Channel Drive Wrightsville Beach , as requested in the permittee's application dated 1/2/17 (MP-1)-12/29/16 (MP-2) and 9/15/16 (MP-4) incl. attached workplan drawings (3), 2-4 of 4, all dated 1/12/17. This permit, issued on May 11, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the reconfigured docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires firrther Division approval. In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Stewart Edwards Permit No. 31-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) This permit does not authorize any tie pilings associated with Slip No. 1. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 8) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the established Wrightsville Beach pier head line. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Bulkhead 10) The bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawing. 11) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 12) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 13) The bulkhead shall be constructed prior to any backfilling activities. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) All backfill material shall be clean and free of any pollutants except in trace quannues.RECEIVED MAY 18 2017 Sedimentation and Erosion Control �+nA nnAA HH nn rr ��TT 17) In order to protect water quality, runoff from construction shall not visibIPP asC't I am'd9t of suspended sediments in adjacent waters. 0 t Stewart Edwards Permit No. 31-17 Page 3 of 3 ADDITIONAL CONDITIONS 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 20) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. 22) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 & Nationwide Permit 18 (Action ID No. SAW-2017-00219), which was issued on 2/6/17. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 2017-0072. NOTE: An application processing fee of $400 was received by DCM for this project. (90 sq. ft. not calculated for access credit) Proposed floating docks = 8 ft. x 28 ft. = 224 sq. ft. 4 ft. x 16 ft. = 64 sq. ft. 6 ft. x 16 ft. = 96 N. ft. Total = 504 sq. ft. The docking facility would provide docking space for up to five (5) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule and the pier width rule. Specifically, the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6)(G)(iii), including the official pier -head line established by the Town of Wrightsville Beach, the 1/4 width and channel location. The proposed structures would be located entirely over open water within the applicant's area of riparian access. It is the writer's recommendation that any permit issued should include standard permit conditions for docking facilities. It is the staffs recommendation that the applicant's proposal to install approximately 77 linear feet of bulkhead with approximately 30 square feet of coastal wetland fill water ward of the existing deteriorating bulkhead is CONSISTENT with the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for Estuarine Waters, Rules of 15 NCAC 7H.0207 (d) Use Standards for Public Trust Areas and Rules of 15 NCAC 7H.0208 (b)(7) Use Standards for Bulkheads. The project is located at 612 N. Channel Drive in Wrightsville Beach, New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are ES, EW and PTA. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach Land Use Plan and offer the following comments. The general area of the project is classified Developed, while the AECs impacted by the work are classified as Conservation/Resource Protection. In general, the Town of Wrightsville Beach allows development in Conservation/Resource Protection classified AECs which is consistent with the State's minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some policies, which exceed the State's minimum use standards including those for piers and marinas. However, none of these more restrictive policies seem to be applicable to this project. This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan. Staff review of the plans and specifications 1cations on January 20, 7 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first. PROJECT SUMMARY: The applicant proposes to replace an existing bulkhead and ppriv e docking facility along the edge of Banks Channel. JAM 1� 2017 DCM- MHD CITY o Stewart Edwards Page 2 9. PROJECT DESCRIPTION The project site is located at 612 N. Channel Blvd., adjacent to Banks Channel in the Town of Wrightsville Beach, New Hanover County. To locate the project site from the WiRO take US Hwy 74/76 to Wrightsville Beach. Travel across the drawbridge and keep right on Causeway Drive. Turn left on N. Channel Blvd. just before the Causeway Bridge leading to the barrier island. Continue to the terminal end of N. Channel Blvd. and the property will be located on the right hand side of the road, at the end of the cul-de-sac. The project site is approximately 0.18 acres in size, which the applicant currently maintains a single-family residence. The highground is vegetated primarily with maintained lawn grass and ornamental landscaping. The project site has approximately 77 linear feet of shoreline frontage along Banks Channel, which is stabilized by a timber bulkhead and Normal High Water (NHW) meets the bulkhead. There is a very small stand of Coastal Wetlands (Smooth Marsh Cordgrass - Spartina Alterniora) along the outer edge of the existing wall, near the applicant's northern property comer, which is approximately 6' x 5' in size. At the property, the applicant also maintains a private docking facility, which consists of a fixed pier (6' x 48') that extends to a covered platform (14' x 15'), which connects (via ramp) to a horseshoe shaped floating dock. A 12' x 13' boatlift exists along the southern side of the floating dock, approximately 28' from the common riparian corridor shared with the southern adjacent riparian property owner. According to the application package, existing water depths surrounding the existing docking facility range from approximately -5.0' to -6.0', relative to normal low water (NLW). DCM was not able to locate a previous permit for the existing facility; however, based on historical aerial photography the existing docking facility appears to have been in place since the early 1990's. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace an existing bulkhead and private docking facility along the edge of Banks Channel, at 612 N. Channel Drive, in Wrightsville Beach, NC. The configuration of the existing docking facility currently provides dockage for up to four (4) vessels, and that slip count would be expanded to five (5) under the proposed re -configuration. Based on drawings provided by the applicant, the existing docking facility is shown to be located within the 15' riparian corridor setback along the northern side of the property, and the applicant is proposing to relocate the entire facility to eliminate this encroachment. The application states the existing pier and fixed "L-head" shaped gazebo would remain in place with no modifications or expansions; however, a new floating dock spine (8' x 32') would be installed just waterward of the fixed gazebo, along with two finger piers (1 @ 4' x 16' and 1 @ 6' x 16'). The two finger piers would run perpendicular to the shoreline and would be installed on opposite ends of the floating dock spine. In addition to the floating component, a new 13' x 14' boat lift would be installed along the southern side of the proposed 6' x 16' finger pier. As designed, the proposed facility would provide dockage for up to five (5) vessels. Existing water depths in the vicinity of the proposed docking facility range from approximately -5.0' to -6.0' at NLW. In total, the proposed facility would extend approximately 100' from the waterward edge of the proposed bulkhead. RECEIVED JAN 17 Z017 DCM- MHD CITY Stewart Edwards Page 3 Additional development on the subject property includes the installation of a new bulkhead just waterward of the existing bulkhead, located along the western edge of Banks Channel. According to the application package, the existing wall is failing and is in need of replacement. The new alignment would be positioned an average of two (2) feet, with a maximum of three (3) feet waterward of the normal/mean high water line. The proposed realignment would result in the filling of approximately 30 sq. ft. of Coastal Wetlands, consisting solely of Smooth Marsh Cordgrass, which is sparsely established along the northern property line. According to the permit application, this small area of wetland fill is necessary to achieve a "straight" bulkhead alignment. Each end of proposed wall would "tie" into the adjacent bulkheads located on either side of the applicant's property. 10. ANTICIPATED IMPACTS The proposed structures (bulkhead, floating docks and boadift) would incorporate approximately 1,586 sq. ft. of Estuarine Waters and Pubic Trust Area, essentially within an area currently usurped by the existing docking. The proposed structures would extend approximately 100' into a waterbody, which measures approximately 620' across. This distance does not exceed the quarter width of the waterbody, nor does it exceed the established pier -head alignment. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area requirement and would accommodate up to five (5) vessels within water depths ranging from approximately -5.0' to -6.0' at NLW. The proposed bulkhead would result in the filling of approximately 30 sq. ft. of Coastal Wetlands and approximately 1,020 sq. ft. of shallow bottom habitat below the normal/mean high water level. Additional high ground disturbance, as a result of the bulkhead installation, would total approximately 1,386 sq. ft. Minor increases in turbidity should be expected during construction.
