Street, near the town of Hertford as requested in the pernrittee's application dated 3/1/17 including attached
workplan drawings (9), all dated 2/14/17.
This permit, issued on May 8, 2017 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Marina and Travel Lift
1) This permit authorizes only the docks, piers, travel lift, tie pilings, and other structures and uses
located in or over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, shall become a permanent part of this marina without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.
2) In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no
pile driving shall be permitted between April 1 and June 30 of any year without the prior approval of
the Division of Coastal Management, in consultation with appropriate resource agencies.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the
qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.

ADDITIONAL CONDITIONS
Any modification of the approved marina design shall require a permit modification.
is No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the
'permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence
of the permitted structure.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
-This permit authorizes a maximum of 20 formalized boat slips.
The marina shall display a sign showing the location of the nearest pumpout facility, including other
appropriate waste disposal information, at the entrance and exit from the main pier.
=The travel lift, piers, and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor.
iTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day
operation of the facility to prevent facility waste from entering the adjacent waters. Such
discharge, either directly or indirectly, to adjacent waters could contravene state water quality
standards, thereby violating state law.
Shoreline Stabilization — Bulkhead/Rip Ran
'. The alignment of the authorized bulkhead and rip rap shall be staked by a representative of the Division
of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall
_require the alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected
start of construction.
I) The rip rap located on the eastern boundary shall not extend onto or in front of the adjacent riparian
property without fast obtaining written authorization from the property owner, and a copy of such
authorization provided to the Division of Coastal Management. Without first obtaining this
authorization, any and all reference to the originally proposed alignment onto the adjacent property in
-the attached permit application or workplan drawings is hereby considered null and void.
The bulkhead shall be constructed prior to any backfilling activities.
Z) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.

ADDITIONAL CONDITIONS
The fill material and rip rap shall be clean and free of any pollutants except in trace quantities.
Submerged Lands Easement
,An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
`construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
Navigational Aids
,.Unless specifically altered herein, this permit authorizes the installation of 4 day marker type
navigational aids, all as expressly and specifically set forth in the attached permit application and
Workplan drawings.
The navigational aids shall conform with any and all appropriate regulations governing such structures,
including but not limited to marking and lighting requirements of the N.C. Wildlife Resources
.Commission and/or the U.S. Coast Guard.
General
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
:waters at or adjacent to the authorized work.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
This permit does not authorize any land disturbing activities or development associated with the upland
property. The dispensing of petroleum products, sanding, sandblasting or painting associated with
vessel maintenance is not authorized under this permit. Future development of the permittee's property
may require a modification of this permit. Contact a representative of the Division at (252) 264-3901
prior to the commencement of any such activity for this determination. The permittee is further advised
that many non -water dependent activities are not authorized within 30 feet of the normal water level.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
'I.,,.This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage or injury to the authorized structure or work
which may be caused from existing or future operations undertaken by the United States in the public
interest.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to any authorizations
required from the NC Division of Water Resources.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-00571) issued 5/4/17.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Attached you will find the completed CAMA Major Permit Application package for the above refer-
enced project. This application is for permitting the necessary waterfront structures for a full service
boat maintenance facility on the designated 9.88 acre parcel in the Perquimans County Commerce
Center. The proposed facility is to be located on the west shore of the Perquimans River just south of
the U.S. Route 17 Bridge. The property is located in the Perquimans County Commerce Center. The
site currently has a composite sheet pile bulkhead across 164 LF of the shoreline which was installed
under a previous CAMA permit but the project was never completed. The bulkhead will be repaired
and reinforced as required to conform to the bulkhead sections included in the attached application
drawings, and will also have a 36 LF closure piece constructed to close off an existing partially complet-
ed boat launch ramp which will be filled and abandoned in place once the bulkhead closure is in place.
The disturbed land area for the bulkhead reinforcement and repair as well as the new bulkhead clo-
sure and fill at the boat ramp will be 5500 SF. There will be a 'Travelift' haulout slip constructed to ac-
commodate a 330,000 LB. (150 Metric Ton) capacity marine travelift for hauling vessels. There will be
20 slips with finger piers provided on a floating dock for the storage of boats waiting to be serviced or
hauled and for those on which work has been completed and are awaiting pick up by theirowners.
The site also currently has a 100' x 50' metal building and a 100' x 30' open concrete pad along the
front or southwest wall of the building which were constructed under a previous permit. The reason
for separating the waterfront structures from the upland development is to be able to take advantage
of a scheduling opportunity available with the contractor that is going to perform the waterfront
work.
Copies of the adjacent property owner letters and forms that were sent by certified mail along with
the project permit documents are included and we will forward you the completed forms when we
receive them back.

the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may

Gregg,
The project site is a mere 0.59 miles downstream from the portion of the Perquimans River that is designated a an Joint
AFSA. The same fish utilizing the area upstream are also utilizing this area and must pass through this area on their
spawning migration. The demarcation of that line is likely due to the area where WRC and DMF sampling stations occur
and the convenience of using the bridge and the line. The width of the river is a minimal consideration with the
anadromous species that use this system (blueback herring, alewife, and hickory shad). These fish generally travel along
the margins of the river in the near shore environment where the proposed development would occur. The Chowan
River for example is a much larger and wider body of water where the AFSA moratorium is used regularly.
On another topic of this project did the applicant ever provide more information about the upland development of the
site that would accompany the travel lift? Wash -down area, containment, etc. I know the guys with waters resources
were discussing it for a bit.

