the
"Conservation/Open Space" designation.
Residential Agricultural Classification. This designation is intended to delineate
lands where the predominant land use is scattered, low density residences
dispersed among farm land and open spaces.
Conservation/Open Space. This designation is intended to delineate areas where
traditional land uses are not desirable or expected to develop. Commercial and
industrial uses that are water dependent and which cannot function elsewhere or
are supportive of commercial fishing are permissible uses in Conservation/Open
Space -designated areas. The County's goals and polices support the continued use
of land in (this designation) for appropriate uses that are compatible with the fragile
nature of the Conservation/Open Space areas.
Definitions of keywords are provided on page 115 of 233. These words include "Support: Supply
the needed staff support, policies, and financial assistance at all levels to achieve the desired
goal."
The following LUP policies may be applicable to this request.

Project Setting
David and Glenda Hollowell's property is located at 537D Wingfield Road (SR1228), in Tyner,
Chowan County. The property consists of two tracts totaling 30.98 acres with-661linear feet
of shoreline along the Chowan River. The property is zoned Agricultural, with a single family
residence within 55' of normal water level (NWL). Use of the property is for residential,
agricultural and commercial fishing. A second dwelling is location on the property 1,500'
landward of the project site. Approximately 17 acres of the property is in agriculture (cotton).
Vegetation on the property includes, but is not limited to, cotton, american sycamore, (Platanus
occidentalis), bald cypress (Taxodium distichum), tulip poplar (Liriodendron tulipifera), loblloy
pine (Pinus teada), dogwood (Comus florida), river birch (Betula nigra), greenbrier (Smilax
rotundifolia), poison ivy (Toxicodendron radicans), pokeweed (Phytolacca americana), spotted
spurge (Chamaesyce maculata), carolina jasmine (Gelsemium sempervirens), cat brier (Smilax
rotundifolia), poison ivy (Toxicodendron radicans), wild grape vine/riverbank grape (Vitis
riparia), domestic grasses and omamentals.
Located between 5' and 25' from NWL is a derelict bulkhead constructed around 1974. Mr.
Hollowell used the bulkhead are for staging a commercial fishing business until the bulkhead
failed. Based on available aerial photographs the bulkhead started experiencing severe failure
around 2009. Within the last year there have been three severe erosion events along the bank
behind the applicant's dwelling from heavy rain (The most recent event being in August of this
year). One area of failure in the bank/shoreline is within 20' of the stairs to the applicant's
residence.
There are no pier structures or docks located along the applicant's shoreline. Currently Mr.
Hollowell moors his boat along an unprotected shoreline (tied to a tree) along an adjacent
property to the south, belonging to his son. The closest bulkhead to the applicant's north of the
property is -730', and to the south is -955'.
The elevation of the bank around the dwelling is-16717' above NWL. Heavy vegetation along
the shoreline has helped impede some erosion. It appears that the cause of the erosion is from
fast moving water coming from the farm fields on the landward side of the dwelling, during
severe rain events.
Water depths along the old derelict bulkhead range from -2' to -2.5'. The water bottom is a fine
silty sand. There is no submerged aquatic vegetation within the propcR &Dlhere
are no wetlands along the project site.

Development Proposal
The applicant would like to construct a replacement bulkhead along QT9' 8f s e adjacent
to, and landward of, the remnant bulkhead constructed in 1974. The proposed replacement
bulkhead would be an average of 7.5', and a maximum of 11', waterward of NWL. The total
area of anticipated shallow bottom fill will be -2,025 square feet (sf).

The landward extent of disturbance to backfill and slope the bank along the proposed bulkhead
will be —50' as needed to slope the bank to an approximate 3:1 slope along 320' of shoreline.
The total area of high ground disturbance anticipated in conjunction with the bulkhead
construction is—16,000sf.
Anticipated Impacts
1) Filling of 2,012sf of shallow bottom (previously high ground).
2) The loss of 2,025sf of shallow water habitat.
3) Approximately 16,000sf of high ground disturbance from cut and fill activities associated
with the construction of the bulkhead.
4) Temporary turbidity can be anticipated in and adjacent to the work area during
construction.

Narrative
I am requesting a permit to construct a bulkhead along approximately 27C' of shoreline on the Chowan
River. There is a failed bulkhead along this alignment that is between 5' and 20' waterward of my
eroding shoreline. Recent heavy rains have caused the bank to fail in at three places. One area of bank
failure is approximately 20' from the back steps of my house. The elevation at my house is between 16'
and 18' above normal water level.
The proposed replacement bulkhead is landward of the old bulkhead and would be an average of 7.45'
(maximum of 11'). There are two large sycamore trees along the bank that we would like to save. To
remove the trees would mean work and costs that are excessive given the elevation and limited access
to behind the house.
Water depth along the old bulkhead are between -2' and -2.5'. There is no vegetation growing in the
water within the area that I am proposing the new bulkhead.
I am a commercial fisherman, and have used the property for commercial fishing for over 20 years. I
would like to replace the bulkhead and reestablish the bulkhead so that I can tie my boat up behind the
house for easy access. I would also like to lower the steep bank and grade it back to approximately a 3 to
1 slope to better protect my home.

I am writing to notify you that I am applying for a permit to build a bulkhead in front of my property at
537 D Wingfield Road, Tyner, NC. The bulkhead I am proposing would be 304 feet long with a maximum
of 21 feet waterward of the normal water level (NWL). I am proposing that this run along an existing
alignment. The shoreline along the existing alignment is approximately 25 feet above NWL and has
failed in two sections. One failed section is 19 feet from my home and the other is 70 feet from my
home. This is a major concern for our family and we would like to rectify this issue.
The old alignment was trenched through clay in the 1970's. Construction of the bulkhead would
reestablish a previous working shoreline for my fishing operation. If you have any questions or concerns

The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of your property located 537D
Wingfield Road in Chowan County. It was received complete on September
19, 2019, and appears to be adequate for processing at this time. The
projected deadline for making a decision is December 3, 2017. An additional
75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th
day.
If this agency does not render a permit decision within 70 days from
September 19, 2017, you may request a meeting with the Director of the
Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt
of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the
location of the proposed development. Enclosed you will find a "Notice of
Permit Filing postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would
be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice

The NC Department of Environmental Quality hereby gives public notice as
