1) Unless specifically altered herein, this Minor Modification authorizes the boat lift addition, all as
expressly and specifically set forth in the attached letter and workplan drawings. Any additional
development activities may require a modification of this permit.

This permit action may be appealed by the penniffee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
General
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
3) This Minor Modification shall be attached to the original Permit No. 124-17, which was issued on
11/6/17, and copies of all documents must be readily available on site when Division personnel inspect
the project for compliance.
4) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2017-02025.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2017-1095.

Tim and Tom Conley — 716 S. Lumina, Wrightsville Beach, New Hanover County
Mr. Duncan, acting agent for Tim and Tom Conley is requesting a minor modification to State Permit # 124-17. State
Permit # 124-17 was originally issued on November 6, 2017 for a 4-slip docking facility and is due to expire on
December 31, 2020.
Mr. Duncan states that the owners are requesting a minor modification to State Permit # 124-17 to install a 12' by 13'
boat lift in an existing slip. The permitted docking facility is a linear configuration of fixed pier, floating platforms, and a
covered gazebo extending approximately 169.2' into Banks Channel, see As -Built survey in the project file received on
April 2, 2018. The proposed boatlift would be installed on the northeast side of the floating dock in the most landward
slip, designated as slip-3 on the As -Built. The lift would extend outside the current footprint and into the 15' riparian
setback. A waiver was obtained from the northeast neighbor, 714 S. Lumina. The water depths in the area of the
proposed lift range from -2.5 NLW to — 4 NLW.
The agent has submitted a check (check No. 8357) in the amount of $100 for the modification request. As proposed,
this office has no objection to the proposed project modification as long as there are no objections from other the
agencies to this proposal. It appears that the project continues to be CONSISTENT with the use standards set forth
in NCAC 07H .0208(b)(5).
By copy of this memo, DCM is requesting that NC DEMLR and NC DWR provide any comment that your agency
may have on the proposed project to Curt Weychert of DCM's Wilmington office within 14 days of receipt of
this memo.

owner, waiver for the north side adjacent property owner, and a check for $250.00 for a
proposed boatlift to be installed in an existing boatslip on the north side of existing
floating dock. Property is located at 716 South Lumina Ave, Wrightsville Beach, NC
28480. Property owners name is Tom Conley. We have a little over 3' at normal low
tides at the front most landward end of proposed boatlift, which would be the east end. If

This permit, issued on November 6.2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Anv violation of these terror may

Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other

3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) No portion of the authorized docking facility shall extend past the Town of Wrightsville Beach's
established pier line.
8) The authorized covered platform shall not be enclosed. Any material used on the sides shall riot obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
9) The authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
13) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