I am getting some push back from staff about the AFSA moratorium recommendation you both have in your
comments. There is concern with the number of pilings and the width of the river, and the benefit of conditioning
it. The Feds did not condition any moratorium and I looked into the area and could not find that portion of the river
designated on the DMF web maps. Could you all provide any additional comments to the importance of the moratorium
for this project so I can present to the higher ups tomorrow?

The project site is a 9.8-acre (430,404sf) tract located in the Perquimans County Commerce Center at 101
N. Granby Street, off Harvey Point Road (SR1336), approximately 3110 of a mile east of US Hwy 17, in
Perquimans County. The north side property has -217' of shoreline fronting on the Perquimans River, and
of that -200' is high ground that slopes down into a non -coastal wetland. The average elevation along an
existing bulkhead adjacent to the river is 8' above normal water level. The 200' section of high ground has
an existing damaged vinyl bulkhead with a 36' wide opening for a boat ramp that was authorized by CAMA
Major Permit #96-00, and issued to Perquimans County. The permit also included a ten -slip docking facility
and a travel lift haul -out facility. In August 2001, the permit was transferred to Anthony, Margie and Samantha
Wooddisse of Shore Flyte Marine, a marine sales and service business. Existing structures on the property
include a 100' x 50' building with a 100' x 30' concrete pad and two sections of bulkhead forming a ramp, 8'
below grade, that was never completed. There is no access road or drive on the property to access the water.
Soil on the high ground section of the property is Conetoe loamy sand sloping to the west into the adjacent
wetland.
Vegetation on the property includes, but is not limited to, american sycamore (Platanus occidentalis),
sweetbay (Magnolia virginiana), bald cypress (Taxodium distichum), tulip poplar (Lidodendron tulipffera), ash
(Fraxinus excelsior), loblloy pine (Pinus teada), greenbrier (Smilax rotundifolia), common goldenrod
(Solidago altissima), poison ivy (Toxicodendron radicans), pokeweed (Phytolacca amerfcana), spotted
spurge (Chamaesyce maculata), virginia creeper (Parthenocissus quinquefoliaand), and wild grape
vine/riverbank grape (Vdis ripada ). On the waterward side of the bulkhead there is a fringe of cypress trees
paralleling the shoreline. Mapping of the area does not show the project area as a known submerged aquatic
vegetation (SAV) habitat. Potential habitat has been identified-1,000' southeast of the property. While no
SAVs have been observed in the area, repeated verbal and written requests for SAV information were
disregarded by the consultant.
The adjacent water bottom is a sandy substrate with varying depths ranging from -2' at the bulkhead, -11.5'
at a distance of 200' offshore and -8' at 230' offshore. There is a -500' long sandbar paralleling the shoreline
-275' offshore that extends 250' past the applicant's property to the southeast. Water depths along the
sandbar shallow to 4.5'. The Perquimans River is-5,000' wide its narrowest point from the applicant's
property.
Located northwest of the project site is farmland and southeast of the site is a NC Wildlife Resources
Commission boat ramp that is currently under construction. The property is across the street from the future
site of the Perquimans County Marine Industrial Park that received a CAMA Major Permit #15-11 under the
name NC Seafood Park, which authorized the construction of a large boat basin for commercial vessels.
Uses within % mile of the site include agricultural, historical (Newbold White House), commercial, and
recreational. Applicant's consultant was not able to produce reaaesf �cr�y�f f�e�heological Report noted
in the enclosed application. f C
Development Proposal MAR 17 2017
Elite Management, LLC has proposed the construction ofDO* MAPaQi9ttXo travel lift piers, the
closing and filling of a 36' wide x 120' boat ramp, and the repair of two breaches in the existing bulkhead.
The proposed development is the first step in an overall development plan that will include a boat /barge
repair and maintenance facility that will include extensive grading, an access road for the travel lift and a
storm water retention pond.

footprint. The owner has not purchased a floating system pending permit approval. The facility is

placed on the proposed dock.

