Island, at 7019 US 158, in Grandy, as requested in the permittee's application dated 6/15/17, including attached
workplan drawings (3) all dated 4/7/17.
This permit, issued on September 1, 2017 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)f these terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe nuu ana voia.
Sediment Stabilization - Bulkhead
1) The alignment of the authorized bulkhead shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to
initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall
require the alignment to be re -staked by DCM within a maximum of 30 days, prior to the new
expected start of construction.
2) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved
bulkhead alignment.
3) The bulkhead shall be constructed prior to any backfilling activities.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
=The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
No backfill material is to be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
All fill material to be placed below normal water level shall be confined behind the permitted bulkhead.
A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
,. ;grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Excavation
In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
No excavation shall take place outside of the area indicated on the workplan drawings.
Excavation shall not exceed -5.5 feet below the normal water level in the access channel and -5 feet
below the normal water level in the basin. In no case shall the depth of excavation exceed the depth of
,.connecting waters.
The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
P2) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawings.
Maintenance Clause
f3) :The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
;any maintenance work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
'. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed: The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the pernuttee's signature shown anew on the original plan.

.All excavatedmaterials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
No spoil material shall be placed within 30 feet of the normal water line.
=The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
Docking Facility Replacement
This permit authorizes only the replacement of the docks, and finger piers associated with the basin, and
uses located in or over the water that are expressly and specifically set forth in the permit application.
No other structure, whether floating or stationary, shall become a permanent part of this marina/docking
facility without permit modification. No non -water dependent uses of structures shall be conducted on,
in or over Public Trust waters without pennit modification.
This permit authorizes no additional formalized boat slips.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
,permitted activity without having it transferred to a third party.
•-22) - The permittee and/or his or her contractor shall meet with a representative of the Division prior to
,,'.project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
E: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2017-01394).
E: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-0809.

PE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The pemuttee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
TE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Dews Island Club is a historic waterfowl hunt and management club. The property is owned by Dews
Island Group and is comprised of approximately fifteen (15) members. Dews Island is a three -mile -long
island on Currituck Sound (east of Jarvisburg Village), and separated from the Currituck peninsula by
Deep Creek. The island was probably named for Colonel John Dew who in the 1650s had been
commissioned to survey the area for the Crown. Ownership of the island dates back to 1844 when the
state of North Carolina granted the 386-acre island and marshland to James Mercer, William A. Jarvis,
Bannister Jarvis and Thomas Griggs.
Ownership of Dews Island changed several times between 1844 and 1923, when it was purchased by
Norfolk sportsmen J.W. Barom and Raymond Peel for waterfowl hunting, and a modest clubhouse was
constructed. In 1929 the property was purchased by George Eyer, a stockbroker from New York City, who
renovated and enlarged the clubhouse and installed heating and plumbing. From the effects of the stock
market crash and the Great Depression that followed, the property was put up and advertised for sale. In
1943, Thurmond Chatham of Winston-Salem, North Carolina, purchased Dews Island, the surrounding
marshland and the eighteen -room clubhouse. John Wright of Jarvisburg served as the manager from
1943 until 1986, at which time his son Jerry Wright took over management of the island. The property
remained in the ownership of the Hanes and Chatham families until the early 1990's at which time Dews
Island Group was formed from partners in NC, SC and FL to purchase the island and clubhouse. The
island is still managed by the Wright Family and represents one of the last remaining private waterfowl
clubs on the Currituck Sound.
The property is an island that is accessible by boat and by a small bridge over a narrow waterway (Deep
Creek) of Currituck Sound and Dowdy Bay. The bridge is only accessible by golf cart -type vehicles and
truck and large equipment use of the bridge is not allowed by Club covenants, nor is the bridge capable of
supporting heavy loads. The Island contains the historic clubhouse, barns, a man-made boat basin with
docks and bulkhead, soundfront bulkheading (much of which is failing), a sound pier and access trails,
including a small bridge. There is a large heart -shaped waterfowl impoundment which is the focus of the
island in terms of current and historic waterfowl hunting and management, there are coastal wetlands,
upland areas and a grain meadow. This historically significant property is suffering from high rates of
erosion which is exacerbated by storm events, including nor'easters and tropical storm events. Other
properties of this nature in Currituck County and elsewhere in the state that did not en oreline
stabilization projects have become significantly impacted to the point cR�Ee � mpletely
eroded away.
The primary objectives of this CAMA Major Permit request are to: JUN 2 9 Z017
1. Stabilize the soundfront shoreline (including bulkhead replan nth l @Ja Nttion and
structural support). The historic waterfowl impoundment is i of Being impacted if erosive
forces continue to impact the soundfront shoreline without proper bulkheading and reclamation.
2. Replacement of dilapidated bulkheading along the canal leading from the boat basin to a small
golf cart bridge.
3. Maintenance dredging in the existing boat basin and outside the entrance to the basin where
sand shoaling has occurred.
4. Replacement of the dock work inside the boat basin. This work has already been permitted
through CAMA Emergency Permit #70005. This work has been included in this CAMA Major
request (described in MP-4) since the emergency permit is only valid through October, 2017. The
plan is to reconstruct the docks after interior maintenance dredging occurs.
The reclamation areas will be planted with native vegetation in the Spring of 2018, dominantly Spartina
patens. For short-term stabilization, these fill areas will be seeded with rye grass immediately after filling
occurs in the Winter of 2017.
In 2015 and 2016, prior to Quible participation in the project, SAV surveys were conducted by Carolina
Marine Structures in cooperation with some regulatory agencies. The findings included sparse
occurrences of Widgeon grass and Eurasian water milfoil, but no SAV beds were encountered. A SAV

