Bruce Chappell c/o Stephen Conway
Page Two
9. PROJECT DESCRIPTION:
The project site is located at 21 Bahama Dr., adjacent to Banks Channel, in New Hanover County. The
property is in the Town of Wrightsville Beach. To locate the property travel east approximately 1 mile
from Military Cut -Off Road (N.C. Highway 76) towards Wrightsville Beach. From the drawbridge, take a
slight left onto W. Salisbury Street and travel approximately 1 mile to the stoplight and make a left
onto N Lumina Avenue. Travel approximately 0.25 miles and turn left on Parmele Blvd. Take the first
left onto Bermuda Drive, and then the next right onto Bahama Drive. The property of interest is the
last home on the left.
The applicant's property contains a two-story single family home, is approximately 0.28 acres, and
averages 7' above mean sea level with 197 linear ft. of shoreline. An existing timber bulkhead
measuring approximately 200' in length stabilizes the entire shoreline except approximately 16' along
the northwest shoreline where a boat ramp exists. Waterward of the bulkhead is a private docking
facility that extends into Banks Channel in a northwesterly direction which accommodates up to four
(4) vessels. Upland vegetation consists of ornamental shrubbery, trees, and lawn grass. Just waterward
of the existing bulkhead, on the northernmost end of the shoreline is an area of Coastal Wetlands
averaging approximately 30 ft. in width. This area is vegetated primarily with Smooth Cordgrass
(Spartino alterniflora).
CAMA Major Permit No. 62-11 was issued for development of a 13' by 12' boat lift and an 8' by 8'
floating structure. GP #44913 was issued in 2006 for a new bulkhead 2' waterward of the bulkhead
existing at the time. Currently, just waterward of the bulkhead, and south of the boat ramp, is a
platform measuring 14' by 14' with a ramp leading to a floating structure measuring approximately 8'
by 40' running parallel to the shore. At the northern end of the floating structure is a 13' by 12' boat
lift. The terminal end of the docking facility varies from approximately 1' to 20' landward of the Town
of Wrightsville Beach's Pierhead line.
The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high
ground portion of the project area as Developed. The area surrounding this section of the AIWW is
mostly residential development. The waters of Banks Channel, which are included in the Wrightsville
Recreational Area, are classified SB# by the Division of Water Resources. They are NOT designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the
harvest of shellfish
PROPOSED PROJECT:
The applicant proposes to expand a docking facility and dredge. As proposed the existing platform
along the bulkhead would be expanded on the north and south end, 10' in each direction (see Sheet 2
of 4). The northern 10' expansion would be covered. This expansion would occur over open water. An
8' by 30' portion of floating dock would be added to the southern end of the existing floating dock,
which would also be entirely over open water and landward of the Town of Wrightsville Beach's
Pierhead line. This would allow the docking facility to provide dockage for up to five (5) vessels in water
depths that currently range from -1.5' at NLW to -3' at NLW. The facility would extend approximately
45' into a waterbody measuring 249', which would conform to the ''/, width rule.
AUG 01 2017
DCM- 11PND CITY
Bruce Chappell c/o Stephen Conway
Page Three
The applicant also proposes to dredge from the existing boat ramp area and around the docking facility
to a final depth of -6' at NLW. Per the application, connecting water depths at the edge of the dredge
footprint are -67' at NLW. The dredge footprint in the boat ramp area would slope from -3' at NLW to
-6' at NLW (see Sheet 3 of 4). The proposed access channel from the boat ramp would measure
approximately 25' in width by 10' in length and would connect to the dredge area around the docking
facility which would measure approximately 140' in length by 35' in width. The dredging would be
performed by bucket to barge and the spoils would be taken to the Agnes Beane property. No
presence of SAV, shellfish, or Coastal Wetlands was noted in the proposed dredge area.
10. ANTICIPATED IMPACTS
The proposed expanded docking facility would incorporate an additional approximately 520 sq. ft. of
Estuarine Waters and Public Trust Area. The expanded facility would provide dockage for five (5)
vessels in water depths of -6' at NLW after proposed dredging. The expansion would not cause the
facility to encroach any further into the water body. Currently the facility extends approximately 45'
into a water body measuring 249' which conforms to the ''/< width rule. Additionally, the application
shows the facility conforming to the Town of Wrightsville Beach's Pierhead line.
The proposed dredging would result in the disturbance of approximately 5,150 sq. ft. of shallow
bottom habitat in Estuarine Waters and Public Trust Area. No SAV, shellfish, or Coastal Wetlands were
noted in the dredge footprint, however, there are Coastal Wetlands immediately adjacent to the north
of the proposed dredging near the boat ramp. The applicant proposes to remove approximately 950
cubic yards of material, which is primarily sand, by bucket to barge. The spoil would be transported to
the Agnes Beane property. Minor turbidity increases can be expected during the construction process.

SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
Bruce Chappell
Dear Mr. Conway:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on July 24, 2017. Processing of the application
is ongoing. However, it has been determined that additional information will be required prior to
the Division taking final action on your application. These required items are summarized
below:
1) The US Army Corps of Engineers has requested additional information by way of
the attached email sent to you on September 25, 2017. Please note the NC
Wildlife Resources Commission has also requested a 10' buffer between excavated
areas and the coastal wetlands and the NC Fisheries Resource Specialist has
requested a 10' buffer off Coastal Wetlands and a 20' buffer between dredging and
oyster resources by way of the attached comments.
2) The MP-4 form indicates a roofed platform is proposed, yet the side view drawing
does not show a roofed structure. Please be aware that the roofed structure must be
located entirely over open water and should not extend over high ground and into
the 30' buffer in accordance with the buffer rules set forth in 15A NCAC 07H
.0209(d)(10), unless the roofed area would be located entirely over an existing
impervious surface, as excepted in 15A NCAC 07H .0209(d)(10)(H).
Therefore, it is necessary that processing of your permit application be placed in abeyance to
give you an opportunity to address the request of the US Army Corps of Engineers. Once we
receive information requested above and the US Army Corps of Engineers has notified the
Division of Coastal Management Major Permit Section in writing that no further actions are
necessary on the part of the applicant, we will resume processing of your application.

RECOMMENDATIONS FOR Bruce Chappell c/o Stephen Conway 7/27/17
The total area of platform was calculated as follows:
Shoreline length = 197' x 8 sq. ft. = 1,576 sq. ft.
Proposed and existing platform along shoreline = 28' x 14' = 392 sq. ft. (6' through middle not calculated for access)
Existing floating dock = 40' x 8' = 320 sq. ft.
Proposed floating dock addition = 30' x 8' = 240 sq. ft.
Total = 952 sq. ft.
It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight -
square foot rule, the quarter width rule, and would not encroach into the 15' adjacent riparian corridor setback
requirement. The proposed facility appears to meet the Town of Wrightsville Beach's Pierhead line. In the absence of
any concerns from the commenting agencies, it is recommended that a permit be issued subject to the standard
conditions for private docking facilities.
It appears that the project is also CONSISTENT with NCAC 07H .0208(b)(1) in regards to dredging, including the disposal
of dredge spoils. This office has no objection to the proposed work, provided it is consistent with all other state and
federal permitting requirements, it is recommended that a permit be issued subject to the standard conditions for
dredging.

MEMORANDUM
To: Heather Coats
From: Michael Christenbury, Wilmington District Planner
Subject: Consistency Determination, Major Permit Applicati PnBruce Chappell,
Wrightsville Beach — New Hanover County
Date: October 5, 2017
The applicant proposes to expand an existing docking facility and dredge adjacent to
Banks Channel. The project is located at 21 Bahama Drive in Wrightsville Beach.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan.