The proposed development is the first phase of a boat and barge maintenance facility. The consultant is
aware that any possible approval of the current development plan is no assurance of future permit approvals.
This application would simply provide the property owner the ability to construct water based infrastructure
in preparation for future development that would accommodate a boat and barge maintenance facility.
The consultant states in the MP4 Form under Docking Facility/Marina Operations that industrial pollutants
will be handled in the following manner: "Booms and diapers will be kept on site for any potential vessel leaks,
and paint and waste will be contained on the existing concrete slab and disposed in proper containers for
removal by a licensed waste disposal contractor". The existing concrete slab (adjacent to the existing
building) is —675' from the proposed travel lift haul -out site with no improved roadlaccess from the proposed
haul -out site to the concrete slab. The ground is rutted and unsuitable for a 150-ton capacity travel lift. The
has been notified that an acceptable plan would be required prior to allowing any vessel maintenance on the
property, and is subject to approval by the Division of Energy, Mineral and Land Resources.
Anticipated Impacts
The proposed development, if approved, will result in the following impacts:
1) Increased boating in conjunction with the proposed facility.
2) Increased fuel and oil in surrounding waters associated with the vessels using the facility.
3) The installation of sheathing and pilings for the piers and bulkhead will result in temporally turbidity
adjacent to the work area.
4) High ground disturbance associated with the proposed development will be 7,367sf.
5) Floating and stationary docks and piers will result in the shading of 4,130sf of open water.
6) Lot cover within the 30' buffer totaling 320sf, or 1.6%.
7) Proposed development will result in the filling of 686sf of Shallow Water Bottom.
8) If approved as requested maintenance work involving possible pollutants will be conducted on the
property without appropriate precautions.
9) If approved as requested, the placement of riprap on the comers of the existing bulkhead will result
in the encroachment of —60sf into an adjacent non -coastal wetland and —30sf onto an adjacent
property.

future marina at this site. Through discussions with several review agencies, you were advised that
the future marina will require a State stormwater permit prior to any upland development; and a
Federal stormwater permit prior to the operation of any industrial activities at the marina.
By letter dated May 2, 2017, your consultant, Mr. Hal Goodman, provided additional
information, along with a conceptual plan for the marina. The conceptual plan is not adequate to
conduct a formal review, nor determine whether the necessary stormwater permits may be issued
for this project. For this reason, we are considering the information provided for this CAMA Major
application to be'incomplete and updating our stormwater files to show this project as "returned
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC'2H.1000 and may result in appropriate enforcement actions by
this Office.

Elite Management, LLC has proposed the construction of a 20-slip docking facility, a travel lift haul -out with
two piers, the closing and filling of a 36' wide x 120' boat ramp, and the repair of two breaches in the existing
bulkhead. The proposed development is the first step in an overall development plan that will include a boat
/barge repair and maintenance facility that will include extensive grading, an access road for the travel lift and
a storm water retention pond.
I have reviewed the rules as they pertain to marinas and bulkheads, and would like to offer the following:

(b) Specific Use Standards
(5) Marinas shall comply with the following standards:
(A) Marinas shall be sited in non -wetland areas or in deep waters (areas not requiring dredging)
and shall not disturb shellfish resources, submerged aquatic vegetation as defined by the
MFC, or wetland habitats, except for dredging necessary for access to high -ground sites. The
following four alternatives for siting marinas are listed in order of preference for the least
damaging alterative; marina projects shall be designed to have the highest of these four
priorities that is deemed feasible by the permit letting agency:
(i) an upland basin site requiring no alteration of wetland or estuarine habitat and
providing flushing by tidal or wind generated water circulation or basin design
characteristics;
(ii) an upland basin site requiring dredging for access when the necessary dredging and
operation of the marina will not result in significant adverse impacts to existing fishery,
shellfish, or wetland resources and the basin design shall provide flushing by tidal or wind
generated water circulation;
(iii) an open water site located outside a primary nursery area which utilizes piers or
docks rather than channels or canals to reach deeper water; and
(iv) an open water marina requiring excavation of no intertidal habitat, and no dredging
greater than the depth of the connecting channel.
Consistent: The marina will be in open water with no alteration to wetlands and no
excavation.

(B) Marinas which require dredging shall not be located in primary nursery areas nor in areas
which require dredging through primary nursery areas for access. Maintenance dredging in
primary nursery areas for existing marinas shall comply with the standards set out in Part
(b)(1)(1) of this Rule;
Consistent: No dredging required.
(C) To minimize coverage of public trust areas by docks and moored vessels, dry storage
marinas shall be used where feasible;
Consistent: No storage or long term dockage.
(D) Marinas to be developed in waters subject to public trust rights (other than those created by
dredging upland basins or canals) for the purpose of providing docking for residential
developments shall be allowed no more than 27 square feet of public trust areas for every one
linear foot of shoreline adjacent to these public trust areas for construction of docks and
mooring facilities. The 27 square feet allocation does not apply to fairway areas between
parallel piers or any portion of the pier used only for access from land to the docking spaces;
Consistent: Commercial facility.
(E) To protect water quality in shellfishing areas, marinas shall not be located within areas where
shellfish harvesting for human consumption is a significant existing use or adjacent to such
areas if shellfish harvest closure is anticipated to result from the location of the marina.
Consistent: No shellfishing in or near the project area.
(F) Marinas shall not be located without written consent from the leaseholders or owners of
submerged lands that have been leased from the state or deeded by the state;
Consistent: No known leasehold in or near the project area.
(G) Marina basins shall be designed to promote flushing through the following design criteria:
Consistent: Open water location.
(H) Marinas shall be designed so that the capability of the waters to be used for navigation or for
other public trust rights in estuarine or public trust waters are not jeopardized while allowing
the applicant access to deep waters;
Consistent: Navigation will not be jeopardized within or near the project area. Markers
to be installed on up river and down river sides of an existing sandbar for safety.
(1) Marinas shall be located and constructed so as to avoid adverse impacts on navigation
throughout all federally maintained channels and their boundaries as designated by the US
Army Corps of Engineers.
Consistent: Project site is not within a federally maintained channel.
(J) Open water marinas shall not be enclosed within breakwaters that preclude circulation
sufficient to maintain water quality;
Consistent: Project does not include a breakwater.
(I) Marinas which require dredging shall provide areas in accordance with Part (b)(1)(B) of this
Rule to accommodate disposal needs for future maintenance dredging, including the ability to

