Hardee,1720 Village Point Road SW, Shallotte, NC 28470 Authorizing development in Brunswick County adj. to the Shallotte River, at 1720 Village Point Road SW, Shallotte , as requested in the permittee's application dated 9/14/17 (MP-1) & 9/15/17 (MP-4), incl. attached workplan drawing (1), dated 8115/17. This permit, issued on December 12, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the pemrittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Kendall Hardee Permit No. 142-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours ECE1v��s�prD inclement weather. V C 5) This permit authorizes a maximum of 4 formalized boat slips. DEC 14 20V 6) The pier and associated structures shall have a minimum setback distance of 15 feet$w of the structure and the adjacent property owners' riparian access corridor to the so 7) Should the adjacent property to the north be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. 8) No portion of the authorized docking facility shall extend into the channel portion of the waterbody, as depicted on the workplan drawing. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 13) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2017-02226), which was issued on 10/23/17. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2017- 1300. NOTE: An application processing fee of $250 was received by DCM for this project. Existing Fixed Platform: 12' x 16' = 192 sq. ft. Existing Floating Platform:10' x 16' = 160 sq. ft. Proposed Floating Platform: 10' x 16' = 160 sq. ft Proposed Finger Pier: 6' x 12'= 72 sq. ft. Total = 584 sq. ft. It is staff s recommendation that the extending the proposed docking facility appears CONSISTENT with the rules in 15A NCAC 07H.0208 (b) (6) (G) which limit docking facility length. The proposed docking facility would not exceed the 1/4 width distance of the waterbody and would not extend into the channel portion of the waterbody as located by the applicant's surveyor. The proposed docking facility would not exceed the waterward distance of the adjacent docking facility to the north. The proposed docking facility would extend approximately 35' waterward of the adjacent docking facility to the south, however the adjacent docking facility to the south measures less than 100' in length from the edge of marsh vegetation and should not be referenced for a pier head alignment. The construction of the proposed floating platform extension would provide two (2) additional slips allowing the facility to accommodate a total of four (4) vessels in waters that are open to the harvest of shellfish. Provided there are no concerns from the Division of Marine Fisheries, Shellfish Sanitation Program, or any other commenting agency, it is recommended that a permit be issued to include standard permit conditions. The applicant proposes to expand an existing private docking facility to achieve greater water depth and accommodate up to four (4) vessels. The project is located at 1720 Village Point Road, adjacent to the Shallotte River in Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are E W and PTA. The Waters at the project site are classified as SA; HQW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Brunswick County Land Use Plan and offer the following comments. The AECs impacted by the work are classified as Residential. In general, Brunswick County allows development in Residential classified AECs which is consistent with the State's minimum use standards. The Brunswick County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Brunswick County Land Use Plan. Staff review of the plans and specifications on October 11, 2017 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. PROJECT SUMMARY: The applicant proposes to expand an existing private docking facility to achieve greater water depth and accommodate up to four (4) vessels. PROJECT DESCRIPTION The applicant's property is located at 1720 Village Point Rd adjacent to the Shallotte River in the town of Shallotte, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto main St./1JS-17 Bus. S and travel approximately 1.77 miles. Turn left onto Village Dr. and travel approximately 1.5 miles. Turn left onto Village Point Rd. SW and travel approximately 3.4 miles. The project site will be located on the left hand side of the street. The project site measures approximately 0.57 acres in area and is currently developed with a single family residence and private docking facility. High ground vegetation consists mainly of lawn grass and live oak trees. The property has approximately 90' of shoreline frontage along the Shallotte River and is stabilized by an existing bulkhead. The application states that the property maintains an average elevation of approximately 20' above Normal High Water (NHW). Coastal wetlands are present waterward of the existing bulkhead and include a high marsh area measuring approximately 10' in width consisting primarily of Black Needlerush (Juncus roemarianus) and a low marsh area measuring approximately 20' in width consisting primarily of Smooth Cord Grass (Spartina altemiflora). The Mean Low Water (MLW) contour is located approximately 10' waterward of the existing bulkhead. The property maintains an existing pier and docking facility which was recently authorized on February 3, 2017 under General Permit No. 68027-D after the original pier and docking facility was destroyed by Hurricane Matthew in October of 2016. The existing boatlift is the one remaining component of the original facility that was not destroyed. The recently constructed pier measures approximately 6' in width by 92' in length and terminates at a fixed L-head measuring approximately 12' in width by 16' in length. A ramp measuring approximately 4' in width by 16' in length leads down to a newly authorized floating platform measuring approximately 10' in width by 16' in length, aligned parallel to the shore. The waterward end of the existing docking facility measures approximately 100' from the waterward edge of marsh vegetation. Existing water depths at the waterward end of the existing floating platform measure approximately -3' @ MLW. The waters of the Shallotte River are classified SA; HQW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility to achieve greater water depth and accommodate up to four (4) vessels. The proposal would include a new fixed finger pier measuring approximately 6' in width by 12' in length that would extend off the existing fixed platform perpendicular to the shoreline. The existing ramp would be relocated to the end of the proposed finger pier and would lead down to the proposed relocated floating platform measuring approximately 10' in width by 16' in length. An additional floating platform measuring approximately 10' in width by 16' in length is proposed to extend off of the north side of the existing relocated floating platform. Both floating platforms would be aligned parallel to the shoreline and would allow for dockage of two vessels on the waterward side and one vessel on the landward side. Water depths in the areas of the proposed slips range from approximately -5' @ MLW to -8' @ MLW. The proposed floating dock extension would encroach into the 15' Adjacent Riparian Corridor Setback to the north, however the adjacent property owner has waived the setback requirement. The waterward end of the proposed docking facility would terminate approximately 12' waterward of the existing location. The proposed waterward extension of the docking facility would not exceed the -8' Mean Low Water (MLW) contour which was located as the approximate edge of the deep -water navigation channel by the applicant's surveyor (See Sheet 2 of 2). ANTICIPATED IMPACTS The proposed pier docking facility expansion would incorporate approximately 232 sq. ft. of Estuarine Waters and Public Trust Area. The floating platform extension would allow for two (2) additional docking spaces for a total of four (4) slips for the facility, which is located within waters that are OPEN to the harvest of shellfish. The proposed docking facility expansion would allow for approximately 110' of separation from the adjacent docking facility to the north and approximately 60' of separation from the adjacent docking facility to the south. The proposed docking facility would extend a distance measuring approximately 112' into open water within a water body which measures approximately 936' in width. This distance would conform to the t/4 width rule and would not exceed the -8' MLW contour which appears to be the edge of the navigable channel. The proposed new docking facility would not exceed the waterward distance of the adjacent docking facility to the north but would be located approximately 35' waterward of the adjacent docking facility to the south. The applicant has obtained a waiver to the 15' Adjacent Riparian Corridor Setback requirement to the north and is not proposing to encroach into the 15' Adjacent Riparian Corridor Setback to the south.
