Docking Facility 1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconstructed docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Daiping Ma ADDITIONAL CONDITIONS Permit No. 98-17 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 6 formalized boat slips. Formalized docking space on the south side of the dock is not authorized under this permit. Cleats shall not be installed on the south side of the dock. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking' with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or fixture operations undertaken by the United States in the public interest. 11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. (not counted due to alignment) Proposed fixed dock replacement = 170 ft. x 6 ft. = 1020 sq. ft. (not calculated due to alignment) Proposed step-downs = 6 at 2 ft. x 5 ft. = 60 sq. ft. Total counted= 60 sq. ft. The docking facility would provide docking space for a total of six (6) vessels. It is staff's recommendation that the proposal appears to be consistent with the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule, the eight -square foot rule and the pier width rule. The boat slips would be in water ranging in depth from 1' to 2' at NLW in a Primary Nursery Area. The basin has a history of maintenance dredging from General Permits since 1998, however, it is recommended that any further evaluation on impacts to PNA be coordinated with the DCM Fisheries Resource Specialist. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements and the DCM Fisheries Resource Specialist has no finding of Significant Adverse Impacts to the resource. It is recommended that any permit issued should include standard conditions for docking facilities. The applicant proposes to replace a fixed community docking facility. The project is located at 368 Friendly Lane, adjacent to Myrtle Grove Sound in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, ES and PT. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County Joint Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. In general, New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards, including those for dredging. However, none of these standards appear to be applicable to this proposal. This project is consistent with the 2016 New Hanover County Comprehensive Land Use Plan. Cc: File 07. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn right onto Masonboro Loop Road and take the immediate left onto Friendly Lane. Travel east for approximately 0.4 miles until you reach the second right hand turn, and continue down Friendly Lane and the property of interest is the last lot on the left. The 1.869 acre property is currently developed with a single-family home and elevation on the tract ranges from 6' above normal high water (NHW) on the west side of the property and slopes to meet an area of coastal wetlands on east side of the property, with approximately 275 linear feet of water frontage. Developed properties border the site to the north, south, and west. Vegetation on the high ground portion of the tract includes Live Oak (Quercus virginiana), various pines, shrubs and maintained grasses. There is an existing timber bulkhead along the eastern boundary of the upland portion of the property and a concrete boat ramp at the southeast corner. Adjacent to the boat ramp is a fixed access pier measuring approximately 6' in width by 29' in width oriented in a north -south direction. The access pier leads to a community dock measuring approximately Tin width (5' wide walkway with a 2' wide lower fixed catwalk) and 170' in length oriented in an east -west direction. The most waterward 75' of the community dock is dilapidated due to storm damage from Hurricane Matthew. An access channel is located waterward of the property and the adjacent properties along Friendly Lane and Friendly Shores Road, which connects to Myrtle Grove Sound/Atlantic Intracoastal Waterway (AIWW). There is a fringe of coastal wetlands, consisting primarily of Smooth Cordgrass (Spartina alterniflora), along the west side of the boat ramp and on the east side of the ramp underneath the access walkway the extends along the southern edge of the dock approximately 130' from the shore. Other wetland species include Saltmeadow Cordgrass (Spartina patens), Glasswort (Salicornia spp.), Sea Lavender (Limonium caroliniana), and Spike Grass (Distichlis spicata). The basin has previously been dredged to a depth of -4 at NLW under various CAMA General Permits (GP 20429, 1998; GP 27409, 2001; GP 47497, 2007). After an investigation using historical imagery it appears the docking facility was constructed sometime prior to 1978. The City of Wilmington and New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Myrtle Grove Sound are classified as SA,ORW by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to replace a fixed community docking facility. The proposed docking facility would occupy approximately the same footprint as the existing facility. The application states there is no work planned on the timber bulkhead, boat ramp, or fixed access pier. The applicant proposed to replace the dilapidated fixed dock with a new fixed dock measuring 170' in length by 6' in width. The new dock would have six (6) step downs incorporated into the design each would measure 5' in length by 2' in width (See Sheet 1 of 2). The application states a handrail would be installed along the south side of the dock. The proposed dock would extend approximately 40' into a waterbody measuring approximately 230' to 400' in width which would meet the '% width rule. The application also states the new docking facility would accommodate six (6) vessels in water depths measuring approximately 2' at NLW, however, during a site visit the water depths ranged from 1'-2' at NLW. 10. ANTICIPATED IMPACTS The proposed pier replacement would incorporate approximately 1190 sq. ft. of open water area that is currently incorporated by a dilapidated community docking facility. The docking facility would provide dockage for 6 vessels in water depths measuring approximately 1'-2' at NLW. Minor increases in turbidity should be expected during construction. Construction method: Remove rotted pilings, cross members, stringers and deck boards and haul away. The pier is approximately 170 feet long from the westem end at an existing access ramp (elevated wooden walkway) to its terminus at the eastern end of existing dredged boat basin. The current pier has been in place for at least twenty-five years and has been repaired after storm events but the piling structure has become roved and portions of the decking and structure have fallen in to the water. The pier has a fixed deck approximately 15 inches above normal high water and a catwalk approximately 30 Inches below the deck for boat access at low tide. We intend to replace the pier exactly as is by setting new 8 inch pressure treated pilings, new cross members, new stringers and deck boards. The existing handrail (south side only) will be replaced in kind. The pier will be replaced in the same footprint as the existing pier, no excavation (dredging), removal of vegetation or other changes to the basin are planned. All work will be done by a marine contractor (to be determined). The pier is roughly centered in the riparian corridor which is approximately 180 feet wide and no waivers are needed to meet the 15 foot setback requirement.