(L) Manna design shall comply with all applicable EMC requirements for management of
stormwater runoff. Stormwater management systems shall not be located within the 30-foot
buffer area outlined in 15A NCAC 07H .0209(d);
Consistent: No storm water management systems.
(M) Marinas shall post a notice prohibiting the discharge of any waste from boat toilets and listing
the availability of local pump -out services;
Consistent: Two signs will be posted on the proposed docking facility.
(N) Boat maintenance areas shall be designed so that all scraping, sandblasting, and painting will
be done over dry land with collection and containment devices that prevent entry of waste
materials into adjacent waters;
Per the application the concrete slab and building may be used for maintenance using a
"Diapers" collection system for potential pollutants. While this is not an acceptable
method of collection, the intent of this permit was to establish waterfront infrastructure
and come back later for additional permits to complete the maintenance facility.
(0) All marinas shall comply with all applicable standards for docks and piers, shoreline
stabilization, dredging and dredged material disposal of this Rule;
Consistent: No dredging.
(P) All applications for marinas shall be reviewed by the Division of Coastal Management to
determine their potential impact to coastal resources and compliance with applicable
standards of this Rule. Such review shall also consider the cumulative impacts of marina
development in accordance with G.S.113A-120(a) (10);
Consistent: Permit issued for a marina in 2000.
(Q) Replacement of existing marinas to maintain previous service levels shall be allowed
provided that the development complies with the standards for marina development within this
Section.
Consistent: New marina, not replacement.
(7) Bulkheads:
(A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of
normal high water or normal water level;
Consistent: The proposed bulkhead will be in line with the existing bulkhead and will
only be placed waterward of NWL at two breaches and in the existing "incomplete" boat
ramp.
(B) Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant
adverse impacts to the resources;
Consistent: Wetlands involved are non -coastal.
(C) Bulkhead backfill material shall be obtained from an upland source approved by the Division of
Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project
involving excavation from a non -upland source, the material so obtained may be contained
behind the bulkhead;
Consistent: Applicant will obtain backfill from a high ground commercial source.

(D) Bulkheads shall be permitted below normal high water or normal water level only when the
following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features,
e.g. steep grade bank, which will cause the applicant unreasonable hardship under the
other provisions of this Rule;
Consistent: Erosion at breaches.
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of
application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship
resulting from the unusual geographic or geologic features;
Consistent: Alignment with existing bulkhead.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners;
Consistent: No adverse impact to public trust rights.
(iii) the need for a bulkhead below normal high water or normal water level is documented by
the Division of Coastal Management; and,
Consistent: Small area of erosion behind existing bulkhead.
(iv) the property to be bulkheaded is in a non -oceanfront area. Consistent: Yes.
(E) Where possible, sloping rip -rap, gabions, or vegetation shall be used rather than bulkheads.
Consistent: Existing 8' high bulkhead.
Comments:
As noted previously, the applicant has requested development as a precursor to future development that
will include a boat and barge maintenance facility. However, the application notes activities in the
application that would indicate that some maintenance may occur prior to the installation of necessary
improvements to meet the full needs of a maintenance facility.
Proposed riprap at the northwest comer of the existing bulkhead would result in - 60sf of non -coastal
wetland fill, that could be avoided by moving the placement - 5'. Proposed riprap at the southeast comer
of the existing bulkhead would result in a -30sf encroachment onto the adjacent property without
authorization.
Based on a review of the application, narrative, plans, and the Division's rules I would like to
recommend approval of the request with the following permit conditions:
1) The dispensing of petroleum products is not permitted on the property without approval by the
Division of Energy, Minerals, and Land Resources and modification of the CAMA Major Permit.
2) No sanding, sandblasting, or painting associated with boat or barge maintenance may be
conducted on the property, without approval by the Division of Energy, Minerals, and Land
Resources and modification of the CAMA Major Permit.

