This permit, issued on July 25, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
ie subject to tines, imprisonment or civil action; or may cause me permit to oe nuu ana voice.
Bulkhead
1) The alignment of the authorized bulkhead shall not exceed a distance of four feet waterward of the
existing deteriorated bulkhead.
2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is
not authorized.
4) The bulkhead shall be constructed prior to any backfilling activities.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020

ADDITIONAL CONDITIONS
5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
7) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
U.S. Army Corps of Engineers Conditions
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at htto:/hVww.fws.gov/nc-
es/mammal/manatee euidelines.pdf.
11) The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice
from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions
caused thereby, without expense to the United States.
12) Approval of the structure is based on determinations that there would be no obstruction to navigation.
The structure may be damaged by wave wash from passing vessels.
13) Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing
activities shall take place at any time in the construction or maintenance of this project, in such a manner
as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of
waters or wetlands.
14) Except as authorized by this permit or any USACE approved modification to this permit, no excavation,
fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance
of this project, within waters or wetlands. This permit does not authorize temporary placement or double
handling of excavated or fill material within waters or wetlands outside the permitted area. This
prohibition applies to all borrow and fill activities connected with this project.

Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition.
General
16) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.
17) The permitted access pier reconstructed over Coastal Wetlands shall be elevated a minimum of three feet
over the wetland substrate as measured from the bottom of the decking.
18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
19) The pemuttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the pemuttee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources authorized the project by way of General Certification 4097
(DWR Project No. 2017-0675), which was issued on 6/16/17.
NOTE: The U.S. Army Corps of Engineers has assigned the project Action ID No. SAW-2017-00945.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Development permit, acting as agent for Nathanial Evans, to undertake development
activities at property adjacent to a canal off the AIWW, at 72 Wilmington Street, in Ocean
Isle Beach, Brunswick County.
Although processing of the application is nearing completion, additional time is needed for
this office to complete the review and make a decision on your request. Therefore, it is

G.S. 113A-122(c) which would make October 2, 2017, the new deadline for reaching a

9. PROJECT DESCRIPTION
The applicant's property is located at 72 Wilmington Street, adjacent a man-made canal contiguous
with the AIWW in the Town of Ocean Isle Beach, Brunswick County. Directions from Highway 17 south
of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue
straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd St. and travel
approximately 0.3 miles. Turn left onto Wilmington St. and travel approximately 0.3 miles. The project
site will be located on the right side of the street.
The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the
high ground area of the lot averages approximately 6'-7' above Normal High Water (NHW). High
ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The
shoreline of the property has been stabilized with an existing timber bulkhead and the dead -men
anchoring system is currently tied in to the existing house pilings. The existing house foundation is
located approximately 11' landward of the existing bulkhead on the southern half of the property and
approximately 23' landward of the existing bulkhead on the northern half of the property (see Drawing
1 of 3). The adjacent properties' shorelines are stabilized by bulkheads which tie into the applicant's
property. Coastal Wetlands consisting primarily of Smooth Cord Grass (Spartina alterniflora) are
present waterward of the existing bulkhead and extend waterward approximately 28' in width as
measured from the existing bulkhead. NHW is located at the existing bulkhead. An existing docking
facility extends from the center of the property off of the existing bulkhead and consists of an elevated
fixed platform measuring approximately 12' in width by 10' in length and ramp measuring
approximately 3' in width by 16' in length which leads to a floating dock measuring approximately 8' in
width by 16' in length and boatlift measuring approximately 13' in width by 13' in length.
The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the
adjacent high ground portion of the project area as Residential. The waters of the canal are classified
SA; HQW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA)
by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to construct approximately 50 linear feet of redi-rock bulkhead with
approximately 200 square feet of coastal wetlands fill and remove the existing fixed platform for
proposed construction of a new access pier. The proposed redi -rock wall would be aligned an average
4' waterward of the existing sheet -piles. The proposed alignment would be located approximately 4'
waterward of the adjacent bulkheads to the north and south of the applicant's property. The redi-rock
block installation involves the placement of concrete blocks with an average approximate base width
of 28". Installation of the bottom layer of redi-rock blocks, which have an average approximate base
width of 41", requires the excavation of an area measuring approximately 50' in length by 4' in width
by 30" in depth (see Drawing 3 of 3). This excavation area is proposed to be lined with a bed of 57
stone completely encased in geotextile fabric (see Drawing 1B). The approximately 9" to 20" void
located between the existing bulkhead and the proposed red -rock blocks would also be lined with
geotextile fabric and filled with 57 stone (see Drawing 113). RECEIVED