field map from Carolina Marine Structures is included herein. A cursory follow-up 2017 SAV evaluation
was conducted by Quible on June 1, 2017. No that date, only sparse Widgeon grass was present. There
were no beds of SAV in the project areas.
The excavation work will be performed with a mechanical long reach excavator using a clamshell bucket.
Material from the excavator bucket will be transferred onto a material (hopper) barge with sides. Use of a
clamshell bucket minimizes the amount of bottom disturbance, and when the bucket is fully loaded, the
amount of water transferred to the barge is minimal. Some runoff will occur from the hopper barge via
slots or weep holes. The barge, when loaded, will be moved to the edge of the boat basin adjacent to one
of the two designated stockpile areas (shown on plan), where material will be transferred to the soil
stockpile area. Dried material will then be transported to the shoreline reclamation areas after the new
bulkhead construction is complete.
Alternatives considered to the proposed bulkhead included construction of an offshore rock sill and a rock
revetment. Based on file review and review of previous scoping meeting minutes, rock was a preferred
alternative by some resource agencies. This was considered by the applicant, but based on the site
access constraints, hauling granite or other rock (or concrete) to this shoreline is not practical. This is due
to the fact that the small access bridge does not allow any level of heavy loads and water depths in the
shoreline stabilization areas do not support barging of heavy materials. Other alternatives for this project
considered hauling in sand for additional bulkhead backfill. For the same access and water depth issues,
importing sand in any significant quantities is not possible. On the island, the only mechanized
equipment will be small scale for these reasons. Bulkhead material (sheeting and lumber) will be able to
be brought in, but this will be a time consuming process and much of the material will be walked in or
carted on small equipment.

Uplands on site are mostly maintained grasses with areas of trees. Wetlands along the shoreline contain Phragmites, wax
myrtle, groundsel bush, black needle rush and salt meadow corcigrass.

The purpose of this project in to reclaim lost shoreline due to erosion and stablize the reclamation with a new bulkhead that
ties in to the exisitng bulkheading onsite. The purpose of the excavation of the exisitng man made boat basin is to maintain
depths needed for access to and from the basin as well as maintenece of the interior of the basin. Daily operations will
include routine boating and hunting activites, just as the site is currently used.

Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
Installation of a drop wall designed bulkhead, using vinyl sheet piling. The sheet piling will be positioned using a vibrating
hammer. Equipment will include a 20' x 40' barge, a Takeuchi 1140 Excavator with NPK vibratory head and bucket, dredge
scow pan, skidsteer. The skidsteer will be stored onsite, all other equipment will be stored on the barge, which will be
moored in the exisitng boat basin.

Replace 707 linear feet of bulkhead along the eastern shoreline of the property, to the north of the exisitng hunt lodge and
boat basin. Replace 325 linear feet of exisiting bulkhead along the canal connecting the existing duck impoundment to the
boat basin. This includes reclamantion backfill behinf propsosed and extisng bulkheading in the areas shown on the plan.

where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Morning Brian,
To date I have received DWR approval and am only waiting on USAGE. I've made a few inquiries and hope to
have something asap. Once those comments are in I should be able to make a determination shortly thereafter.
Also want to provide some info about the two temporary spoil sites within the 30ft buffer. We've discussed
this with staff and those sites will be conditioned outside the 30ft buffer. Dump trucks would be allowed within the
buffer to transport the spoil. Let me know if you have any questions.

Quality General Certification Number4097 and the conditions listed below. This certification is associated
with the use of CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of
Engineers (USACE). This Certification allows you to use the CAMA Major Permit when the Division of

2. Water Quality Certification
The proposed project must comply with all the conditions of the General Water Quality
Certification(s) 4097. [15A NCAC 02B .0507(c)]

The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for
Class SC Waters (3)(g) pH: shall be normal for waters in the area, which generally shall
range between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; (1) Turbidity: the turbidity in the receiving water shall not
exceed 25 NTU; If turbidity exceeds this level due to natural background conditions, the
existing turbidity level shall not be increased. [15A NCAC 028.0220]

2017, requesting a 401 Water Quality Certification from the Division for the subject project. The Division
has determined that your application is incomplete and cannot be processed. The application is on -hold
until all of the following information is received:

Please provide more details regarding avoidance and minimization of 0.11 acres of coastal
wetland impacts for this project. (15A NCAC 02H .0506(f) and (g)]
This Office believes that the proposed impacts to coastal wetlands on the plans as described
can be moved or reconfigured to minimize the impacts. Please revise the plans to minimize
the impacts or provide a detailed explanation of why this plan for replacement of the
remnant bulkhead utilizing the historic alignment cannot be practically accomplished,
reduced or reconfigured to better minimize disturbance to the coastal wetlands. As part of
the narrative, please conduct an alternative analysis addressing why this is the preferred
methodology compared to other shoreline stabilization methods such as breakwater or low
profile bulkhead that would be graded to the existing wetland elevation as discussed during
the October 16, 2016 onsite multi -agency meeting.
Pursuant to 15A NCAC 02H .0506(f) and (g), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information is not
received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve
the application and it will be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate fee.