Good afternoon Mr. Shoaf,
Our office originally submitted the attached permit application package for Elite Management, LLC, to State and Federal
Review agencies on March 14, 2017, with a review deadline of April 4, 2017. At that time a packet was sent to the
Perquimans County Planning Department. However, it has been brought to my attention that the property site,
although owned by Perquimans County, falls under the jurisdiction of the Town of Hertford. Charlan Owens felt that the
Town should have the opportunity to review Elite Management's proposal.
I know that April 4`h may not give you enough time for a sufficient review. Normally we give the review agencies 21 days
from the date of the Memorandum to respond. The public comment period runs through April 11`h. We would greatly
appreciate any input you may have, and ask that you send your comments to Gregg Bodnar as soon as it is feasible.

at 101 N. Granby Street, at the Perquimans County Commerce Centre, in the Town
of Hertford.

Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016.
Overview: The 9.8 acre subject property has approximately 217 linear feet of shoreline along the
Perquimans River. The Perquimans River is approximately 5,000 feet wide at this location. Water
depths range from -2 feet at the shoreline, -11.5 feet a distance of 200 feet offshore and -8 feet a
distance of 230 feet offshore. A sandbar averaging about 35 feet in width and 500 feet in length
parallels the shoreline approximately 275 feet offshore. Water depths shallow to -4.5 feet along
the sandbar. Approximately 200 linear feet of the property's shoreline is high ground, with the
remainder sloping into a Section 404 wetland. The average site elevation at the shoreline is 8
feet above Normal Water Level (NWL). The site is primarily cleared with some trees, and contains
wooded wetland areas and a fringe of cypress trees at the shoreline. Wetland and shoreline
areas of the site are located in the AE Floodzone, with the remainder located outside of the
floodplain.
Existing site improvements consist of a 100 foot by 50 foot building with a 100 foot by 30 foot
concrete pad accessed from an unimproved driveway off North Granby Street. Existing shoreline
improvements consist of two (2) sections of damaged vinyl bulkhead totaling 164 linear feet with
a 36 foot wide by 120 foot long opening 8 feet below grade to accommodate a boat ramp that was
never installed. The bulkhead has been breached in two (2) areas. There is no access road to
the shoreline improvements.

Installation of a twenty (20)-slip boat docking facility consisting of a 6 foot wide by 10 foot long

two (2) 6 foot wide by 90 foot long travel lift piers and an 8 foot wide by 40 foot long concrete
travel lift apron, and; installation of 36 linear feet of bulkhead, bulkhead fill and riprap are
proposed. Two (2) "No Sewage Discharge" signs will be placed on the dock. The bulkhead will
be installed to close off the boat ramp. The boat ramp will be filled along with the two (2) breached
area. Riprap will be installed at the northwest and southeast corners of the existing bulkhead,
with encroachments into Section 404 wetland and onto an adjacent property without authorization.
For safe navigation, four (4) day markers will be placed on the up river and down rivers sides of
the sandbar.
This is the first step of an overall development plan for a boat/barge repair and maintenance
facility. The facility will require extensive grading, an access road for the travel lift and a storm
water retention pond —items not included in this application. The applicant has been notified that
an acceptable plan will be required prior to allowing any vessel maintenance on the site.
The waters of the Perquimans River in this area are classified as Class SB waters and are closed
to shellfish taking. Mapping of the area does not show the project area as known submerged
aquatic vegetation (SAV) habitat. Potential submerged aquatic vegetation (SAV) habitat has been
identified approximately 1,000 feet southeast of the property. SAV information has not been
provided by the applicant. A review of historic and archaeological resources has not been
provided. An existing archaeological report noted in the application was not provided.
Anticipated Impacts resulting from this project are expected to include: the shading of 4,130 sq.
ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the filling of 686
sq. ft. of Public Trust Area/Estuarine Waters AEC and 4,996 sq. ft. of High Ground within the
Estuarine Shoreline AEC, and; the grading/disturbance of 2,698 sq. ft. of High Ground within the
Estuarine Shoreline AEC.
Encroachment of riprap into a Section 404 wetlands area within the Estuarine Shoreline AEC is
also indicated.
Basis for Determination:
The property is designated as "Commercial' on the Town of Hertford Future Land Use Map
(FLUM). This property is located in the Perquimans County Commerce Centre within the
Town of Hertford.

On March 21, 2017, the Division of Water Resources (Division) received your application dated March 14,
2017, requesting a 401 Water Quality Certification from the Division for the subject project. The Division
has determined that your application is incomplete and cannot be processed. The application is on -hold
until all of the following Information Is received:
1. SW Plan Coastal Stormwater and NCG190000 for Marinas— Phase Plan:
Based on a review of your application, this Office will require the submittal of a conceptual
stormwater management plans for the future phases of the project that includes the following:
a. A depiction of the drainage areas on the site.
b. An estimate of the percent imperviousness associated with each of the drainage areas.
c. A calculation of the water quality volume associated with each drainage area.
d. A depiction of a BMPs proposed for the site. For each BMP, note the size and type on the