The existing timber bulkhead would remain in place and there would be limited high ground
disturbance given the fact that redi-rock construction does not require any tie back/anchoring system.
This method of construction would also aim to alleviate threats to the existing house foundation which
is structurally anchored to the existing bulkhead.
The applicant is also proposing to remove the existing fixed platform which measured approximately
10' in width by 12' in length and construct a new access pier measuring 4' in width by 7' in length.
11. ANTICIPATED IMPACTS
The proposed new redi-rock bulkhead construction would result in the filling of approximately 400
square feet of Coastal Wetlands, Estuarine Waters and Public Trust Area. The proposed impacted
coastal wetlands consist primarily of Smooth Cord Grass (Sportina alterniflora) located below NHW in
shallow bottom area. The proposed redi-rock blocks would require the excavation and offsite disposal
of approximately 19 cubic yards of material from below NHW. The applicant is proposing to dispose of
the excavated material at the Ike Williamson Sand Pit located at 5399 Oak Tree Lane SW, Shallotte NC.
The proposed removal of the existing fixed platform and construction of a proposed new pier would
reduce the current shading impacts over the existing marsh substrate which may allow for
reincorporation of coastal wetland species in within the previously shaded areas. The proposed new
access pier would not encroach into either adjacent 15' riparian corridor setback. Minor turbidity
increases can be expected during the construction process.

Project Narrative:
Reason for Major Development Permit Application:
A CAMA Major Development Permit is being applied for in order to construct a new concrete block
seawall (Redi-rock) in front of the existing wood seawall. Due to the proximity of Mr. Evans house to the
current Seawall (11' from concrete foundation as noted on drawing #1), we are asking your permission
to place the block wall just beyond the current wooden seawall (shown in drawing #2). We are applying
for a 48" extension into the Wetlands / Cord Grass in order to place the needed leveling foundation (#57
gravel), and base blocks that measure 41" deep. We feel that 48" from the base is the minimum
required to work in front of the existing outward leaning wall and it will allow room to excavate required
soils and set the new block wall.
Construction Process:
The Block wall construction will start by removing canal soils and Cord Grass from in front of the existing
wall to an extent no greater than 48" outward and no more than 30" deep. Total materials excavated
will total 18.52 cubic yards or less. This will be followed by placing geotextile drainage fabric in the
excavated trench and up the face of the existing wood wall. #57 gravel will then be packed in the
trenched area in order to level and provide a solid foundation for the block wall. We then begin stacking
the block with the bottom block below the average canal soil grade in order to fight years of erosion
from canal dredging without undermining the wall. After the blocks are stacked geotextile drainage
fabric is placed between all blocks to allow proper drainage without yard erosion. Likewise, the layer of
fabric between the blocks and face of the existing wall ensures no future yard erosion will occur that
could damage wetlands in front of the new wall. We fill all areas between the new block wall and
existing wall, now covered in geotextile cloth, with #57 gravel to allow proper drainage. Water drainage
from the yard, be it storm water or tidal waters, will not be altered from the current wood wall in
quantity or salinity.
Alternative Construction:
Mr. Evan's foundation is only 11' from the existing seawall making removal of the wall and excavating 4'
behind very difficult as well as structurally risky to his foundation. As noted in drawing #3, the current
seawall is anchored back to the front post of the house. I've included a picture (picture #2) of the house
foundation / poles showing how the poles are being pulled by the seawall away from the concrete
foundation. The close proximity of the house to the canal makes traditional wood and vinyl walls that
require deadman construction very difficult to install and a hazard to the structural integrity of the
residence as evidenced by the house poles (deadman) being pulled from the concrete foundation.
We feel that the 4' Extension being applied for is imperative to both safely constructing a structurally
sound seawall and providing the type of wall that will not endanger the Evan's residence for years to
come.

