This permit, issued on September 18, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Cultural Resources Protection 1) Prior to the initiation of any land -disturbing activities authorized by this permit, the permittee shall, in coordination with the N.C. Department of Natural and Cultural Resources (NCDNCR), develop and implement an archaeological survey of the proposed project area. Initiation of permitted land - disturbing activities shall not begin until written approval is obtained from NCDNCR, and a copy of such approval has been submitted to the Division of Coastal Management. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee limas and Julie Gardner Permit No.111-17 Page 2 of 4 ADDITIONAL CONDITIONS Upland Development Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the homesite, driveway, culverts, pool, retaining wall, and other associated infrastructure, all as expressly and specifically set „forth in the attached permit application and workplan drawings. Shoreline Stabilization - Bulkhead The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked and verified by DCM within a maximum 'of 30 days prior to the new expected start of construction. The bulkhead shall be constructed prior to any backfilling activities. The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The fill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. No backfill material is to be placed within 30 feet of the normal high water line, except that which will '..'be used to backfill the area behind the permitted bulkhead. A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Pier and Platform This permit authorizes only the pier and platform, and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this pier and platform without permit modification. No non - water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The petn ittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor and Julie Gardner ADDITIONAL CONDITIONS ;; This permit does not authorize any formalized boat slips. Permit No.111-17 Page 3 of 4 The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Sedimentation and Erosion Control An Erosion and Sedimentation Control Plan may be required for this project. Contact the Division of Energy, Mineral and Land Resources, Land Quality Section at 943 Washington Square Mall, Washington, NC 27889 prior to the commencement of any such activity for this determination. USACE Conditions In order to compensate for impacts associated with this permit, mitigation shall be provided in accordance with the provisions outlined in the U.S. Army Corps of Engineers, Wilmington District Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any special conditions listed on this form, are hereby incorporated as special conditions of this permit General vegetated wetlands shall be excavated or filled, even temporarily, outside of the areas indicated in attached workplan drawings. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Any mitigative measures or environmental commitments specifically made by the applicant for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. permittee and/or his or her contractor shall meet with a representative of the Division prior to Pet initiation. This pemut does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2017-00188). The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4097 and assigned the project DWR Project No. 2016-1236. and Julie Gardner Permit 111-17 t Page 4 of 4 ADDITIONAL CONDITIONS Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. GARDNER LOTS 30 & 31 — OSPREY DRIVE ALBEMARLE SHORES U CHOWAN COUNTY, NORTH CAROLINA The applicant owns Lots 30 and 31 of Albemarle Shores II in Chowan County. The site is situated between the improved Osprey Drive and Albemarle Sound. Highground along Osprey Drive is available for wastewater disposal, and a highground area on the Albemarle Sound is desirable for residential construction. The project anticipates the need to fill wetlands which are subject to Section 404 of the Clean Water Act for access and to support the residential construction. Also proposed is the construction of a bulkhead along the eroding shoreline an average of 2 feet waterward of Normal Water yet not exceeding 5 feet. An 85-foot long pier with a 20 x 20 foot tee is proposed to provide access to water for a shallow draft boat. Water depths at the end of the pier are approximately 3.5 feet. Of the 1.968 acres of wetlands at the site, 0.15 acres are proposed to be filled for access and 0.19 acres for house construction. All fill will be retained by a retaining wall with 15-foot tiebacks. Mitigation is proposed for unavailable wetland impacts from The Great Dismal Swamp Restoration Bank. SECTION .0200 - THE ESTUARINE AND OCEAN SYSTEMS 15A NCAC 07H .0206 ESTUARINE WATERS (c) Management Objective. To conserve and manage the important features of estuarine waters so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing estuarine waters so as to maximize their benefits to man and the estuarine and ocean system. Consistent: The proposed bulkhead, pier and platform fall within the general use standards. (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. Consistent: The project meets the use standards and is consistent with the intent of this rule. 15A NCAC 0711.0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: NIA — 404 wetland impacts. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; Consistent: No SAVs, Coastal Wetlands, or shellfish beds. (B) Development shall comply with state and federal water and air quality; Consistent: Not an issue. (C) Development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: Proposed pier will be 6' wide. (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The combined area will be within the limitation. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: None proposed. (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: NIA (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; Consistent: NIA (F) Piers and docking facilities shall be single story. (iii) not extending more than one-fourth the width of a natural water body, or human made canal or basin. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Consistent: Requested with platform is 105'. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The dock will maintain a minimum of 15' from the riparian line. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. (7) Bulkheads: (A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level; Consistent: Bulkhead shall be an average of 2' waterward of normal water level. (B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources; Consistent: No Coastal Wetlands. (C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead; Consistent: Applicant will obtain backfill from a high ground commercial source. (D) Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent (iii) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; and, Consistent (v) the property to be bulkheaded is in a non -oceanfront area. DATE: August 21, 2017 Consistency Determination: The request is consistent with/not in conflict with the Chowan County/Town of Edenton 2008 Core Land Use Plan certified by the CRC on July 24, 2008. Overview: The 3.97-acre project site consists of two (2) vacant waterfront lots with a combined shoreline of 255.33 linear feet along the Albemarle Sound. Water depths range from 0 at the shoreline to -3.5 feet at a distance of 105 feet offshore. There is a 5 to 6-foot-high escarpment along the natural shoreline with clear evidence of erosion. Fetch at this site is estimated at over 9 miles, making the shoreline extremely susceptible to erosion. The site consists of approximately .74 acre of soundside uplands and 1.26 acres of roadside uplands that are bisected by approximately 1.97 acres of Section 404 wetlands. The property is located primarily within the AE floodzone with ".2 percent annual chance of flooding" areas near the roadway. A 5 foot to 6-foot-high concrete barrier is located along the northeast corner of the shoreline. The barrier was placed by the adjacent property owner to protect the corner of his bulkhead. An initial Major Permit application for site development was reviewed on January 17, 2017. A second was reviewed on February 1, 2017. This review is for an updated Major Permit application routed on July 28, 2017. The updated application indicates reduced impacts to Section 404 wetlands and modification of proposed brick patio/pool deck and retention wall. Installation of 252 linear feet of vinyl bulkhead and a 6-foot-wide by 85-foot-long pier with a 20 foot by 20-foot terminus platform on the Albemarle Sound; installation of a gravel access road, septic pumping station with septic drain field, two (2) retaining walls totaling 978 linear feet and four (4) 24-inch diameter culverts, and; construction of a single family house with associated swimming pool and brick patio/pool deck are proposed. The concrete barrier at the northeast corner of the shoreline will be removed. Wetlands will be filled to allow for construction of the access road and the waterfront building site. The septic pumping station will be located on the soundside uplands and the septic drain field will be located on the roadside uplands. The retaining walls will contain proposed wetland fill and the culverts will be used to maintain a hydrological connection between the wetland areas. As determined from the wetland fill plan, a well is to be located within 50 feet of the shoreline. The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish taking. Waters at the project site are known for Submerged Aquatic Vegetation (SAV) but no vegetation was found within the proposed work area. Historic site (CO 0247) is located approximately 3,500 feet south of the project site. There are no known geologic formations or archaeological sites associated with the project site. Anticipated Impacts resulting from this project are expected to include: filling of 504 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), 2,443 sq. ft. of Estuarine Shoreline AEC; .34 acre of Section 404 Wetlands, and .17 acre of uplands outside of an AEC; the grading of 1.13 acre of uplands within the Estuarine Shoreline AEC, and; the shading of 910 sq. ft. of Public Trust Area/Estuarine Waters AEC. The applicant's consultant has submitted an application to The Great Dismal Swamp Restoration Bank, LLC to obtain wetland mitigation credits in trade for the proposed wetland fill. Confirmation of the wetland mitigation credit has not been received. Basis for Determination: The Edenton/Chowan County Future Land Use Map identifies the project site as "Low Density Residential". As indicated on Page 135, "...coastal wetlands, estuarine waters, estuarine shoreline, public trust