We appreciate your review of this CAMA Major request and for providing your feedback related to the
proposed work and the need to provide a description of need, avoidance and minimization or a revised
plan. As indicated in the CAMA narrative, "This historically significant property is suffering from high rates
of erosion which is exacerbated by storm events, including nor'easters and tropical storm events. Other
properties of this nature in Currituck County and elsewhere in the state that did not enact shoreline
stabilization projects have become significantly impacted to the point of being unusable or completely
eroded away."
While there are abundant coastal wetlands on the Dews Island Property, those wetlands proposed to be
impacted by the erosion protection bulkhead are those that have been created through recent erosion as
the existing wall has deteriorated and become washed out. In fact, the vast majority of coastal wetlands
proposed to be impacted are recognized as a fringe strip that was formed over the last two years directly
behind the northern 400 linear feet of bulkhead to be replaced. Soon, if not addressed, this northern
proposed bulkhead area will look like the highly eroded and scalloped out southern section. The same
thing is true for the proposed replacement bulkhead at the entrance to the boat basin. Within the last
year, this area has eroded and allowed coastal wetland species to grow because of a compromised
bulkhead that has been damaged by heavy weather events. In prior CAMA permits that we have worked
on, "fringe" coastal wetlands behind existing bulkheading has been recognized as such. While there is no
separate designation between fringe coastal wetlands and natural/other coastal wetlands in the CAMA
application, we hope that this description and the accompanying aerial photo set helps to describe the
nature of the proposed erosion protection. The aerials included with this memo are from 2008, 2011,
2013, 2016 and 2017 respectively. This photo set is helpful to see the high rate of erosion that has
progressed rapidly as the existing bulkheads fail.
The historic waterfowl impoundment and boat basin will surely be breached and eroded to the point of not
being useable if no action is undertaken very soon. We reviewed the potential to bring in rock, and as
stated in the CAMA application, the hauling and of rock by truck is not possible in this setting due to
access constraints. This option, if pursued, would have to include barges to float in rock. This would
likely not be possible due to shallow water, and if this were possible, work would have to take place
during high tides and bottom scarring would be inevitable.
Similarly, we explored a breakwater and low -profile wall, but, the exposure, high degree of wind tide
fluctuation and erosion rates would prevent these devices from effectively dealing with the problem. The
northern majority of ibulkhead to be replaced does serve as a breakwater at this time (since it has become
battered and is coming apart), but this clearly does not protect the shoreline from eroding. If no new
bulkhead or a no -action alternative is implemented, the land separation between the impoundment and
the sound will soon be breached and ripped open. One alternative that would minimize coastal wetland
fringe impacts would be to pull the bulkhead to the landward edge of the northern 400 feet of bulkhead.
While this would decrease initial wetland impacts by more than 50 percent, it has been our experience
that this coastal fringe area (on the waterward side of a bulkhead) will erode quickly. Additionally, this will
narrow the land separation from the sound to the impoundment (this is already a narrow strip of land).
For these reasons, we do not believe that this alternative should be the preferred course of action.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes maintenance dredging within an existing basin, new excavation for the access channel, and
replace bulkhead along over 1000ft of shoreline. The 152'x82' boat basin has filled in with sediment over
decades and will be dredged to -5' NWL and spoil material will be held onsite. Once dredging is
complete in the boat basin the docks will be replaced. The open water entrance to this boat basin will be
dredged as well to facilitate better navigation from the basin to open water. The -proposed access channel
measures 164' in length x 30' in width to a depth of -5.5' NWL, although it will widen 86' to match to
opening of the boat basin. Along the shoreline of Currituck Sound approximately 707 feet of bulkhead are
proposed. The northernmost 300' follows along the alignment of a remnant bulkhead and will result in the
fill of approximately 2,500 square feet of coastal wetlands. The remaining 407' of bulkhead follows an
alignment approximately 27' waterward of NWL. Along this section mostly open water fill is proposed as
well as 1,600 square feet of coastal wetlands. Additionally, 370' of bulkhead is proposed along a
manmade canal the extends through the property from the basin. This portion will follow the existing
bulkhead alignment.
In order to protect fisheries resources in the vicinity of the project this office has recommendations for
both the excavation and bulkhead portions of the project. For the excavation portion of the project a
moratorium on dredging from April 1— September 30 is recommended. Although no SAV was found to
be in the footprint of the proposed access channel Currituck Sound and the surrounding area is known
SAV habitat and the turbidity and potential sedimentation from dredging events during the growing
season could have a negative impact on that habitat. Also, this time of year is when biological
productivity is highest and larval and juvenile fishes that may be unable to avoid the disturbance area are
at their highest abundance.
For the bulkhead portion of the project there are no comments for the section along the manmade canal.
For the northernmost 300' that will result in 2500 square feet of wetland fill there are no comments for
the following reasons. The small strip of land in this area has a roadway that is being threatened between
the freshwater pond on the property and the open waters of the Currituck Sound where this approximately
6' wide fringe of wetlands exist. The wetlands that exist here are only due to erosion'forces of water

