attached workplan drawings (2), "Cross Section" dated 6/27/17 and "Location Map" dated 7/18/17.
This permit, issued on December 11, 2017 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

No Wake Pilings 7
1) Unless specifically altered herein, this permit authorizes the installation of three (3) No Wake Pilings,
all as expressly and specifically set forth in the attached permit application and workplan drawings.
2) The No Wake Pilings shall conform with any and all appropriate regulations governing such
structures, including but not limited to marking and lighting requirements of the N.C. Wildlife
Resources Commission and/or the U.S. Coast Guard.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

The U.S. Army Corpsof Engineers authorized the project byway of Nationwide Permit 1
(Action ID SAW-2017-02083) issued 12/8/17.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 2017-1183.
Future development may require a modification of this permit. Contact a representative of the
Division at (252) 808-2808 prior to the commencement of any such activity for this
determination.
An application processing fee of $400 was received by DCM for this project.
Project Narrative
Carteret County is proposing three no wake zone pylon signs along Bulkhead Channel, the
exact pylon sign locations have been included on the attached map. The no wake zone along
bulkhead channel is extremely important due to its proximity to Rachael Carson Reserve and Radio
Island Public Beach Access. This no wake zone helps protect the shoreline of Rachel Carson
Reserve and it protects the public at the Radio Island Public Beach Access.
Carteret County has two existing no wake zone buoys marking this area. The North
Carolina Wildlife Resources Commission and the North Carolina Marine Patrol have issued
numerous citations to boaters violating this no wake zone. Boaters often state that the reason they
did not abide by the no wake zone was because they never saw the existing buoys. Once the pylon
signs are installed, boaters should be able to easily and clearly identify the no wake zone.
The pylons will be a total of forty-five feet in length and will be driven fifteen feet into the
ground by a pile driver. Fifteen feet of the pylon will be above the mean high water line and the
no wake signs will be placed towards the tops of the pylons. Signs will have a standard four square
foot white reflective face with an orange border and an orange circle in the center.

The purpose of this project is to aid in the navigation of the Bulkhead Channel no wake zone. The proposed pylon signs will
be used by the public on a daily basis.

The only equipment that will be used for this project is a pile driving barge. All of the construction equipment used for this
project will be stored off -site.

where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 115-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

Although processing of the application is nearing completion, additional time is needed for this

which would make January 5, 2018 the new deadline for reaching a decision on your request.

The following are my comments and recommendations regarding the proposal. The proposal is
for the addition of three no wake pilings along the existing Bulkhead Channel. They would be
placed in accordance with the NC Wildlife coordinates and guidelines. All work would be placed
along the channel edge and in the same alignment as the existing no wake buoys and USCG
navigation marker pilings.
The proposed work is consistent with 15A NCAC 7H.0208 therefore the Morehead City District
Office recommends the project be authorized as proposed on plats dated received 8/7/17,
contingent upon all applicable general conditions and the following standard conditions:
• There are no slips authorized.
• The no wake buoys shall be placed in accordance to NC wildlife coordinates and
guidelines and shall not exceed the existing buoy and USCG navigation alignment.
• No work shall hinder navigation in any way, shall be properly marked and shall not
extend within the channel.

On September 18, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources
received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and
specifications on September 18, 2017 has determined that the development activities proposed at this time will not
pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are
reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be
subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By
copy of this letter, we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

Consistency Determination: The request is consistent with/not in conflict with the Carteret County Land
Use Plan certified by the CRC on December 20, 2010.
Overview: The applicant is proposing to install three (3) "No Wake" pilings within the existing
established No Wake Zone. The project site is located along Bulkhead Channel and adjacent to Rachel
Carson Reserve and Radio Island Public Beach Access, Carteret County, North Carolina.
The pilings would be places at the following locations:
• Piling #1:-34.708526N & 76.679815W
• Piling #2:-34.712079N & 76.678825W
• Piling #3:-34.708931N & 76.678857W
AECs in the project area include: Estuarine Waters(EW) and Public Trust Areas (PTA). The project is
located at Morgan Creek/Bogue Sound, the water is classified as SA (Market Shellfishing, Salt Water).
The project area is closed to shellfishing. The site is not a Primary Nursery Area (PNA), and no
Submerged Aquatic Vegetation (SAV) or shellfish beds were observed within the proposed project area.
A review archaeological and cultural resources was not provided.
Anticipated impacts resulting from this project are expected to include: the incorporation of 112 ft2 of
Open Waters, there would be temporary turbidity during placement of the pilings.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan
Update. The Future Land Use Map (FLUM) designates the site as Conservation due to the sites location
in Estuarine Waters and Public Trust Area AECs (Areas of Environmental Concern). Land uses allowed
in Areas of Environmental Concern are those consistent with the State's minimum use standards and
state and federal regulations.

9. Narrative Description
The Town of Morehead City "No Wake" piling project is located along Bulkhead Channel
and adjacent to The Rachael Carson Reserve and the Radio Island Public Beach Access.
The "No Wake" zone currently has USCG navigation pilings and several no wake buoys
along Bulkhead Channel.
The Morehead City Land Use Plan classifies this property as Port Mixed Use, with all
AEC's classified Conservation. This section of Morgan Creek/Bogue Sound is not
designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water
classification of SA. No SAV's or shellfish beds were observed within the proposal project
area. This area is presently designated as a "No Wake" zone by the WRC as per 15A
NCAC 10F.0330.
10. Project Description:
The "No Wake" pilings, per the applicant, would be placed in accordance to coordinates
provided by the NC Wildlife and would follow all required NC Wildlife guidelines. This
area is designated as a regulated area per 15A NCAC 1 OF.0330, Carteret County, to
provide a no wake zone in the waters of Morgan Creek and vicinity. Once the pilings have
been appropriately placed, the "no wake" area would be enforceable by WRC. The pilings
would be located along the channel edge of Bulkhead Channel and would not extend into
the existing channel area. They would be located at the following coordinates;

• Piling #2- 34.712079N

• Piling #3- 34.708931N
76.678857W
The pilings would be marked with the standard 4 square foot white reflective face with an
orange border and an orange circle in the center containing "No Wake" and "Slow . They
would be 10 inches in diameter and 45' long. The pilings would be driven 15' into the
ground by a pile driver and would be 15' above mhw/nhw.
11. Anticipated Impacts:
The proposed piling placement would incorporate a total of 112ftz of open
Waters and would cause temporary turbidity during placement. There would be no
hindrance to navigation due to the fact they would be located outside and along the edge of
bulkhead channel. The piling placement has the potential to improve public safety within
this area and ensure this "No Wake" zone is enforceable by NCWRC.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development along Bulkhead channel adjacent to at the property along the
Morehead/Beaufort Causeway in Morehead City. The complete package was received on 8/18/17. The
projected deadline for making a decision is 11/1/17. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 8/18/17, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify mein writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

riparian landowners receive a copy of the application and all development plans of a CAMA major
permit applications. Upon receipt of this letter, you will have thirty (30) days in which to submit
comments on the proposed project to the NC DCM. The entire permit application and all
development plans have been included with this letter.
Carteret County is proposing to place three no wake zone pylon signs along Bulkhead
Channel, which is adjacent to your property. The pylons will be a total of forty-five feet in length
and will be driven fifteen feet into the ground by a pile driver. Fifteen feet of the pylon will be
above the mean high water line and the no wake zone signs will be placed towards the tops of the
pylons. The signs will have a standard four square foot white reflective face with an orange border
and an orange circle in the center.
