This permit, issued on December 5, 2017 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Dockine Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2020 In issuing this permit, the State of Notch Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. RECEIVED nF(' 1 2 2017 Signature of Permittee Bruce Chappell Permit No. 139-17 Page 2 of 5 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) No portion of the authorized docking facility shall extend past the Wrightsville Beach Pier Head Line. 7) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 8) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 9) The roof dripline of the covered platform shall be constructed entirely over open water and shall not extend landward of the bulkhead. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Excavation 11) Excavation shall not exceed -6 feet below normal low water. In no case shall the depth of excavation exceed the depth of the connecting waters. 12) No excavation shall take place outside of the alignment indicated on the workplan drawing(s). 13) The temporary placement of double handling of excavated materials within waters or vegetated wetlands is not authorized. 14) All excavated materials shall be confined above normal high water level and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to preveentt spillover solids into any marsh or surrounding waters. 15) No spoil material shall be placed within 30 feet of the normal high water line. DEC 12 2017 16) The disposal area shall be properly graded and provided a ground covers t on within 30 working days of project completion. tR��� 17) No excavation shall take place within ten feet of any Coastal Wetlands or the oyster aggregation to the south of the proposed dredge area. rM 1 Bruce Chappell Permit No. 139-17 Page 3 of 5 ADDITIONAL CONDITIONS 18) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the beginning of any dredge activities. NOTE: While this project is not located in a Primary Nursery Area (PNA), the permittee is encouraged to consider performing the authorized excavation during the time when biological productivity is at its least (from October to February). Maintenance Clause 19) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any future maintenance work, as authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. U.S. Army Corps of Engineers Conditions 20) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http•//w-ww.fws.¢ov/nc-es/mammaUmanatee euidelines.pdf. 21) Best management practices identified as field marking existing oyster reefs and shall bottom locations at low -tide shall be implemented in order to prevent construction and dredging equipment from negatively impacting those resources. 22) Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 23) Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. RECEIVED DEC 12 2017 Bruce Chappell Permit No. 139-17 Page 4 of 5 ADDITIONAL CONDITIONS 24) The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States or the State of North Carolina. 25) Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 26) The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 27) Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 28) Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 29) The permittee, upon receipt of a notice of revocation of the federal permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre - project condition. DCM- Wq,pr6 I T 31) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 32) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2011- 00684. NOTE: The N.C. PROJECT DESCRIPTION: The project site is located at 21 Bahama Dr., adjacent to Banks Channel, in New Hanover County. The property is in the Town of Wrightsville Beach. To locate the property travel east approximately 1 mile from Military Cut -Off Road (N.C. Highway 76) towards Wrightsville Beach. From the drawbridge, take a slight left onto W. Salisbury Street and travel approximately 1 mile to the stoplight and make a left onto N Lumina Avenue. Travel approximately 0.25 miles and turn left on Parmele Blvd. Take the first left onto Bermuda Drive, and then the next right onto Bahama Drive. The property of interest is the last home on the left. The applicant's property contains a two-story single family home, is approximately 0.28 acres, and averages 7' above mean sea level with 197 linear ft. of shoreline. An existing timber bulkhead measuring approximately 200' in length stabilizes the entire shoreline except approximately 16' along the northwest shoreline where a boat ramp exists. Waterward of the bulkhead is a private docking facility that extends into Banks Channel in a northwesterly direction which accommodates up to four (4) vessels. Upland vegetation consists of ornamental shrubbery, trees, and lawn grass. Just waterward of the existing bulkhead, on the northernmost end of the shoreline is an area of Coastal Wetlands averaging approximately 30 ft. in width. This area is vegetated primarily with Smooth Cordgrass (Spartino alterniflora). CAMA Major Permit No. 62-11 was issued for development of a 13' by 12' boat lift and an 8' by 8' floating structure. GP #44913 was issued in 2006 for a new bulkhead 2' waterward of the bulkhead existing at the time. Currently, just waterward of the bulkhead, and south of the boat ramp, is a platform measuring 14' by 14' with a ramp leading to a floating structure measuring approximately 8' by 40' running parallel to the shore. At the northern end of the floating structure is a 13' by 12' boat lift. The terminal end of the docking facility varies from approximately 1' to 20' landward of the Town of Wrightsville Beach's Pierhead line. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The area surrounding this section of the AIWW is mostly residential development. The waters of Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB# by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish PROPOSED PROJECT: The applicant proposes to expand a docking facility and dredge. As proposed the existing platform along the bulkhead would be expanded on the north and south end, 10' in each direction (see Sheet 2 of 4). The northern 10' expansion would be covered. This expansion would occur over open water. An 8' by 30' portion of floating dock would be added to the southern end of the existing floating dock, which would also be entirely over open water and landward of the Town of Wrightsville Beach's Pierhead line. This would allow the docking facility to provide dockage for up to five (5) vessels in water depths that currently range from -1.5' at NLW to -3' at NLW. The facility would extend approximately 45' into a waterbody measuring 249', which would conform to the ''/, width rule. Per the application, connecting water depths at the edge of the dredge footprint are -67' at NLW. The dredge footprint in the boat ramp area would slope from -3' at NLW to -6' at NLW (see Sheet 3 of 4). The proposed access channel from the boat ramp would measure approximately 25' in width by 10' in length and would connect to the dredge area around the docking facility which would measure approximately 140' in length by 35' in width. The dredging would be performed by bucket to barge and the spoils would be taken to the Agnes Beane property. No presence of SAV, shellfish, or Coastal Wetlands was noted in the proposed dredge area. 10. ANTICIPATED IMPACTS The proposed expanded docking facility would incorporate an additional approximately 520 sq. ft. of Estuarine Waters and Public Trust Area. The expanded facility would provide dockage for five (5) vessels in water depths of -6' at NLW after proposed dredging. The expansion would not cause the facility to encroach any further into the water body. Currently the facility extends approximately 45' into a water body measuring 249' which conforms to the ''/< width rule. Additionally, the application shows the facility conforming to the Town of Wrightsville Beach's Pierhead line. The proposed dredging would result in the disturbance of approximately 5,150 sq. ft. of shallow bottom habitat in Estuarine Waters and Public Trust Area. No SAV, shellfish, or Coastal Wetlands were noted in the dredge footprint, however, there are Coastal Wetlands immediately adjacent to the north of the proposed dredging near the boat ramp. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 21 Bahama Drive adjacent to Banks Channel in Wrightsville Beach, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to expand an existing docking facility and perform maintenance dredging within a 5,150 ft' area. The dock extension would provide dockage for five vessels in water depths of -1.5' to -3' NLW and extend 45' into a waterbody measuring 249'. Dredging would be conducted at the existing boat ramp to connect to waters -6' deep. Material would be removed via bucket to barge and placed on uplands. Banks Channel at this location is classified SB by the Environmental Management Commission. The NCWRC has reviewed the permit application and does not believe the project will have significant impacts to wildlife resources. To minimize impacts to adjacent wetlands, excavation should only occur at distances 10' or greater from wetland substrates. The proposed project is located at 21 Bahama Drive, adjacent to Banks Channel, Wrightsville Beach, New Hanover County, North Carolina. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc- es/maminal/manatee guidelines.pdf. 2. A ten -foot dredge offset from all wetlands, oyster aggregations, shell bottom, and emergent salt marsh vegetation shall be instituted. 3. All excavated materials will be confined landward of the mean high water level elevation contour within adequate dikes or other retaining structures to prevent spillover of dredged materials into any vegetated wetlands or surrounding waters. 4. Best management practices identified as field marking existing oyster reefs and shell bottom locations at low -tide shall be implemented in order to prevent construction and dredging equipment from negatively impacting those resources. T 1, S. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 6. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 7. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. 8. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. 9. Description of the Proposed Project The applicant proposes to remove an existing docking facility and replace with a new pier (eight feet by 60 feet) and floating dock (eight feet by 30 feet). The new docking facility will extend 45 feet into the waterbody and include a floating dock with dockage for up to five vessels. The applicant proposes maintenance dredging around the docking facility. The estimated volume of dredging is 950 cubic yards from 4,200 square feet of shallow bottom to establish a controlling depth of -6.0 feet at mean low water. The applicant proposes to excavate sediment via a bucket -to -barge (clamshell) operation and to transport the dredged material to an approved disposal site. Water depths within the footprint of the project area are approximately -1.5 to -3.0 feet mean low water. Maintenance dredging has not occurred within the footprint of the docking facility in recent years. Impacts to Essential Fish Habitat The project area is not a state -designated Primary Nursery Area; however, the project area clearly functions as nursery habitat for federally managed species as well as other species of commercial or recreational importance. The SAFMC identifies shallow intertidal and sub -tidal bottom in estuarine waters as EFH for penaeid shrimp and for estuarine -dependent species within the snapper/grouper complex. The SAFMC identifies these areas as EFH because fish and shrimp concentrate in these habitats for feeding and refuge and experience high growth and survival rates when located in these habitats. The SAFMC provides detailed information on the EFH requirements of federally managed species in amendments to the fishery management plans and in Volume IV of the Fishery Ecosystem Plan of the South Atlantic Region. To reduce the environmental impacts of maintenance dredging, the NMFS recommends the applicant reduce the footprint for excavation in consideration of sloughing of side slopes expected to occur after dredging occurs. The applicant should ensure a ten -foot dredge offset from coastal wetlands includes all emergent salt marsh vegetation, oyster reefs, and shell bottom to minimize environmental impacts to sensitive habitats. EFH Conservation Recommendations Section 305(b)(4)(A) of the Magnuson -Stevens Act requires NMFS to provide EFH Conservation Recommendations for any federal action or permit which may result in adverse impacts to EFH.