Gordon Myers, Executive Director
MEMORANDUM
TO: Heather Coats
Division of Coastal Management
North Carolina Department of Environmental Quality
FROM: Maria T. Dunn, Coastal Coordinator
Habitat Conservation Division
DATE: August 18, 2017
SUBJECT: CAMA Dredge/Fill Permit Application for Bruce Chappell, New Hanover County, North
Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 21 Bahama
Drive adjacent to Banks Channel in Wrightsville Beach, NC. Our comments are provided in accordance
with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to expand an existing docking facility and perform maintenance dredging within a
5,150 ft' area. The dock extension would provide dockage for five vessels in water depths of -1.5' to -3'
NLW and extend 45' into a waterbody measuring 249'. Dredging would be conducted at the existing boat
ramp to connect to waters -6' deep. Material would be removed via bucket to barge and placed on
uplands. Banks Channel at this location is classified SB by the Environmental Management Commission.
The NCWRC has reviewed the permit application and does not believe the project will have significant
impacts to wildlife resources. To minimize impacts to adjacent wetlands, excavation should only occur at
distances 10' or greater from wetland substrates. This distance in these water depths would provide
adequate slope to minimize sloughing of wetland substrates.
We appreciate the opportunity to review and comment on this permit application. If you need further
assistance or additional information, please contact me at (252) 948-3916 or at

MEMORANDUM:
TO: Heather Coats, DCM Assistant Major Permit Coordinator
FROM: Curt Weychert, DCM Fisheries Resource Specialist((;fU
SUBJECT: Bruce Chappell Dock Expansion and. Dredge Application
DATE:, August 8, 2017
A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
CAMA permit application for proposed actions that impact fish and fish1habitats. The applicant is proposing
to expand an existing docking facility and perform -maintenance dredging. The project area is in an area of
productive coastal wetlands, shallow soft bottom, as well as shellfish habitat that facilitate nursery habitat as
well as refuge and foraging habitat for transient fish and invertebrates.
DCM/Fisheries would not object to the project as long as the dredging maintains a standard 10-foot buffer
from any coastal wetlands and maintains a 20-foot buffer from the oyster resource identified in Figure 1.
While the project location is not designated Primary Nursery Area, an in-waterwork moratorium will not be
suggested on this project. However, it should beexpressedto the applicant that in order`to have the least
possible impacts on fisheries resources, work should he performed in a time period where biological
productivity isat its least (October -February).
Contact Curt Weychert at (252) 808-2808 ext. 213 or Curt.WevchertOncdenngov with further questions or
concerns.

Dear Mr. Huggett:
Reference the application of Mr. Bruce Chappell, to replace and expand an existing private
docking facility and dredge in the vicinity of the dock structure. The proposed project is located at 21
Bahama Drive, adjacent to Banks Channel, Wrightsville Beach, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the application and
your field investigation report.
We recommend that the following conditions be included in the State authorization
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere
to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/maminal/manatee guidelines.pdf.
2. A ten -foot dredge offset from all wetlands, oyster aggregations, shell bottom, and emergent
salt marsh vegetation shall be instituted.
3. All excavated materials will be confined landward of the mean high water level elevation
contour within adequate dikes or other retaining structures to prevent spillover of dredged materials into
any vegetated wetlands or surrounding waters.
4. Best management practices identified as field marking existing oyster reefs and shell bottom
locations at low -tide shall be implemented in order to prevent construction and dredging equipment from
negatively impacting those resources.
T 1,
S. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For
further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910)
772-2191.
6. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be approved by
the US Army Corps of Engineers (USACE) prior to implementation.
7. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3
feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of
the aquatic environment.
8. The permittee understands and agrees that, if future operations by the United States require
the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required,
upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work
or obstructions caused thereby, without expense to the United States.
9. Approval of the structure is based on determinations that there would be no obstruction to
navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit
should not be construed, as relieving the permittee of taking proper steps to insure the structure and
moored boats will not be damaged by wave wash.
10. The authorized structure and associated activity must not interfere with the public's right to
free navigation on all navigable waters of the United States. No attempt will be made by the permittee to
prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work
for reason other than safety.
11. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this project, in
such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce
the reach of waters or wetlands.
12. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, within waters or wetlands. This permit does not authorize temporary
placement or double handling of excavated or fill material within waters or wetlands outside the
permitted area. This prohibition applies to all borrow and fill activities connected with this project.
13. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials.
In the event of a spill of petroleum products or any other hazardous waste, the permittee shall
2
.11 `.f
immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800)
662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will
be followed.
14. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in trace
quantities. Metal products, organic materials (including debris from land clearing activities), or
unsightly debris will not be used.
15. If the permittee discovers any previously unknown historic or archeological remains while
accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who
will initiate the required coordination procedures.
16. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide each of
its contractors and/or agents associated with the construction or maintenance of this project with a copy
of this permit. A copy of this permit, including all conditions, shall be available at the project site during
construction and maintenance of this project.
17. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area.
This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate
devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate
stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all
aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter
113A Article 4).
18. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes
and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
19. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time and manner as
the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its
pre -project condition.
20. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section
10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps
of Engineers within 24 hours of the permittee's discovery of the violation.