areas, and 'Section 404' wetlands..." are considered to be part of the "Conservation/Open Space" designation. Low Density Residential Classification. This designation is intended to delineate lands where the predominant land use is low density residences, particularly properties with waterfront access and areas where public water service is readily available. The overall residential density within this classification is generally 1 to 2 dwelling units per acre. Conservation/Open Space. This designation is intended to delineate areas where traditional land uses are not desirable or expected to develop. Land development may however include public building and facilities necessary to support existing land uses... (P)assive recreation would be appropriate in this designation as long as environmentally sensitive areas are not negatively impacted... The County's goals and polices support the continued use of land in (this designation) for appropriate uses that are compatible with the fragile naturi���vED Conservation/Open Space areas. This location has a high probability for containing archaeological sites, particularly given its proximity to former Heriots Island, also known as Batt's Island. Nathaniel Batts operated a trading business in the area during the seventeenth century and archaeological sites associated with these or earlier activities may be present in the subject parcel. The high ground along Osprey Drive, where the proposed septic drain field and "repair area" is to be located, has the greatest potential to contain such deposits. We recommend that prior to the initiation of any ground disturbing activities within the project area, a comprehensive archaeological survey of the project area be conducted by an experienced archaeologist. The purpose of this survey will be to identify and evaluate the significance of archaeological sites that may be damaged or destroyed by the proposed project. Potential effects on unknown resources must be assessed prior to the initiation of construction activities. Please note that our office now requests consultation with the Office of State Archaeology Review Archaeologist to discuss appropriate field methodologies prior to the archaeological field investigation. In addition to a standard subsurface archaeological survey through shovel testing, we also recommend limited mechanical stripping be conducted in portions of the project area that have especially high probability for archaeological remains. One paper and one digital copy of all resulting archaeological reports, as well as one copy of the North Carolina site form for each site recorded, should be forwarded to the Office of State Archaeology through this office for review and comment as soon as they are available and in advance of any construction or ground disturbance activities. The property addresses are 226 and 228 Osprey Drive, Edenton, North Carolina. Both lots have unprotected shorelines totaling-255.33' abutting the Albemarle Sound. A 5' concrete barrier has been placed along the northeast corner of the applicant's shoreline by the adjacent property owner, to protect the corner of their bulkhead. There is a 5' to 6' high escarpment along the applicant's shoreline with clear evidence of erosion. It is estimated that the fetch at this site is over 9 miles, making the shoreline extremely susceptible to erosion. Both lots are deep (between 665' and 803') with two areas of high ground bisected by 1.968 acres of 404 wetlands. Uplands on the road side of the two properties is ~1.262 acres (54,972sf), and the upland area on sound side is -.735 acres (23,016sf). Albemarle Shores is a two phase 95 lot residential subdivision Zoned Al (Agricultural) by the Chowan County Planning Department. Located to the north of Albemarle Shores, at the end of Osprey Drive, is the entrance to The Refuge at Drummonds Point, a vacant waterfront residential subdivision. Located to the immediate north of the applicant's property is a developed residential lot, to the south is a vacant residential lot with an elevated walkway over the 404 wetlands to access the waterfront section of the property. The two lots abut Osprey Drive to the west and the Albemarle sound to the east. Vegetation includes, but is not limited to, Black Tupelo (Nyssa sylvatica), Narrow -leaved Cattail (Typha angustifolia), Bald Cypress (Taxodium distichum), Arrow Arum (Peltandra virginica), Virginia Chain Fern (Woodwardia virginica), Caric Sedge (Carex spp.), Swamp Loosestrife (Decodon verticillatus), groundsel tree (Baccharis halimifolia), carolina jasmine (Gelsemium sempervirens), Sweet Bay (Mannoila virginiana), Catbrier (smilax bona nox), Loblolly Pine (Pinus teada), American Holly (Ilex opaca), Live Oak (Quercus Virginian), Poison Ivy, (Toxicodendron radican), Spanish Moss (Tillandsia usneoides), Red Maple (Acerrubrum), Wax Myrtle (Myrica cerifera), Virginia Creeper (Parthenocissus quinquefolia), and Pokeweed (Phytolacca americana). Water depths graduate from 0' at the shoreline to -3.5' at a distance 105' offshore. The waters adjacent to the project site are a known submerged aquatic habitat, but no vegetation was found within any proposed work area. One known historic site (CO 0247) is documented as being-3,500' south of the applicant's property. There are no known geologic formations or archaeological sites associated with the applicant's property.
