This permit, issued on May 31, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Dockina Facility 1) This permit authorizes only the reconfigured docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This pemtit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Joseph Coates Permit No. 68-17 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility shall extend past the Carolina Beach pier head line/federal channel setback, as depicted on the plans. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to prevent the full and free usftE2MVE9navigable waters at or adjacent to the authorized work. JUN 0 8 2017 General 12) The permittee and/or his or her contractor shall meet with a representa1?V9dl"tiidVPoWoYt0 project initiation. 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2017-00831), which was issued on 4/26/17. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. DWR- 17-0482. NOTE: An application processing fee of $250 was received by DCM for this project. (not counted due to alignment) Proposed covered platform (gazebo) = 12 ft. x 12 ft. = 144 sq. ft. (36 sq. ft. not counted due to alignment) Proposed floating dock = 30 ft. x 6 ft. = 180 sq. ft. (not counted due to alignment) Proposed floating dock = 20 ft. x 6 ft. = 120 sq. ft. Total counted= 228 sq. ft. The docking facility would provide docking space for the total up to three (3) vessels at this location. It is staffs recommendation that the proposal appears to be consistent with the use standards set forth in NCAC 07H .0208(b)(6), including, the%width rule, the eight square foot rule and the pier width rule. The proposed structures would be located over coastal wetlands and open water. This office has no objection to the proposed project provided it is consistent with all other state and federal permitting requirements. Any permit issued should include standard conditions for docking facilities. PROJECT DESCRIPTION RECEIVED APR 18 2017 DCM- MHD CITY The project site is located at 515 Canal Drive, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in the Town of Carolina Beach, New Hanover County. To get to the site from the Wilmington Regional Office travel south onto College Road and then continue on Carolina Beach Road (US Highway 421) for approximately 15 miles. Travel approximately 2.5 miles after crossing Snow's Cut Bridge, turn left onto Carl Winner Drive and continue until you reach a stop light at Canal Drive. Turn left onto Canal Drive and continue north. The subject property is a vacant lot and will be located on your left adjacent to residential properties to the north and south. The applicant's vacant lot is approximately 8000 sq. ft. and averages approximately 2 ft. above normal high water (NHW). High ground vegetation that exists on the property consists of native grasses. The applicant's measured shoreline is 50 ft. in length, including a 10 ft. wide concrete boat ramp. The property is stabilized by a bulkhead which ties into the adjacent bulkheads to the north and south. An existing two (2) slip docking facility extends approximately 37 ft. waterward of the bulkhead into the Yacht Basin with a 26 ft. by 13 ft. fixed L-head which transitions via ramp to a 6 ft. wide by 30 ft. long floating dock perpendicular to the shoreline. There is an approximately 22 ft. wide pocket of coastal wetlands, consisting primarily of Smooth Cordgrass (Spartina a/temiftora) and Black Needlerush (Juncus roemerianus), which transition to Salt Meadow Grass (Spartina patens), adjacent to the existing bulkhead. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to reconfigure the existing docking facility for a private three (3) slip docking facility with an access pier, covered gazebo and floating docks. The applicant states that the existing docking facility will be removed and a new pier, measuring approximately 50 ft. in length by 6 ft. in width, would extend from the existing bulkhead 4 ft. south of the existing pier footprint towards the Carolina Beach Yacht Basin/Myrtle Grove Sound. A fixed gazebo measuring 12 ft. in length by 12 ft. in width would extend to the south at the terminal end of the pier. A ramp would extend waterward of the gazebo to the west to a 6 ft. wide by 30 ft. long floating dock which connects to a 20 ft. wide by 6 ft. wide floating dock creating a "T" head configuration (see Sheet 1 of 1). The application states that the proposed new docking configuration would provide docking space for up to three (3) vessels within existing water depths ranging from — 6 ft. to -10.0 ft. at normal low water. (NLW) (See Sheet 1 of 1). 10. ANTICIPATED IMPACTS The proposed structures would incorporate approximately 612 sq. ft. of Estuarine Waters and Pubic Trust Area and shade approximately 132 sq. ft. of Coastal Wetlands. The proposed structure would extend approximately 91 ft. into a water body, which measures approximately 375 ft. across. The structures would be located in water depths of -6 ft. to -10 ft. at NLW and would conform to both the 1/4 width rule and the Carolina Beach pier head line according to the application. The proposed structures would not encroach into either adjacent 15' Riparian Corridor Setback Area requirement or the USACE 80 ft. setback requirement. The project property is currently vacant with an assigned address of 515 Canal Drive, Carolina Beach, NC. Other than an existing bulkhead, there are no existing structures and the property serves only as a private parking area and access facility. Both adjacent lots are fully developed residential properties. The property is stabilized by way of an existing timber bulkhead and vegetated (grass) cover. Current development includes a fixed pier, deck, and floating dock. Partly submerged on the southernmost boundary of the property is an existing ten foot, concrete boat ramp. The Cape Fear Yacht Basin is a man-made water body. Purpose and Need: The purpose of the project is to rehabilitate an existing residential docking facility currently in a state of disrepair. In addition to the proposed rehabilitation project the applicant has also proposed a new 6'x 20' floating dock to be "married" to the existing floating dock. The primary objective of the project is to provide the owner with a safe, functional residential pier and docking facility. Along with providing a safer boat access for the applicant, the proposed construction will also eliminate existing riparian encroachments. The proposed 6'x 20' floating dock will bring the applicants total wet slips from two (2) to three (3). The proposed parallel floating dock will provide improved/safer docking for transient (daily recreational use) boats. Given the current perpendicular layout, docking can sometimes be difficult during high winds. All existing and proposed construction will occur well within the designated pier headline and clear of any local or federal navigation channel setbacks.
