This permit, issued on March 30.2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
)e subject to tines, imprisonment or civil action; or may cause the permit to be null ano voia.
Docking Facilities
Unless specifically altered herein, this permit authorizes only the access piers and docking facilities,
all as expressly and specifically set forth in the permit application and workplan drawing. No other
structure(s), whether floating or stationary, shall become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures shall be conducted on/in, or
over public trust waters without permit modification.
2. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit, The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at, or adjacent to, the authorized facilities.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure(s) and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
7) This permit authorizes a maximum of four (4) formalized boat slips. Any request to add additional slips
shall require a modification of this permit.
8) This permit does not authorize the placement of any tie pilings in association with this structure.
Bulkhead
9) The bulkhead shall be constructed no more than 1' waterward of the existing bulkhead.
10) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead and retaining wall.
11) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
12) The bulkhead and retaining wall shall be constructed prior to any backfrlling activities.
13) The bulkhead and retaining wall shall be structurally tight so as to prevent seepage of backfill materials
through the structure.
14) The bulkhead and retaining wall shall be solid and constructed of treated wood, concrete slabs, metal or
vinyl sheet piles, or other suitable materials approved by Division personnel.
15) All backfill material shall be clean and free of any pollutants except in trace quantities.

16) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
17) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
18) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
21) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 & Nationwide Permit 3 (Action ID No. SAW-2017-00474), which was issued on
3/30/17.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR-
2017-0267.
NOTE: An express permit application processing fee of $2,000 was received by the Department of
Environmental Quality for this project.

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following application was submitted for a development permit in an
Area of Environmental Concern as designated under the CAMA: On February 23, 2017, Jenna
Black & Brandon Grimes proposed to replace a bulkhead, expand an existing docking
facility and construct a new retaining wall at 338 Sea Manor Drive, adjacent to Waters Bay /
AIWW, in Surf City, Pender County. A copy of the application can be examined or copied at the

8. PROJECT SUMMARY: The applicant proposes to replace an existing failing bulkhead, construct an
elevated fixed platform, new floating dock at an existing pier, a new pier and covered platform and a new
retaining wall.

9. PROJECT DESCRIPTION:
The applicant has requested the subject CAMA Major Permit application be processed under the Express Review
Permitting Program. The project site is located at 338 Sea Manor Drive, adjacent to Waters Bay and the AIWW,
in Surf City, in Pender County. To locate the project site from the Wilmington Regional Office (WiRO), travel
north on US 17N / Market Street towards Jacksonville for approximately 20. miles to NC Hwy 210. Turn right
onto NC Hwy 210 and travel approximately 2.84 miles to NC Hwy 50 / NC 210. Turn right onto NC Hwy 50 /
NC 210 and travel approximately 1.18 miles to Atkinson Point Road. Turn left onto Atkinson Point Road and
travel approximately 0.07 miles to Sea Manor Drive and turn right. Sea Manor Drive dead ends at the subject
property.
The subject property encompasses approximately 0.75 acres which is somewhat triangular in shape and has an
elevation that ranges from approximately 2 feet to 5 feet above normal high water (NHW). The applicant currently
maintains a single family residence on the property. Existing high ground vegetation on the tract consists of lawn
grasses, oaks and ornamental landscaping. The property has approximately 450 linear feet of shoreline which is
bordered by Waters Bay just off of the AIWW. The northwestern portion (approx. 215 linear feet) has been
stabilized with a timber bulkhead. Approximately 98 linear feet of this bulkhead was replace under CAMA General
Permit #65175 which was issued on 4/1/15. There is an existing platform, with steps leading down into the water,
that measures approximately 8' by 8' and is located at the western end of the bulkhead, along with a deteriorated
single pole jet -ski lift which is located adjacent the platform. The application states that the jet -ski lift will be
removed prior to any new construction. The remaining approximately 130 linear feet of bulkhead is deteriorating
and bowing out water ward. There are Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina
alternii fora) with occasional Glasswort (Salicornia spp.) intermixed adjacent to the existing failing portion of the
bulkhead in an area measuring approx. 1'-1'/2' in width and 82' in length. The remainder of the shoreline (approx.
225 linear feet) along the southeastern side of the property is somewhat stabilized with natural vegetation.
The applicant maintains an existing docking facility located at the southeast corner of the property which based on
aerial photography, has been in existence since at least 1989; however, no permit history has been located. The
existing facility accommodates one (1) vessel in water depths ranging from approximately -3' to -5' @ normal low
water (NLW).
The Pender County 2006 Land Use Plan Update classifies adjacent waters and high ground as Conservation /
Resource Protection. The waters of Waters Bay and the AIWW are classified SA-HQW by the Division of Water
Resources. They ARE designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are
Closed to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to replace an existing failing bulkhead, construct an elevated fixed platform, new floating
dock at an existing pier, a new pier and covered platform and a new retaining wall. As proposed, the existing
approximately 130' of deteriorating bulkhead would be replaced an average of P to 2' water ward of the existing
bulkhead and tie into the recently replaced wooden bulkhead. As a result of the proposed placement, approximately
125 sq. ft. of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alterniflora) with occasional
Glasswort (Salicornia spp.) would be filled. A new platform measuring approx. 10' in width by 50' in length is also