bulkhead facing the Currituck Sound the proposed alignment does follow a remnant bulkhead but it failed
many years ago and has a large wash out area. Using this alignment put the bulkhead an average of 27'
waterward of NWL and a maximum of 47' waterward of NWL. On October 19, 2016 at the on -site
scoping meeting with multiple agencies the alternative discussed for using a bulkhead in this area was to
create a breakwater/low-head bulkhead that would be graded to the existing wetland elevation. This
alternative would be preferable to the currently proposed plan to fill the entire area to the high -ground
escarpment. This area of the project is not imminently threatening road as the section to the north and
there are no buildings being protected it is just a reclamation of eroded land that occurred over the past
decade. (Google Earth Images) The option of using a breakwater in this section of the project would also
be seen as an acceptable alternative to help reduce overall impacts to fisheries habitat from a project that
is impacting a large area already.
Incorporating the moratorium on dredging activities from April 1 — September 30 and using an alternative
discussed above to repair the southern 407' of bulkhead would reduce concerns over potential negative
impacts to fisheries habitats in the project area.

Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC on
May 18, 2007; as amended through June 24, 2009.
Overview: The approximately 400 acre subject property is an island, locally known as Dews
Island, with over 6.35 miles of shoreline. The island is bounded by the Currituck Sound to the
east and south, Dowdy Bay to the north and Deep Creek to the west. The site primarily consists
of Coastal Wetlands and Section 404 Wetlands. Elevations on the island are very low at .5 feet
to 1.5 feet above Normal Water Level (NWL). Existing site improvements consist of a hunting
lodge, gazebo, sheds, wooden walkways, two (2) timber bridges, dirt pathways for small vehicle
access and waterfowl impoundments. Existing shoreline improvements consist of 4,212 linear
feet of bulkhead, a pier with terminus platform on the Currituck Sound, an 82 foot wide by 152
foot long man-made basin connecting to the sound that includes an 8 foot wide by 145 foot long
dock with three (3) 6 foot wide by 32 foot long finger piers, and a man-made canal with water
control structure that connects the man-made basin to an approximately 30 acre heart -shaped
waterfowl impoundment on the north side of the island. Bulkhead is located along the canal, in
the man-made basin, and north and south of the man-made basin along the Currituck Sound.
The site has received numerous CAMA General Permits since 1986, primarily for bulkhead. A
CAMA General Permit issued in 2005 allowed for dredging within the man-made basin. A CAMA
General Permit issued in April 2017 was an emergency permit to replace damaged docks within
the basin.

The project area is located on the northeast side of the island within the man-made canal, the
man-made basin, the waters of the Currituck Sound leading into the basin, and shoreline along
the Currituck Sound north of the basin mouth. Water depths within the basin range from 2.6 feet
to 5.2 feet below NWL. Water depths within the sound near the mouth of the basin range from
2.5 feet to 5.5 feet below NWL. The man-made basin contains sparse Submerged Aquatic
Vegetation (SAV) but there is no SAV located in the sound near the mouth of the basin. The
project area is located within VE and AE Floodzones.
A 300 foot remnant wooden bulkhead section located 445 feet north of the mouth of the manmade
basin is functional but failing. The shoreline in this area has eroded an average of 27 feet
landward from the bulkhead section. The erosion escarpment elevation is 1.5 feet above NWL.
The erosion area is within 55 feet of breaching the heart -shaped impoundment. Two (2) separate
Coastal Wetland areas totaling 1,595 sq. ft. exist landward of this section. A 407 foot wooden
bulkhead section further north is in the early state of failure. Water levels occasionally top the
bulkhead, which has allowed approximately 2,560 sq. ft. of Coastal Wetlands species to take root
on its landward side.
Dredging of a 30 to 69 foot wide by 164 foot long access channel to a depth of 5.5 feet below
NWL; dredging the existing man-made basin to a depth of 5 feet below NWL; creation of two (2)
30 foot by 60 foot spoil sites within 75 feet of the shoreline; installation of 707 linear feet of
replacement bulkhead with associated fill along the Currituck Sound; installation of 300 linear feet
of replacement bulkhead along the man-made canal, and; replacement of the existing dock and
finger piers located within the man-made basin are proposed. The dredged channel will connect
the man-made basin to the sound. The channel will be 30 feet wide in open waters and increase
to 69 feet wide as it enters the basin. Dredging will be done mechanically with a long reach
excavator using a clamshell bucket and a hopper barge with sides. When loaded, the barge will
be moved to the basin/channel bulkhead and spoil material will be transferred to one of the two
areas where it will dry and eventually be used as bulkhead backfill material. Approximately 300
linear feet of the bulkhead along the sound will be aligned with the remnant bulkhead, tie into
existing vinyl bulkhead on the south end, and be 2 feet waterward of existing bulkhead to the
north. This section will average 27 feet waterward of NWL with a maximum distance of 47 feet
waterward of NWL. The remaining 407 linear feet of bulkhead along the sound will continue 2
feet waterward of existing wooden bulkhead where it will end with a return wall tying into an
existing vinyl bulkhead. Landward washed-out areas along the sound side bulkhead will be
repaired and all bulkhead will be backfilled to existing ground level with dried dredge spoils and
seeded with rye grass for immediate stabilization. Approximately 183 feet of bulkhead will be
installed on the east side of the man-made canal and 187 feet on the west side, extending from
the basin. Due to the narrow canal width, existing bulkhead will be removed and the new bulkhead
will be installed in the same alignment. The existing storm damaged dockage in the man-made
basin will be replaced when dredging is complete.
Both spoil sites are in the AE Floodzone. Bulkhead backfill will occur in the VE zone.
The waters of the Currituck Sound in this area are classified as SC and are closed to shellfish
taking. A review of historic resources and archaeological sites was not provided.

