Any additional development activities may require a modification of this permit. Shoreline Stabilization — Rip Rap Sill Extension 2) The sill extension shall be constructed in accordance with the alignment depicted on the attached workplan drawings. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. ADDITIONAL CONDITIONS Permit No.102-17 Page 2 of 3 3) The alignment of the authorized sill extension shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 4) The sill material shall consist of clean oyster shell, granite, marl, or broken concrete. Sill materials shall be of a size sufficient and design to prevent its movement from the approved alignment by wave or current action. The pernrittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. 5) In accordance with commitments made by the permittee, the Estuarine Waters located landward of the silll shall be planted with native Coastal Wetland species, all expressly and specifically detailed in the attached narrative and workplan drawings. 6) No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved sill extension alignment for the purposes of wetland creation. 7) The sill shall be constructed prior to any backfilling activities for the purposes of wetland creation. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a high ground source and confined behind the permitted sill extension. 10) No backfill material is to be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted sill extension for the purposes of wetland creation. 11) All fill material to be placed below normal water level shall be confined behind the permitted sill extension. General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) This Minor Modification shall be attached to the original Permit No. 102-17, which was issued on 9/1/17, and copies of both documents must be readily available on site when Division personnel inspect the project for compliance. 14) All conditions and stipulations of the active permit remain in force unless specifically altered herein. Dews Island Group, LLC has requested a Minor Modification to Major Permit #102-17, which was issued on September 1, 2017 and expires on December 31, 2020. The original major permit authorized the dredging of an access channel and basin, ±707' of bulkheading adjacent to the Currituck Sound, ±370' of bulkhead replacement within a canal and the replacement of storm damaged docks within the basin. 2. Dews Island Group, LLC has requested to modify Major Permit #102-17 to include the placement of a riprap revetment/sill along the shoreline adjacent to an existing soil road to protect it from erosion. The location has ±150' of existing riprap revetment/sill that varies in width from 8'-12'. The soil road is bounded by USACE 404-wetlands to the west and coastal wetlands consisting of Spartina patens and Scirpus spp. on the east. The proposal is to fortify the existing riprap, extend it ±50' at the north end on the landward side of the relic bulkhead and extend it f 110' to the south. The proposed revetment sill will be 12' wide and have a height of 2' above NWL. Along the south extension immediately adjacent to the soil road, an area of shallow bottom (f1,070 ft2) is proposed to be filled with sand material matching the adjacent wetland elevation and planted with Spartina patens. The applicant also proposes to remove a non-functioning, relic clay culvert. The proposed development area is void of SAV and water depths are ±1' below NWL. 3. I conducted a site visit on June 13, 2018 to review the Minor Modification request pursuant to the provisions of reference (a) and have determined that the request meets the requirements contained in 15A NCAC 07H .0208 USE STANDARDS. 4. The required fee of $100, paid by Check #5013, was received by the Elizabeth City District Office on September 17, 2018. 5. It is recommended that the Minor Modification request be granted, provided all the Permit Conditions of the original permit issued on September 1, 2017 remain in effect. Griffin St. Suite 300 Elizabeth City, NC 27909 RE: Minor Modification Request (CAMA Major 102-17) Dews Island, Currituck County, NC Dews Island Group, LLC Mr. Renaldi, The purpose of this correspondence is to request a Minor Modification to CAMA Major Permit 102-17. The currently proposed work is meant to protect the soil access road along the Currituck Sound to the south of the Clubhouse. The shoreline in this area has suffered from intense erosion over the years and this are in particular is not well protected. The access road and adjoining wetlands have been eroding at a rapid rate. Please see the accompanying exhibit that illustrates the existing conditions on the left side of the sheet and proposed work on the right side of the sheet. As shown, there is a dilapidated bulkhead on the northern portion of the proposed rock protection area and there is a low -profile rock sill along a significant portion of the rest of the proposed rock protection area. The existing rock consists of a combination of granite and concrete and is between 8 and 12 ft wide on average. The proposed work includes enhancement and expansion of the existing sill, with a 12 ft wide maximum base and a rock height of 2 ft above normal water level (NW L). The owners and the marine contractor who have extensive knowledge of this shoreline believe it is important to be able to place rock up to 2 ft above NWL to protect from erosion that frequently tops the existing low sill with high velocities. There is currently no rock behind the dilapidated bulkhead. In this area the remnant bulkhead will serve as the waterward edge of the sill. As listed in the notes on the plan, the existing rock footprint is 1,796 sq.ft., and we are requesting a net increase of 1,238 sq.ft. In areas that already have rock, the existing rock will be capped with additional material. In addition to the rock work, we are proposing sand fill behind the sill on the south side where the highest amount of erosion has been occurring. This sand fill will match the elevation of the adjacent wetlands and will be planted with Spartina patens or a similar coastal wetland grass as part of this restoration/reclamation effort. Included on Sheet 2 are representative cross -sections of the work proposed. As shown on the plan, there is an existing broken clay culvert running under the soil road. According to the owners, this pipe has not functioned properly in many years and is not necessary. Therefore, this will be removed as other work is taking place. Included with the plan set are photographs of the project area taken on 6/27/201 B. On that date I walked the entire project area while surveying in -water conditions and the footprint of the existing rock and evaluated conditions for SAV. No rooted SAV was encountered in this area. During a previous visit on 6/13/2018, the tide was lower and I could clearly see the bottom. No SAV was encountered on this day either.
