Bulkhead 1) The bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawings. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No. 105-17 Page 2 of 2 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 7) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 0) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. On August 22, 2016, processing of your application was placed on hold pending requests for green cards and additional information from the N.C. Division of Water Resources and U.S. Army Corps of Engineers. We are in receipt of all such information and received notice that no further information is required by either the N.C. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters, Estuarine Shoreline, Coastal Wetlands and PTA. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, Ocean Isle Beach allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Ocean Isle Beach Land Use Plan update. As I understand it, you are submitting a revised to pull the Fisher's proposed bulkhead (at 6 Monroe Street) back to a distance of 2' waterward of their existing bulkhead, and Mr. Green would like to extend out to the Fisher's proposed bulkhead in order to create a straight wall alignment. To answer your question below, we really don't have a mechanism in our rules to allow for compensatory mitigation in exchange for coastal wetland fill, particularly when the fill has been determined to be unjustified and is simply to achieve a better alignment with the neighbor(s). Typically our policy is to allow for replacement bulkheads to be constructed 2' waterward of an existing wall, except when a documented need exists. In this case, and based on the information provided to us to date, the Division has found that due to the proximity of the house pilings to the bulkhead, and due to the location of the Fisher's bulkhead to the north, a new alignment extending up to the Fisher's existing wall (a distance of approximately 5' waterward of the existing wall on the Fisher side and up to 2' out on the southern side) is reasonable and justified. If Mr. Green wishes to extend an additional 2' further waterward to meet the proposed bulkhead alignment to the north, he would need to seek a variance from the Coastal Resources Commission (CRC). In order to approve a variance, the CRC must find that the permit decision we made has caused the Mr. Green unreasonable hardship, that the hardship is not a result of his own actions, that the hardship is due to conditions peculiar to the property, and that granting a variance would be consistent with the spirit, purpose, and intent of the rules. The variance would most likely be heard at our November 7-8 CRC meeting, which will be in Atlantic Beach. Here's more info on the variance process: http•//deo nc gov/about/divisions/coastal-management/coastal-management-permits/variances-appeals If Mr. Green decides he does wish to seek a variance, please submit the updated plans (both plan and side view) and MP-2 form with the wall aligning with the Fisher's proposed wall to the north and up to 2' out on the south. Plans would need to be accurately drawn to scale, using a standard engineer's scale. I would recommend also providing a new narrative with any and all justification for the extension possible. I've been advised that this alignment sufficiently minimizes the impacts in order to meet the requests and permit requirements of the US Army Corps of Engineers and the Division of Water Resources and will allow them both to resume processing of their respective permits. We (DCM) could issue a permit, but with the condition that the new bulkhead shall not extend waterward of the Fisher's existing bulkhead to the north. Mr. Green could then submit a variance request to seek relief from that permit condition. If the CRC grants the request, we would issue a modified permit and Mr. Green could then construct in line with the Fisher's new wall, as proposed. If his request is denied, he can construct as was originally permitted (in line with the adjacent existing wall), or he can appeal the variance decision to the Superior Court. Again, being a quasi-judicial proceeding, Mr. Green would need to represent himself at the variance hearing or hire an attorney to represent him. If Mr. Green decides he would instead prefer to move forward more expeditiously with permitting and construction, I would ask that you please revise the plans and MP-2 form to reflect a proposed bulkhead limited to an alignment with the Fisher's existing wall (and again, up to 2' out on the south side). This would greatly simplify the process and allow us to issue a permit more quickly and without further complication. I hope this all makes some sense! I realize it's a little confusing, especially describing the bulkhead alignments, particularly since the existing bulkhead on the property isn't straight across. Any other suggestions would be helpful on how we can mitigate the impact to grass, yet achieve the straight line from 6 Monroe's new wall would be greatly appreciated. This will lower the cost for the wall construction and greatly improve the aesthetics. It is the opinion of this office that the proposed bulkhead may be considered CONSISTENT with the Use Standards for Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H ,0205, .0206 & .0207. The applicant proposes to install a replacement vinyl bulkhead approximately 7.5 feet waterward of an existing timber bulkhead and filling the area. This fill would result in a loss of approximately 350 square feet of estuarine waters, coastal wetlands, and public trust area. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, drum species, and ray. Coastal wetlands are considered among the most productive ecosystems in the world (NCDEQ 2015). Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. The proposal to move the new bulkhead approximately 10 feet waterward of the existing bulkhead is viewed as unnecessary and would cause a loss of shallow bottom habitat as well as public trust water. For these reasons, it is the position of DMF to object to the project as currently proposed. If the applicant proposed to move the new bulkhead waterward only to the distance absolutely necessary for construction (generally <2-foot waterward), the objection would be withdrawn. Directions from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 211 St. and travel approximately 0.21 miles. Turn left onto Monroe St. and travel approximately 0.1 miles. The project site will be located on the right side of the street. The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the high ground area of the lot averages approximately 2'-3' above normal high water (NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The shoreline of the property has been stabilized with an existing timber bulkhead and the existing house structure is located approximately 5' landward of the existing bulkhead on the northern side. On the southern side of the property, the house structure is located approximately 11' landward of the existing bulkhead. Coastal Wetlands are present waterward of the bulkhead, consisting primarily of Smooth Cordgrass (Sportina alterniflora). The Coastal Wetlands are, on average, 15' in width as measured from the bulkhead. Normal High Water (NHW) is located along the existing bulkhead for the property. There is an existing docking facility which consists of a pier measuring approximately 6' in width by 25' in length. An existing ramp measuring approximately 4' in width by 16' in length leads to a floating dock aligned parallel to the canal which measures approximately 8' in width by'16' in length. consists of a fixed platform measuring approximately 5' in width by 8' in length. There is an existing boatlift located on the northern side of the existing floating dock which measures approximately 13' in width by 13' in length. The adjacent property's shoreline to the north has been stabilized by an existing timber bulkhead which is aligned approximately 5' waterward of the applicant's existing bulkhead. The adjacent property's shoreline to the south has been stabilized by an existing timber bulkhead which is aligned approximately 14' waterward of the applicant's existing bulkhead. Both of the adjacent properties to the north and south are developed with single-family residences and docking facilities. No known archaeological sites are within the project vicinity. The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the canal are contiguous with the AIWW are classified SA by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. As proposed, the bulkhead alignment would be approximately 2' waterward of the existing adjacent bulkhead to the north and approximately 11' waterward of the existing adjacent bulkhead to the south. The existing timber bulkhead would remain in place and the limits of disturbance would be located approximately 15 feet landward of the proposed bulkhead alignment for the tie -back system. The applicant is proposing to install the tie -backs thru the existing wall to prevent land disturbance associated with removal of the old wall. This method of construction would also aim to alleviate threats to the existing porch which resides in close proximity relative to the existing bulkhead wall. The adjacent owner to the north (Fisher) has also submitted an application for major development proposing a bulkhead alignment that would tie into the applicant's proposed bulkhead. 11. ANTICIPATED IMPACTS The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the filling of approximately 350 square feet of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alternifloro).