Anticipated Impacts resulting from this project are expected to include: the dredging of .46 acre
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the filling of .23
acre of Public Trust Area/Estuarine Waters AEC and 4,646 sq. ft. of Coastal Wetlands AEC, and;
the disturbance of .21 acre of Estuarine Shoreline AEC.
Basis for Determination:
The project area is located within the "Jarvisburg" subarea and is designated as "Limited Service
Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use
Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas'
as indicated on Page 11-1.
As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-term
management and protection of significant, limited, or irreplaceable areas. Proper management is
needed to conserve the natural, cultural, recreational, scenic or biologically productive values of
these areas. The Conservation class should be applied to areas that should not be developed at
all (preserved), or if developed, done so in a very limited manner characterized by careful planning
and cautious attention to the conservation of environmental features."
Definitions of key words are provided on Page 9-2. These words include "Encourage: to favor or
foster', "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial
support".
Land Use Plan policies address the use of vegetated buffers along the shoreline to reduce
pollutants and protect water quality. In this case, the bulkhead will eliminate erosion along a pre-
existing hardened shoreline.
The following LUP policies may be applicable to this request.

for location in a coastal wetland must be water dependent (i.e. utility easement,
bridges, docks and piers) and be developed so as to minimize adverse impacts."

Subparagraph (1)(A) states that navigation channels and canals may be allowed through fringes
of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no
significant adverse impacts on fishery resources, water quality or adjacent wetlands, and, if there
is no reasonable alternative that would avoid the wetland losses.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (1)(B) states that all dredged material shall be confined landward of regularly and
irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent
water bodies or coastal wetlands.

Subparagraph (1)(C) states that dredged material from maintenance of channels and canals
through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles,
or disposed of by a method having no significant, long-term wetland impacts. Under no
circumstances shall dredged material be placed on regularly flooded wetlands. New dredged
material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H
.0209(d)(10).

Subparagraph (1)(D) states that widths of excavated canals and channels shall be the minimum
required to meet the applicant's needs but not impair water circulation.

Subparagraph (1)(E) states that boat basin design shall maximize water exchange by having the
widest possible opening and the shortest practical entrance canal. Depths of boat basins shall
decrease from the waterward end inland.

depth of the connecting waters.

Subparagraph (1)(I) states that maintenance excavation in canals, channels and boat basins
within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC
shall be avoided. However, when essential to maintain a traditional and established use,
maintenance excavation may be approved if the applicant meets all of the following criteria:
(i) The applicant demonstrates and documents that a water -dependent need exists for the
excavation;

(ii) There exists a previously permitted channel that was constructed or maintained under
permits issued by the State or Federal government. If a natural channel was in use,
or if a human -made channel was constructed before permitting was necessary, there
shall be evidence that the channel was continuously used for a specific purpose;
(iii) Excavated material can be removed and placed in a disposal area in accordance with
Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged
aquatic vegetation as defined by the MFC; and
(iv) The original depth and width of a human -made or natural channel shall not be
increased to allow a new or expanded use of the channel.
Consistent: The proposed development is consistent with the intent of this rule.
Paraaranh (6) Piers and Docking Facilities
Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips
shall not be counted in the total. Projects requiring dimensions greater than those stated in this
Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
do not apply to marinas.

or basin. Measurements to determine widths of the water body, canals or basins shall be made
from the waterward edge of any coastal wetland vegetation that borders the water body. The
one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or
a local government in consultation with the Corps of Engineers, has established an official
pier -head line. The one-fourth length limitation does not apply when the proposed pier is located
between longer piers or docking facilities within 200 feet of the applicant's property. However,
the proposed pier or docking facility shall not be longer than the pier head line established by the
adjacent piers or docking facilities, nor longer than one-third the width of the water body.
Consistent: The proposed development is consistent with the intent of this rule.

Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7)(A) states, "Bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level."
Partially Inconsistent: A total of 1,077' of bulkhead is proposed that varies in distance
waterward of NWL:
- ±300' will be constructed in a washed out section along a remnant alignment that
averages t27' waterward of NWL with a maximum distance of ±47'
- ±407' will be constructed 2' waterward of an existing bulkhead
- ±370' will be constructed within an existing bulkhead alignment.
Subparagraph (7)(B) states, `Bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources."
Potentially consistent: The proposed bulkhead alignment is located waterward of a coastal
wetland fringe and bulkhead construction will result in t4,648 ftz of coastal wetland fill. It
should be noted that t3,700 W of this wetland fringe area is located on the landward side of
±550' of existing bulkheading and have grown due to a combination of bulkhead damage,
low bulkhead height and overwash. The remaining coastal wetlands are located within the
area of the failed bulkhead; however, based on my own visual inspections and delineations,
they are rapidly eroding and are not providing a significant productivity level to the
estuarine system.
Subparagraph (7)(C) states, "Bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a
part of a permitted project involving excavation from a non -upland source, the material so
obtained may be contained behind the bulkhead."
Consistent: The applicants have indicated that clean fill will be used.
Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;
Consistent: The property does have a significant erosion problem and the existing
impoundment is in danger of eventually being breached.

(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of application, to
align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the
unusual geographic or geologic features;
Consistent: The proposed alignment along the Currituck Sound aligns with adjacent
bulkheads.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners;
Consistent: The proposed development is consistent with the intent of this rule.
(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management;
Consistent: The proposed development is documented in a Field Investigation Report.
(v) the property to be bulkheaded is in a nonoceanfront area.
Consistent: The proposed development is consistent with the intent of this rule.
15A NCAC 07H.0209 Coastal Shorelines
(c) Management Objective. The management objective is to ensure that shoreline development
is compatible with the dynamic nature of coastal shorelines as well as the values and the
management objectives of the estuarine and ocean system. Other objectives are to conserve and
manage the important natural features of the estuarine and ocean system so as to safeguard and
perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a
management system capable of conserving and utilizing these shorelines so as to maximize their
benefits to the estuarine and ocean system and the people of North Carolina.

(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of

Development shall be compatible with the following standards: DC M- M H D CITY
(1) All development projects, proposals, and designs shall preserve and not weaken or eliminate
natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development is consistent with the intent of this rule.
(2) All development projects, proposals, and designs shall limit the construction of impervious
surfaces and areas not allowing natural drainage to only so much as is necessary to adequately
service the major purpose or use for which the lot is to be developed. Impervious surfaces shall
not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas
exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are
not increased and the applicant designs the project to comply with the intent of the rule to the
maximum extent feasible.
Consistent: The proposed development is consistent with the intent of this rule.
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall permit an angle for graded slopes or fill
which is greater than an angle which can be retained by vegetative cover or other erosion -control
devices or structures.
Consistent: The proposed development is consistent with the intent of this rule.
(C) All development projects, proposals, and designs which involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; provided that this shall not apply to clearing land for the purpose of
forming a reservoir later to be inundated.
Consistent: The proposed development is consistent with the intent of this rule.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water
quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic
Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or
cause degradation of shellfish beds.
Consistent: The proposed development is consistent with the intent of this rule.

(5) Development shall not interfere with existing public rights of access to, or. use of, navigable
waters or public resources.
Consistent: The proposed development is consistent with the intent of this rule.
(7) Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach
upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
(10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new
development shall be located a distance of 30 feet landward of the normal water level or normal
high water level, with the exception of the following:
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;
Consistent: The proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a permit be issued to Dews Island Group, LLC.

Dear Mr. Huggett:
Reference the application of Mr. David Alban and the Dews Island Group for Department
of the Army authorization to dredge 8,492 square feet of an access channel, 11,343 square feet
within a man-made basin, replace 707 linear foot of vinyl bulkhead along eastern shoreline, and
replace 370 linear feet of bulkhead within a man-made canal, on Dews Island, adjacent to the
Currituck Sound, Dare County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE

3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices•around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all

saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

Project Setting
The proposed development is located on an Is��d�1 d as 7019 Caratoke Highway (US
158), Grandy, per the Currituck County tax reL6ftiS"1i i�gidal yy as Dews Island, and is
the location of a historic waterfowl hunt and management club. The island is adjacent to the
Currituck Sound on the east side, Dowdy Bay on the north side and Deep Creek to the west.
The site is accessed by a private dirt road (located to the south of the Cotton Gin Store located
at 6957 Caratoke Highway) that heads east for approximately 1 mile where it ends at a landing
area. A narrow 180' long timber bridge that is only passable to golf cart type vehicles extends
from the landing to the island. There is also a small barge that is used to get larger equipment
to the other side of the bridge. This is the only point of access from land onto the island.
Dews Island is ±3 miles long and ±400 acres in size (including impoundments), a great majority
of which is Coastal and 404-wetlands. Elevations on the island are very low, most of which are
.5' to 1.5' above Normal Water Level (NWL). Man-made features on the island within high
ground include a Hunting lodge, gazebo, sheds, wooden walkways and two timber bridges.
Vegetation in the high ground area includes yard grasses, live oaks, ornamental bushes and
loblolly pines.
The island has ±33,516' of shoreline, of which ±4,212' has been bulkheaded. Man-made
features along the shoreline include a pier that extends out into the Currituck Sound, a man-
made basin, docks within the basin that were severely damaged by Hurricane Matthew, and a
bulkheaded canal with a water control structure that leads out of the basin into a large ±30-acre
heart -shaped waterfowl impoundment (nonhardened shoreline).
The focus of the project area is within the man-made basin, the canal, the waters of the
Currituck Sound leading into the basin and the shoreline to the north of the basin mouth.

