Bulkhead 1) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterw rd of the existing deteriorated bulkhead. 2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. RECEIVED 4) The bulkhead shall be constructed prior to any backfilling activities. Davis, Director Division of Coastal Management This permit and its conditions are hereby Michael Ervin Permit No. 94-17 Page 2 of 2 ADDITIONAL CONDITIONS 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 7) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 10) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The pemrittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. 2017-0825. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID No. SAW-2017-01497. These required items are summarized below: 1) The Return Receipts (green cards) or signed statements of no objection are needed to show proof of adjacent property owner notification, as required by15A NCAC 07J .0204. If you can provide to this office with the requested information within five working days from the date of this letter, DCM staff will continue processing of the application and the processing clock will not be suspended. If the required information is not received in this office within the specified timeframe, processing of the application will be suspended in accordance with 15A NCAC 07J.0204(d) until such time as the requested information is provided. It is also necessary that the standard review time be extended. An additional 75 days is provided by G.S. I I3A-122(c). It is the opinion of this office that the proposed bulkhead is CONSISTENT with the Use Standards for Coastal Wetlands, Estuarine Waters and Public Trust Areas, as set forth in NCAC 07H .0205, .0206 & .0207. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued provided the proposed bulkhead steps out in front of the existing bulkhead only what is necessary for the driving of the vinyl sheet piles and associated tie back system, with a 2' maximum distance waterward of the existing bulkhead. The project is located at 10 Monroe Street, adjacent to a mamnade canal off the AIWW in Ocean Isle Beach, Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters, Estuarine Shoreline and Coastal Wetlands and PTA. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, Ocean Isle Beach allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Ocean Isle Beach Land Use Plan update. PROJECT DESCRIPTION The applicant's property is located at 10 Monroe Street, adjacent a man-made canal contiguous with the AIWW in the Town of Ocean Isle Beach, Brunswick County. Directions from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd St. and travel approximately 0.21 miles. Turn left onto Monroe St. and travel approximately 0.1 miles. The project site will be located on the right side of the street. The project site is a canal front lot with approximately 50' of shoreline frontage. The elevation of the high ground area of the lot averages approximately 2'-3' above normal high water (NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The shoreline of the property has been stabilized with an existing timber bulkhead and the existing house structure is located approximately 19' landward of the existing bulkhead, with an existing porch located approximately 13' from the bulkhead. There is a lobe of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) located waterward of the property's bulkhead on the northern side and measuring approximately 15' in width by 17' in length. Normal High Water (NHW) is located along the existing bulkhead for the property. There is an existing docking facility which consists of a pier measuring approximately 4' in width by 23' in length. An existing ramp measuring approximately 4' in width by 16' in length leads to an existing floating dock aligned parallel to the canal which measures approximately 8' in width by 16' in length. The adjacent shorelines to the north and south have been stabilized with bulkheads the tie directly into. Both of the adjacent properties to the north and south are developed with single-family residences and docking facilities. No known archaeological sites are within the project vicinity. The Town of Ocean Isle Beach Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Residential. The waters of the canal are contiguous with the AIWW are classified SA by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to install approximately 50 linear feet of new vinyl bulkhead approximately 2' waterward of the current alignment with approximately 30 square feet of associated Coastal Wetlands fill. The applicant is proposing to install the tie -backs thru the existing wall to prevent land disturbance associated with removal of the old wall. This method of construction would also aim to alleviate threats to the existing porch which resides in close proximity relative to the existing bulkhead wall. ANTICIPATED IMPACTS The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the filling of approximately 230 square feet of Coastal Wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora) and approximately 70 square feet of open water within the Estuarine Waters Areas of Environmental Concern. The proposed bulkhead construction would result in the disturbance of approximately 900 square feet of high ground for the tie -back system.