Note the continued separation of the house piling from the concrete foundation.
This is the case for the 3 pilings in the 16' of foundation nearest the canal
(foundation area can be viewed in drawings #2 and #3). The existing seawall was
tied to the 3 front house pilings due to the close proximity to the canal, or in
other words, the lack of acceptable distance to adequately set deadmen. The
previous owners filled the gap once but over time lateral pressure has continued
to cause the seawall to lean and pull the pilings towards the canal. The lack of
space between house foundation and canal will cause problems anchoring a vinyl
wall as it did the current wood wall. With no need for deadmen anchoring, the
concrete block wall (self anchors) would be the better choice for this situation.

Unless exempted by a condition of this permit or the regulations, construction of new
air pollution sources or air cleaning devices, or modifications to the sources or air cleaning
devices described in this permit must be covered under a permit issued by the Division of Air
Quality prior to construction. Failure to do so is a violation of G.S.143-215.108 and may
subject the Permittee to civil or criminal penalties as described in G.S.143-215.114A and 143-
215.114B.
This permit shall be effective from July 16, 2012 until July 1, 2017, is nontransferable to
future owners and operators, and shall be subject to the conditions and limitations as specified
therein.
This Permit is the result of a request for a permit renewal with no changes. The Permittee
is responsible for carefully reading the entire permit and evaluating the requirements of each
permit stipulation. The Permittee shall comply with all terms, conditions, requirements,

Regulations, including Title 15A North Carolina Administrative Code (NCAC), Subchapter
2D .0202, 2D .1902, 2D .1904, and 2Q .0810 (proh. small).
2. PERMIT RENEWAL AND EMISSION INVENTORY REOUIREMENT - The Permittee,
at least 90 days prior to the expiration date of this permit, shall request permit renewal by
letter in accordance with 15A NCAC 2Q .0304(d) and (f). Pursuant to 15A NCAC 2Q
.0203(i), no permit application fee is required for renewal of an existing air permit (without
a modification request). The renewal request (with AA application form) should be
submitted to the Regional Supervisor, DAQ. Also, at least 90 days prior to the expiration
date of this permit, the Permittee shall submit the air pollution emission inventory report
(with Certification Sheet) in accordance with 15A NCAC 2D _0202, pursuant to N.C.
General Statute 143 215.65. The report shall be submitted to the Regional Supervisor, DAQ
and shall document air pollutants emitted for the 2016 calendar year.
3. To avoid applicability of 40 CFR Part 60, Subpart E "Standards of Performance for
Incinerators", only collected land clearing material shall be burned. The presence of any
synthetic material constitutes a mixture of wastes which is not authorized under this permit.
The burning of synthetic materials may subject the Permittee to meeting applicable
requirements of 40 CFR Part 60, Subpart E and may further subject the Permittee to
enforcement action initiated by the Division as authorized under NCGS § 143-215.114A
(civil penalties); § 143-215.114B (criminal penalties); and § 143-215.114C (injunctive
relief).
4. For the purpose of this permit as well as the following conditions and stipulations, as
defined by 15A NCAC 2D .1904(a), this facility is considered a PERMANENT site.
5. In accordance with 15A NCAC 2D .1902 "AIR CURTAIN BURNER DEFINITIONS" an
Air Curtain Burner means a stationary or portable combustion device that directs a plane of
high velocity forced draft air through a manifold head into a pit or container with vertical
walls in such a manner as to maintain a curtain of air over the surface of the pit and a
recirculating motion of air under the curtain.
6. In accordance with 15A NCAC 2D .1904 "AIR CURTAIN BURNERS". operation of the air
curtain burner shall be regulated by the following conditions and stipulations:
a. Prevailing winds - Prevailing winds must be blowing away from any area, including
public roads within 250 feet, which may be significantly affected by smoke, ash or other
air pollutants from the burning.
b. Materials allowed to be burned - Only collected land clearing, stumps, trees, limbs, and
branches shall be burned. Synthetic materials, grass clippings, and collected le
not allowed. Leaves still on trees or brush may be burned. RECEIVED
c. Permissible hours of operation - Burning shall be conducted only during the hours AY 2 s 2011