The shoreline leading north from the basin mouth has a functioning vinyl bulkhead for ±445'.
From this point a remnant wooden bulkhead extends north for ±300' to a wooden section of
bulkhead that is still functional. In 2008 aerials, the remnant section of bulkhead was still
functional, but due to age and storms the bulkhead failed and now the shoreline has eroded an
average of ±27' landward from the remnant bulkhead. The erosion escarpment elevation is
±1.5' above NWL and is now within ±55' of breaching the large heart -shaped impoundment.
Two separate coastal wetland areas exist within this section totaling ±1,595 ft2 and are made
up of black needlerush (Juncus roemerianus) and salt meadow hay (Spartina patens).
The wooden bulkhead to the north of the remnant bulkhead runs for ±407' at which point it
connects to a vinyl bulkhead. While this section is functioning, it is in the early stages of failure.
This bulkhead's height is low and high water levels occasionally top it, which has allowed a
±2,560 ft2 area of black needlerush (Juncus roemerianus) and salt meadow hay (Spartina
patens) to take root on the landward side for its entire length.
The waters of the Currituck Sound are classified as SC and are closed to shellfish taking.
Water depths within the Currituck Sound near the mouth of the basin range from 2.5' to 5.5'
below NWL and are void of Submerged Aquatic Vegetation (SAV). Water depths within the
basin range from 2.6' to 5.2' below NWL with sparse SAV. The bottom substrate within the
project area is made up of fine sands, silts and detritus.
Prior permit history on the site includes CAMA General Permits:
GP-A1870 issued 2/26/1986 for bulkheading; GP-A2176 issued 8/8/1986 for bulkheading;
GP-A3503 issued 8/26/1987 for bulkheading; GP-37305 issued 3/21/2004 for bulkheading;
GP-A37460 issued 3/16/2005 for dredging within the basin and 500' of bulkhead
replacement within the remnant bulkhead location; GP-45399 issued 7/24/2006 for

The applicant proposes to dredge an access channel that will be 164' In eng will have a
width that varies from 30' in the open waters increasing to ±69' in width as it enters the man-
made boat basin. The proposed dredge depth of the access channel is 5.5' below NWL.
Existing water depths within this area range from 2.5' to 5.5' below NWL and average ±3.5' in
depth. The access channel dredge area is ±8,492 ft2 and it is estimated that ±652 cubic yards
of spoil material will be dredged from this area. Perthe submitted SAV survey, this area is void
of SAV's and the bottom substrate is fine sands.
The existing ±152'x82' boat basin will then be dredged to a depth of 5' below NWL. Existing
water depths within the basin range from 2.6' to 5.2' below NWL and average ±3.7' in depth.
The basin dredge area is ±11,343 ft2 and it is estimated that±563 cubic yards of spoil material
will be dredged from this area. Per the submitted SAV survey, this area contained sparse
occurrences of Widgeon grass (±567 ft2) and Eurasion milfoil with no SAV beds encountered.
The bottom substrate is made of fine sands, silt and detritus.

All proposed dredging will be done mechanically with a long reach excavator using a clamshell
bucket and a hopper barge with sides. When loaded, the barge will be moved adjacent to the
basin/channel bulkhead and spoil material will be transferred to one of two 60'x30' stockpile
areas to dry for use as bulkhead backfill material.
The applicant proposes to construct ±707' of vinyl bulkhead along the shoreline adjacent to the
Currituck Sound north of the basin. Approximately 300' of this will be within an alignment of a
remnant bulkhead and will tie into an existing vinyl bulkhead on the south end and be 2'
waterward of an existing bulkhead to the north. This section of proposed bulkhead will average
±27' waterward of NWL with a maximum distance of ±47'. The remaining ±407' of proposed
bulkhead will continue to the north 2' waterward of an existing wooden bulkhead where it will
end with a return wall tying it to an existing vinyl bulkhead. The bulkhead will be backfilled to
the existing ground level with the dried dredge spoils and seeded with rye grass immediatelyto
stabilize the area for the short term and later planted with Spartina patens for long term
stabilization.
An additional ±370' of vinyl bulkhead replacement is proposed within a canal (±183' on the east
side and ±187' on the west side) that extends from the basin in a northwest direction. Due to
the narrow canal width, the existing bulkhead will be removed and new bulkheading will be
constructed within the same alignment.
The applicant proposes to repair and backfill a washed-out area, caused by a separation of
vinyl sheeting, on the landward side of an existing vinyl bulkhead located on the north side of
the basin & basin entrance.
When dredging is completed, the applicant proposes to replace all existing storm damaged
dockage within the southeast portion of the basin. Dock dimensions to be replaced include a
±145'x8' section that is adjacent to the bulkhead on three sides of the basin and three 32'x6'
finger piers.