Mr. Conway,
Please see the attached response from the National Marine Fisheries Service (NMFS) in regard to the dock and dredge
project located at 21 Bahama Drive, in Wrightsville Beach, New Hanover County, NC.
Under federal law, the Corps must coordinate with resource agencies to ensure protection of endangered species,
historic properties and commercial fisheries. In response to the federal public notice, the NMFS has provided the
attached letter which outlines 2 Recommended Conservation Measures. In order to address those concerns, this office
is proposing to include special permit conditions. Please consult with your client and ensure that these conditions can
be adhered to:
1. A ten -foot dredge offset from all wetlands, oyster aggregations, shell bottom, and emergent salt marsh vegetation
shall be instituted.
2. All excavated materials will be confined landward of the mean high water level elevation contour within adequate
dikes or other retaining structures to prevent spillover of dredged materials into any vegetated wetlands or surrounding
waters.
3. Best management practices identified as field marking existing oyster reefs and shell bottom locations at low -tide
shall be implemented in order to prevent construction and dredging equipment from negatively impacting those
resources.
I look forward to your response and will coordinate with the NMFS upon receipt.
Thank you.

Colonel Robert J. Clark, Commander
U.S. Army Corps of Engineers Wilmington District
69 Darlington Avenue
Wilmington, North Carolina 28403-1398
Attention: Tyler Crumble
Dear Colonel Clark:
NOAA's National Marine Fisheries Service (NMFS) reviewed the public notice for SAW-2011-00684,
dated August 22, 2017. The applicant, Bruce Chappell, requests authorization to replace and expand an
existing docking facility and perform maintenance dredging within the vicinity of the dock structure in
waters adjoining Banks Channel in Wrightsville Beach, New Hanover County. The Wilmington
District's initial determination is the proposed pier and dock construction and dredging.may affect
essential fish habitat (EFH) or associated fisheries managed by South Atlantic Fishery Management
Council (SAFMC), the Mid -Atlantic Fishery. Management Council, or NMFS. As the nation's federal
trustee for the conservation and management of marine, estuarine, and diadromous fishery resources, the
NMFS provides the following comments and recommendations pursuant to the authorities of the Fish and
Wildlife Coordination Act and the Magnuson -Stevens Fishery Conservation and Management Act
(Magnuson -Stevens Act).
Description of the Proposed Project
The applicant proposes to remove an existing docking facility and replace with a new pier (eight feet by
60 feet) and floating dock (eight feet by 30 feet). The new docking facility will extend 45 feet into the
waterbody and include a floating dock with dockage for up to five vessels. The applicant proposes
maintenance dredging around the docking facility. The estimated volume of dredging is 950 cubic yards
from 4,200 square feet of shallow bottom to establish a controlling depth of -6.0 feet at mean low water.
The applicant proposes to excavate sediment via a bucket -to -barge (clamshell) operation and to transport
the dredged material to an approved disposal site. Water depths within the footprint of the project area
are approximately -1.5 to -3.0 feet mean low water. Maintenance dredging has not occurred within the
footprint of the docking facility in recent years.
Impacts to Essential Fish Habitat
The project area is not a state -designated Primary Nursery Area; however, the project area clearly
functions as nursery habitat for federally managed species as well as other species of commercial or
