This permit, issued on March 21, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may ie suoject to nnes, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the authorized docking facility, all as expressly and specifically set forth in the attached email, application, and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. 2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. (See Attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the project General Permit 197800056 & Nationwide Permit 18 Action ID No. SAW-2017-00219. NOTE: The N.C. Edwards, 612 N Channel Drive, Wrightsville Beach, in New Hanover County Mr. Jimmy North, acting as agent for Stewart Edwards, is requesting a Minor Modification to State Permit No. 31-17. The Minor Modification request consists of reconfiguring and reducing the footprint of the authorized "U-shaped" floating dock. The authorized "U-shaped" float is oriented with the 26' by 8' main spine nearest to the shore with finger piers on each end. The northernmost finger pier is authorized to be 16.5' by 6' and the southernmost finger pier is authorized to be 16.5' by 6' (see Sheet 2 of 2). The reconfiguration would orient the 26' long main spine closer to the channel and reduce the main spine width from 8' to 6'. This request also includes enlarging the northernmost finger pier to 26' by 6' and the southernmost finger pier to 20' by 4' (see Sheet 1 of 2). The authorized boat lift would remain in the same place. This request also includes the addition of an 8' by 10' uncovered platform on the landward side of the existing gazebo. This request was submitted in a letter dated February 4, 2019 with two (2) drawings, 1-2 of 2 both dated February 4, 2019. State Permit No. 31-17 was originally issued May 11, 2017 for the constructon of the private docking facility. None of the activities authorized in the 2017 permit appear to have been completed, and the facility appears to be consistent with the "Existing Conditions" drawing 1 of 4 dated 12/8/16. State Permit No. 31-17 is due to expire on December 31, 2020. The total shoreline length for the property is 77 linear feet, which allows for the construction of 616 square feet of platform area. The platform area authorized by 31-17 was 515 square feet, and the proposed modification would be a reduction in square footage of platform to 420 square feet. This reconfiguration appears to meet the 8 square foot per linear foot of shoreline requirement. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6) use standards for piers/docking facilities. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Stewart Edwards Permit No. 31-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) This permit does not authorize any.tie pilings associated with Slip No. 1. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 8) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the established Wrightsville Beach pier head line. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Bulkhead 10) The bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawing. 11) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 12) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 13) The bulkhead shall be constructed prior to any backfilling activities. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) All backfill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 17) In order to protect water quality, , runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Stewart Edwards Permit No. 31-17 Page 3 of 3 ADDITIONAL 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 20) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 22) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level.