d. Ban on burning - No fires shall be started or material added to existing fires whenttEIVED

e. Start-up conditions - Only distillate oil, kerosene, diesel fuel, natural gas, or liquefied
petroleum gas may be used to start the fire. The fire shall not be used as a means of
disposal of the above mentioned fuels. Start-up shall not last more than 30 minutes, and
there shall be only one start-up per day.
f. Visible emissions certification — Per 21) .1904(b)(6), at least one individual on -site shall
be certified to read visible emissions during all air curtain burner operations, and the
facility shall be tested by the Permittee for visible emissions during air curtain burner
operation within 5 days after initial operation, and within 90 days before permit
expiration.
g. Operating conditions - (i) The burner must meet manufacturer's specifications which
shall be kept on site and made available to DAQ inspectors upon request. (ii) Ash shall
not build up to a depth higher than one-third the depth of the pit or where it begins to
impede combustion. The ash shall be adequately watered prior to removal to prevent
fugitive emissions. (iii) Material shall not be loaded into the pit to a depth where it
protrudes above the air curtain.
h. Opacity limits - Visible emissions shall not exceed 10 percent opacity during operation
when averaged over a six -minute period except for one period with a six -minute
average not to exceed 35 percent opacity during a one hour period. During start-up, the
visible emissions shall not exceed 35 percent opacity when averaged over a six -minute
period.
i. Required distances - The air curtain burner shall be at least 500 feet from any dwelling,
occupied structure, commercial or institutional establishment which is not located on the
property on which the burning is conducted. Any air curtain burners with distances less
than 500 feet need to attain a signed, written exception from the Regional Supervisor
waiving the requirement before such burning is conducted. RECEIVED
j. Recordkeeping and Reporting Requirements — The owner or operator of the air cmovil$ 6 2017
burner shall follow the recordkeeping and reporting requirements as set forth in

7. MALFUNCTION SITUATIONS - At times of air curtain burner malfunctions, no additional
material shall be added to the fire until the burner is repaired and operating properly. Any air
curtain burner malfunctions that occur during burning shall be recorded in a logbook and made
available to DAQ inspectors upon request.
8. DIVISION OF WASTE MANAGEMENT REQUIREMENT - Issuance of this permit by the
Division of Air Quality shall not relieve the Permittee of the responsibility of obtaining a valid
"TREATMENT AND PROCESSING PERMIT" from the Division of Waste Management.
This DAQ permit is issued under the requirement that the Permittee has or will have received
such TREATMENT AND PROCESSING PERMIT before operating the air curtain burner.
The Permittee shall maintain a valid TREATMENT AND PROCESSING PERMIT during all
future operations of this permitted air curtain burner. Mr. Ed Mussler, Permitting Supervisor,

