Any violation a of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Boathouse This permit authorizes only the boathouse, walkway, boat lift and stairs, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) ,This permit action may be appealed by the permittee or other ;:qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Signature of Petmittee s E. and Cecilia Coleman Permit No. 96-17 Page 2 of 3 ADDITIONAL CONDITIONS The footprint of the boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed 400 square feet. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. "No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Freestanding Moorings ,,'`This permit authorizes only the mooring buoys and uses located in or over the water that are expressly '-and specifically set forth in this permit. No other structure, whether floating or stationary, shall become ;;a,permanent part of these moorings without permit modification. No non -water dependent or i -,commercial uses of structures shall be conducted on, in or over public trust waters without permit modification. Freestanding moorings shall be marked or colored in compliance with U.S. Coast Guard and NC Wildlife Resources Commission requirements and the required marking maintained for the life of the moorings. ling moorings must bear the owner's name, state vessel registration numbers and/or U.S. Documentation numbers. Required identification must be legible for the life of the moorings. .The type of material used to anchor the mooring buoys must be non-polluting and of sufficient weight ;and design to safely anchor the buoy and vessel. The mooring and attached vessel shall not interfere with the access of any riparian owner nor shall it block riparian access by blocking channels, deep water, etc. which allows riparian access. Freestanding moorings shall not be transferable or assignable. Upon transfer of riparian property ownership, the moorings shall be removed by the original permittee unless a new permit is issued to the new riparian owner. :If freestanding moorings are to be replaced, the moorings shall comply with those guidelines of the Division in place at that time. The permittee is cautioned that this permit does not authorize the placement of tie pilings in association with the authorized mooring buoys. E. and Cecilia Coleman ADDITIONAL, CONDITIONS Permit No. 96-17 Page 3 of 3 General No sewage, whether treated or untreated, shall be discharged at any time from any boats using the authorized docking facility. Any sewage discharged at the authorized docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 'Should either adjacent riparian properties be sold prior to the initiation of the boathouse or freestanding moorings, or sold prior to the commencement of the boathouse or freestanding moorings, the permittee 'shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking .facility. .This permit authorizes a maximum of 6 formalized boat slips (1 boat lift, 2 existing personal watercrafts lifts, and 3 freestanding moorings). permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the en approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit does not'eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2017-01289). The N.C. Division of Water Resources assigned the project DWR Project No. 2017-0751. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. An application processing fee of $250 was received by DCM for this project. Project Narrative James E. Coleman, III and Cecelia S. Coleman Boat Lift Project/Mooring Buoys May 23, 2017 Application is being made for permit to construct a covered boat house with motorized lift installed using lumber and wood pilings as an extension to existing pier. Conventional carpentry and pier construction methods will be utilized. The boat house roof line will be 24' X 16' from dripline to dripline. The roof line will be 2.5' from the riparian line and the pilings will be "3.5' from the riparian line. There will be a 3' walkway on the south and east sides of the boathouse, under the roof line. The east walkway will extend 4'8" to the north and conned to the existing pier via three steps to the existing pier. The boat lift will be 12' x 12'. The new construction will be located 4' from the existing south property line. There are also three mooring buoys included in the application, to be attached via screw anchors. Two moorings will be for 9'9" jetskis, and the third for a 15' day sailer. The jetski moorings are located 28' and 58' from the bulkhead, 18' from the north property line, and will have a radius of 12' from center. The day sailer mooring will be located 118' from the bulkhead, 34' from the north property line, and will have a radius of 25' from center. DAVIS Director The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. James and Cecelia Coleman Major Permit Application June 14, 2017 Page 2 Project Settina James and Cecelia Coleman's property is located at 222 Pocahontas Trail (SR#1244), Sandy Cove, located between Chowan Beach and Arrowhead Beach, on the Chowan River, in Chowan County. The property has 75.41' fronting on the Chowan River, and is currently zoned residential by Chowan County. Existing development on, and adjacent to, the property is limited to a single-family residence with associated infrastructure, a 75.2' long bulkhead, a 5'- 8" x 73' pier, a 15' x 16' platform, and two personal water craft lifts situated along the pier. Sandy Cove is a waterfront residential subdivision with similar waterfront development near, and adjacent to, the applicant's property. The lot in question has an average elevation of 10' above normal water level (NWL). Vegetation