Lumina Ave., Wrightsville Beach, NC 28480 Authorizing development in New Hanover County adZto Banks Channel, at 716 S. Lumina Drive, Wrightsville Beach , as requested in the permittee's application dated 8/11/17 (MP-1), and revised 10/31/17 (MP4) incl. attached workplan drawing (1) dated 10/31/17. This permit, issued on November 6, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to subject to fines irriprisomnent or civil action; or may cause the permit to be null and void.. _ Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Tom & Tim Conley Permit No. 124-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility shall extend past the Town of Wrightsville Beach's established pier line. 8) - The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 9) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. Swim Platform and Docking Facility Agent: Charles Duncan l.erration' The project site is 39.5 ft. of shoreline adjacent to the Intracoastal Waterway (IC WRY). The project property is contains a single family residential structure with an assigned address of 716 South Lumina Avenue, Wrightsville Beach. NC. Other than an existing bulkhead, there are no existing marine structures and the property serves only as a private residence. The adjacent lot to the north is a fully developed residential property with pier and docking facilities. The adjacent lot to the south is vacant with no existing marine structures. A community pier exists 103' to the south. The property is stabilized by way of an existing timber bulkhead and vegetated (grass) cover. The shoreline at the proposed project is entirely beach sand with no existing vegetation. Pare= and Need: The purpose of the project is to construct a 6'x 45' fixed pier that will allow access to a 6'x 60* floating dock,. 9.5x 20 gazebo and 9.5 x 15' uncovered fixed dock. The owner is also proposing a (' 'x /1'swimming platform that will be accessed by way of ladders both on the platform and fixed duck. The: primary objective of the project is to provide the owner with a safe, functional residential pier and docking facility. The proposed project will provide safe boat access for the applicant without encroaching on any existing riparian corridors. The proposed 6'x 60' floating dock will provide the applicant with a total of four (4) wet slips. The proposed structures would be located entirely over open water and would not encroach into either adjacent 15' riparian corridor setback area. However, it should be noted that there are five (5) tie pilings located along the property line to the north that appear to be associated with the docking facility to the north. PROJECT DESCRIPTION: The project site is located at 716 S. Lumina Avenue, adjacent to Banks Channel in Wrightsville Beach, New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO) travel east approximately 3.0 miles on Eastwood Rd. towards Wrightsville Beach. Cross the drawbridge and continue on Causeway Drive to Waynick Blvd. Take a right onto Waynick Blvd. and travel approximately 1.2 miles until Waynick Blvd. turns left and becomes Sunset Ave. Travel approximately 340 ft. and turn right onto S. Lumina Ave. Travel approximately 200 ft. and the property of interest will be on the right. The property is currently developed with a single-family home and an existing timber bulkhead. The property has current elevations of approximately 2' above normal high water (NHW). The high ground area is vegetated with lawn grass and the single-family home occupies the area nearest S. Lumina Ave. Directly behind the single-family home on the remainder of the parcel is an open grassy area. There are no coastal wetlands on the property and normal high water meets the bulkhead. Waterward of the bulkhead is sandy bottom with no SAV or shell resource. General Permit #D69293 was issued on 7/3/17 for a portion of the proposed project including a fixed pier and platform, but was never constructed. The Town of Wrightsville Beach Land Use Plan classifies the upland areas of this project as Developed. The waters of the project site are classified as SB by the NC Division of Water Resources. The NC Division of Marine Fisheries has not designated this area of Banks Channel as a Primary Nursery Area, and the waters adjacent to the proposed project are closed to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to construct a new private docking facility into Banks Channel. A new access pier, measuring approximately 44' in length by 6' in width would extend from the existing timber bulkhead towards the west into Banks Channel. At the terminus of the pier, a ramp would lead to a floating platform measuring approximately 60' in length by 6' in width. An access ramp at the waterward terminus of the floating platform would then lead to a partially covered fixed platform measuring approximately 35' in length by 9.5' in width running perpendicular to the channel and shoreline, in the same alignment as the floating platform and access pier. The landward most 20' of the platform would be covered. From the waterward end of the fixed platform a 8' in length by 9'5 in width floating platform would be accessed via ladder. The application states that the existing water depth at the location of the docking structures is approximately -2.5' to -6.0' @ normal low water. The docking facility would not encroach into either 15' riparian setback area, and the structures would be approximately 15' from the facility to the north (tie pilings on property line) and approximately 75' from the closest facility to the south. The application states that the proposed structures would accommodate up to four (4) vessels at this location. 10. ANTICIPATED IMPACTS The proposed docking facility construction would incorporate 1,032.5 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structures would extend approximately 169' into the waterbody, which measures approximately 1,000' across. This distance would conform with the 1/4 width rule and the established Town of Wrightsville Beach Pierhead Line. The structure would not encroach into the adjacent 15' riparian corridor setback area. Minor increases in turbidity should be expected during construction. The project property is contains a single family residential structure with an assigned address of 716 South Lumina Avenue, Wrightsville Beach, NC. Other than an existing bulkhead, there are no existing marine structures and the property serves only as a private residence. The adjacent lot to the north is a fully developed residential property with pier and docking facilities. The adjacent lot to the south is vacant with no existing marine structures. A community pier exists 103' to the south. The property is stabilized by way of an existing timber bulkhead and vegetated (grass) cover. The shoreline at the proposed project is entirely beach sand with no existing vegetation. Purpose and Need: The purpose of the project is to construct a 6'x 44' fixed pier that will allow access to a 6'x 60' floating dock,'a 9.5'x 20 gazebo and 9.5 x 15' uncovered fixed dock. The owner is also proposing a 9.5' x 8' swimming platform that will be accessed by way of ladders both on the platform and fixed dock. The primary objective of the project is to provide the owner with a safe, functional residential pier and docking facility. The proposed project will provide safe boat access for the applicant without encroaching on any existing riparian corridors. The proposed 6'x 60' floating ` dock will provide the applicant with a total of four (4) wet slips. Please note that the proposed swim platform will not allow for transient or permanent docking at all. No bumper guards, cleats or similar hardware will be installed. A ladder will be installed on the western (waterway) side to further prevent transient docking.