9. In accordance with 15A NCAC 20.0810 "AIR CURTAIN BURNERS" (Prohibitory Small),
this Rule applies to facilities whose only sources requiring a permit is one or more air curtain
burners.
(a) Any facility whose air curtain burners combust less than 8,100 tons of land clearing debris
per year shall be exempted from the requirements of Section .0500 of this Subchapter (15A
NCAC 2Q .0500, Title V Permits).
(b) The owner or operator of any air curtain bumer subject to this rule shall submit to the
regional supervisor by March 1 of each year a report containing the following information:
(1) the name and location of the facility;
(2) the quantity of material combusted during the previous calendar year•,
(3) and the signature of the appropriate official certifying truth and accuracy of the
report.
(c) The owner or operator of any facility subject to this rule shall provide documentation of the
quantity of material combusted to the Director upon request. The owner or operator of a
facility exempted by this Rule from Section .0500 of this Subchapter shall retain records to
document the amount of material combusted per year for the previous three years.
(d) For facilities covered by this Rule, the owner or operator shall report to the Director any
exceedance of a requirement of this Rule within one week of its occurrence.
B. GENERAL CONDITIONS AND LIMITATIONS
1. TWO COPIES OF ALL DOCUMENTS, REPORTS, TEST DATA MONITORING DATA,
NOTIFICATIONS, REQUESTS FOR RENEWAL, AND ANY OTHER INFORMATION
REQUIRED BY THIS PERMIT shall be submitted to the:

For identification purposes, each submittal should include the facility name as listed on the
permit, the facility identification number, and the permit number.
2. RECORDS RETENTION REQUIREMENT - Any records required by the conditions of this
permit shall be kept on site and made available to DAQ personnel for inspection upon
request. These records shall be maintained in a form suitable and readily available for
expeditious inspection and review. These records must be kept on site for a minim%-86ED

3. ANNUAL FEE PAYMENT -Pursuant to 15A NCAC 2Q .0203(a), the Permittee shall pay
the annual permit fee within 30 days of being billed by the DAQ. Failure to pay the fee in a
timely manner will cause the DAQ to initiate action to revoke the permit.
4. EQUIPMENT RELOCATION - A new air permit shall be obtained by the Permittee prior to
establishing, building, erecting, using, or operating the emission sources or air cleaning
equipment at a site or location not specified in this permit.
5. REPORTING REQUIREMENT - Any of the following that would result in previously
unpermitted, new, or increased emissions must be reported to the Regional Supervisor,
DAQ:
a. changes in the information submitted in the application regarding facility emissions;
b. changes that modify equipment or processes of existing permitted facilities; or
c. changes in the quantity or quality of materials processed.
If appropriate, modifications to the permit may then be made by the DAQ to reflect any
necessary changes in the permit conditions. In no case are any new or increased emissions
allowed that will cause a violation of the emission limitations specified herein.
6. This permit is subject to revocation or modification by the DAQ upon a determination that
information contained in the application or presented in the support thereof is incorrect,
conditions under which this permit was granted have changed, or violations of conditions
contained in this permit have occurred. The facility shall be properly operated and
maintained at all times in a manner that will effect an overall reduction in air pollution.
Unless otherwise specified by this permit, no emission source may be operated without the
concurrent operation of its associated air cleaning device(s) and appurtenances.
7. This permit is nontransferable by the Permittee. Future owners and operators must obtain a
new air pen -nit from the DAQ.
8. This issuance of this permit in no way absolves the Permittee of liability for any potential
civil penalties which may be assessed for violations of State law which have occurred prior
to the effective date of this permit.
9. This permit does not relieve the Permittee of the responsibility of complying with all
applicable requirements of any Federal, State, or Local water quality or land quality control
authority.
10. Reports on the operation and maintenance of the facility shall be submitted by the Permittee
to the Regional Supervisor, DAQ at such intervals and in such foam and detail as may be
required by the DAQ. Information required in such reports may include, but is not limited
to, process weight rates, firing rates, hours of operation, and preventive maintenance
schedules.