on the property is primarily domestic grass and ornamental trees and shrubs. The Chowan River is a" Blackwater" river due to high tannins from bordering cypress swamps. No submerged aquatic vegetation was found within the proposed project area. Water depths vary from 6" at the applicant's bulkhead to -3.5' at the end of the existing pier. The water bottom within the project area is a gentle sloping, fine sandy substrate. No submerged aquatic vegetation was fund within the project area. The Chowan River within the project area is an Anadromous Fish Spawning Area, as determined by the NC Division of Marine Fisheries and the NC Wildlife Recourses Commission. Development Proposal The Coleman's, propose to construct a 24' x 16' boathouse with a boatlift and a 3' wide interior walkway on the south side of an existing platform. Approximately V-0" x 16' of the proposed boathouse roof will extend over the existing platform and new shading by the structure will be limited to 368 square feet (sf). (iii) not extending more than one-fourth the width of a natural water body, or human made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: The pier location will not be over any shell fishing franchise. (10) Freestanding Moorings (A) A "freestanding mooring" is any means to attach a ship, boat, vessel, floating structure or other water craft to a stationary underwater device, mooring buoy, buoyed anchor, or piling (as long as the piling is not associated with an existing or proposed pier, dock, or boathouse); (B) Freestanding moorings shall be permitted only: (i) to riparian property owners within their riparian condors; Consistent: To be placed within the property owners corridor with waivers from adjacent property owners for encroachment. (ii) to any applicant proposing to locate a mooring buoy consistent with a water use plan that is included in either the local zoning or land use plan. NIA (C) All mooring fields shall provide an area for access to any mooring(s) and other land based operations that shall include wastewater pump -out, trash disposal and vehicle parking; NIA (D) To protect water quality of shellfishing areas, mooring fields shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas if shellfish harvest closure is anticipated to result from the location of the mooring field. In compliance with Section 101(a)(2) of the Federal Water Pollution Control Act, 33 U.S.C. 1251 (a)(2), and North Carolina Water Quality Standards adopted pursuant to that section, shellfish harvesting is a significant existing use if it can be established that shellfish have been regularly harvested for human consumption since November 28, 1975 or that shellfish are propagating and surviving in a biologically suitable habitat and are available and suitable for harvesting for the purpose of human consumption. The Division of Marine Fisheries shall be consulted regarding the significance of shellfish harvest as an existing use and the magnitude of the quantities of shellfish that have been harvested or are available for harvest in the area where harvest will be affected by the development; NIA (E) Moorings shall not be located without written consent from the leaseholders or owners of submerged lands that have been leased from the state or deeded by the state; Consistent: No submerged lands associated with the site. DATE: June 27, 2017 Consistency Determination: The request is consistent with/not in conflict with the Chowan County/Town of Edenton 2008 Core Land Use Plan certified by the CRC on July 24, 2008. Overview: The subject property is a .54 acre site with approximately 75 feet of shoreline along the Chowan River. Existing site improvements include a single-family house with associated infrastructure. Existing shoreline improvements include a bulkhead along the entire length of shoreline, a 5 foot 8 inches wide by 73 foot long pier with a 15 foot by 16 foot terminus platform and two (2) personal watercraft lifts located on the north side of the pier. The elevation of the property is approximately 10 feet above Normal Water Level (NWL). Water depths in the Chowan River vary from 6 inches at the bulkhead to -3.5 feet at the end of the pier. Construction of a 24 foot by 16 foot boathouse, a 3 foot wide walkway, stairs, and a 4 foot 8 inches by 8 foot small accessway, installation of a boat lift and three (3) freestanding mooring buoys are proposed. The boathouse will be constructed on the south side of the existing platform. A 1 foot by 16 foot area of boathouse roof will extend over the platform. The walkway will be located on the south side of the existing platform. The stairs and small accessway will extend between the pier and boathouse to access the interior walkway. The three (3) mooring buoys will be installed on the north side of the pier and attached to the water bottom with screw anchors. Repairs to the bulkhead filter cloth on the landward side of the bulkhead will also be completed. The waters of the Chowan River in this area are classified as B and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was not observed in the project area. This designation is intended to delineate areas where traditional land uses are not desirable or expected to develop. Land development may however include public building and facilities necessary to support existing land uses... (P)assive recreation would be appropriate in this designation as long as environmentally sensitive areas are not negatively impacted... The County's goals and polices support the continued use of land in (this designation) for appropriate uses that are compatible with the fragile nature of the Conservation/Open Space areas.