information provided with your application, I have drawn the following conclusions:
(1) You propose to establish a commercial marine repair business on a 9.88-acre site
located at 101 N. Granby Street near Hertford, NC. [Formerly operated & know as
Shore Flyte Marina]
(2) Your application & site plan provides details for the first phase of the development
which includes construction of docking facilities, travel lift piers, bulkhead work; all of
which are represented as "water dependent infrastructure; but does not propose any
new upland development.
(3) You are aware of the requirement to apply for, and obtain, a Coastal State
Stormwater Permit for any proposed upland development, prior to beginning said
upland development; upland development meaning any impervious type
surface. The previous stormwater permit issued to Shore Flyte Marina for this site has
expired. This type of permit would be reviewed & issued by this office.
(4) You are aware of the requirement to apply for, and obtain, a separate and different
stormwater permit for industrial activities regulated by the Federal Stormwater Rules;
more specifically, a permit for marine activities covered by the North Carolina General
Stormwater Permit for Marina activities (NCG19). An NCG19 permit for marina
activities was issued to the previous owner for this site, but is now inactive. An
application for coverage under this permit is reviewed by DEMLR & issued from our
Central Office in Raleigh.
Mr. Rivera and Mr. Goodman, given the scope and complexity of your project, especially
the intended use of the site, it would be beneficial to all parties & agencies involved to share
& discuss the permit requirements & process through a formal scoping
process. Unfortunately this scoping process has not occurred. I understand the sense of
urgency to begin construction for the "water dependent infrastructure" and your desire to
obtain the necessary CAMA Major permit in a timely manner. However, there are
environmental issues & concerns that could be better addressed "upfront" in the review of a
project, rather than after development has begun.
Mr. Rivera, in order for our office to submit favorable comments to the Division of Coastal
Management regarding your CAMA application, we are requesting your comments,
questions & general acknowledgement, particularly to items (3)&(4) of this email. You can
submit your comments by letter to me at this office. We look forward to working with you

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant is
proposing a 20-slip docking facility, travel lift, and repair of sections of bulkhead. The docking facility
will consist of a floating dock spine 214' x 8' and have multiple narrower finger piers with tie pilings.
The travel lift piers will be 90' x 6' in length and the lift area will have water depths of approximately -5'
NWL. Bulkhead replacement and associated fill will be along several short sections of bulkhead as well
as across the face of an existed dilapidated boat ramp.
The project is located adjacent to the Perquimans River south of highway 17. This area of the river is
utilized by anadromous fish such as blueback herring and alewife during their spawning migration in the
spring of the year. Activities such as driving pilings on a large scale can cause disruptions to fish during
this yearly spawning migration. To reduce the potential for negative impacts to these fish during the
spawning migration an in -water work moratorium from April 1 — June 30 is recommended.

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish, wildlife, and public access resources. The project site is
located at 101 N. Granby Street adjacent to a NCWRC public access area and NC Seafood Park Authority
site adjacent the Perquimans River in Hertford, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended, 16 U.S.C. 661 et seq.).
The applicant proposes to construct a 20-slip docking facility, travel lift piers, bulkhead, and associated
infrastructure for a boat / barge repair and maintenance facility. Details on the upland development was
not provided, but water dependent development includes a 20-slip docking facility for vessels up to 50' in
length that has slip depths varying from 4' to -5.5' NWL, two travel lift piers, the closing and filling of a
36' by 120' unfinished boat ramp, riprap, and other shoreline stabilization reinforcements. The
Perquimans River at this location is classified SB by the Environmental Management Commission and is
designated an anadromous fish spawning area (AFSA) by the NCWRC.
We have reviewed the permit application and believe there is insufficient information to adequately
determine the impacts this project will have on wildlife resources. Items of concern include the following:
• The project proposal did not include a complete development layout. It is difficult to understand
the project's overall scope if it is not presented during this process.

• A 20-slip marina should have a marina management plan to address emergency action toward
spills, location of spill and safety equipment, presence of a dockmaster, docking rules, and other
contact information.
• A vessel maintenance yard has the potential to introduce considerable toxins into the adjacent
water body depending on type of maintenance performed at the facility and means to contain
waste. Details regarding services provided and management practices must be provided to insure
the site will not introduce toxins to the area.
• The site is adjacent to a NCWRC boating access area (BAA). There is concern that the extended
20-slip facility may further congest the area once the BAA and Perquimans Marine Park are built
out.
• The Perquimans Marine Park was designed to contain industrial type facilities "in the hill" to be
accessed by the dredged basin. This design allows easier containment of spills and minimizes
user conflict with the public. It also was a reason to justify allowing an access channel to be
dredged from the Marine Park to the channel within the Perquimans River. Discussion should be
provided as to why this facility is not proposed in the Marine Park.
• The Perquimans River is a designated AFSA. Any permitted in -water work should adhere to a
February 15 — June 30 moratorium.

2. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality
Certification(s) 4097. [15A NCAC 02B .0507(c)]
3. Turbidity Standard
The Permittee shall adhere specially to 15A NCAC 02B .0222 Tidal Salt Water Quality for
Class SB Waters (3)(g) pH: shall be normal for waters in the. area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of -natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; if turbidity exceeds this level due to natural background conditions, the
existing turbidity level shall not be increased. (15A NCAC 02B .0222]
Continuing Compliance
4. Pump-outs/Sewage Disposal
No sewage shall be allowed to be discharged at any time from boats using the marina.
Appropriate signage should be posted prohibiting sewage discharge and providing
appropriate waste disposal"information. [15A NCAC 02H .0506 (b)(3)]
5. Fueling Facilities
Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a'waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)]
6. Number of Slips/Dock Space
Use of dock space other than the approved 20 slips is prohibited'. Handrails or other
devices, including signage, should be used to discourage use of any dockfpace other than
the 20 designated dockage slips as shown in the approved plan. [15A NCAC 071-1.1205]
Other Conditions
Any marina project that proposes a pumpout with a storage tank are classified as a Non -
Pumpers and will need to obtain a "Non -Pumper" permit from the Division of Waste
Management, Solid Waste Section and provide a copy to this Office prior to the

8. Fueling at Marina Projects
Any marina project that proposes to dispense or store fuel shall provide an EPA approved
Spill Prevention Control and Countermeasure (SPCC) plan to this Office before the fueling

(NCG190000) approval letters from the Division of Energy, Mining and Land Resources
(DEMLR) to the DWR 401 & Buffer Permitting Unit (1617 Mail Service Center, Raleigh, NC
27699-1617) prior to the beginning of operations. Activities that constitute operations
are hauling of boats, slip occupancy and/or boat maintenance. The project must be
constructed and maintained in compliance with the approved SMP and NCG190000.
After the approval letter is submitted to the Division, the SMP and NCG190000 may not
be modified without priorwritten authorization from DEMLR. If the SMP and NCG190000
are modified in the future, then you shall provide an approval letter for the modifications
to the DWR 401 & Buffer Permitting Unit prior to the commencement of the
modifications. [15A NCAC 02H .0506(b)(5)]
10. Closed -Loop Recycle System Permit
You are required to obtain a closed -loop recycle system permit prior to the beginning of
marina operations. Activities that constitute operations are hauling of boats, slip
occupancy and/or boat maintenance. [35A NCAC 02H .0506(b)(5) and 15A NCAC 02T
.1003(3)]
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Admiriistrative Hearings (hereby known as

Attached you will find the preliminary proposed stormwater plan for the above referenced project.
This preliminary plan is for permitting the necessary waterfront structures for a full service boat
maintenance facility on the designated 9.88 acre parcel in the Perquimans County Commerce Center.
The proposed facility is to be located on the west shore of the Perquimans River just south of the U.S.
Route 17 Bridge. The property is located in the Perquimans County Commerce Center. The site cur-
rently has a composite sheet pile bulkhead across 164 LF of the shoreline which was installed under a
previous CAMA permit but the project was never completed. The bulkhead will be repaired and rein-
forced as required to allow operation of the proposed 150 ton capacity travelift and it will also have a
36 LF closure piece constructed to close off an existing partially completed boat launch ramp which
will be filled and abandoned in place once the bulkhead closure is in place. The disturbed land area for
the bulkhead reinforcement and repair as well as the new bulkhead closure and fill at the boat ramp
will be 5500 SF. There will be a Travelift' haulout slip constructed to accommodate a 330,000 I.B. (150
Metric Ton) capacity marine travelift for hauling vessels. There will be 20 slips with finger piers provid-
ed on a floating dock for the storage of boats waiting to be serviced or hauled and for those on which
work has been completed and are awaiting pick up by their owners. The site also currently has a 100' x
50' metal building and a 100' x 30' open concrete pad along the front or southwest wall of the building
which were constructed under a previous permit. Future upland development will involve construction
of a 100' x 40' concrete washdown pad just landward of the travelift slip. The washdown pad will slope
to a central drain and the captured effluent will be piped to a collection box with a filtration system.
The clean effluent will be piped to a holding tank as shown on the attached plan. This water in the
holding tank will then be recycled for re -use as washdown water. The washdown pad area will be sur-
rounded by a "ClearSpan' fabric structure to confine any airborne spray generated during the wash -
down process to the concrete pad to drain and be filtered. Additionally, A portion of the surface be-
hind the bulkhead along with a road to the existing building will be graded to slope to the infiltration

pond and have a gravel surface placed. There will be a second infiltration pond placed near the front
right corner of the property just off Granby Street. This pond will treat the runoff from around the
existing building and concrete slab as well as the remainder of the front portion of the property. This
submittal is preliminary and is meant to provide your office with a conceptual plan of what is pro-
posed as we are currently in the process of just obtaining permits to install the waterfront facilities
and will then submit detailed plans and design calculations for the upland development and the han-
dling of stormwater runoff as well as washdown water so that we may obtain all of the necessary
permits to comply with the water quality and wastewater management regulations.

