DAVIS Director This letter is in response to a March 26, 2018 letter, from Brian Rubino of Quible & Associates, P.C., in which it was requested that Major Permit #102-17 be modified to expand the spoil stockpile on the northwest side of the boat basin from 1,800 ft2 to 6,453 ftz, replace an additional 284' of existing bulkhead within the canal in the existing alignment and replace 39' of a failing impoundment water control structure. Major Permit #102-17 was issued to Dews Island Group, LLC, on September 1, 2017. This Permit is for dredging of an access channel and basin, ±707' of bulkheading adjacent to the Currituck Sound, ±370' of bulkhead replacement within a canal and the replacement of storm damaged docks within the basin. The project is located on an Island addressed as 7019 Caratoke Highway (US-158), Grandy, per the Currituck County tax records. It is known locally as Dews Island, and is the location of a historic waterfowl hunt and management club. The island is adjacent to the Currituck Sound on the east side, Dowdy Bay on the north side and Deep Creek to the west Your modification request as described and/or depicted in your submittal dated March 26, 2018, is hereby authorized as a refinement to CAMA Major permit #102-17. All existing conditions remain in effect, including the expiration date of December 31, 2020. This letter is provided to you as a record of the authorization, and should be included with the Permit file. You may need to obtain a building permit from Currituck County. Griffin St. Suite 300 Elizabeth City, NC 27909 RE: Letter of Refinement Request (CAMA Major 102-17) Dews Island, Currituck County, NC Mr. Renaldi: The purpose of this letter is to formally request a Letter of Refinement to CAMA Major Permit 102-17 for the following items: Item 1: Expansion of the spoil stockpile area on the northwest side of the boat basin from 1,800 sq.ft. to 6,453 sq.ft. The purpose of this is to have sufficient area to place wet spoil material between the dredge and bulkhead backfill activities. This expanded area was reviewed on March 23, 2018. 1 did not observe the presence of any jurisdictional features, and this expansion area is not located within the 30 ft CAMA vegetative buffer. Item 2: Replace an additional 284 linear feet (9) of existing and failing bulkhead and 39 If of a failing water control structure along the canal to the west of the boat basin. Item 3: Dredge period extension request for the area within the existing boat basin. The open water dredge work will be complete prior to April 1, 2018, however, Carolina Marine (contractor) would need some additional time to complete the permitted dredging within the boat basin. Therefore, we are requesting that the dredging inside the basin is allowed to occur until April 20, 2018. In association with this request, the contractor agrees to install a sediment curtain across the mouth of the boat basin. Included with this letter are two copies of the updated CAMA plan. DAVIS Re: CAMA MP#102-17 — Dews Island Group LLC Dredge Period Extension Request Dear Mr. Rubino: This letter is in response to your request dated March 26, 2018 for Dews Island Group LLC to extend their dredging efforts within the existing man-made upland basin beyond the April 1st dredge moratorium as listed in Condition #8 of CAMA Major Permit #102-17. After Discussions with representatives of the North Carolina Division of Marine Fisheries and the North Carolina Wildlife Resources Commission, your request has been approved with the following condition: • A turbidity curtain is to be properly installed at the mouth of the basin until dredging is complete to reduce impacts to the open waters of the Currituck Sound. Per the requested date, dredging is to be completed by April 20, 2018. No other modifications to the previously proposed development are authorized by this letter and all other permit conditions associated with Major Permit #102-17 remain in effect. This deadline extension is valid only for dredging efforts between April 1— April 20, 2018. Please do not hesitate to contact me if you have any questions or comments. DCM fisheries recognizes the weather conditions this March have been rather unfavorable and that the contractor worked to complete the open water portion of the dredging first. They are anticipating that the open water dredge work will be completed by April 1, but will need additional time within the boat basin. They are requesting an extension until April 201", 2018 and the contractor (Carolina Marine Structures) agrees to install a sediment curtain across the mouth of the boat basin. I believe they started the project on Friday, March 23. They got a late start because of the weather. NCWRC does not object to the moratorium extension until April 20 as long as the excavation work is only within the boat basin and a turbidity curtain is placed across the mouth of the basin to minimize elevated turbidity levels in the adjacent water body.