11. A violation of any term or condition of this permit shall subject the Permittee to enforcement
pursuant to G.S. 143-215.114A, 143-215.114B, and 143-215.114C, including assessment of
civil and/or criminal penalties.
12. Pursuant to North Carolina General Statute 143-215.3(a)(2), no person shall refuse entry or
access to any authorized representative of the DAQ who requests entry or access for
purposes of inspection, and who presents appropriate credentials, nor shall any person
obstruct, hamper, or interfere with any such representative while in the process of carrying
out his official duties. Refusal of entry or access may constitute grounds for permit
revocation and assessment of civil penalties.
13. The Permittee must comply with any applicable Federal, State, or Local requirements governing the
handling, disposal, or incineration of hazardous, solid, or medical wastes, including the Resource
Conservation and Recovery Act (RCRA) administered by the Division of Waste Management.
14. PERMIT RETENTION REQUIREMENT - The Permittee shall retain a current copy of the air
permit at the site. The Permittee must make available to personnel of the DAQ, upon request, the
current copy of the air permit for the site.
15. CLEAN AIR ACT SECTION 112(r) REOUIREMENTS - Pursuant to 40 CFR Part 68 "Accidental
Release Prevention Requirements: Risk Management Programs Under the Clean Air Act, Section
112(r)," if the Permittee is required to develop and register a risk management plan pursuant to
Section 112(r) of the Federal Clean Air Act, then the Permittee is required to register this plan in
accordance with 40 CFR Part 68.
16. PREVENTION OF ACCIDENTAL RELEASES - GENERAL DUTY - Pursuant to Title I Part A
Section 112(r)(1) of the Clean Au Act "Hazardous Air Pollutants - Prevention of Accidental
Releases - Purpose and General Duty," although a risk management plan may not be required, if the
Permittee produces, processes, handles, or stores any amount of a listed hazardous substance, the
Permittee has a general duty to take such steps as are necessary to prevent the accidental release of
such substance and to minimize the consequences of any release. This condition is federally -
enforceable only.
17. GENERAL EMISSIONS TESTING AND REPORTING REQUIREMENTS - If emissions testing is
required by this permit, or the DAQ, or if the Permittee submits emissions testing to the DAQ in
support of a permit application or to demonstrate compliance, the Permittee shall perform such
testing in accordance with 15A NCAC 2D .2600 and follow all DAQ procedures including protocol
approval, regional notification, report submittal, and test results approval.

Floating dock: Approximately 8' in width by 16' in length = 128 sq. ft.
Fixed Platform: Approximately 10' in width by 12' in length = 120 sq. ft. (to be removed)
Boatlift: Approximately 13'in width by 13' in length (not counted towards allowable platform area)
Proposed access pier: Approximately 4' in width by 7' in length = 28 sq. ft. (credited as access)
Total=128 sq. ft.
It appears that the removal of the existing fixed platform and construction of the proposed access pier would
be consistent with rules 15A NCAC 07H.0208 (6) as well as rules 15ANCAC 07H.1200.
It is the opinion of this office that the proposed redi-rock bulkhead is CONSISTENT with the Use Standards for
Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 & .0207. In
the event, there are concerns from this agency or any other state or federal agencies regarding the associated
Coastal Wetlands impacts with the proposed redi-rock bulkhead construction, the project may be found to be
INCONSITENT. It is recommended that any permit issued include standard permit conditions for bulkhead
construction.

The applicant is proposing to construct approximately 50 linear feet of refi-rock bulkhead
with approximately 200 square feet of coastal wetland fill. The project is located at 72
Wilmington Street, adjacent to a manmade canal off the AIWW in Ocean Isle Beach,
Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are Estuarine
Waters, Estuarine Shoreline, Coastal Wetlands and PTA. Waters at the project site are
classified as SA; HQW and are not open to the harvesting of shellfish. The area is not a
Primary Nursery Area.
I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential.
In general, Ocean Isle Beach allows development in Residential classified AECs, which
is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use
Plan contains some policies, which exceed the State's minimum use standards. However,
none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Ocean Isle Beach Land Use Plan update.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Evans,
You have our approval, in accordance with the attached conditions and those listed below, to impact
a total of 0.009 acres (400 square feet) of 404 wetlands in order to construct 50 linear feet of
bulkhead and a new access pier as described in your application received by the N.C. Division of
Water Resources (DWR) on May 30, 2017. After reviewing your application, we have decided that
the impacts are covered by General Water Quality Certification Number 4097 (GC4097).
You should obtain or otherwise comply with any other required federal, state or local permits before you
go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -discharge,
and stormwater regulations. Also, this approval to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit. This

This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland
or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). This approval requires you to follow the conditions listed in the attached certification and any
additional conditions listed below.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee. If the property is sold, the new owner must be given a copy
of this approval letter and General Certification and is responsible for complying with all conditions. Any
new owner must notify the Division and request the Certification be issued in their name { 15A NCAC
02H .0501 and .0502).