bulkhead approx. 10' water ward in an area with water depths averaging approximately -1.8' @ NLW. The
application states that the proposed platform could accommodate up to two (2) vessels. The application states that
a new fixed pier would extend to the northern point of the property adjacent to the terminal end of the new bulkhead,
and would measure approx. 6' in width by 22' in length. A new elevated covered fixed platform would be located
at the water ward end of the new pier and would measure approx. 20' in width by 16' in length.
The applicant is also proposing to install a new "low lying" retaining wall which would begin adjacent to the
proposed pier and would extend approximately 200 linear feet in a southerly direction towards the property line and
existing pier. As proposed, the new retaining wall would be located on high ground and landward of all wetlands.
Lastly, the applicant is proposing to install a new floating dock, measuring approx. 6' in width by 16' in length
which would be connected via an access ramp to the existing 10' in width by 22' in length fixed platform which is
located at the southeastern comer of the property. This would allow up to two (2) vessels to be moored in water
depths ranging from -3' to -5' @ NLW at this location.
10. ANTICIPATED EUPACTS:
The proposed structures would incorporate approximately 1,242 sq. ft. of Public Trust Area and Estuarine Waters
and 125 sq. ft. of Coastal Wetland fill, consisting primarily of Smooth Cordgrass and occasional Glasswort. The

The new proposed pier and covered platform would extend approximately 20' into a waterbody which measures
approximately 110' across, thus, would not exceed the '/4 width of the waterbody nor extend into the existing
channel. The proposed floating dock addition to the existing pier and platform would extend a total distance of
approximately 48' into a waterbody which measures approximately 226' across, thus, would not exceed the'/4 width
of the waterbody nor extend into the existing channel at this location. The proposed bulkhead and retaining wall
would disturb approximately 3,000 sq. ft. of high ground. The proposed structures would accommodate a total of
up to four (4) vessels (2 at each location) within current water depths ranging from approximately -1.8' to -5' @
NLW. Minor turbidity increases may be expected during the construction process.

under the CAMA Major Permit / Corps of Engineers 291 General Permit process. Under most circumstances, the
Federal review of these applications would be after March 24, 2017. If the US Army Corps of Engineers does not
render a decision on your project by the time a CAMA permit decision can be made, the Division of Coastal
Management will render a permit decision on the CAMA Permit only. Should that occur, the US Army Corps of
Engineers would most likely process your project as a General Permit 291. Should you wish to place your project
on hold before March 24, 2017, pending the receipt of the Federal decision, the Division of Coastal Management
will render a decision once the Federal comments are received.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.

Dear Ms. Black and Mr. Grimes:
On March 1, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received
a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
March 2, 2017 has determined that the development activities proposed at this time will not pose a threat to surface
water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.