recreational importance. The SAFMC identifies shallow intertidal and sub -tidal bottom in estuarine
waters as EFH for penaeid shrimp and for estuarine -dependent species within the snapper/grouper
complex. The SAFMC identifies these areas as EFH because fish and shrimp concentrate in these
habitats for feeding and refuge and experience high growth and survival rates when located in these
habitats. The SAFMC provides detailed information on the EFH requirements of federally managed
species in amendments to the fishery management plans and in Volume IV of the Fishery Ecosystem Plan
of the South Atlantic Region.
To reduce the environmental impacts of maintenance dredging, the NMFS recommends the applicant
reduce the footprint for excavation in consideration of sloughing of side slopes expected to occur after
dredging occurs. The applicant should ensure a ten -foot dredge offset from coastal wetlands includes all
emergent salt marsh vegetation, oyster reefs, and shell bottom to minimize environmental impacts to
sensitive habitats.
EFH Conservation Recommendations
Section 305(b)(4)(A) of the Magnuson -Stevens Act requires NMFS to provide EFH Conservation
Recommendations for any federal action or permit which may result in adverse impacts to EFH.
Therefore, NMFS recommends the following to ensure the conservation of EFH and associated fishery
resources:
The permit should require a ten -foot dredge offset, based on the projected equilibrated side
slopes, from coastal wetlands including all emergent salt marsh vegetation, oyster aggregations,
and shell bottom.
The permit should require best management practices, such as field marking oyster reefs and shell
bottom, to keep construction equipment and activities from encroaching into oyster and shellfish
habitat.
Section 305(b)(4)(B) of the Magnuson -Stevens Act and implementing regulation at 50 CFR Section
600.920(k) require the Wilmington District to provide a written response to this letter within 30 days of
its receipt. If it isnot possible to provide a substantive response within 30 days, in accordance with the
"findings" with the Wilmington District, an interim response should be provided to the NMFS. A
detailed response then must be provided prior to final approval of the action. The detailed response must
include a description of measures proposed by the Wilmington District to avoid, mitigate, or offset the
adverse impacts of the activity. If the response is inconsistent with the EFH conservation
recommendations, the Wilmington District must provide a substantive discussion justifying the reasons
for not following the recommendations.
Thank you for the opportunity to provide these comments. Please direct related questions or comments to
the attention of Dr. Ken Riley at our Beaufort Field Office, 101 Pivers Island Road, Beaufort, North
Carolina 28516-9722, or at (252) 728-8750.

request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

Hope all is well. I wanted to touch base on a Major Permit Application that we are submitting for a

Narrative for 21 Bahama Drive:
My client, Bruce Chappell wishes to add additional seating to his existing sitting area some of which he
would like to cover and some of which he would like to leave open for sunbathing. In additional to this
he would like to add an 8'x30' floating dock to his existing 8'x40' floating dock. His new structure and
existing structure will all be within the existing Wrightsville Beach pier head line. Along with the
additional floating dock and fixed pier work we would like to propose some maintenance dredging for
his property. It has experienced some fill on the east edge of his proposed 8'x 30' structure which would
hinder him from accessing the back side of his new and existing floating dock.
Thank you for your consideration of this request.