• The two proposed spoil transfer sites will result in the disturbance of±3,600 ft2 within the ES
AEC.
• The proposed dredging will temporarily increase turbidity.

Sound) and the filling of the washed-out area will result in the filling of t10,005 ft2 of EW and
PTA AEC's with dried dredge spoils.
The construction of the bulkhead along the proposed alignment (adjacent to the Currituck
Sound) and the filling of the washed-out area will result in ±427 cubic yards of fill material
below NWL in the EW and PTA AEC's.

Wetland AEC.
• The construction of the bulkhead within the canal will disturb f5,550 ft2 within the ES AEC.
The proposed dock replacement will have no additional impacts since it is currently existing
and there are no proposed expansions.

BEING the northern portions of Dews Quarter Island (also
known as Duce Quarter Island and as Dews Island), which
Island was conveyed to Thurmond Chatham by L. S. Blades,
Jr., Trustee, by deed recorded in Book 76, at page 449,
in the office of the Register of Deeds of Currituck
County, with such northern portion of the Island
consisting of approximately 245 acres, and being all of
the northern portion of such Island from the northernmost
point southwardly to an imaginary line extending from the
easterly edge of such Island to the westerly edge of such
Island, with the center point of such line being
approximately 3,100 feet north of the southernmost tip of
such Island, and being that same property described in
the Will of Thurmond Chatham, recorded in Book 8 of
Wills, at page 165 through 170, in the office of the
Clerk of Court of Currituck County, as follows: "The
Northern portion of my property known as Dews Island,
being roughly one-half of the Island and being that part
of the Island North of a line running East and West
halfway between Sand Cove Blind and South East Point
Blind."
SECOND PARCEL
BEING the southern portion of Dews Quarter Island (also
known as Duce Quarter Island and as Dews Island) which
Island was conveyed to Thurmond Chatham by L. S. Blades,
Jr., Trustee by deed recorded in Book 76, at page 449 in
the office of the Register of Deeds of Currituck County
with such portion of the Island being all of the southern
portion of such island from the southernmost point
northwardly to an imaginary line extending from the
easternly edge of such island to the westernly edge of
such island with the center point of such line being
approximately 3,100 feet north of the southernmost tip of
such island and being that same property devised to Hugh
Gwyn Chatham and Richard T. Chatham, Jr., under Section
First: (b) of Codicil dated the 20th day of April 1953,
to the Will of Thurmond Chatham recorded in Book 8 of the
Wills at page 165 through 170 in the office of the Clerk
of Court of Currituck County, such property being
described therein as "all the remainder (being the
southern portion) of the said property" the northern

As adjacent riparian property owner to the above referenced project, it is required by NCDEO, Division of

The NC Division of Coastal Management hereby acknowledges receipt of your application on
May 15, 2017, for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted as per 15A NCAC 07J.0204. This revealed
certain deficiencies, which must be corrected before the application package can be accepted as
complete. To assist you in expediting the permitting process as much as possible, I am notifying
you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed
review.
Because the deficiencies are easily correctable, I am not returning the original application package.
Please make the needed changes, and submit the appropriate documentation. With the retained
copy of the application, I can commence the detailed review. Please understand that the subsequent
detailed review may reveal additional areas where further information or documentation is
required to demonstrate compliance with the rules directly applicable to the proposed
development. If this occurs, you will be notified of such issues separately.
Our initial screening has identified the following deficiencies:

When drawings are color or larger than 11 inches by 17 inches, 26 copies must be
provided. I understand that the 26 copies will be submitted once the final drawings
are approved

A Plan View must be submitted that:
- Indicates Water Depth contours or spot elevations
1. On sheet 1 of 3, show the existing water depths relative to NWL
within and adjacent to the dredge area.
- Identifies the area of coastal wetland fill. Indicate the square footage on
the site plan (sheet 1) next to each separate area of coastal wetland fill.
- Indicates that the bulkhead within the canal is within the existing
alignment.
A Narrative Description of the proposed development was submitted; however, please
include a section that considers the constraints (economical and logistical) associated with
the potential methods of shoreline stabilization: installation of a bulkhead (preferred),
verses placement of an offshore sill or rock revetment. In addition, discuss the alternatives
and constraints (economical and logistical) associated with fill material sources
(maintenance of existing basin, excavation within the onsite pond or offsite source).
4. A copy of a Deed or other Title Indicating Document must be provided. Please submit the
needed documentation.
To expedite our response to your permitting request, we will commence the detailed review of
your application for a permit pending the receipt of the additional information requested above.
However, the statutorily provided 75/150 days allowed for review cannot commence until such
time as we have received a complete application package. Once your application has been accepted
as complete, you will receive a separate notification letter.
If it is not possible to render a permit decision within 70 days of the date when your application is
received complete, you may request a meeting with the Director of the Division of Coastal
Management and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