2. Any final construction plans for this project must include or reference the application and plans
approved by the Division under this authorization letter and certification. The applicant will also be
required to evaluate all acquired permits to assure that they are consistent and all relative impacts are
accounted for and shown on the construction plans. [15A NCAC 02H .0502 (b) and 15A NCAC 02H
.0506 (4)] The applicant shall require his contractors (and/or agents) to comply with all of the terms
of this Certification, and shall provide each of its contractors (and/or agents) a copy of this
Certification.
Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices must be
used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this
Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [1SA
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance: .
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal law. If the Division determines that such standards or laws are not being
met, including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, than the
Division may reevaluate and modify this General Water Quality Certification. [15A NCAC
02H .0507(d)]
All mechanized equipment operated near surface waters or wetlands will be regularly inspected
and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic
fluids or other potential toxic chemicals. In the event of a hydrocarbon or chemical spill, the
permittee/contractor shall immediately contact the Division of Water Quality, between the hours
of 8 am to 5 pm at the Wilmington Regional Office at 910.796.7215 and after hours and on
weekends call (800) 858-0368. Management of such spills shall comply with provisions of the
North Carolina Oil Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506
(b)(3) and (c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].

8. Fueling, lubrication and general equipment maintenance should not take place within 50 feet of a
waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC 02H .0506 (b)(3)
and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or authorized
agent is required to return a completed certificate of completion form to the NCDEQ DWR
401 and Buffers Unit North Carolina Division of Water Resources, 1617 Mail Service Center,
Raleigh, NC, 27699 within ten days of project completion. The certification of completion is
available at: http://portal.ncdenr.ora/web/wq/swp/ws/401/certsandpennits/apply/forms).
Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form may be obtained from the OAH at http://www.ncoali.coin/ or by
calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH filing

On May 24, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a
copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
May 25, 2017 has determined that the development activities proposed at this time will not pose a threat to surface
water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to
construct approximately 50 linear feet of redi-rock bulkhead resulting in approximately 200 square feet of
coastal wetlands fill.
Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in
shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide
nursery functions and support fish production. Traditionally, aligning a bulkhead 4' waterward into coastal
wetlands would be subject to avoidance and minimization of impacts. However, because this redi-rock
seawall is intended to last in perpetuity with the property, the cumulative impacts of periodically rebuilding
less -permanent bulkheads will be avoided. Due to unique, site -specific characteristics, the structure must be
placed waterward of the existing failing bulkhead.

1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The
guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf.
Dredging is not authorized.
3. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast
Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact
the U.S. Coast Guard Marine Safety Office at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a
part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior
to implementation.
5. The permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the
Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free
navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of
Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States.
6. Approval of the structure is based on determinations that there would be no obstruction to navigation. The
structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as
relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave
wash.
7. The authorized structure and associated activity must not interfere with the public's right to free navigation on
all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by
the public of all navigable waters at or adjacent to the authorized work for reason other than safety.
8. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities
shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal
flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands.
9. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within
waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill
material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
10. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and
wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or
any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control
Act will be followed.
11. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from
an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic
materials (including debris from land clearing activities), or unsightly debris will not be used.
12. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the
authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination
procedures.
13. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit
in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated
with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of this project.
14. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in
sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to,
the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain
in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes
Chapter 113A Article 4).
15. . The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area
of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less
in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25
NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
16. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of
the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his
authorized representative may direct, restore the water or wetland to its pre -project condition.
17. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and
Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the
permittee's discovery of the violation.