The NC Division of Coastal Management hereby acknowledges receipt of your application for the Elite
Management Services on October 4, 2016. My review has revealed certain deficiencies, which must be
corrected before the application package can be accepted as complete. To assist you in expediting the
permitting process as much as possible, I am notifying you of these deficiencies immediately so that they can
be quickly corrected to facilitate my detailed review.
I am retaining the original application package so that I may continue reviewing the project. Please understand
that the subsequent detailed review may reveal additional areas where further information or documentation
is required to demonstrate compliance with the rules directly applicable to the proposed development. If this
occurs, you will be notified of such issues separately.
My initial screening has identified the following deficiencies:
Narrative: Please give a complete description of the proposed development. The Narrative should
include not only the travel lift, bulkhead and dock, but all of the development listed in the application
forms. In addition, the Narrative should address existing conditions on the property including the two
large breaches in the existing bulkhead, the section of existing bulkhead on the northwest comer that is
—7' landward of the proposed alignment, the 137'-144' sloping ramp with vinyl walls (>6' above grade at
normal water level). The project also includes hydraulic dredging, the construction of a bermed spoil
retention pond and a stormwater pond, that should be addressed. RECEIVED

Sheet 3 of 7: Site Plan must show the entire tract (property) and all proposed development.

b. Show all proposed imperious surfaces, including the 200' x 1 00'"compacked" graveled area
immediately landward of the bulkhead.
c. Show the maintenance area where sandblasting and painting will occur and the system that

h. The location of the bulkhead is incorrectly shown on the northwest comer. It is approximately
7' landward of the bulkhead on the other side of the unfinished boat ramp.

not appears to be as depicted on the site plan.

I. The spot elevation shown in the boat ramp access is incorrect.
m. Show the full extent of the dredge area. The plan measures —137' waterward of normal water
level (NWL) and 27.9' wide, and the application states that it will be 160' x 40'.
n. It appears that the bulkhead and boat ramp shown on the site plan are from the original
drawing submitted for CAMA Major Permit #96-2000, issued in June of 2000. The actual
location of the bulkhead and ramp were slightly altered at construction and included cut and
fill, altering elevations. Please change as needed for consistency.
Sheet 4 of 7: This is a second site plan with only one difference being a sand bar waterward of the
proposed docking facility. Is this area to be dredged. Please clarify on the plan and
and to the application's Excavation and Fill Table if needed.
4. Additional information required:
a. Cross section drawing of the bulkhead at the boat ramp.
b. Cross section drawing of travel lift show include the full extent of the proposed dredge area
160' from NWL as stated in the application.
c. Cross section drawing of the dredge spoil berm.
d. Note the retention capability of the proposed dredge spoil retention pond.
e. The placement of a compacted gravel work area 100' from the bulkhead will result in 100%
lot cover within the 75' AEC. An engineered "innovative" stormwater system is required to
meet the intent of the 30% lot cover limitation.
f. Please check water depths on the plan. The depths shown in1999 are significantly different
from the current depth (10' or greater). While some change is anticipated a depth change of
more than 10' is unusual.
g. Note on plan when a Submerged Aquatic Vegetation (SAV) survey was conducted and your
findings.

Attached you will find the preliminary proposed stormwater plan for the above referenced project.
This preliminary plan is for permitting the necessary waterfront structures for a full service boat
maintenance facility on the designated 9.88 acre parcel in the Perquimans County Commerce Center.
The proposed facility is to be located on the west shore of the Perquimans River just south of the U.S.
Route 17 Bridge. The property is located in the Perquimans County Commerce Center. The site cur-
rently has a composite sheet pile bulkhead across 164 LF of the shoreline which was installed under a
previous CAMA permit but the project was never completed. The bulkhead will be repaired and rein-
forced as required to allow operation of the proposed 150 ton capacity travelift and it will also have a
36 LF closure piece constructed to close off an existing partially completed boat launch ramp which
will be filled and abandoned in place once the bulkhead closure is in place. The disturbed land area for
the bulkhead reinforcement and repair as well as the new bulkhead closure and fill at the boat ramp
will be 5500 SF. There will be a `Travelift' haulout slip constructed to accommodate a 330,000 LB. (150
Metric Ton) capacity marine travelift for hauling vessels. There will be 20 slips with finger piers provid-
ed on a floating dock for the storage of boats waiting to be serviced or hauled and for those on which
work has been completed and are awaiting pick up by their owners. The site also currently has a 100' x
50' metal building and a 100' x 30' open concrete pad along the front or southwest wall of the building
which were constructed under a previous permit. Future upland development will involve construction
of a 100' x 40' concrete washdown pad just landward of the travelift slip. The washdown pad will slope
to a central drain and the captured effluent will be piped to a collection box with a filtration system.
The clean effluent will be piped to the infiltration pond as shown on the attached plan. The washdown
pad area will be surrounded by a "ClearSpan' fabric structure to confine any airborne spray generated
during the washdown process to the concrete pad to drain and be filtered. Additionally, A portion of
the surface behind the bulkhead along with a road to the existing building will be graded to slope to
the infiltration pond and have a gravel surface placed. There will be a second infiltration pond placed

around the existing building and concrete slab as well as the remainder of the front portion of the
