It is the opinion of this office that the proposed bulkhead may be found to be CONSISTENT with the Use Standards for Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 & .0207. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued provided the proposed bulkhead steps out in front of the existing bulkhead only what is necessary for the driving of the vinyl sheet piles and associated tie back system, with a 2' maximum distance waterward of the existing bulkhead. RECEIVED JUL 0 7 2017 DCM- MHD CITY a MEMORANDUM To: Heather Coats From: Michael Christenbury, Wilmington District Planner k- Subject: Consistency Determination, Major Permit Application, — Julie Elkins Fisher, Ocean Isle Beach, Brunswick County Date: September 14, 2017 project is consistent and not in conflict The applicant is proposing to install approximately 50 linear feet of new vinyl bulkhead with associated fill at 6 Monroe Street, adjacent to a manmade canal off the AIW W in Ocean Isle Beach, Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters, Estuarine Shoreline, Coastal Wetlands and PTA. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, Ocean Isle Beach allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Ocean Isle Beach Land Use Plan update. R90AN Skew BRAXTON DAVIS nn«.rr MEMORANDUM: TO: Heather Coats, DCM Assistant Major Permit Coordinator FROM: Curt Weychert, DCM Fisheries Resource Specialist SUBJECT: Julie Elkins Fisher CAMA Dredge and Fill Application Comments DATE: July11, 2017 A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the CAMA permit application for proposed actions that impact fish and fish habitats. The applicant proposes to install a replacement vinyl bulkhead approximately 6 feet waterward of an existing timber bulkhead and filling the area. This fill would result in a loss of approximately 300 square feet of estuarine waters, coastal wetlands, and public trust area. Shallow soft bottom is an important foraging habitat for juvenile and adult'fish and invertebrates, and aids in storing and cycling of sediment; nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native.coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs; flounder, spot, Atlantic croaker, sea mullet, drum species, and ray. Coastal wetlands are considered among the most productive ecosystems in the world. Coastal wetlands are a productive detritusbased system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. The proposal to move the new bulkhead approximately 6 feet waterward of the existing bulkhead is viewed as unnecessary and would cause a_loss of shallow bottom habitat as well as public tmst water. For these reasons, it is the position of DW to ghj2 t to the project as currently proposed. If the applicant proposed to move the new bulkhead waterward only to the distance absolutely necessary for construction (generally <2-foot waterward), the objection would be withdrawn. Contact Curt. Weychert at (252) 808-2808 ext. 213 or Curt. Weychertgnedenr.gov with further questions or concerns. This office will require the applicant to show that he/she has avoided and minimized impacts to waters of the US to the maximum extent practicable. -For example, please describe why the bulkheads on lots 4 and 6 cannot be constructed with less fill (same with the other lots to a lesser extent). -Can the bulkheads on lots 4 and 6 be pulled back to align with the adjacent bulkheads? It seems that if the bulkhead on lot 6 could be aligned with the existing bulkhead to the left of it and still have enough room so as not to compromise the house foundation. 2. Please submit photos of the current bulkhead structures to show that they are in disrepair and failing (so as to assist in showing that these projects are needed and impacts are unavoidable). In that phone call, we discussed the need for additional information in order to process the permit applications you submitted to the NC DCM. To reiterate: 1. PROJECT DESCRIPTION The applicant's property is located at 6 Monroe Street, adjacent a man-made canal contiguous with the AIWW in the Town of Ocean Isle Beach, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd St. and travel approximately 0.21 miles. Turn left onto Monroe St. and travel approximately 0.1 miles. The project site will be located on the right side of the street. The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the high ground area of the lot averages approximately 2'--3' above normal high water (NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The shoreline of the property has been stabilized with an existing timber bulkhead and the existing house structure is located approximately 10' landward of the existing bulkhead, with an existing porch located approximately 9' from the bulkhead. Coastal Wetlands, consisting primarily of Smooth Cordgrass (Sportina olterniflora), are present waterward of the existing bulkhead and extend into the canal approximately 25' on the north side and approximately 12' on the south side. The Coastal Wetlands are, on average, 17' in width as measured from the bulkhead. Normal High Water (NHW) is located along the existing bulkhead for the property. There is an existing docking facility which consists of a fixed platform measuring approximately 12' in width by 12' in length which leads to a pier measuring approximately 4' in width by 16' in length. An existing ramp measuring approximately 4' in width by 12' in length leads to a floating dock aligned parallel to the adjacent canal which measures approximately 8'in width by 16'inlength. The adjacent property's shoreline to the north has been stabilized by an existing timber bulkhead which is aligned approximately 4' waterward of the applicant's existing bulkhead. The adjacent property's shoreline to the south has been stabilized by an existing timber bulkhead which is aligned approximately 5' landward of the applicant's existing bulkhead. Both of the adjacent properties to the north and south are developed with single-family residences and docking facilities. No known archaeological sites are within the project vicinity. The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the canal are contiguous with the AIWW are classified SA by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. RECEIVED JUL 0 7 2017 DCM- MHD CITY Julie Elkins Fisher c/o Pauline Benton Page Three 10. PROPOSED PROJECT: The applicant proposes to install approximately 50 linear feet of new vinyl bulkhead approximately 6' waterward of the current alignment with approximately 300 square feet of associated Coastal Wetlands fill. As proposed, the bulkhead alignment would be approximately 2' waterward of the existing adjacent bulkhead to the north and approximately 11' waterward of the existing adjacent bulkhead to the south. The adjacent owner to the north (Pringle) and to the south (Green) have also submitted applications for major development proposing bulkhead alignments that would tie into the applicant's proposed bulkhead. The existing timber bulkhead would remain in place and the limits of disturbance would be located approximately 16 feet landward of the proposed bulkhead alignment for the tie -back system. The applicant is proposing to install the tie -backs thru the existing wall to prevent land disturbance associated with removal of the old wall. This method of construction would also aim to alleviate threats to the existing house foundation which resides in close proximity relative to the existing bulkhead wall. 11. ANTICIPATED IMPACTS The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the filling of approximately 300 square feet of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Sportina olterniflora). The proposed bulkhead construction would result in the disturbance of approximately 700 square feet of high ground for the tie -back system. Minor turbidity increases can be expected during the construction process. Submitted by: Sean C.
